00:00there was a young baseball phenom who's 18 years old named fernando tatis and at 18 years old
00:06an adult the ability to sign a contract as an adult he uh signed a deal uh with a company
00:14that gave him uh two million dollars in exchange for 10 of his future baseball earnings for the
00:21next 25 years wow all right and uh this company uh you know it's a recognized company it's called
00:29big league advance fund bla for short and they gave uh fernando tatis two million dollars now
00:35there's no guarantee that fernando tatis jr was ever going to become the player he became so it was
00:41like we're going to give you two million bucks we're going to take that risk that you're going
00:45to become a rock star and when you do become a rock star we get 10 essentially of all future
00:52earnings that you make all right yeah fernando tatis has a contract worth let's just call it
00:58about 400 million dollars yeah uh with the san diego padres meaning that he has to pay this bla
01:04group 40 million dollars okay yeah he decided to sue them and he sued them saying that it was uh
01:13an
01:13unfair contract and that he didn't know what he was doing more or less a power phrasing all the stuff
01:17here and that um he should not have to pay them 10 of all of his royalties and earnings over
01:25the course
01:25of 25 years so i went to court what do you think the judge said in court because the decision
01:30came
01:31down over the weekend well i've heard of some of these kind of some people say predatory some people
01:35say anticipatory contracts like this usually they hold up the contract usually they do he was 18 years
01:43old so he's legally consenting adult he was not 17 that would have rendered it illegal uh or
01:48unenforceable because the miners you know cannot sign a contract without an adult or a lawyer signing
01:55it on his behalf so he went to court and he said i don't want to pay them 40 million
02:00bucks and the
02:01judge said it's an enforceable contract you owe them every penny that they deserve they took a two
02:06million dollar risk on you and that risk is paying off they made an investment in you before anyone knew
02:12that you were going to make that kind of money and you signed a contract maybe out of greed i
02:17don't
02:17know you signed the contract because someone handed you two million dollars up front and that's the
02:23risk they took and bla won the court case they're now going to get 10 of all of his earnings
02:30for 25
02:32years so a minimum of 40 million dollars it might be closer to 60 or 70 when it's all said
02:39and done
02:39wow uh this is kind of wild now one what was tatis senior doing at that time now tatis senior
02:46made 18
02:46million during his run now not the same kind of money but he should have been well off enough to
02:50where his son didn't need two million dollars right away for sure to me this is a fail on tatis

02:55part partially because he should be able to tell him he's not like some of these other kids were
03:00coming out of cuba and coming out of dominican republic with nothing he was a kid who should if his

03:06the right thing had some privilege in his life instead maybe he didn't so fail on senior's part

03:21on his back and has not a penny to his name some of those companies have people say they've taken
03:26advantage of some of those guys coming over where they're not used to have he's also educated right
03:31right so he grew up a wealthy kid right and then 18 year olds listen 18 year olds are adults

03:38you've had 18 yes they're not really they're not really adults the law sees them as adults right
03:43that's what i mean so like commit a crime at 18 you get tried as an adult right right you

03:47the military contract at 18 right you're going to be treated as a guy that signed a contract as an
03:52adult yes but i so while i understand him suing i understand it in his case i blame the family

03:58the people around him more than yeah by the way i have a problem with you at 18 now my

04:03didn't go to his dad but you know that that's still that's part of the deal who's looking out for

04:08that's that's what i mean like this guy was a a type pro a top prospect he was one of

04:13prospects in baseball right i know the phillies tried to get him they got outbid quite a few teams
04:17i think the yankees were on him pretty early a lot of people knew about this kid why is he

04:22two million dollars knowing he had the potential to earn the 400 million that he's earning that's a big
04:27mistake to me by the family and i guess kudos to that company though because now they're making
04:32money on the investment so the way the bla looks at is hey we gave you two million bucks in

04:39it's nine years later right and we want to get paid right and had that right and i'm looking at
04:45it had
04:45he not made the majors or not made money he would not have had to pay it back that's the
04:50risk on their
04:51end so let's say he had just been a you know quad a player he would not have had to
04:55pay them you
04:56only have to pay them if you do make it so there is risk on their side i think they
05:01took a two
05:01million dollar risk and it might have been a calculated risk because his dad was pedigree and
05:06he was a phenom obviously coming up right but uh the judge ruled against him in favor of that company
