00:00So, a story that's sending shockwaves through college athletics
00:04is the Brendan Soresby saga.
00:09Plays quarterback for Texas Tech.
00:11He's been granted a temporary injunction against the NCAA
00:15that's going to allow him to play during the 2026 season.
00:20Soresby received the decision from Lubbock judge Ken Curry
00:24on Monday morning one week after a hearing.
00:28Now, as part of the decision, he's going to set out the first two games of the season
00:31against Abilene Christian, I mean, that's a joke game, and Oregon State.
00:35However, he's going to return for the Big 12 opener on September 18th against Houston.
00:41Now, for those who don't know, he was ruled permanently ineligible by the NCAA
00:45after admitting to placing thousands of bets over four years.
00:499,000 different bets.
00:51Including multiple bets on his own team while redshirting at Indiana.
00:55Wagered over $90,000.
00:57So, NCAA rules hold that any player who gambles on their own team
01:01or another in their athletic department will not be allowed to participate
01:05in college athletics.
01:07If there's ever one constant through the history of the NCAA,
01:11it was if a player or a coach was found to bet legally or illegally on the sport,
01:20they were ineligible.
01:21Ineligible to play.
01:22The NCAA sharply criticized the ruling in a statement on Monday.
01:27Here's what they said.
01:28Quote,
01:28The NCAA strongly disagrees with the court's ruling in Swordsby's case
01:32and is deeply concerned about the damaging, far-reaching, and broadly destabilizing
01:37ramifications of this outcome, which undermines and corrupts the integrity of sports.
01:42Makes no sense.
01:44I mean, NCAA has zero power.
01:46None.
01:47I mean, they're toothless at this point.
01:48They really are.
01:49They have literally no power.
01:51I mean, you can't blame them in this instance, right, that a court overruled them.
01:55No, but the fact that a case can go to the court and overrule the NCAA, they've got no power.
02:03And by the way,
02:04They've got zero.
02:04Anything, you go to court for anything, right?
02:06I know, but he shouldn't be able to go to court for that.
02:08A court in Lubbock, Texas, too?
02:10You think you're not going to rule in favor of Texas Tech?
02:14I don't know the legal system, but when I saw the thing there, it was like it clears the way
02:19for him to play again.
02:20I just felt like, well, there'll be another, there'll be some sort of appeal or something.
02:23Right, if there's a legitimate reason to go to the court, and if there's a legitimate reason that the judge
02:29can be in favor of the athlete, that's one thing.
02:33How can you be in favor of a kid who was gambling on his sport, including his games?
02:38It's absurd.
02:39How can a judge be in favor for that?
02:42I don't get it.
02:44Yeah, I don't know.
02:45It's unbelievable.
02:47Yeah, I thought Scott Van Pelt made a good point on Twitter.
02:49He goes, there really aren't any rules.
02:50You just go to court.
02:51If it fails, go to court again until a judge says you're all set.
02:54On a seventh year, sure.
02:56Broke rules, that's fine.
02:57There aren't any rules.
03:00That's kind of the way it's completely the Wild West now with college athletics.
03:04Yeah, there was another lawyer.
03:06His name's Tom Mars.
03:09He's been battling the NCAA.
03:11That's what he does for a living.
03:13He couldn't believe it.
03:15He couldn't believe the ruling.
03:17And this is an attorney who's done that for his business.
03:20He's been attacking the NCAA for years, and he could not believe the ruling from Judge Curry.
03:28I don't know where to go from here, but NCAA, they need some antitrust exemption, whatever the terms are, but
03:36they've got zero power.
03:38Well, they did file an immediate appeal, I think.
03:42Oh, I'm sure they did.
03:43Yeah.
03:43They did, but they said that there's a very good chance it's not going to be heard until after the
03:49season starts, and even then, they're massively pushing it.
03:53I mean, they could change it all around, but they dusted off a judge who retired 14 years ago and
04:01brought him in from, I'm sure they paid him off or whatever, and everyone said, well, he didn't go to
04:05Texas Tech.
04:06Well, whatever.
04:06I mean, they brought in some guy, a handshake deal.
04:09He could still be a huge fan.
04:10The court is in Lubbock, Texas.
04:11I mean, it's a home game court date for Soresby.
04:17I mean, it's a joke.
04:19How much are they paying him?
04:21How much is he getting?
04:22Soresby?
04:22Yeah.
04:23I'm sure he's getting five million.
04:24I'm surprised he wasn't courtside in the Knicks game last night.
04:27I guess they say this has got to all be figured out by June 22nd.
04:30He's got two weeks or so, so he can apply for the supplemental draft if it looks like it's going
04:35to go south.
04:36Yeah.
04:38So now there's fallout, too, because now Georgia and Nebraska have said they will not schedule games against Texas Tech
04:45in any sport across the board.
04:48They're just like, this is outrageous.
04:50We're just not going to schedule you.
04:52Well, every school should do it.
04:53I would guess they're going to get blacklisted by a lot of schools.
04:56Yeah.
04:57I mean, those are two really big names that have already come out.
04:59And if that happens, I mean, it's just the first two schools.
05:03But if, you know, a hundred schools say they're never going to play in any sport, Texas Tech's going to
05:09have to say, OK, sorry, we lost this battle.
05:11Yeah, I just don't see it playing out.
05:12I think there's been too much outrage.
05:14Yeah.
05:15There's a ton.
05:16Something's going to happen.
05:17Also, you're just completely enabling Soresby and his behavior.
05:22And I know he's gone to, like, some form of rehab for his gambling addiction.
05:26But you're just letting him play despite him placing 9,000 bets.
05:33Well, I didn't.
05:33Multiple.
05:34Yeah.
05:35I didn't realize.
05:35I thought he had, like, sat out of here.
05:37I didn't realize he had actually even played last year.
05:39Oh, yeah.
05:40So it's like he barely, he didn't even really suffer any consequences.
05:43He was the number one transfer portal kid.
05:45He was the number one quarterback in the portal.
05:47I can't remember who pointed it out.
05:49I saw it on social media yesterday.
05:52Rick Neuheisel at one point was fired as Washington's football coach.
05:56Because he entered an NCAA tournament pool.
05:59Because he won new brackets.
06:00He couldn't stay away from the brackets.
06:01Not even his sport.
06:02Yeah.
06:03So dumb.
06:03I know.
06:03Think about that.
06:04And he's doing a pool, which everybody does.
06:07I mean, we've come a long way.
06:08And college football said, nope.
06:10You gambled.
06:11You're out.
06:12You can't fill out a bracket.
06:13He should have sued for $100 million.
06:15Which just shows you how the times have turned.
06:18And it's just become, as Kate said, the wild, wild west.
06:20Well, that was insane then.
06:22Yeah.
06:22That's not just insane now.
06:23That was insane then.
06:25Yeah.
06:25So the fact that he can't play in the first two weeks of this season, is that an NCAA restriction?
06:30Or is that Texas Tech?
06:33I think that was a ruling maybe by the judge as part of the deal.
06:38Oh, the judge said you're out in the first two weeks.
06:40I believe that's what I read.
06:41But I can double check it.
06:43Curry ruled that Sorsby's attorneys demonstrated he will suffer a probable, imminent, and irreparable injury if he's unable to play.
06:52Yeah.
06:52The judge decided he can't play in the first two games.
06:55So it was the judge.
06:56Okay.
06:56Yeah.
06:58All right.
06:58So yeah, maybe Kix is right.
06:59That was probably the deal.
07:00A mandatory two-game suspension was a condition of his ruling.
07:05Wagered $90,000 on professional and college sports over four years.
07:09Yeah, but it was like over 1,000 bets, right?
07:10So he's betting like $9 a game.
07:11No, $9,000.
07:12$9,000 bets.
07:13Yeah.
07:14But it was $90,000.
07:15That's a lot of bets.
07:16$10 a bet.
07:17$10 a game.
07:17I mean, he had small wages.
07:18Yeah, he spent $10 a game.
07:19Yeah.
07:20But 40 bets involving Indiana football when he was a freshman.
07:23I mean, yeah.
07:24I mean, he's a DJ.
07:25Yeah.
07:25I like the K-State athletic director's quote.
07:28He called the situation effing BS.
07:32That's his quote.
07:33That's solid.
07:34I like that guy.
07:36Yeah.
07:36Gene Taylor.
07:37I don't know.
07:37I'm willing to bet that he doesn't suit up.
07:39You're willing to bet?
07:40Yes.
07:40I'm willing to bet that he's not going to suit up for a Texas Tech.
07:45Something's going to happen.
07:46Either there's going to be the outrage from either the schools or there'll be some sort
07:49of appeal.
07:50Something's going to happen.
07:52I hope you're right.
07:53There's too much outrage.
07:54I hope you're right.
07:55Is that why the Texas Tech billionaire possibly bailed on appearing on the show late last week?
08:01Because he knew this was coming down the pike?
08:04Oh, that's right.
08:04He was a Cody Campbell.
08:05No, but he's very hard to figure out because he wants regulation.
08:09And then he was cheering on Sorsby last night.
08:13Right, of course.
08:13Right.
08:14Because he knows he's going to help him win games if he plays.
08:16That's what he cares about.
08:17Why doesn't the committee just not let Texas Tech in the playoff?
08:21Yeah.
08:21It's a great move.
08:22Right?
08:23Sure.
08:23It's all just whatever we think.
08:26We can just say they weren't good enough.
08:27You're banned.
08:28They didn't prove enough on the field.
08:29Right.
08:29You know.
08:31Well, because they would, I don't know, some judge, they would go to a judge and the judge
08:35would say, no, he's got to be there.
08:36Right.
08:36They'd get an injunction.
08:37They've got to be in the playoff.
08:37No, no, no, not by ruling them ineligible.
08:39Just be like the Florida State deal.
08:41Just leave them out.
08:41Oh, yeah, yeah.
08:41Just leave them out.
08:42Even though they're like 12-0.
08:4412-0 and smashing everyone.
08:45You're not quite good enough.
08:46Didn't prove enough to us.
08:48Right, right.
08:48During the year.
08:49And the other big 12 teams have all talked about like forfeiting the games.
08:53Refusing to play Texas Tech.
08:55Right.
08:55But then that would.
08:56That would give them automatic wins.
08:58They'd lose automatic wins and they'd lose a lot of TV money and all that stuff.
09:03But I think if the, you know, there's only two schools now that have come out and said
09:08we're never playing them.
09:09But if 25 schools or 50 schools or 75 schools or the rest of the NCAA comes out and says
09:15we're
09:15never playing Texas Tech.
09:17It's a big twill!
09:18They got no power.
09:20They're going to have to tell Swordsby you can't play.
09:22Is anybody on Swordsby's side or Texas Tech's side?
09:26I'm wondering, you know, their side would be.
09:28Texas Tech fans.
09:29Yeah.
09:30Their side would be that Swordsby is, you know, going to.
09:34Classes, whatever.
09:36Classes.
09:37Rehabbing.
09:37I actually think Tim Brando.
09:38That he's getting a penalty.
09:39He's getting a penalty for two games.
09:41I think Tim Brando somewhat defended him.
09:43Said he maybe believes in second chances or something along those lines.
09:47I think Doug Gottlieb kind of was like questioning him on Twitter.
09:51Or, you know, he said he doesn't really care either way, but he could see a person getting
09:56a second chance.
09:57Something along.
09:57That's about as much as I saw.
09:59Now, I know there's some people that say, well, it's a dangerous precedent.
10:03I saw Daniel Jeremiah.
10:04It's a dangerous precedent that now, you know, now you have something set.
10:10Was there any precedent in this type of case?
10:14Because it almost seems like the judge just made up something out of, you know.
10:18So, I guess Texas Tech recommended the two-game suspension.
10:21The Redman guys had been suspended for gambling before.
10:23That's what you mean, right?
10:25Even at Maryland, they had issues.
10:26How about the college hoops players that were suspended?
10:31I think a couple of them were kicked out of school for doing it.
10:36Yeah, the guys at the basketball, small basketball schools?
10:38Yeah.
10:38Yeah, but they were like fixing the games, weren't they?
10:40Well, I mean, I think the ones that were accused of fixing or found guilty of fixing, yeah,
10:45that they should have certainly been kicked out.
10:48But there was a bunch of, there was a kid from Iowa that was suspended, a kid from Iowa
10:52State who was suspended.
10:55Remember Scott Milanovic?
10:56There's been a bunch.
10:58At Maryland, back in the 90s.
11:00So, it seems like the judge just rubber stamped what his lawyers wanted.
11:06Because they suggested the two-game suspension, right?
11:09The lawyers did.
11:09Yes.
11:11Yeah.
11:12I don't know.
11:13I don't see it playing out.
11:17It's going to steamroll.
11:18There's too much outrage.
11:19It's almost like universal.
11:22It'll be interesting to see what happens over the next few weeks.
11:24Yeah, what if all the other big 12 teams just say, we're not going to play Texas Tech
11:28in football this fall?
11:30What do you do?
11:30There might be contracts.
11:31I don't know if they can do that.
11:33Yeah, I don't know how that works.
11:33You know what I mean?
11:34You got a contract.
11:35You get paid a million dollars.
11:36You show up.
11:37I mean, I don't know.
11:37I don't know how that works.
11:38So, he never bet on games that he played in, right?
11:44I guess he bet on his team when he wasn't playing.
11:47Yes, he bet on his team.
11:48He had the 9,000 bets, $90,000, but he never bet on a game that he was playing in.
11:54The judge basically just felt sorry for him.
11:57That's really what it comes down to.
11:59The quote is that Swarsby would suffer improbable, imminent, and irreparable injury if the court
12:05didn't alter the NCAA's ineligibility decision.
12:10Meaning, basically, it would affect his ability to go pro and make a living after being at Texas Tech.
12:16That's kind of the way I'm reading into that.
12:19Essentially, that's what he said.
12:21But it's still a rule.
12:23It's still an NCAA rule that if you bet on sports, college, especially your own sport, you are ineligible.
12:32Well, apparently, those rules, they don't mean anything.
12:34They're not rules.
12:35They don't matter anymore.
12:36I know.
12:36Because like J.P. said, Scott Van Pelt said, if you're upset with a rule or a ruling, you just
12:42take it to court.
12:43You take your chances in court.
12:44So he took it to court.
12:45And you have to get a favorable judge.
12:47He took it to court.
12:47He got slapped on the wrist with a two-game ban, and he's able to play going forward.
12:53They basically cried to the judge and said, we're sorry.
12:57We understand there's a rule.
13:00Don't just murder our quarterback's career.
13:04He'll sit out for a couple games, and then he should get a second chance.
13:08Yeah, and like Drab said, they went to the judge nursing home and pulled the judge out, put him in
13:14the bench, and basically got the ruling they wanted.
13:18I mean, it's absurd.
13:19College sports right now is absurd.
13:22And it's not even college sports anymore.
13:24It's lower-tier professional sports is what it is.
13:28It's exactly what it is.
13:28Everybody's getting paid.
13:29I think if he has good people around him, they're going to say, hey, you're going to be enemy number
13:34one.
13:35And maybe he'll just bow out.
13:38They say he could be a second or third-round pick, potentially.
13:41Just enter the supplemental draft and get going.
13:45Yeah, but if you go through all this, I think you play.
13:48You do go through it, but you don't expect this kind of outrage.
13:50You think it's going to fly under the radar, maybe.
13:52He's going to literally be a poster boy for hatred for college sports.
13:56What happens with his NIO money if he doesn't play?
13:59We'll have to give it back, I would think.
14:01Yeah.
14:01I would think he'd have to give it back.
14:02I can't imagine he's not sitting out.
14:03You've got to play for that money.
14:04Huh?
14:05He's not sitting out.
14:06No.
14:06He went through all this.
14:07I don't think he's going to be.
14:09Does he want to be forever known as the number one college football villain?
14:14I don't know.
14:15I don't think it'll be Soarsby's decision.
14:16I think it'll be Texas Tech's decision.
14:18Well, that could be, too.
14:19Of course.
14:20But I think there's a possibility.
14:22His people around him say, you know what?
14:24This ain't good for your brand.
14:26You want to play in the NFL?
14:28We should probably just say, you know what?
14:30We thought better of this.
14:31We're just going to go on to the next level.
14:34It's too divisive of an issue, and he's ready to move on.
14:38I think that would be the smart move.
14:40I think that's very unlikely.
14:41Okay.
14:42And I think his brand, you're saying that he's the villain, and I get that.
14:48But really, the brand is kind of larger, that people just look at this as college sports
14:55are effed up.
14:56Right.
14:56But he'd be the poster boy for it forever until the next scandal of this note.
15:01I think he should bow out.
15:03If I was his agent, I would say, you know what, dude?
15:06Let's just move on.
15:07By the way, in his $90,000 of bets, with 9,000 bets, the ones which jump out at me.
15:14Okay.
15:15So he bet on the NBA.
15:16He bet on college football, college basketball, MLB.
15:19Bet on everything.
15:20But he also bet on Turkish basketball.
15:23Full-on degenerate.
15:24I mean, he's betting on whatever he can find.
15:26Romanian soccer.
15:28Yeah.
15:29And he bet on Nathan's hot dog eating contest.
15:32Who wouldn't bet on Joey Chestnut to destroy the competition?
15:35I can't believe you bet on that.
15:36We all know people that bet on stuff like that.
15:38I know.
15:38It's just funny.
15:40Come on.
15:40You think Drab hasn't scoured FanDuel for an exotic tennis match here and there?
15:45You're going to bet on anything.
15:47So he apparently bet on, they've tracked that he bet on $90,000 in wagers.
15:53He transferred $60,000 to two friends who help him bet on FanDuel, HardRockBet, Underdog,
15:59and PrizeBets.
16:00He spread his money all over the place.
16:02In some ways, he's kind of smart.
16:03He's spread it out.
16:05Leading on friends.
16:06Total sicko.
16:07Yeah.
16:08His password is Texas Tech QB.
16:10You know who he's going to end up like?
16:11He's going to end up like Arch Schleeser.
16:14I mean, unless he has an intervention, unless he has a major big-time intervention.
16:20Yeah.
16:20He has a serious gambling addiction.
16:22He's going to be...
16:23Like, James said we goof on like, ah, he's an addicted gambler.
16:26Like, okay, maybe to a slight extent, but not...
16:29You're not...
16:30Soresby, you're not on that level.
16:31He says he wagered $850 only on Indiana.
16:35And it was when he wasn't playing, so it helped him feel like more part of the team.
16:40Connectivity.
16:41But the quote was...
16:41Some people can't watch the game if they don't have any cash.
16:43That's true.
16:44Just skip the game.
16:45In his written statement to the NCAA, he said,
16:49It became a habit for me to bet.
16:50My betting became a compulsion, which made it virtually impossible to resist the constant
16:55notifications I received from the betting apps.
16:59I lost complete control of my addiction.
17:02I now realize the apps controlled me, and I did not control them.
17:07When did all this get outed?
17:09Like, after the season?
17:10Like, that's when it was outed?
17:12After he transferred.
17:14Then they dug into him?
17:15He transferred from Cincinnati.
17:16Yeah.
17:17Yeah.
17:18Yeah.
17:19And they found out that his lawyers were telling the judge that he's got a mental health issue,
17:23so the judge probably felt even worse for him.
17:27Mental health being addicted to gambling?
17:30Yeah, yes.
17:30They say he's got a...
17:32After this has all happened, he's got a mental health...
17:35Right, it's a disorder.
17:37Yeah.
17:37Well, all right, I'm making the prediction that either Texas Tech pulls him, or he actually
17:43pulls out himself.
17:44I'm making that prediction.
17:46I don't know if he's going to...
17:47If he pulls out himself and doesn't get the $5 million, why would he do that?
17:51Just to go to the NFL, go to the supplemental draft, and...
17:54There's no guarantee he's going to make $5 million in the NFL.
17:56I'm trying to get that $5 million.
17:57There's not, but I don't think he's going to get the $5 million anyway.
17:59He's just going to be public enemy number one.
18:01Texas Tech could probably...
18:02Like, this is going to steamroll, so more colleges are going to get pissed off.
18:05I think he should get ahead of it.
18:07And so I could see Texas Tech making that decision.
18:10I'm not so sure Sorsby would.
18:11I mean, he's battled it all the way through, and...
18:13I know, but I don't think he expected this kind of outrage.
18:17This is massive international outrage.
18:20He had smart people around him.
18:21He should have.
18:21Yeah.
18:22All right, coming up at 7 o'clock, we're going to get into the commanders.
18:25We'll play some audio from Beamich and Finley yesterday about who might be the problem
18:30in the Brandon Ayuk saga.
18:32That's coming up at 7 o'clock right here on The Fan.
