00:59Did you review that with your attorney?
01:00Did you understand it?
01:01Yes, ma'am.
01:02Counsel, do you waive the reading of the indictment?
01:04We waive, Your Honor.
01:05State, are you proceeding on the indictment as presented?
01:07No, we're proceeding on the lesser included offense of deadly conduct class A misdemeanor.
01:12Any objection?
01:13None.

01:23Did you review that document with your attorney?
01:25Did you understand it?
01:26Did you sign it in all the appropriate places?
01:29Did you understand the state is proceeding on the lesser included offense of deadly conduct as a class A misdemeanor?
01:35The range of punishment for that offense is up to a $4,000 fine and up to one year in
01:39the Bexar County Jail.
01:40Did you understand?
01:41If you have a plea bargain agreement with the state, the court does not have to follow your plea bargain
01:45agreement.
01:46If for any reason the court does not follow your plea bargain agreement and gives you more than you bargained
01:50for,
01:50the fact that you entered a plea will not be used against you and you will be allowed to withdraw
01:54your plea.
01:54Did you understand?
01:55Yes, ma'am.
01:56Did you understand you have a right to jury trial, a right for you or your attorney to cross-examine
02:00and confront any witnesses the state would call on the right to remain silent?
02:04Yes, ma'am.
02:05Did you understand by entering this plea bargain agreement you were giving up those rights?
02:09Yes, ma'am.
02:09And did you intend to give up those rights and enter into a plea bargain agreement in this case?
02:13Yes, ma'am.
02:14Counselor, has your client been able to provide you with any defenses?
02:17Yes, ma'am.
02:18Do you believe he has a rational as well as a factual understanding of the charges against him?
02:22I believe so, ma'am.
02:23Do you believe he's currently competent and was legally sane at the time of the offense?
02:26In my opinion, yes, ma'am.
02:27Mr. Pullman, has anyone threatened you, coerced you, or placed you in fear to get you to enter this plea?
02:32Oh, yeah.
02:32Has anyone promised you anything other than the plea bargain agreement?
02:35Oh, yeah.
02:36Are you satisfied with the way you've been represented?
02:38Yes, ma'am.
02:39Are you a U.S. citizen?
02:40Yes, ma'am.
02:40Court will find that the defendant has knowingly and voluntarily waived his right to jury trial.
02:45Showing you the plea bargain page.
02:46Did you review that page with your attorney?
02:48Did you understand it?
02:49Yes, ma'am.
02:50According to the plea bargain agreement, the state is proceeding on the lesser included offense of deadly conduct as a
02:55class A misdemeanor.
02:56Punishment is to be assessed at one year in the Bexar County Jail.
03:00There's a $1,000 fine.
03:01State is probating $500.
03:03State recommends deferred adjudication.
03:05And there should be no contact with the complainant.
03:07Did you understand that to be the plea bargain agreement?
03:10Judge, I think it was recommending regular probation.
03:15Did I?
03:15Oh, did I say deferred?
03:17You said deferred.
03:17I'm sorry.
03:18Community supervision.
03:19That's okay.
03:19The state is recommending community supervision or regular probation.
03:23Did you understand that to be the entirety of the plea bargain agreement?
03:26Yes.
03:26Defense, is that the plea bargain agreement?
03:28It is, Your Honor.
03:29State, is that the plea bargain agreement?
03:30Yes, Your Honor.
03:31Next, I'm showing you the paragraph entitled waiver of appeal paragraph.
03:34Did you review that paragraph with your attorney?
03:36Did you understand it?
03:37And did you sign it in both places?
03:39Yes, Your Honor.
03:40Did you understand by signing that you're waiving your right to appeal, the only items
03:43that can be appealed are written pretrial motions that have been filed, heard, and ruled
03:47upon by the court.
03:48Did you understand?
03:49Yes, Your Honor.
03:49Counsel, have there been any such motions?
03:51No, Your Honor.
03:54Next, I'm showing you outside the plea bargain agreement.
03:57The state is recommending that your community supervision be for a term of two years.
04:00There will be a tap evaluation, 100 hours of community service restitution, and hostility,
04:06aggression, and control course.
04:08Did you understand those are recommendations from the state and the court does not have
04:11to follow those recommendations?
04:13Yes, Your Honor.
04:13Then to the offense of daily conduct as a class A misdemeanor.
04:16How do you plead?
04:17Guilty, not guilty, or no contest?
04:19State, any evidence?
04:21State offers states exhibit one and its attachments into evidence.
04:24No objections.
04:24Mr. Pullman, I'm showing you what's entitled Waiver and Consent to Stipulation of Testimony
04:29and Stipulations.
04:30Did you review that document with your attorney?
04:32Did you understand it?
04:33Did you sign it in all the appropriate places?
04:36Again, did you understand you have a right to jury trial, a right for you or your attorney
04:39to cross-examine and confront any witnesses the state would call, and the rights remain
04:42silent?
04:43Yes, Your Honor.
04:44Did you understand that today the state will be presenting evidence in the form of witnesses,
04:48statements, and police reports, but most importantly, there will be no live testimony?
04:52Did you understand?
04:53The court will find that the defendant has knowingly and voluntarily waived and consented
04:56to stipulation of testimony and stipulations.
04:59The court will accept into evidence states exhibits one and attachments and review the
05:02same.
05:03In a review in states exhibits one and attachments, the court will find there is sufficient evidence
05:06to find you guilty, and the court will find you guilty.
05:09Are you proceeding with sentencing?
05:10Yes, Your Honor.
05:11If I may just speak to the court briefly on a couple of issues.
05:14Yes.
05:14Your Honor, first of all, Mr. Pullman would like the court to know that he is a repo driver
05:20for 18 rooms for semi-trucks, and so his job takes him across the nation.
05:25With regard to the no-contact order, he is of the understanding that he will just avoid
05:29Bexar County since he can pick and choose which job to take, but would like the court
05:33to know that he does travel for his job.
05:35Well, I mean, he can't avoid Bexar County because he's going to be supervised in Bexar County.
05:39He was going to ask for a transfer to Harris County where he lives.
05:42He did not live here in San Antonio, Your Honor.
05:44That was the other issue he wanted to address with the court.
05:46And then the final one would be if the court would allow him to purchase a community service
05:49hour since he does not live in the Bexar County area, the citizens of Bexar County wouldn't
05:53benefit from his community service.
05:55All right.
05:57So, Mr. Pullman, how old are you?
06:0047.
06:0147?
06:02How long did you know the complainant before you came to meet her in Bexar County?
06:10I mean, you wouldn't know.
06:12I mean, your attorney doesn't know.
06:13He wasn't with you when y'all met.
06:14I have no idea of the court.
06:16Are you on a jury trial?
06:18Your Honor, we had that discussion.
06:20And this is what Mr. Pullman has chosen to do.
06:23I have no idea.
06:25No, I mean, if you want a jury trial, we'll give you a jury trial.
06:28I've taken this because I'm an ex-con.
06:31I don't want to take a trial.
06:33You're not willing to drop the page.
06:34I mean, I'm fine.
06:38No, here's the thing.
06:40Where we are is you've entered a plea.
06:42Yeah.
06:43Now, if you want a jury trial, we will give you a jury trial.
06:46I don't want a jury trial.
06:47All I'm trying to tell you, ma'am, is that I have no idea who this showy person is.
06:52I can tell you specifically, every single woman that I have ever been in a big relationship with in a
06:59geographical location, I do not work, play, live anywhere in.
07:04So you're saying you've never dated anyone in Bexar County.
07:07Is that what you're telling me?
07:09Oh, man.
07:09I have never dated anyone in Bexar County.
07:11So I'm not saying it might be this person knows me from Harris County and just reported here.
07:17I'm not sure what happened, but I've never dated anybody in Bexar County.
07:24So, I mean, I couldn't.
07:28The name is very, very specific.
07:31I have never addressed it anybody in the show.
07:33I don't know who this person is.
07:38And, Your Honor, if I may offer, I have had a discussion with Mr. Pullman.
07:42This is the route he chose to go.
07:43We did discuss whether or not we should take it to trial.
07:47For whatever reasons that are his own, he has chosen to take this plea bargain and do it.
07:53Is it a chance that he was doing a repossession here in Bexar County and this is in relation to
07:58that?
07:58Possibly.
07:59He doesn't necessarily know the names of the people he's doing a repossession from, but this is the route Mr.
08:04Pullman has chosen to go if the court will accept this plea.
08:08Judge, the ID was provided by the complainant, I think, from a picture of his ID on her cell phone.
08:14You know, we believe based on what defense is saying, took that into account in the offer we made in
08:22this case.
08:23But because she's the complaint is very clear.
08:26She's saying that you went through her phone and you became angry about messages.
08:32So here's the thing.
08:33You're 47 years old.
08:35Move on.
08:37I mean, you're old enough to know.
08:39Here's the thing.
08:39You are old enough to know when you're 47, you're not a teenager.
08:44If somebody is cheating on you, if somebody has a relationship with somebody else, there are two things to have.
08:50There are two ways to handle that.
08:51The first way is you accept it and deal with the fact that the person that you love or want
08:57to be with is going to be cheating on you.
08:59The second way is you tell that person, I'm not going to deal with this.
09:04Either you're going to be faithful and with me or you're not.
09:07If you're not, then I'm leaving.
09:08Those are the two choices.
09:10This choice here is not a good choice.
09:13All right.
09:14This is what the court is going to do.
09:15As previously stated, the court is finding you guilty.
09:17The court will sentence you to one year in the Bexar County Jail, suspended and probate it for two years.
09:27There's a thousand dollar fine.
09:30Five hundred is to be probated.
09:33Well, actually, there's a thousand dollar fine in the entirety of the fine will be probated.
09:40There's to be no contact with the complainant.
09:48And that's Uche Otikor, U-C-H-E hyphen A-W-A-J-I, last name O-T-I-K
10:02-O-R.
10:05There's to be anger management.
10:10Transfer to Harris County.
10:18One hundred hours of community service restitution.
10:22If you want to buy those hours, the court allows those to be bought out at seven dollars and twenty
10:28five cents per hour.
10:29And that will go to the San Antonio Food Bank.
10:38There's to be regular reporting.
10:42By Zoom.
10:44Or in person.
10:48Proof of employment.
10:51Within 15 days.
10:54There's to be no employment as a home health care provider or with minors.
11:00There's to be regular UAs.
11:03Or drug patch.
11:08Defendant allowed to travel for work.
11:18All right.
11:18Probation.
11:19Is there anything else he needs?
11:20No, Your Honor.
11:21Is there anything else you need from the court?
11:23No, ma'am.
11:24You're welcome.
11:24I'm going to show you what's entitled trial court certification of defendant's rights to appeal.
11:28Did you review that document with your attorney?
11:30Did you understand it?
11:31And did you sign it?
11:32Yes, Your Honor.
11:32Because this is a plea bargain agreement, because I followed your plea bargain agreement, and because you waive your right
11:37to appeal, you do not have the court's permission to appeal.
11:40Do you understand?
11:41All right.
11:41Good luck to you.
11:42Court is calling 2022 CR 4502, state of Texas versus Ricardo Martinez.
11:49Can I have parties announced for the record, please, for the state?
11:52Michelle Hayden for the state.
11:54For the defense.
11:54Victoria Cruz on behalf of Raymond Martinez for the defense.
11:58All right.
11:58And are you Mr. Martinez?
12:00Yes, Your Honor.
12:01All right.
12:01Counsel, I'm showing you the discovery acknowledgement.
12:03Have you received all the discovery in this case, and did you review it with your client?

12:41Do you have it as a family household?
12:43Okay, thank you.

13:21have to whisper.

17:02He does work in Valverde County and in?
17:06The court.
17:07Well, I work, my job has a job for the contact and the Oversons, but I might be, I might
17:12have
17:12to travel in the future.
17:14What counties?
17:16It depends on, I don't know at the moment, I think I might be in Austin.

17:34And is it the one with the complainant?
17:36No.
17:37All right.
17:40So, there's no reason for you to contact the complainant at all, do you understand?
17:44Yes, Your Honor.
17:45So, why were you being abusive?
17:49At the time, I was, you know, the argument is that good from a phone to end up, the situation
17:55where I ended up.
17:55Well, what is this situation?
17:57The phone that, well.
17:59No, what did you do?
18:00What did I do?
18:01Yeah.
18:01Well, I was, pretty much, I was grabbing my phone from her, holding her, and trying to
18:09me to talk.
18:09No, it says that she passed out.
18:11She passed out.
18:12She said that she got to talk her out, but I didn't, I didn't talk her out to me.
18:16She told me, I didn't talk her like, I was holding her down on the floor.
18:21Holding her down how?
18:22Like on the floor, I was, I had my arm back around her, and I was trying to get the
18:25phone
18:26at the same time.
18:28I'm waiting on the floor.
18:32Well, it says here, she had redness to her nose and the front of her neck.
18:37So how did she get redness on her nose, neck, and upper back?
18:43I don't, I don't mean to call that.
18:45All right.
18:45And then there was a seven-year-old there.
18:48So do you know that the seven-year-old hurt you all?
18:54And how old are you?
18:55I'm 30.
18:56And how old is your child?
18:58He is seven.
19:01All right.
19:02And that's with some other female?
19:04Yes.
19:05And do you see your child?
19:08Oh, we have.
19:11That's either yes or no.
19:12Oh, yes.
19:12When's the last time you saw your child?
19:14I saw him.
19:15Oh, actually, not recently.
19:16I haven't seen him.
19:17And we're kind of going through like the child.
19:19So what is it?
19:25This is something I want you to think about.
19:29Hypothetically, let's say that the mother of your child got involved with another boyfriend.
19:35And that boyfriend was abusive to her.
19:37And your son heard it and knew about it.
19:40What damage do you think that would do to his psyche?
19:44And that's what you did on this day.
19:48You understand?
19:51All right.
19:51This is what the court is going to do.
19:53The court is going to sentence you to two years deferred adjudication.
19:58$750 fine.
20:00That'll be probated.
20:02Affirmative finding of family violence.
20:05The BIPP course.
20:0780 hours of community service restitution.
20:1040 of those hours will be waived if you provide proof of the COVID vaccination.
20:14Court is not requiring you to get the COVID vaccination.
20:16But if you do, 40 of those hours will be waived.
20:20There's going to be parenting classes with Triple T.
20:25There's to be no contact with Heather Cruz.
20:32There's to be a transfer to Val Verde County.
20:42Defendant is allowed to travel for work.
20:50Proof of employment within 15 days.
20:55No employment as a home health care provider or with minors.
21:00There's to be regular reporting by Zoom or in person.
21:09There's to be regular UAs.
21:12If you're direct tested today, what are the results going to be?
21:14Good.
21:15Same.
21:16Okay.
21:19All right.
21:20Probation, is there anything else that he needs?
21:23Is there anything else you need from the court in order to be successful?
21:31I'm going to show you what's entitled trial court certification of defendants' rights to appeal.
21:37Did you review that document with your attorney?
21:39Did you understand it?
21:40And did you sign it?
21:40Yes, Your Honor.
21:41Because this is a plea bargain agreement, because I followed your plea bargain agreement,
21:45and because you waive your right to appeal, you do not have the court's permission to appeal.
21:49Do you understand?
21:50Yes, Your Honor.
21:50Because this is an affirmative finding of family violence, you're not allowed to own or possess any weapons or ammunition.
21:56Do you understand?
21:57If you have a question over what a weapon or ammunition is, you'll need to speak to an attorney.
22:01Do you understand?
22:02All right.
22:03Good luck to you.
22:04We're off the record.
22:05Here's the thing.
22:06Everything that you do affects children.
22:09You understand?
22:10So you need to make sure that you are a better person for your son and make sure that he's
22:15somebody that would want to look up to you.
22:20All right.
22:21Good luck to you.
22:21Chad Pullman, 47, stood before Judge Stephanie Boyd with a plea deal and a story.
22:27He had no idea who the victim was and had never dated anyone in Behar County.
22:33His own attorney admitted they discussed a trial, but Pullman, an ex-con repo driver, chose to plead guilty.
22:40Then Judge Boyd read the room.
22:42She revealed the victim had a photo of Pullman's ID on her phone.
22:46The denial crumbled.
22:47In a moment of raw courtroom honesty, Boyd leaned in and destroyed his excuses with four words.
22:54You are 47 years old.
22:56Move on.
22:57She lectured him like the adult he refused to be.
23:00There are two ways to handle cheating.
23:01She said, accept it or leave.
23:04Violence and deadly conduct are not options.
23:07Boyd accepted the plea but stacked the punishment.
23:10One year in jail, suspended.
23:12Two years probation.
23:13No contact.
23:14Anger management.
23:16One hundred hours of community service.
23:18And when Pullman tried to buy his way out of service hours, she allowed it.
23:22Dollars 7.25 per hour paid directly to the San Antonio food bank.
23:27He couldn't run.
23:28He couldn't hide.
23:29Judge Boyd made sure his punishment fed the very community he terrorized.
23:34That's not justice.
23:35That's a master class.
23:36That's a master class.
23:37That's a master class.
