00:00A very, very dangerous person. And I'm going to tell you, what does this look of bewilderment?
00:06You're charged with aggravated robbery. You're charged with retaliation. And now you pick up two other cases.
00:15I'm going to do everything in my power to protect the public.
00:18And I'm going to tell you now, if that means having to stick your bonds with $50,000, I will do it in a heartbeat.
00:25I'm going to put a whole host of conditions on you.
00:28I don't know if you're going to get out, but if you do, you violate one small thing.
00:36You will be staying with me. Do you understand?
00:40No dope, no alcohol, no going to any of the places where you've been charged with theft or any of the other things that you got.
00:48No weapons. And I'm putting an ankle monitor and I'm giving you a curfew.
00:52I don't want you out in the middle of the night. Your curfew is from 9 p.m. to 6 a.m.
00:58Do you understand? Your bonds now are set at around, what, 70?
01:07Whose record?
01:09Shreya's record.
01:10Oh, no, Josh, he stepped out because he was just coming out to sign the condition.
01:13Oh, I can step in.
01:14No, well, I think his bonds are wholly insufficient.
01:18His criminal mischief is at $1,000.
01:20His theft is at $800.
01:22That's just, and he's charged with aggravated robbery and a retaliation.
01:26I don't think so.
01:28That's like, that's, yeah.
01:31I'm going to need, so what we'll do is I'm going to roll him to tomorrow and we'll talk with Josh tomorrow.
01:35But I now find that your bonds are wholly insufficient.
01:38You're way too dangerous, man.
01:40Way too dangerous.
01:41Do you need to wait on the bond conditions then?
01:46No, let's have it signed just in case he makes bond now.
01:49That way we have it in place.
01:52But I'll readdress the bond tomorrow.
01:58Perception is reality.
02:00So you're wanted at a current California for willful cruelty to a child.
02:10Are you waiting for him to extradition, sir?
02:12Yes, sir.
02:13Okay.
02:13So what that means is we give the demanding jurisdiction here, California, two weeks to come pick you up.
02:19And if they fail to come pick you up within that time, we will release you.
02:22Yes, sir.
02:24You know that California is already ready to come get him?
02:27Amy?
02:27Oh, yes.
02:29Okay.
02:29All right.
02:31Good luck.
02:32Thank you, sir.
02:32All right.
02:33Thank you, Josh.
02:36So let me get this right, Josh.
02:39He was out on bond for the aggravated robbery.
02:42He was out on bond on the other case, on the retaliation.
02:46And then he picked up these two new cases, right?
02:48Is that right?
02:48Yeah.
02:49Let me check it out.
02:59I think he was out on bond for the aggravated robbery.
03:06And then...
03:07Oh, the aggravated robbery.
03:10Yes.
03:12And then picked up the retaliation on 9-4.
03:15And then after that, so it's a third time he's out, and then he picks up another case?
03:23The retaliation judge are from August of this year.
03:27There's two cases in this court.
03:30Yes.
03:30Let me see.
03:30It was after the aggravated robbery and before the retaliation.
03:35All right.
03:36So the retaliation is September 3rd.
03:42The mischief is August 28th.
04:00That is August 8th, 28th.
04:12As soon as I found that I had the warrant.
04:20I got myself there.
04:23Okay.
04:24Okay.
04:2415 00.
04:2616.
04:2716.
04:3017.
04:3018.
04:3118.
04:3318.
04:3320.
04:3420.
04:3420.
04:3521.
04:3522.
04:3721.
04:3822.
04:3823.
04:3922.
04:3923.
04:3923.
04:4022.
04:4123.
04:4123.
04:4123.
04:4223.
04:4224.
05:12Okay, so let's talk about this.
05:32So, officers get a call that a robbery has occurred.
06:14Three vapes and other stuff, sodas.
06:19And complainants stated both defendants walked in at the same time.
06:28Waters came up to the counter stating he wanted to purchase a t-shirt located behind the counter.
06:33While that was happening, Marshall attempted to come behind the counter, but the complainant was able to stop him.
06:39He reported that Marshall then came around to the front of the counter where Waters was, that he was distracted by Waters who purchased a t-shirt, opened the package shirt, and seconds later wanted a refund, which he gave him the refund.
06:55The complainant reported that as that was happening, Marshall used his hands to mess with the glass partition, heard the glass breaking, grabbed three vape pens, other things, and ran out the store without any attempt to pay.
07:12The complainant says that he knows both defendants by sight and can identify them from priors.
07:26So, while being out on all that, on the aggravated robbery,
07:46in that one, what do we have, is he, is he, did he hold someone up?
07:54Yeah, let's see how dangerous Mr. Marshall really is.
08:00Allegedly.
08:01So, the complainant witness was a delivery man for Domino's.
08:09I believe he made a delivery to the co-defendant in that case.
08:13The complaining witness said he felt something wasn't right and told the co-defendant to just pay him half so he could leave.
08:20The co-defendant pulled out a handgun, pointed it at the complaining witness, and demanded the pizza.
08:25The complaining witness noticed this defendant by his vehicle at that point, and observed defendant Marshall open, his front passenger door reach in, and instill a fanny pack that held his cell phone.
08:40So, this defendant was...
08:41He's not the one with the actual...
08:43He was not the one pointing the gun.
08:55The complainant began to feel that something was not right and off to accept half the amount due for the pizza, just so that he could leave the location.
09:19White then pulled out a firearm, pointed at the complainant, and demanded the pizza.
09:25White told complainant that he had five seconds to give him everything he had, and began to count out loud.
09:32Do you know how scary that is to have someone hold a gun at you, tell them you have five seconds to give him everything, or else?
09:44That is really, really terrifying, and can cause people to have nightmares, all kinds of psychological issues.
09:55Do you know how scary that is to have someone hold a gun at you?
10:14When defendant White reached his five-second countdown, the complainant stated that he saw defendant White attempting to pull the trigger and could hear a clicking sound.
10:27It was at that moment the complainant was fearing for his life.
10:31He attempted to push defendant White's pistol away from his face and was able to retrieve his own firearm, namely a pistol.
10:45The complainant feared for his life and discharged the pistol at defendant White.
10:49Oh, the complainant shot and killed defendant White, who died at the seat.
11:03Complainant stated that defendant Marshall ran off with his property, and the complainant drove to a safe location before calling the police.
11:09This is Houston.
11:18I will do everything in my power to protect our city.
11:22I want you to understand that person is now gone.
11:28For a pizza, his life is now gone.
11:31For a pizza, his life is now gone.
11:33How well did you know this person?
11:38How well did you?
11:39Was he a good friend of yours?
11:42Someone I knew in the apartments.
11:54I'm going to make each of your bonds $3,500, Mr. Marshall.
11:58I want you to understand that if you are able to make bond, I'm putting a whole host of conditions on you.
12:09I will understand.
12:10Don't be a danger to our city.
12:12You have but one life.
12:14Stop.
12:15You have but one life.
12:17You know, when it's gone, it's gone forever.
12:20And it's so very, very short.
12:23So, heed the advice, because I'm not giving you any more warnings.
12:27Do you understand?
12:29Yes.
12:29Okay.
12:30Thanks, Steve.
12:36Good morning, Mr. Jones.
12:38Good morning.
12:38Mr. Jones, you were wanted out of the state of wherever.
12:42Probably denial, I don't know.
12:44But I have him here now because your lawyer is asking me to set you a bond.
12:49Yes, sir.
12:49I don't know.
12:50I've never met you before.
12:51I don't know who you are.
12:52Order of the court.
12:53You know, my primary concern are two things.
12:58Number one, will you go back to the jurisdiction that you wanted from?
13:02Number one.
13:02Yes, sir.
13:03More importantly, and most importantly, are you a danger to the community?
13:07I know that you're going to tell me that you're not.
13:09Everyone says that, right?
13:10But what really dictates is how you look on paper, because that tells me who you really are.
13:15So, I just don't know.
13:17We'll go through all that, and we'll determine whether, you know.
13:20I do know that you have an open evading arrest in a motor vehicle, so you're now charged with a third-degree felony.
13:29And so, all right, Amy, tell me about it.
13:31Yeah, he's running from St. Lucie County in Florida.
13:35Oh, Florida.
13:37Oh.
13:37Yeah.
13:38Ouch.
13:39He's going for a violation of probation for a grant theft of a motor vehicle.
13:44We're asking for a new bond at this time.
13:47But one thing, he picked up this evading of a motor vehicle wall on that probation.
13:50He has an...
13:51Is this a stolen car, too?
13:54Allegedly.
13:58I don't think he was charged with that, Judge.
14:00So, I would say...
14:01Yeah, I mean...
14:02A prohibited vehicle on the toll.
14:04But we had an earlier case today, same thing, in a stolen car, right?
14:10Allegedly.
14:10And they didn't charge him with the UUMB, but they could have.
14:13So, it's intake...
14:15I don't know.
14:16Just these days, it's...
14:18I'm seeing a prohibited vehicle on the toll.
14:21So, it is a prohibited vehicle?
14:22On the toll.
14:26So...
14:26I don't know.
14:27A prohibited vehicle could be a vehicle that has...
14:29Yeah, it's very valid.
14:32We're no tagged, so we're...
14:34What other kind of criminal history have you got?
14:35Yeah, he has...
14:37The same number of fraud and forgery charges out of Florida and Georgia.
14:40How many?
14:4122 pages worth.
14:4222 pages worth of criminal history?
14:45Yes.
14:45He also has...
14:45Wow!
14:46Several failures to appear out of Florida.
14:49He was arrested in May 3rd of 2023 for a probation violation in Florida.
14:54Of course, this probation violation is for three different violations for a failure to report
14:58and then changing address without permission, I think.
15:0122 pages of priors.
15:03Well, I would say this, Judge.
15:04Sometimes the one case can take up to two pages sometimes, so...
15:09Even by that theory.
15:10Even...
15:11I get cheaper.
15:13He also has misdemeanor and felony willful obstruction of law enforcement officers out of Georgia.
15:18I'm surprised you even got probation.
15:22You know?
15:23I mean, really.
15:25You know...
15:26All the charges were trickled down to two counts.
15:31So, it was...
15:35All those charges are the exact same charge and they dropped it to...
15:3922 pages worth of the exact same charge?
15:41It was 19 charges.
15:43And they brought it down to two...
15:44They were basically two charges, two different kind of charges, but nine charges a week.
15:49It happened that would garner 19 charges.
15:53That's usually something where you have, like, a mass event, like a shooting or like...
16:02The probation violation's original charge, which was a grand theft of a motor vehicle,
16:06he obtained that motor vehicle by...
16:09Like, false offenses or something?
16:10Yeah, he tried to buy it with a false fix-up for a false company.
16:16Judge, if I may?
16:17Sure.
16:17Judge, I'm not asking for a PR bond.
16:19I'm asking for a...
16:20Even if you consider a bond, a high bond amount that would allow him to go turn himself in.
16:25He would have skin in the game.
16:27It's a monetary sum that would ensure that he goes and turns himself in.
16:31He hasn't messed up in your court before.
16:34I'm seeing.
16:35I'm sorry.
16:36And so, it would allow him to at least go present himself while also understanding the risk of losing a big deal of money.
16:45So, I'd say that...
16:46Whose money?
16:47Not his money.
16:49What kind of money you got?
16:51I don't know.
16:52Doing what?
16:54I don't know.
16:59I'd like to afford him the opportunity to get a post-it bond.
17:03If you entertain me.
17:04Well, the first thing I'd need to know is, out of the 22 pages, what are all those...
17:10I'd like a list of every single charge that he's ever had.
17:14Okay.
17:15I'd like to know the disposition of those charges.
17:18Okay.
17:18Because, you know, the problem is, Mr. Jones, is that when you have too much baggage, the more baggage you have, the higher of a flight risk you are.
17:30Because, you know, that at some point, you're going to have to answer to those charges, and you're going to try to...
17:35I answer to all those charges.
17:38I don't know that.
17:39I know you're telling me that.
17:40I don't understand, but those...
17:42I handled that.
17:43That was my first real case, and I handled it.
17:47I handled everything.
17:48Yeah, I mean, in some of those, like with the FTA and stuff, I turned myself in.
17:54It was mis-exchange with court dates and stuff like that, and it would show where I turned myself in, like, multiple times.
18:01In this case here, you're trying to evade capture here.
18:05I mean...
18:06So, I don't know.
18:09You know, I'd need to know a lot more about you before I were to grant your bond.
18:12You know, the current case, I can't speak on that right now, but all the other cases, I turned myself in, and I handled what I needed to have.
18:20You know, has he ever had a prior fugitive case before?
18:24Out of where?
18:25So, Ricardo, if you want, we can do a deeper dive, or you guys can do a deeper dive, and let me know more about him.
18:31Here's the thing, Judge.
18:32I don't think it's...
18:33Here's how this would work.
18:37I don't have access to the 22 pages.
18:39I would love to give you the report by tomorrow.
18:42I can do that.
18:42So, what we can do is we can ask Amy to print you out the NCIC report.
18:47Can you provide him with a copy?
18:49I thought I'd say, if that's all right with you, Judge.
18:52There, at least at the minimum, I know that they'll let you look at the report.
18:56So, you can look at it and write it down.
18:58I don't know if they'll give you a copy of it, but at least you can look at it, and we can try to work through to see all the charges of what they are.
19:05Right.
19:05Try to find out what the disposition, but...
19:07I can also go through it, and...
19:09Right.
19:11Okay.
19:11But with 22 pages of prior criminal history, I'm going to tell you now, it's a really uphill battle to give you a bond.
19:18And if I do give you a bond, it's going to be a hell of a high amount now.
19:23In the five, high five digits, perhaps six digits, because, no, I want to make sure that you turn yourself in.
19:33And the problem is, is that I know that there's a hurricane out there hitting Florida, so it's a perfect time for you to give me this kind of excuse there.
19:40I couldn't make it there.
19:41I couldn't make it here because of this and that.
19:43And when here...
19:44Okay.
19:44I'll explain some of his options.
19:54Judge, we'll go over where we're at, and I'll see how you must proceed.
19:57Okay.
19:58But I'm going to tell you now, if I were to give you a bond, it's going to be in the high five digits.
20:07I understand.
20:08Judge, my understanding is he already waived on October 8th.
20:12You know what?
20:15And I'm going to tell you now, we have at least three other people here from Florida, and I think it's Miami-Dade, right?
20:22Wasn't it Miami-Dade that we have?
20:24How far is that from Miami-Dade?
20:28So perhaps we can come get them to pick you up in addition to those two, because I know that we have at least two transports that are coming here to pick up another three individuals from Florida.
20:38So maybe we can get you on that, and they're supposed to be here next week.
20:42You know, so if you waive, or look, like, I mean, you've already waived, so great.
20:47I'm not trying to run from nothing.
20:49I just want to get this over with you.
20:50Here's the only other advice I'm going to give you now, is that you need, if you do go back, you have to stay in contact with your felony lawyer in your felony case.
21:00Because if you don't, and they think that you have absconded, they're going to file, they're going to issue a warrant in that case.
21:06And then the hold that you have here for your Florida stuff, it's going to happen to you over there, over here, because you're going to be over there.
21:13And then you're going to get a Harris County hold.
21:15So when you do finish up over there, you're not going to get out, and they're going to try to transport you back over here.
21:20That is Eileen, Eileen Bogart is your lawyer over there.
21:30So just stay in touch with her to let you know what's, let her know what's going on, and that way they don't want to keep it.
21:34Okay?
21:35Okay, of course.
21:36Can you let they know that perhaps we can get them on the train of transport?
21:44Good morning, Mr. Houlihan.
21:45Good morning.
21:46How's it going?
21:47Sucks.
21:48Good?
21:49Wonderful.
21:50Definitely don't ever want to come back here.
21:52The worst of an experience you have, the higher likelihood you have of truly listening and realizing that we mean business, because that's what we do.
22:01When we ask you, I'm sorry, when we tell you not to do something, it's not for shifting giggles, it's for the real deal, and you're not supposed to.
22:08And when you do, there are serious consequences.
22:11And coming in here and tell me it's NyQuil or this, I don't care.
22:15No alcohol means no alcohol from any source.
22:17Now, at the same time, I don't want you to plead guilty just to get out, right?
22:22Because that's what you were going to do, and that's what everybody does just to get out, and I don't want that to happen.
22:28I'm going to give you another chance today.
22:31I'm going to put a monitor on your ankle so that I know that you're not consuming alcohol.
22:36And I'm going to tell you now, I will never play this game again with you.
22:39So the next time you consume alcohol, and I don't care what source it is, and you've got your mom here to know, whatever it is, I don't care if it's the tequila lollipop, hair dye, you've had dinner with Mother Teresa, whatever.
22:51The next time you consume, you will be with me.
22:55And you know now, you have no one to bond you out.
22:58So you're going to sit there for who knows how long.
23:02Do you understand?
23:03Yes, sir.
23:03No alcohol whatsoever.
23:07Yes, sir.
23:07The monitor that I'm going to put on you costs around $400 to $500 a month.
23:13I'm going to waive that fee for you so that there's no excuse.
23:17You need to charge that thing on a daily basis.
23:20So if the battery goes dead, so do you.
23:23You must charge it on a daily basis.
23:26Be careful for whatever you put in your body because that machine is extremely finicky.
23:30It tests alcohol through your perspiration.
23:33So whatever you're eating, be careful.
23:36Apples.
23:36What happens to apples?
23:38What happens to bananas?
23:39They can become alcohol at some point.
23:43So you need to be careful.
23:45Apples, some fruit ferments.
23:47So just take that with what it is.
23:50Be careful whatever you put in your body.
23:52Are there instructions somewhere?
23:54Yeah, they will advise them when he gets the monitor.
23:58They'll advise them on what he can and can't do.
24:00But it's also common sense.
24:01You have to know everything that you put in your body.
24:03If you're going to go to a party and there's a bucket of punch there,
24:06it's probably not a good idea to drink the punch, right?
24:10Yes, sir.
24:11All right.
24:12Just use common sense.
24:17It's not that hard.
24:18And be nice to people.
24:19I definitely let them out.
24:20I'm letting you out now.
24:22I don't want to end up being like my father.
24:29Right there gives you pause to concern.
24:31I mean, you're headed there.
24:35I mean, you're in jail.
24:37You're headed there.
24:38I mean, if there's no other wake-up call,
24:41then this is the wake-up call.
24:44Don't end up like that.
24:46It's you have the opportunity now to apply for a diversion program
24:51that if you get in, which you probably will,
24:54if you do the application correctly,
24:56if you complete it successfully,
24:58they'll dismiss this case against you.
25:00It's a really big deal because when you get a DWI on your record,
25:02it closes so many doors.
25:05Not to mention your life,
25:06it's going to cost more in every respect.
25:09So just be good.
25:11All right.
25:11Yeah, drug testing as well.
25:19You're going to be tested 40 days from today.
25:20If you find weed in your system in 40 days,
25:23that tells me that you've continued to smoke weed.
25:25I'm going to put you in jail.
25:27Don't smoke weed.
25:28Don't go to any parties.
25:30Don't hang out with anyone that you think that they're going to use
25:32because peer pressure sucks.
25:35And it's very, very difficult.
25:36So if you're hanging out with the wrong people,
25:39they're going to take you down.
25:41No dope, no alcohol.
25:42You'll be tested in 40 days.
25:44And you know now what that machine does.
25:46Do you have any questions?
25:48Okay.
25:49Listen to Mr. D and then we'll see you in a couple of weeks.
25:52Thanks for coming.
25:54Do you have any questions?
25:59Remember, be patient with Mr. Dixon.
26:02He has so many cases.
26:04I mean, you see he's running from court to court to court to court.
26:07He's like Speedy Gonzalez.
26:09So just take care.
26:11Understand he has a lot of cases.
26:12And if you call him, at some point he'll get to you.
26:15And if you can always come here and meet here as well.
26:20We're always happy to have you at any time as well.
26:22Okay.
26:23All right, guys.
26:24Good luck, Mr. Golan.
26:25All right, sir.
26:26This way for me.
26:27Thank you, Your Honor.
26:28Thank you, Mr. Dixon.
26:29Judge, for clarification,
26:31the authorities need support.
