00:00:00Come up, Ms. Gutierrez. Either you have a problem or you just don't care about court orders.
00:00:06It's one or the other. If you have a problem, I'm going to address it for you. And I promise you,
00:00:11you're not going to like the way that I do it. Do you understand? I'm now going to put an ankle
00:00:15monitor on you. And if I ever find that you test positive again for anything, and I don't give a
00:00:20rat's behind what it is, you will stay with me. And if it becomes an extreme case, I can have a
00:00:27hearing to hold you in contempt, slap you with 180 days, probate it for two years, and put you in a
00:00:32lockdown rehab facility. Do you understand if that's what it's going to take? I'm amending the
00:00:37conditions now to put a scram on her ankle. I hope above all else in this short life, you are not
00:00:43driving. Because if it comes to my attention that you are in violation of this affidavit, it's really
00:00:48not going to go well for you. You understand? Yes. Okay. All right. Your Honor, we do have an offer.
00:00:55Um, and we wanted to run it by you to see if it was something that you take. It is a jail offer.
00:01:01So, Your Honor, it was, yeah, I didn't see it. But yes, it was a minimum of 30. And we just didn't
00:01:10realize she had 10 days credit. So it wouldn't be a time. How does she have 10 days credit?
00:01:13I don't, I didn't run her. So that's what she did. Let me know. She has about 10 days credit.
00:01:18So we can verify. Uh, two, five, four, five thousand. Five thousand. Five. Five. I don't, I don't know.
00:01:27It's just. Sandra Coutiers. Hmm? She has one day. She has one day credit. One day.
00:01:31How did you get 10 days credit? One day. Um, that's all. I was, I was in jail for, so I was on probation
00:01:37before when I caught this new charge. I was actually did a five-year probation. And I was supposed
00:01:44to sign my papers that day that I was, I guess, exited out of jail, the day that I left jail.
00:01:50And, um, I, that was, it was like a week before. So yeah, please. I'm not sure. Just you guys talk
00:01:57early. I don't want you to say something that really hurts your case, you know? So it's probably
00:02:01better that you just talk with the chisons, figure out what you guys, we only have one day credit here.
00:02:06That's all we have. If you want to, I'm happy to do it. That's good. If you guys want to do it.
00:02:11Um, the one day, Judge? Right. Well, she has one day credit. I'm not going to give her more than
00:02:15she's entitled to. I understand. You know, I can only give you what you're entitled to, right?
00:02:20Yes, Judge. What you have here. So if you want to do that, I'm, you have my blessing. It's up to you
00:02:28guys. But as of today, if she leaves here, she gets an ankle monitor. Of course. And then if you test
00:02:36positive again, it's not going to go well for you. Okay. You'd let me know. Yes, ma'am.
00:02:42Does she have to go back in here, Judge? No, but she's going to meet with pre-character.
00:02:47Um, on Ms. Sandra? Yes. We have a new offer, probation officer, um, 15 month offer with a
00:02:55T-RAS. Whether the T-RAS states that she should do, she'll do it. Okay. Sounds good. Sounds good,
00:03:02Judge. Thank you. We'll write it up. Here's the thing, though. She couldn't even make a felony
00:03:06probation. How's she going to make this one? She didn't make a felony probation. Did she
00:03:10make it or did she get it? She completed it. Five years. Tell her that if she tests positive,
00:03:19I will put her in a treatment facility, though. So she knows. Yes, Judge. Or in a fair one.
00:03:23Yes, Judge. And she did. Absolutely. Yes, Judge. I'll let her know.
00:03:27Fam on which one? Ms. Gutierrez, you're charged with driving while intoxicated.
00:03:32It's a second. Am I right? Yes, Judge. What happens the next time?
00:03:38If you ever pick up another DTVI, what's going to happen? It'll be a felony.
00:03:44Two to ten independent pension. Any prior pen trips? Yes, Judge. How many? Just one.
00:03:52You could be potentially a 15-to-life case next time. You pick up a DTVI. 15-to-life. Minimal.
00:04:00With your record, just mere smell will be enough. So if I were you, if you want to get lit, wonderful.
00:04:11Just don't get into a car. Find another way. Take an Uber. 30 to 50 bucks will get you wherever you want to go in this city.
00:04:18Don't matter where you want to go. Anywhere. Do you understand? It's not hard. One button. All you need is literally push one car away for you.
00:04:28Wherever you want to go.
00:04:28You are giving up the right to a trial. Right to compel witnesses to test for any behalf. Confront and cross-examine your accusers. If you're not a citizen, there are possible immigration consequences. You can be deported, excluded from the country, deny naturalization under federal law. You give up the right to appeal.
00:04:44Once you accept this agreement, there's no turning back. Do you understand? This will go on your record. It's going to be there for the rest of your life. Now, is it being reduced to a first?
00:04:55Yes, Judge.
00:04:56Okay. There is a surcharge that you will be required to pay in this case. You will be required to pay a $3,000 surcharge. And if you don't pay it, every $100 you owe, you will sit one day in jail. Do you understand?
00:05:11It's a second. I'm not waiving it. And it's being reduced to a first. You were lucky because a second, it's a $6,000 surcharge that you'd be, if you don't pay one day, every $100 you owe.
00:05:24So, you will be required to pay this fee. You will also be required to pay the core costs as well.
00:05:30You have entered into an agreement where they're offering you 180 days in jail to be probated for 15 months.
00:05:37As part of the agreement, you will do a repeat offender DWI education class, one victim impact panel.
00:05:47You will do a T-RAS to see what other conditions you may need.
00:05:52If they assess other conditions, you must fulfill them. They may do intensive outpatient treatment. They may do just supportive outpatient treatment. They may do inpatient treatment. I don't know what they're going to do.
00:06:04But you must fulfill whatever they say. Do you understand?
00:06:07Yes.
00:06:08No drugs, no alcohol, guardian interlock. But since you don't have the ability to drive, you must get a portable device.
00:06:1825 hours of community service. Do you have any children?
00:06:24Okay, get rid of the community service. I'd rather do a parenting class.
00:06:27$100 one-time donation to Mothers Against Drunk Driving.
00:06:35If you need extra time to pay, we will give it to you. All you have to do is ask.
00:06:40I'm telling you now, there's two, three possible things that could make this thing really go sideways.
00:06:47The first is if you drink. If you consume, a warrant will be issued. They will file a motion to revoke your probation. We will have a hearing here.
00:06:58If they prove it to me that you're consuming, it's very well possible that we put you into inpatient treatment.
00:07:03The other thing that you could, the worst possible thing you could do is drive.
00:07:07If you drive without a Texas driver license and a liability insurance, likewise, they will issue a motion to revoke.
00:07:15The other thing is take off. If you abscond and you take off, it's that, it's an instant warrant.
00:07:24If you ever have an issue, you can come talk to us. We can work it out.
00:07:29There's never nothing that can be solved. Everything can be solved in this life one way or the other.
00:07:34Those are the three things that are all hang-ups. Do you understand?
00:07:40Sure.
00:07:41So cut her fees.
00:07:42Yes, sir.
00:07:44How do you plead to the offensive driver while intoxicated? Guilty or not guilty?
00:07:47Guilty.
00:07:48Is there an accident in this case?
00:07:50No? Okay. All right, ma'am. Best of luck to you. We'll have you meet with Shari.
00:07:56Thank you, Judge. Good to see you again.
00:07:59Judge, I have Dennis Fisher, and this one's getting old, but he's sent me a bunch of character letters that I need to compile into a packet.
00:08:07And so can I get two weeks on that? I'm hoping they'll approve them for PTI.
00:08:10They had previously offered him time served.
00:08:13369.
00:08:14I know, Judge.
00:08:15Could we get two weeks, and then we'll just either see if they'll approve them for PTI or set it for trial, clear trial?
00:08:20Have everything.
00:08:20Judge, you sent me the letters based on them yesterday, so I have to compile them into a packet.
00:08:24I'll give you one week.
00:08:25Okay, one week.
00:08:27I'll compile them into a packet today and just send them so we can at least get a response on that.
00:08:32You want me to approach on a different one?
00:08:34Yeah.
00:08:34Judge, I have Moses Garza. I don't know if you want to talk to him. He's kind of unsure. I'm guessing we're just going to have to set it for trial because he's...
00:08:43No, no, no, no. We've literally set it to consider since December.
00:08:48Mr. Garza.
00:08:49I think he's in the hallway. I'll go get him, Judge.
00:08:51You have had since December to consider what to do. It is now time to consider now what you want to do with this case.
00:08:59Today is the plea deadline. You must either accept the plea bargain agreement or we will set your case for trial.
00:09:05If I set your case for trial, that's okay, but I'm not going to take anything else. I'm not here to play games.
00:09:11You either... That's it. You're out of time. It's 190 days old.
00:09:15I will have you talk with your lawyer. You consider what you want to do, but today's the day.
00:09:19Yes, Judge. Okay.
00:09:23Judges, I don't know if Jorge Gomez ever checked in. He had... He picked up a new case.
00:09:29Yeah, we already... Yeah, I know. We were going to end up revoking it, right? Because he didn't show up today.
00:09:36And he picked up a new case. He had them on BBR.
00:09:38I haven't been able to get in...
00:09:39Okay.
00:09:40You know.
00:09:40Okay.
00:09:40I did text the judge.
00:09:42In regards to your charge of driving while intoxicated, you're facing up to six months in jail and or a $2,000 fine.
00:09:49You have worked out an agreement where they're offering you three days in jail with credit for the one day that you have done.
00:09:54You need to understand that this charge, it's going to go on your record.
00:09:57It's going to be there for the rest of your life.
00:09:59You can never take it off.
00:10:01You ever get pulled over again, an officer is going to see this.
00:10:04If they see, if they smell anything funky, if they smell alcohol, if they smell marijuana, it's not going to go well for you.
00:10:11It's... Let me say, it's probably not going to go well for you.
00:10:15Don't give them the ammunition.
00:10:17Don't... Really.
00:10:18All you have to do is one button on your phone, a car will take you wherever you want to go.
00:10:2340 bucks.
00:10:24You understand?
00:10:25I understand.
00:10:26Right. It's not hard.
00:10:28You're giving up the right to a trial, right?
00:10:30To compel witnesses to test their behalf, confront and cross-examine your accusers.
00:10:34If you're not a citizen, there are possible immigration consequences.
00:10:37You can be deported, excluded from the country, deny naturalization, and give up the right to appeal.
00:10:41Like I said, so that's why it stays on your record.
00:10:44Is this what you want to do?
00:10:47I have to plead.
00:10:49Is this what you want to do?
00:10:52Yes.
00:10:54Your other option is trial.
00:10:55This is the only best option right now.
00:10:57In trial, I would need better representation, and you've been a defense attorney, and you know how this is going to go, and it's not going to work out.
00:11:04And I'm not in a financial step.
00:11:05I'm sorry.
00:11:06I'm not in a financial step.
00:11:07Let's go to trial, sir.
00:11:08Our lawyer, if you want, you'd understand.
00:11:11I'm not going to take this plea if you don't think I'm guilty.
00:11:14You know?
00:11:14We don't play games here.
00:11:16Right?
00:11:17You need to understand that he's got a lot of stuff going on in his life, too.
00:11:22He's got hundreds of cases, right?
00:11:25So the evidence is out there.
00:11:28It is what it is.
00:11:30Have you been able to see the evidence?
00:11:32I have, and it's not good, but it's not bad either.
00:11:36Talk about the facts of the case.
00:11:38I'm just saying, if you've seen what's out there, I don't know.
00:11:41I have not seen it.
00:11:43But juries aren't dumb.
00:11:46They know what drunk people look like.
00:11:48They know what intoxicated people.
00:11:49Drunk doesn't have to be falling down stupid where you're pissed all over yourself.
00:11:53And, no, it doesn't have to be like that.
00:11:56And you understand?
00:11:58I understand.
00:11:58Because this is a lifetime decision that you make today.
00:12:02Once you do this, there's no turning back.
00:12:04So you need to be fully aware.
00:12:06Because, like I said, there's no more provable slaps on the wrist from now on.
00:12:11It's a minimum of 30 days in jail for any new cases that you pick up here.
00:12:15So if you want to do it, we can.
00:12:17If you don't, we can set you for trial.
00:12:20Do you apply for PTI or no?
00:12:21Judge, we talked a lot about PTI, and it was an income issue.
00:12:26He just doesn't think he can afford PTI.
00:12:28But we've had many conversations about it.
00:12:30That's something.
00:12:31You're going to pay for it one way or the other.
00:12:33You know, DPS is going to start charging you for this thing, right?
00:12:36Your insurance is going to skyrocket.
00:12:38Insurance now is crazy as it is.
00:12:40So you're going to pay for it one way or the other.
00:12:42The option for PTI is if you're granted entry into it and you complete it, the case gets dismissed.
00:12:48Not a financial standpoint, Jaden.
00:12:49I've been over my financials, and I don't want to be in a bigger hole than what I'm already in.
00:12:57Don't want a trial?
00:12:59I'm waiving the right to a trial.
00:13:01Okay.
00:13:01All right.
00:13:02How do you plead to the case?
00:13:03Guilty or not guilty?
00:13:03Guilty, Your Honor.
00:13:04I'll find you guilty.
00:13:05I'm going to send you to the agreement.
00:13:06The only thing, just don't pick up another one.
00:13:10If you think that this was bad, wait until you get a second DWI.
00:13:14Wait until you get some, I mean, it only gets worse.
00:13:19Now, he's asking me to waive the fee for you, which is a $3,500 fee.
00:13:25I'm going to do it now.
00:13:26But you pick up a second DWI.
00:13:28It's a $6,000 fee, not to mention the minimum of 30 days in jail.
00:13:32So, get a clue.
00:13:35It's not hard.
00:13:36You understand?
00:13:37All right.
00:13:38Best of luck, amen.
00:13:39Thank you, Judge.
00:13:40Thank you, Your Honor.
00:13:41Just be safe.
00:13:43It's not all.
00:13:44Good morning, sir.
00:13:45Good morning.
00:13:45Sir, you are charged with driving while intoxicated.
00:13:47First offense, it's elevated to a Class A misdemeanor because of the high blow.
00:13:51You are facing up to a year in jail and or a $4,000 fine.
00:13:55We are going to do probable cause.
00:13:56You have the right to remain silent.
00:13:57Anything you say can and will be used against you.
00:14:00You have the right to have an attorney present.
00:14:01If you cannot afford one, one will be appointed to you, sir.
00:14:04Okay.
00:14:05On March 17th, 2025, an officer was dispatched to a call for service at the 400th block of
00:14:11West Gray Street, Houston, Harris County, Texas.
00:14:14Upon arrival, the officer observed the defendant sitting inside his vehicle.
00:14:18The officer made contact with the defendant and observed the defendant have bloodshot eyes,
00:14:22unsteady balance, and was confused.
00:14:25The defendant stated he didn't have anything to drink.
00:14:27A Houston Fire Department employee, the wheel witness, stated the defendant was asleep in
00:14:32the driver's side of the vehicle with his foot on the brake and the vehicle in drive.
00:14:36The wheel witness stated he had a hard time waking up the defendant.
00:14:40SFSTs were conducted.
00:14:41Six out of six clues were observed on the HGN.
00:14:44Five out of eight clues observed on the walk-in turn.
00:14:47Three out of four clues observed on the one-leg stand.
00:14:50The DIC was read, and the defendant consented to a breath test.
00:14:53The results were 0.179 and 0.175.
00:14:58Where was he?
00:14:58Was he in the middle of the road?
00:14:59It sounds like...
00:15:00Yeah, I don't...
00:15:02So it says that he was sitting inside his vehicle on the 400th block of West Gray Street,
00:15:07which is accessible to the public.
00:15:09On a public road.
00:15:10Don't...
00:15:11Please.
00:15:12I have no idea what that is, where it is.
00:15:17Is he in the middle of the road?
00:15:18Is he in a parking lot?
00:15:19Is it Domino's Pizza?
00:15:23I mean...
00:15:24It says it's on a public...
00:15:25It says it's on a public street.
00:15:29It says...
00:15:30Well, more specifically, it says 400th block of West Gray Street.
00:15:33It's a public street.
00:15:34I mean, I need more information.
00:15:35I mean, does it say he's on a street there, or are you assuming?
00:15:38No, I'm not assuming.
00:15:39I'm saying what it says is that the 400th block of West Gray Street is a public street.
00:15:45It doesn't say it's specifically...
00:15:46It doesn't ask him if he's driving.
00:15:52It doesn't...
00:15:53None of that.
00:15:54I mean, really.
00:15:55Yeah, he did have the vehicle in drive with his foot on the brake and was unconscious.
00:16:00But in regards to the location aspect of it, there's nothing further stated on that.
00:16:04I mean, I'm sorry.
00:16:05I'm going to find no probable cause.
00:16:06I can't just go forward with assumptions here, you know?
00:16:09Mr. Cleary, be safe, man.
00:16:12You know, we have every single day...
00:16:14Look, this weekend, how many people died on the road here in Harris County?
00:16:18You know?
00:16:19Really.
00:16:20Be smart.
00:16:21You know, you have but one life.
00:16:23Don't do something where you either ruin your life or, more importantly, ruin someone else's life.
00:16:27Okay?
00:16:28I appreciate that.
00:16:28Please take a seat from the sir.
00:16:30I'm going to find no probable cause.
00:16:31All right, Judge, next is stage 4.
00:16:35Door.
00:16:35Adam?
00:16:37No, I'm the secretary.
00:16:39Mr. Door, you're charged with assault with a family member.
00:16:42You're facing up to a year in jail and or a $4,000 fine.
00:16:46We're going to do probable cause.
00:16:47You have the right to remain silent.
00:16:49Anything you say can and will be used against you.
00:16:51You have the right to have an attorney present.
00:16:52If you cannot afford one, one will be appointed to you, sir.
00:16:55Yes, sir.
00:16:56Officer was dispatched to a disturbance.
00:16:58The complainant and the defendant are in a dating relationship.
00:17:03The complainant stated the defendant shoved her multiple times with his elbow and also grabbed her arm, causing pain.
00:17:08The officer observed the complainant to have a scratch on her chin, scratches on her arm, and a large purple bruise on her right arm.
00:17:14Know that he hit her?
00:17:16Do we know?
00:17:17So the complainant stated the defendant shoved her multiple times with his elbow and also grabbed her arm, causing pain.
00:17:24All right.
00:17:24Mr. Doran, we're going to find that there's sufficient probable cause to go forward with your case.
00:17:29This case is 1,139 days old.
00:17:33If you take off again, I'm going to make the bond so high, you'll have hair falling off.
00:17:38Do you understand?
00:17:39Yes, sir.
00:17:39As it stands now, I'm going to put an ankle monitor on you so I know where you are at all times.
00:17:43You will have a GPS monitor.
00:17:45I am now also issuing a protective order that you're not to have any contact with this person whatsoever.
00:17:50Ms. Ray Perez is now a protected individual.
00:17:53You cannot commit family violence or an assault against this person.
00:17:57Commit and act in furtherance of an offense under Section 42072 of the Texas Petal Code, which is the stalking statute.
00:18:04You cannot threaten, harass, be in possession of a weapon, or go within 200 feet of where she lives or where she works.
00:18:10Do you understand?
00:18:11Yes, sir.
00:18:12If you violate this protective order, if the state can and will file a violation protective order, it's one of the worst cases you can pick up.
00:18:18Do you have a lawyer today?
00:18:20No, sir.
00:18:21What are you doing about that?
00:18:21I'll need to file one.
00:18:24Okay.
00:18:25We will give you time.
00:18:26I'm telling you now, I'm fast tracking this to trial.
00:18:29In 30 days, is discovery complete?
00:18:31Discovery, it looks like we are missing some photos potentially, but besides that, discovery is...
00:18:37If you can try to get on them.
00:18:38In 30 days, I'm putting this case to trial.
00:18:40Do you understand?
00:18:41It would behoove you to immediately go out there and start trying to find a lawyer.
00:18:46I'm going to have you go to Victoria, sign a reset.
00:18:48After that, you'll get with Felicia for your bond conditions.
00:18:50I'm going to have you take a seat while we create all the documents.
00:18:52We'll have you sign them, and then you'll be free to go, sir.
00:18:54Yes, sir.
00:18:54Mr. McIntosh, you're charged.
00:18:57You're on bond for a theft.
00:18:59You've now picked up a new theft.
00:19:01On the new case, you're facing up to six months in jail and are a $2,000 fine.
00:19:07We are going to do probable cause.
00:19:08You have the right to remain silent.
00:19:10Anything you say can and will be used against you.
00:19:12You have the right to have an attorney present.
00:19:14If you cannot afford one, one will be appointed to you, sir.
00:19:16On March 6, 2025, an officer was dispatched to a shoplifting call at Walmart in Harris County, Texas.
00:19:24The officer made contact with the asset protection staff.
00:19:28The complainant stated that he recognized the defendant from a previous encounter.
00:19:32The complainant observed the defendant grab multiple items and attempted to leave the store,
00:19:37passing all points of sale without attempting to pay.
00:19:39The defendant stated he owned a Purple Heart Veterans Discount, and therefore the amounts to all.
00:19:48That was the first theft, right?
00:19:51I remember that from the first one.
00:19:55That's 254, right?
00:19:59Right.
00:19:59No, this is 255.
00:20:04So maybe similar facts.
00:20:06Then that must be the exact same as the first one.
00:20:12Let me check.
00:20:13It's...
00:20:14Right.
00:20:18Yeah.
00:20:18That's my problem.
00:20:20So...
00:20:21The older theft is from December 16, 2024.
00:20:28Right.
00:20:29And that was from...
00:20:32From Melrose.
00:20:34And this is from a Walmart.
00:20:37And this is on March 6, 2025.
00:20:42I'm not seeing anything on the previous stuff regarding the Purple Heart Discount.
00:20:50Okay.
00:20:52Do you like me to start over?
00:20:54Just to Walmart and how much?
00:20:58$283.62.
00:20:59Judge, if you can recall, this is the young man that we knew had granted a pretrial of...
00:21:07You had given a bond for him.
00:21:10You had me talk to his mother to see if his mother would have a place for him to stay.
00:21:17And she said yes, providing that he puts up an effort to try to get a job and et cetera.
00:21:23Oh, I remember that.
00:21:24Okay.
00:21:25But he now picked up a new case.
00:21:27No, he had...
00:21:27Have we addressed that since?
00:21:29Yeah, we addressed it.
00:21:31We knew that he had picked up another case.
00:21:33That's why you were upset that he had picked up another case while he was on bond for the previous theft.
00:21:40But the court was kind enough to still give him a bond because I had spoken with the mother and the mother informed me that he could stay there and where until certain time that he...
00:21:54Why are we doing another arraignment then today?
00:21:57Yeah.
00:21:57Bond conditions have already been set for this.
00:22:00Why are we doing an arraignment?
00:22:03Is today just a regular setting then?
00:22:05I'm showing them both set for...
00:22:07If you pick up a third case, I'm going to absolutely lose it.
00:22:21Do you understand?
00:22:23Yes, Your Honor.
00:22:23You must get a job or be in school full time.
00:22:29Yes, Your Honor.
00:22:30Do not use any illegal drugs.
00:22:32If I find that you're using, I will lock you up.
00:22:36Yes, Your Honor.
00:22:37Do you understand?
00:22:38You get...
00:22:39We've given you now two PR bonds on the first one, one PR bond on the second case.
00:22:45That's three PR bonds.
00:22:47You will not get another one.
00:22:51Do you understand?
00:22:52Yes, Your Honor.
00:22:54In the next couple weeks, I'm going to send you for a drug test.
00:22:58If I can find that you're using, it's not going to go well for you.
00:23:01Do you understand?
00:23:02Yes, Your Honor.
00:23:03Yes, Your Honor.
00:23:04Let's set this case out for a couple weeks, because I want to know what he's done to
00:23:08get a job.
00:23:09I'm setting your case out for one to two weeks.
00:23:11I want to see what you have done to get a job.
00:23:14If you have done nothing, if you come here and show me that you have not filled out at
00:23:18least 10 to 15 applications for a job somewhere, it's not going to go well for you.
00:23:23Do you understand?
00:23:24Yes, Your Honor.
00:23:25All right, so one of the two weeks, you're going to get tested when you come back.
00:23:29Yes, Your Honor.
00:23:30Yes, Your Honor.
00:23:31All right, Mr. Lee, thanks.
00:23:32Thank you, Ron.
00:23:34Hey, Judge.
00:23:35Yes, approach on Mr. Perez.
00:23:37It's an arraignment.
00:23:38May I call him up?
00:23:40Yeah, please.
00:23:41Take cargo, Perez.
00:23:42Is this all you have today, Michael?
00:23:44I know.
00:23:45No, I've got other ones I need to talk to you about.
00:23:48What is the case number?
00:23:49It is 255-6010.
00:23:52Buenos dias, Senor.
00:23:53For as you are charged with assault, bodily injury, you are facing up to a year in jail
00:23:59and or a $4,000 fine.
00:24:02We are going to do probable cause.
00:24:04You have the right to remain silent.
00:24:06Anything you say can't will be used against you.
00:24:09You have the right to have an attorney present.
00:24:10If you cannot afford one, one will be appointed to you.
00:24:13Okay.
00:24:14Good morning.
00:24:15On March 16, 2025, officers were dispatched to an assault with injuries.
00:24:23Located at 4,000 Hollister in Harris County, Texas.
00:24:29The officers weren't unable to speak with the complainant because his injury caused him to be unconscious.
00:24:36Officers would need surveillance, which showed that the defendant pushed down the complainant with both of his hands, causing the complainant to kick his head first on the concrete.
00:24:49It also showed the complainant to be unconscious.
00:24:54The defendant was identified through a witness who called him out on the scene and identified him.
00:25:05And the defendant matched the person in their surveillance footage.
00:25:08Where was this?
00:25:08Is it at a bar?
00:25:09Are you drinking?
00:25:11What?
00:25:11It doesn't.
00:25:12It gives an address.
00:25:14I believe it was at an apartment complex where he resides.
00:25:16My understanding.
00:25:17I guess we'll see what the surveillance shows.
00:25:19He said it's been demon ill.
00:25:20Mr. Perez, I'm going to find that there's sufficient probable cause to go forward with your case.
00:25:25I want you to understand that I'm going to do everything in my power to protect my city at all costs.
00:25:31This is now your second assault within the last year and a half to two years.
00:25:36If I find that you so much as put hands on any single person, I'm going to lock you up.
00:25:42I don't know what your immigration status is, but if you're not in this country with permission and you go to jail and immigration finds you, they will put a detainer on you.
00:25:50Do you understand?
00:25:52Usted lo entiende.
00:25:54Yes.
00:25:55Yes.
00:25:56I'm ordering you not to consume alcohol, illegal drugs, or prescribed controlled medication.
00:26:01I'm going to raid you.
00:26:02If I find that you're using, likewise, I will put you in jail.
00:26:07Your order not to have any contact with the complaining witness in this case, not to be in possession of any weapons, or not to go within 200 feet of where he lives or where he works.
00:26:16For now, I will have you go to Ramona to Victoria to sign a reset.
00:26:21After that, I'll get you with Felicia.
00:26:22If you're bond conditions, be careful.
00:26:25You are skirting extremely thin ice.
00:26:28Do you understand?
00:26:29If that ice cracks, your butt's going to freeze.
00:26:32Come on.
00:26:33I have three others.
00:26:35Cruz, Jose Cruz.
00:26:37Okay.
00:26:38We submitted the PT application mitigation and the TRAS.
00:26:42We're just waiting.
00:26:43He was approved.
00:26:43We're waiting on the contract.
00:26:46Okay.
00:26:46So let's set it two weeks for you to get everything done.
00:26:49Okay.
00:26:49Can I waive my client's affairs?
00:26:51Yeah.
00:26:51If he doesn't have everything done, though, then he's got to be here because it's an old case.
00:26:56Okay.
00:26:56He's here today.
00:26:57Okay.
00:26:57Okay.
00:26:58I'll waive it as long as he's, you know, got everything done.
00:27:01They're ready to file the supervision order.
00:27:02Perfect.
00:27:03Okay.
00:27:03Next one is Guevara, G-U-E-V-A-R-A, Jose.
00:27:08Okay.
00:27:09We're waiting on approval.
00:27:10We submitted the PT application and mitigation on Friday.
00:27:14This is the one that we had talked about like a week ago that we just found out he needed it,
00:27:18so we submitted everything.
00:27:20We're waiting on approval.
00:27:21Okay.
00:27:21I guess let's do it again.
00:27:22We'll give it another week.
00:27:23Two weeks?
00:27:24No, one week.
00:27:25One week.
00:27:26It's 250 days.
00:27:27Okay.
00:27:28And then the last one.
00:27:30It'll be made if it's not approved or denied by the next one, then I'm, I mean, I'll send
00:27:36an email myself because it's, yeah.
00:27:39Okay.
00:27:39Well, my last one is Diego Gonzalez.
00:27:42Again, same situation.
00:27:44Last time we were here, Judge, I was emailing back and forth with Ashley.
00:27:49Initially, she had said he's denied because he didn't have insurance, and I said, no, he
00:27:52does have insurance.
00:27:54And Geico's been trying to get a hold of the CW, and even the DAs are having a hard time
00:27:58getting a hold of the CW.
00:27:59So, I'm waiting to hear from her.
00:28:01I did give her.
00:28:02You gave her name?
00:28:03I emailed her both.
00:28:04Yes.
00:28:05I emailed her the letter from Geico and insurance.
00:28:08Let's give it a week also to see if she approves or denies.
00:28:11Great.
00:28:11That's all I got.
00:28:12Thank you, Judge.
00:28:13You made me excuse?
00:28:14Thanks.
00:28:14This is an off-docket matter.
00:28:16It's just really quick that I want to bring to your attention.
00:28:19Jonathan Lopez, you scheduled him for a T-RAS.
00:28:24He refused to do the T-RAS.
00:28:25We're due back in court on Monday.
00:28:27I'm not sure if you wanted to put him on docket sooner to address it.
00:28:31Cause number is 255-5478.
00:28:38This is the one you're on the BPO with a bunch of tests that I do right now.
00:28:42No, just, just...
00:28:43We're okay for Monday?
00:28:44Sure.
00:28:45Okay.
00:28:45I just wanted to bring to your attention.
00:28:47Thank you, Judge.
00:28:47All right.
00:28:47Thank you, Judge.
00:28:48Okay.
00:28:49May I have any excuse?
00:28:51Was it for arrangements?
00:28:52Or do we have more?
00:28:54Do you know what I'm doing?
00:28:54Judge, I'm not sure.
00:28:56Who would you have the letter to this arrangement?
00:29:00Judge, if you talk to the arrangements, for card arrangements?
00:29:03We just did that one.
00:29:04Yeah, we just did it.
00:29:05Yes.
00:29:06Okay, I think I probably went.
00:29:07It's very, very simple.
00:29:10Good morning, Judge.
00:29:16Good morning.
00:29:17Hi.
00:29:17I have Mr. Christopher Allen on docket.
00:29:21The state just filed a dismissal on his case.
00:29:23I just want to let you know.
00:29:25The state what?
00:29:27Fouled a dismissal.
00:29:28Got it.
00:29:29Okay.
00:29:29I'll sign up for you.
00:29:30All right.
00:29:30Thank you, Judge.
00:29:31Is he here or no?
00:29:32Yeah, he is in a gallery.
00:29:34Got it.
00:29:34Okay, we'll give him a copy then.
00:29:35All right.
00:29:36Thank you, Judge.
00:29:36Yes, ma'am.
00:29:37All righty.
00:29:38Have a good one.
00:29:38Here, Emil.
00:29:40Miguel.
00:29:42How many do we have?
00:29:45Good morning, sir.
00:29:51Good morning.
00:29:52Do you have a lawyer today?
00:29:53No, sir.
00:29:54No, Your Honor.
00:29:54Do you have the ability to hire a lawyer?
00:29:56I do.
00:29:57The only thing is they're way more expensive than they would be to just pay off what I owe
00:30:01to accounting.
00:30:02I mean, how much does he owe?
00:30:05It's a theft by check.
00:30:07$141.
00:30:09Oh, wait.
00:30:09So, one check was written for $1,377.63, and then one was written for $141.13.
00:30:21What?
00:30:22H-E-B?
00:30:22Uh, the tax assessors.
00:30:25Harris County tax assessor.
00:30:27Okay.
00:30:28Uh, I'll give you a lawyer today.
00:30:30That way you don't have to just start wasting a bunch of money.
00:30:32Do you mind appointing a lawyer?
00:30:34Yes.
00:30:35So, just hang tight.
00:30:35I'll give you a lawyer here momentarily.
00:30:37Okay?
00:30:37I'll give you a lawyer.
00:30:38I'll give you a lawyer.
00:30:38I'll give you a lawyer a little bit.
00:30:38Yeah.
00:30:39Did you put an offer on the case?
00:30:42Um, there is no offer on the case yet.
00:30:45Do you mind?
00:30:45Yeah.
00:30:48Good morning, Mr. Wilson.
00:30:51Do you have a lawyer today?
00:30:52She just reached back to me this morning, so she told me if they don't contact me this
00:30:57evening when she get done with court.
00:30:59Hired her?
00:31:00I just got in touch with her.
00:31:02I've been reaching out to her, but she just responded.
00:31:07Okay.
00:31:08Do you want more time?
00:31:09Yeah.
00:31:10Okay.
00:31:11Head on over to Victoria.
00:31:12We'll give you more time.
00:31:13All right.
00:31:14I just sent you an email on that.
00:31:17Yeah.
00:31:19Yeah.
00:31:20We had addressed it before.
00:31:23Yeah.
00:31:23It was, it was, you sent him to get a drug test, um, on the first BBR, and then it came
00:31:30back positive for opioids, I think, and they said they wanted to send it to a lab.
00:31:34I provided a list of the medications, and then they submitted that second BBR with all
00:31:39that stuff, and saying that he did provide his list of medications.
00:31:43For who?
00:31:44Janiel.
00:31:45Oh, it was Montenal?
00:31:47Yes.
00:31:47Yes.
00:31:48Is it Montenal?
00:31:49Yeah.
00:31:49Montenal is a Montenal.
00:31:50Yeah.
00:31:51So we were waiting for the lab results to come back, and they have come back.
00:31:55We knew there was a presumptive positive.
00:31:59She said some positive for alcohol, right?
00:32:05No.
00:32:06Just opioids.
00:32:07It's a he.
00:32:09Oh.
00:32:09I was thinking someone else.
00:32:11But one of those that she's taking has positive for me.
00:32:15I think several of them do.
00:32:16Um, and just a presumptive look at it, when I first looked at it, it was the anti-psychotic
00:32:22ones that would give false, false tests, as far as that's concerned.
00:32:28Is there just no one at pre-trial that can address this?
00:32:30None of us let go.
00:32:31Not you guys.
00:32:32I know you, but there's no, like...
00:32:35No, we would have to, not even our drug technicians.
00:32:38I reached out to my supervisor very good, and to confirm that, we'd have to get someone
00:32:42who's certified or someone for BBR.
00:32:44Okay.
00:32:45Let me, I'll speak to you now, then.
00:32:47Let me reply to all you guys, and then I'm going to bring someone else in as well.
00:32:51Let's see.
00:32:52But, um...
00:32:54So, I'll send this email, and we'll just stay in touch, and then we'll see what they say.
00:33:00Okay.
00:33:00I'm going to reach out to the higher-ups to see, hey, do we have any...
00:33:03I mean, I can't believe that we don't have anyone that would be able to...
00:33:06Just say one way or the other.
00:33:07Right.
00:33:07Yeah.
00:33:07You know?
00:33:08I'm trying to pull up the picture I have, but it won't pull up for some reason.
00:33:12But, yeah, there are one of the many...
00:33:14I think one or two of the medications that he takes can give presumptive false positives.
00:33:19If that's the case, then, of course, we're not even dealing with it.
00:33:21Right.
00:33:22Same.
00:33:23Okay.
00:33:23So, do you want to leave them off for Friday, or do you want to just hold off?
00:33:27Let's hold off.
00:33:28Okay.
00:33:29Let's see the original date for now.
00:33:30Let me see what...
00:33:31Let's see what they come...
00:33:32Okay.
00:33:32All right.
00:33:33Sounds good.
00:33:34Do you have a date?
00:33:35Do you have a date?
00:33:35She's already fine.
00:33:37Do you have a date?
00:33:37She can, you know.
00:33:38I...
00:33:38What's that?
00:33:40Is it only Monday?
00:33:42Yeah.
00:33:44Apparently, you sent my client to go pee somewhere.
00:33:48She'd have liked to go...
00:33:49I didn't want to be crass, but that's the fact.
00:33:53But, no results.
00:33:54She hasn't provided a sample like that.
00:33:57We've had a lot of history with her.
00:33:59I saw that.
00:34:00I got emails on Friday about it.
00:34:02Had, you know, quite a bit of history.
00:34:05Third bond violation.
00:34:06I saw that.
00:34:07Do you want me to recite it out of my memory?
00:34:10We've had quite a bit of history.
00:34:16Does she not have a prior case with us, too?
00:34:19Is this...
00:34:19I don't think she does.
00:34:22No.
00:34:22Is this the one where there was an issue with a boyfriend?
00:34:25There is a boyfriend in the car.
00:34:27And the really interesting thing about this is, like, the police officers did a full felony
00:34:31stop on a DWI with guns drawn, making them get out.
00:34:34It's kind of weird.
00:34:35Capital?
00:34:35It was really strange.
00:34:37I'm watching it going, like, that's what it was.
00:34:40Of course, it was, like, Precinct 4-ish.
00:34:43Everything up there could be a capital in their minds, you know?
00:34:46And so, I don't know what you want to do with this, Judge.
00:34:51I just don't want her using that.
00:34:53I get you.
00:34:54That's all.
00:34:55I want to ensure that she's married.
00:34:57So.
00:34:59Judge, and then also, we have the English interlock that she's not driving, so we're not
00:35:04allowed to turn her out, and by any means, she had a terrible at first, we had portable
00:35:08violations, so then she's revoked.
00:35:11Then she provided proof that she had gotten her vehicle fixed, so we swapped her over to
00:35:15the ignition interlock.
00:35:17The ignition interlock is not being used.
00:35:19Oh, good.
00:35:20So, let's see how it goes today, and then I'm going to, I'm like, I'm going to random
00:35:26her again, so, you know, if she tests positive, then we'll see.
00:35:30I don't know.
00:35:30I mean, do you want me to wait?
00:35:32I'm perfectly willing to do that.
00:35:34Oh, and then I'll get a hold of you.
00:35:36Or, you know what?
00:35:36I don't have your new number.
00:35:37What?
00:35:38Do you miss?
00:35:40Give me my new work.
00:35:41My old number is still the same.
00:35:43Oh, is it really?
00:35:45Then, hold on, hold on, hold on.
00:35:47You have it, for sure.
00:35:48Yeah, I know.
00:35:49If it's the same one, then don't worry about it.
00:35:51Yeah, it's the same.
00:35:51How do you mean?
00:35:52Uh, five, six?
00:35:54I don't give that out to anyone.
00:35:56That's me.
00:35:57Okay, so I'll just, I'll text you.
00:35:59But do you want me to come back if there's an issue?
00:36:02You can go to Zoom.
00:36:03Okay.
00:36:04Zoom.
00:36:04Perfect.
00:36:05I'm going to go straight to my office.
00:36:06Oh, hi, Joe.
00:36:07How are you?
00:36:08I was asked, but we're going to approve on Espinosa, or with our...
00:36:12This is on the docket.
00:36:14I guess it's on the docket.
00:36:15BWI case, clients here.
00:36:17We are still waiting to hear about whether PTI is going to be approved on this.
00:36:23Everything's in, Judge.
00:36:24We're just waiting to hear back about the approval.
00:36:26Okay.
00:36:28I guess let's give it a week, Joe.
00:36:30Okay, sir.
00:36:31If it's approved, I'll waive, and then we'll switch off like a couple weeks for you guys
00:36:37to get the contract, get the, you know, portable, and all that jazz.
00:36:41If it's denied, it's got to be here, so it's fine.
00:36:43Okay.
00:36:44We'll do that.
00:36:45Okay.
00:36:46Appreciate it.
00:36:46Have fun.
00:36:47Ready?
00:36:48Good morning, Sergeant.
00:36:49Good morning.
00:36:49I am here on Mr. Mark Gurley's case, who's on docket today, Judge.
00:36:56G-U-R-L-E-Y.
00:36:57And initially...
00:36:59I'll wait until you find it, Your Honor.
00:37:01Thanks.
00:37:02Gurley?
00:37:03Yes, sir.
00:37:03Okay, I see it.
00:37:04So initially, I had brought up some concerns that I had with the accuracy of the Dems report
00:37:11and accuracy of the information that was being alleged within the four corners of the probable
00:37:16cause hearing information, I guess.
00:37:19And so, you had said this...
00:37:22As far as probable cause?
00:37:23Right.
00:37:23Yeah, as far as probable cause.
00:37:24You want to redo probable cause?
00:37:25Well, we had heard probable cause, and within the four corners of the Dems, you had found
00:37:30that there was probable cause for the case to continue.
00:37:33But the issue that I had...
00:37:36Can I do it again?
00:37:37Well, I mean, I'm just kind of bringing you up to speed again, Your Honor, because I know
00:37:41it's been a few weeks.
00:37:41So the issue that I had raised at that time was I did not believe that that was accurate.
00:37:49The state had conveyed videos to us about, you know, what the officer had seen from the
00:37:53dash camera perspective.
00:37:54And so I had issues with the accuracy of what was contained within the Dems.
00:37:59I've spoken to the state this morning, and she said that she's reaching out to the police
00:38:03officer to find out, you know, I guess his side of the story is my understanding.
00:38:07I don't want to speak for the state.
00:38:08I've watched the camera footage.
00:38:10I just want to speak to the officer before we make any decisions on the case.
00:38:14What's the issue?
00:38:15The issue is that, from what I can see, I don't want to get into the facts of the case
00:38:20right now in front of you, Judge, too much, but...
00:38:23And don't.
00:38:24Right.
00:38:24And don't.
00:38:25Just do what you need to do.
00:38:27Right.
00:38:28I mean, it's only 25 days old.
00:38:30Sure.
00:38:31I just emailed him today.
00:38:32Yeah.
00:38:33I think a regular...
00:38:34Yeah.
00:38:35It's a very new case.
00:38:36If I can get maybe a couple of weeks, Judge, I've got...
00:38:39I mean, you can have as much as you want.
00:38:40Sure.
00:38:41It's up to you.
00:38:41Yes, sir.
00:38:42I guess if you just said it, if you need me to do another probable cause hearing, I'm
00:38:48happy to do it.
00:38:49Sure.
00:38:49If there's new something that has come to your attention that's not right in the Dems,
00:38:53I'm happy to hear it, and we'll redo probable cause.
00:38:55I'm happy to do it at any time.
00:38:56And maybe the state's conversation with the officer will clarify all of this, and then...
00:39:00Yeah.
00:39:00Absolutely.
00:39:01We'll be done.
00:39:02Okay.
00:39:03All right.
00:39:04Oh, granted for you.
00:39:06Thank you, Rob.
00:39:06Okay.
00:39:06Let's do a second.
00:39:07Back to the machine.
00:39:09Hi, Judge.
00:39:10How are you?
00:39:10Good to see you, Bobby.
00:39:12It's been such a long time.
00:39:13I know.
00:39:14I'm back.
00:39:14What's new?
00:39:15I have.
00:39:15Thanks for the morning.
00:39:17Kids.
00:39:17How are your kids?
00:39:19I mean, it's...
00:39:19How old now?
00:39:20How old?
00:39:2214, 12, 9, 3.
00:39:26There's 12 or 14 girls?
00:39:28A boy and a girl.
00:39:29We put them to work.
00:39:31A girl, girl?
00:39:31Girl.
00:39:32Okay.
00:39:33God bless you in every way there is.
00:39:35She's great.
00:39:35I love it.
00:39:37I'd have more if I had one.
00:39:38Girl, girl.
00:39:38It's just you, man.
00:39:40She's so sweet.
00:39:41I just...
00:39:42Great.
00:39:43You've been there.
00:39:45We were 12-year-old, 13-year-old, 14-year-old girls.
00:39:48I was supposed to wrap her 12-year-old.
00:39:49They're hard.
00:39:50It's okay.
00:39:50They come out of it.
00:39:51Yeah, yeah, yeah.
00:39:52You can't just give a ton of patience, you know?
00:39:54I have Mrs. O'Kley who's not on your docket.
00:39:56Okay.
00:39:57She was here on Friday and she's hired me on DWI and she has two trips planned and she
00:40:02has to do UAs.
00:40:03One is out of the country, one is not.
00:40:05How do you handle that?
00:40:07So, typically, if they're out, we have them...
00:40:11If they're in the United States, we have them go to like a Quest, whatever they are.
00:40:15Okay.
00:40:15They get called on to the UAs.
00:40:17Get the results to you, you get to us, we're happy.
00:40:19Okay.
00:40:19If they're out of the country, how long?
00:40:22She'll be out of the country for five days.
00:40:26So, let her know.
00:40:27Let her know.
00:40:28Yes, or her.
00:40:29Let her know not to use.
00:40:31She's going to get tested as soon as she gets back.
00:40:33Okay.
00:40:33Just so that she knows.
00:40:34Okay.
00:40:35Okay.
00:40:36So, let Alicia know about the dates for the out-of-country one so they know not to call.
00:40:40Okay.
00:40:41Perfect.
00:40:41That's it.
00:40:43Appreciate it.
00:40:43Have fun.
00:40:45Hi, Shreya.
00:40:46She's fine.
00:40:47I'm Sierra Romario.
00:40:48He's got Christopher Torres, who is surrendering himself today.
00:40:53I believe papers are filed and everything.
00:40:56But he had, and I'm a little unclear on the details because I wasn't here, but he had brought
00:41:01an AA log that I believe you were going to, if he had shown you this.
00:41:05No, no, no, no.
00:41:05I said be creative with what end I would consider waiving fee.
00:41:12And so, he's given me an AA log.
00:41:15All right.
00:41:16Give it to the court.
00:41:17All the time, he had gone.
00:41:18He'd gone almost every day.
00:41:20There were some wildfires that he had to be evacuated from.
00:41:22So, that's the only day, or a couple of days, he passed him again for us.
00:41:26And Mario's off picking a jury across the street.
00:41:29Otherwise, he'd be here himself.
00:41:30The reason I had the problem is because he has a prior intoxic assault where there's like,
00:41:35you know, and now we have now another second.
00:41:38Understood.
00:41:38So, that's the problem I had.
00:41:40And I was hoping more than just 11, just classes.
00:41:45Okay.
00:41:46Okay, here.
00:41:47Let me get that back to you.
00:41:49Christopher Torres, come up.
00:41:50So, Mr. Venus, correct me if I'm wrong.
00:41:53Sure.
00:41:54Yes, Judge.
00:41:56Yes, sir.
00:41:57Be as much of a help as I can.
00:41:59On a sentence of 10 years in prison, probated for 10, can that be used on a third degree to enhance to 15 to life?
00:42:08If the probation was successfully completed, no, for enhancement purposes.
00:42:14It could be for jurisdictional purposes to make, under 4904 or whatever it is, to make a, it would count as a previous conviction for those purposes,
00:42:27just like an assault family member, even a deferred adjudication would count to make a second.
00:42:32My curiosity stems from, because with his being taught to Saul, he was sentenced to 10 years, probated for 10 years,
00:42:41and it looks like he may have completed successfully, but it's still a felony conviction, right?
00:42:48Correct, but it's not, you can't use it to enhance punishment ranges, essentially.
00:42:56It could be a jurisdictional paragraph, but not an enhancement paragraph, if that makes sense.
00:42:59My concern, Mr. Torres, is you're now pleading guilty to this DWI second.
00:43:05The problem is, is that if you pick up another DWI, from now on, you're facing a third degree felony.
00:43:13You're looking at two to 10 of the penitentiary, and I don't know if they can use that intoxic assault conviction to enhance you to an even further penalty, a further consequence.
00:43:23I mean, that's why I'm asking.
00:43:24I don't know, you know, I, you know, misdemeanor, but the problem is, is that with a felony conviction, they can use it to enhance punishment.
00:43:32Perhaps it's a 50 in the life next time you pick up another DWI.
00:43:35I don't know.
00:43:36But do you want to take that risk?
00:43:37That's the problem.
00:43:38I mean, imagine all this that you've suffered now, and we're here yet again.
00:43:43What's it going to take?
00:43:44A death?
00:43:45Well, I know you say no.
00:43:47Everybody says no.
00:43:48If I had one strand of hair for every, every time, I'd have a nice looking head of hair.
00:43:54You're facing up to a year in jail and or a $4,000 fine.
00:43:58Is it, what are we doing?
00:44:00Oh, let me get up this three three billion.
00:44:01Look, you're giving up a lot of rights by entering into this agreement.
00:44:04You give up the right to a trial, right to compel witnesses to test your own behalf, confront and cross-examine your losers.
00:44:11If you're not a citizen, there are possible immigration consequences.
00:44:14You can be deported, excluded from the country, deny naturalization under federal law, and you give up the right to appeal.
00:44:20Once you accept this agreement, it will go on your record.
00:44:22It will be there forever.
00:44:23And I'm telling you now, your record, it's not a good thing.
00:44:26You get pulled over, even with the faintest smell of alcohol, you're going to be charged with a felony.
00:44:30Do you understand?
00:44:32I wouldn't, even if you've had a sip of alcohol, I wouldn't get into a car.
00:44:37So, um, he goes in today.
00:44:41Yes, sir.
00:44:41All right.
00:44:42I'm going to waive the fee because you're going into jail now.
00:44:44So I'm not going to tack it on, but stop.
00:44:47Don't kill someone.
00:44:48This weekend alone, three people died on our roads this weekend.
00:44:52This weekend, three people died.
00:44:54It's not hard.
00:44:55Just don't get into a car.
00:44:57How do you plead to the offense?
00:44:58Guilty or not guilty?
00:44:58I'm going to find you guilty, sentence you to 50 days in jail.
00:45:02I'll give you credit for the two days that you've done.
00:45:04I'm going to suspend your license for one year.
00:45:07Do not drive until you get a license.
00:45:08And then we'll take him into custody now.
00:45:09And I'm going to roll your forecast so you won't do anything.
00:45:11All right.
00:45:12Thank you, Judge.
00:45:13Good luck.
00:45:13Great to see you, man.
00:45:15You too, Judge.
00:45:16Too serious.
00:45:17Hi, guys.
00:45:18Hey.
00:45:19Morning, Judge.
00:45:19Hi, Judge.
00:45:21Same old, same old.
00:45:22We're here on Miss Gillis.
00:45:23I thought I had it open.
00:45:27I closed it.
00:45:28All right.
00:45:29So, Judge, she's won out of Pennsylvania for theft by deception.
00:45:32False impression.
00:45:34False impression.
00:45:36So, this one will be asking for no bond on the extradition because over the course of six times,
00:45:44she stole $780,000 from an elderly, and it shows from the hit that she's an international flight risk with a non-American passport.
00:45:55That's the first time I've heard that, an international flight risk is Interpol involved.
00:46:00Well, so that's why I was surprised.
00:46:01Because this was a DHS referral, I was kind of surprised it wasn't a nice hit because she's not a citizen, and it shows.
00:46:06So, I don't know.
00:46:07Want a bond?
00:46:08I want a PR bond.
00:46:09PR bond.
00:46:10Okay.
00:46:10So, let's bring her out, please, Gillis, if you don't mind.
00:46:14Yeah.
00:46:15Joe, you want to talk to me while we wait?
00:46:17Ms. Gillis.
00:46:17Yes.
00:46:18Good morning.
00:46:21So, your lawyer is asking for me to set you a bond.
00:46:25I don't know.
00:46:26I've never met you before, and I have about five minutes to get to know who you are to see whether it would be right to set you a bond.
00:46:35I have no idea what you're charged with, but the problem is, is that you are an inherent flight risk because you're wanted out of another jurisdiction.
00:46:42There's a warrant in some other state, and we got you here.
00:46:45Mr. Ken.
00:46:46Honor, around October 31st, 2023, it's alleged out of Pennsylvania that this now defendant manipulated a bank to over six transactions, caused a total loss of $780,000 to an elderly individual from the retirement fund.
00:47:01There has been a, regarding the affidavit, when speaking with the complainant, state said the checks for the individual were mailed out to her name with the corresponding physical address.
00:47:14On notification from DHS, it shows that she is an international flight risk, and due to those factors, the state would be opposed to a bond for the extradition.
00:47:22Why would the Department of Homeland Security say that she's an international flight risk?
00:47:26I'm not sure I can reach out to them, but obviously if I reach out to them, I can reach out to DHS and ask why.
00:47:32I only get the notification, and so I haven't spoken with an individual.
00:47:35What other criminal history does she have?
00:47:37She does not have any others, just a six-incident surprise in this affidavit.
00:47:41I can clarify.
00:47:42It's possible.
00:47:44I believe they think she's an inherent flight risk because they arrested her at an airport on a connecting flight, which sounds terrible, doesn't it?
00:47:52I'm thinking, oh, she's leaving the country.
00:47:55Really?
00:47:56Was she headed out of the country?
00:47:58No, really.
00:47:58She was going to Jamaica.
00:47:59She's from Jamaica.
00:47:59She comes back and forth for business.
00:48:00She's got an H-1, H-2B, something about H-Visa.
00:48:04And her father is a U.S. citizen.
00:48:07Here's the kicker judge.
00:48:08She gave birth January 30th of 2025.
00:48:12What name?
00:48:13She's breastfeeding.
00:48:14So when our lovely county got her, they said, too bad, so sad.
00:48:20She's been in custody for four days.
00:48:22They've refused to give her access to a pump.
00:48:25She has asked for a heating pad to do it herself.
00:48:29They've only given it to her two times.
00:48:31I mean, we'll see about it.
00:48:32I'll reach out to medical.
00:48:34Don't worry about that.
00:48:35I'll reach out to medical.
00:48:36That is insane.
00:48:37Yeah, I know.
00:48:37That sucks.
00:48:38Six days later, and I'm like, she was clearly arrested with her child, okay?
00:48:42So it's not like she's lying.
00:48:44But I just think because of that, let's add some other things because that by itself is like, oh, that sucks for you, right?
00:48:51But it's a to-be.
00:48:52It's not like she's a flyer.
00:48:53It's not like she's a filler to appear.
00:48:55I get that it's like a theft by deception because of some bank mailing thing.
00:49:00She's never given an opportunity to go turn herself in.
00:49:04So I think that considering the fact she's never had an opportunity to turn herself in, this is not where she's just like running the country.
00:49:10She comes here back and forth.
00:49:12Her child is born here.
00:49:13Her father lives here.
00:49:15Connected with the fact that she has some problems going on with her one-month-old that she's going to have to figure out, I'm asking for a PR bond.
00:49:23I'm asking to give her a chance.
00:49:25We've already done her wrong.
00:49:26Before I give her a PR bond, I would like you to figure out why they're saying that.
00:49:33The international flight risk?
00:49:34Yeah.
00:49:34I'm more than willing to call her.
00:49:36Not only that, but you're telling me that she does this all the time?
00:49:39Let me see.
00:49:40Can you go back and forth?
00:49:41You can tell the judge yourself.
00:49:42Well, I have a travel visa.
00:49:44I have a visiting visa for the U.S., which is a 10-year visa, and I also have an H2 visa, which is a work visa.
00:49:51I worked in Utah.
00:49:53I worked in South Dakota, South Carolina, Massachusetts, Florida for the past five to six years, back and forth.
00:50:04And I also do extensions.
00:50:06Do they should improve all this?
00:50:07Yes, I do.
00:50:08The quarantine office do have my passport with my visa currently stamped in it.
00:50:13So let's do this.
00:50:14Let's roll it to tomorrow, because I don't think now it's—wow, is it already 1130?
00:50:19Yes.
00:50:19Holy moan.
00:50:21So they do have it down here in the old days.
00:50:22Tomorrow, I want proof that she does all this international travel routinely, so we know that she's not just trying to take off.
00:50:31And then I'd like you to reach out to them to see why she's an international flight risk.
00:50:37Is it a 2B?
00:50:38It is.
00:50:39You know, I'd like to know how they justify saying that, right?
00:50:44Or do you just think because she's on a flight now?
00:50:46I don't know.
00:50:47I'm perfectly willing to call.
00:50:50I'm just obviously aware of making the call to DHS regarding the pending Pennsylvania charge.
00:50:54I don't know what's got the trigger, so—because she doesn't have an accident right now, but because she's on a visa.
00:50:58In terms of what they just said to her, though.
00:51:00This is crazy.
00:51:01So, like I said, I'm willing to—
00:51:03Because then ICE is going to put a hold on her.
00:51:04That's what I mean.
00:51:05It's like—
00:51:05ICE is going to do it regardless.
00:51:06ICE has not put a hold on her.
00:51:07No, no, no, no.
00:51:08If she's here with the proper documentation, they're not going to put a hit on her.
00:51:12If she's here with the visas, then there's no reason for her to put a hit.
00:51:16Judge, they're deporting students nowadays, but hey, that's okay.
00:51:19All right, I'd like to put you on the email with medical about the breast pump.
00:51:22I find that outrageous.
00:51:24Yes, I will help you with that.
00:51:25Don't worry.
00:51:25But I'm not prepared to set her a bond yet with Mr. Kim saying the international, and then she's on a flight to Jamaica.
00:51:34We'll get the proof.
00:51:35I'm going to have to zoom in tomorrow, though, but I'll get it handled.
00:51:37Sure.
00:51:38Of course.
00:51:38Yes, sir.
00:51:40How are you, Judge?
00:51:41Good morning.
00:51:42Good morning.
00:51:43Still, yes.
00:51:44Judge, I'm here on Jesus Figueroa.
00:51:46It's approaching on a plea.
00:51:48You're on?
00:51:49Okay.
00:51:49Are you ready?
00:51:50Oh.
00:51:52It's a second BWI?
00:51:53Is it a true first?
00:51:55Is it a true first?
00:51:56Okay.
00:51:57I'm okay with it.
00:51:57Come on.
00:51:58Almost five.
00:51:59But it's a true first.
00:51:59That's why I was.
00:52:00Got it.
00:52:00Okay.
00:52:01All right.
00:52:01Good morning, Mr. Figueroa.
00:52:02Good morning.
00:52:03Sir, you're charged with driving while intoxicated.
00:52:05You're facing up to a year in jail and or a $4,000 and or a $4,000 fine.
00:52:11It looks like the state is going to reduce that, take off the enhancement.
00:52:15So now you're facing only six months in jail and or a $2,000 fine.
00:52:19You've worked out an agreement where they're offering you three days in jail with credit
00:52:22for the two days that you have done.
00:52:24You need to understand that this charge will now go on your record as of today.
00:52:27It's going to be there for the rest of your life.
00:52:30What we're doing today, from now on, you're facing a minimum of 30 days in jail for any
00:52:34new cases that you pick up.
00:52:36No more proverbial slaps on the wrist.
00:52:38Do you understand?
00:52:40Yep.
00:52:40You give up a lot of rights by entering into this agreement.
00:52:43You give up the right to a trial, right to compel witnesses to testify on behalf, confront
00:52:47and cross-examine your accusers.
00:52:49If you're not a citizen, there are possible immigration consequences.
00:52:52You can be deported, excluded from the country, deny naturalization.
00:52:55You give up the right to appeal.
00:52:56Once you accept this agreement, there's no turning back.
00:53:00Do you understand?
00:53:01Yes.
00:53:02This is what you want to do.
00:53:03Yes.
00:53:04How do you plead to the office of driving while intoxicated?
00:53:06Yes.
00:53:07I'm going to find you guilty.
00:53:08I will follow the agreement, send it to the three days in jail, greater be credit for
00:53:12two.
00:53:13I'm now going to suspend your license.
00:53:14I have to.
00:53:15I'm going to suspend it for the minimum, which is 90 days.
00:53:18From now on, you get pulled over.
00:53:20An officer's going to see this.
00:53:21Even the faintest smell of alcohol, dope, anything, you're going to go down.
00:53:25So don't get into a car, even if you've had a sit.
00:53:28You understand?
00:53:29Yes.
00:53:29All right.
00:53:29The blood.
00:53:30Thanks, Josh.
00:53:31And we filed a DPS waiver search.
00:53:34I'm going to waive your fines and fees.
00:53:36That would normally be $4,500.
00:53:39That's what you would normally owe with a case like this.
00:53:42You pick up a second DWI.
00:53:44It's $6,000.
00:53:46Do you understand?
00:53:47Yes.
00:53:48And a minimum of 30 days in jail.
00:53:50Get the clue.
00:53:51All right.
00:53:52Good luck.
00:53:53You can.
00:53:53Thanks.
00:53:54I have another case.
00:53:55Last name is Saeed, S-A-I-D.
00:53:59I'm here.
00:54:00Russell Newman.
00:54:01Attorney Russell Newman is in trial.
00:54:02He wanted me to take care of this case, but he's not present.
00:54:07He's not here today, Judge.
00:54:08I'm going to end up revoking it then.
00:54:10He was supposed to go.
00:54:12Well, let's see.
00:54:13Did he?
00:54:13Do you know, Saeed?
00:54:16Did he show up?
00:54:17We got notification that he did not.
00:54:19Got it.
00:54:19Okay.
00:54:20I'm going to end up revoking it.
00:54:21Something his father has been in touch with me.
00:54:23No.
00:54:24He's supposed to be here.
00:54:25This is the second time we've done this.
00:54:27The case, it's.
00:54:28It's old.
00:54:29Yeah.
00:54:29No.
00:54:30It's 250 days old.
00:54:32Okay.
00:54:32He knew it because I admonished him.
00:54:35Right.
00:54:36I don't know.
00:54:36I'm nauseating last night.
00:54:37Okay.
00:54:38Well, we'll see what we can do with it, Judge.
00:54:40All right.
00:54:40Thanks.
00:54:40All right.
00:54:42Judge 5,002 on both.
00:54:43Just the one from last week.
00:54:44Did he get it done?
00:54:45He did.
00:54:46We just, I just heard we got denied for a PTI.
00:54:50Yeah, I'm shocked.
00:54:50I thought it was a good mitigation packet.
00:54:53What are you going to do?
00:54:53I just do two.
00:54:55Can you do the, the accident and the details of the driving pass?
00:55:00What do you want to do?
00:55:03I'd like to set it for trial.
00:55:04Well, actually, I'd like to have a compliance hearing.
00:55:06There's some discovery that is missing.
00:55:10The state brought it to my attention all at the state.
00:55:14It's a multi-age.
00:55:15So there was multiple agencies on the scene.
00:55:19It appears that we only received discovery from one of the agencies and the other agency did not submit discovery to us.
00:55:25I have watched the footage and I've been able to identify the other officers on scene and I've been in contact with them.
00:55:32I just haven't received the discovery yet.
00:55:36How long do you think, have you spoken to them or no?
00:55:39Yes, I've spoken to the.
00:55:41What did they say?
00:55:42Do they have it?
00:55:42I, they would need to look.
00:55:45I, I, I think there might be an additional offense report out there and I think there might be an additional body-worn camera.
00:55:52Okay, so let's do this.
00:55:54Let's do this.
00:55:55I'll set it for a compliance hearing on Friday.
00:55:58Subpoena the office.
00:55:59Well.
00:56:00I mean, you're judging.
00:56:01If we don't have this by then, I mean, I.
00:56:03I mean, yeah.
00:56:03Does the case seem like.
00:56:04It's not the case, right?
00:56:05I.
00:56:05You know?
00:56:05This is an issue I've seen with this particular agency.
00:56:08What agency is it?
00:56:09It's agency.
00:56:10What the flip?
00:56:11I've seen it where their system do it by offense report number, but sometimes we may have a different office report.
00:56:18So then when the body-worn camera comes back, it tracks to a different number.
00:56:22There's a way that HPV can pull it up by their, I mean, like, name and badge number, but we don't have access to that.
00:56:30We just pull it up by the office report number.
00:56:32I've seen that in felony.
00:56:33It's bit me in the behind before we went on to trial where, you know, I just don't know their body-worn camera.
00:56:38Okay.
00:56:38Um, I mean, I guess Friday.
00:56:41Blaze, what do you think?
00:56:43I mean, it's been.
00:56:45It's been.
00:56:46261 days.
00:56:47I think if we are telling the officer, like, you need to have it by then, I'm hoping the headlights of fire.
00:56:53Okay.
00:56:53Right.
00:56:55I have a scheduling issue for Friday, Judge.
00:56:57I'll zoom in.
00:56:57I can zoom in.
00:56:58Well, what if he's going to do a plea?
00:56:59Well, I guess it's, we'll see if it comes.
00:57:02See if it comes.
00:57:03Yeah.
00:57:04I think they may dump it.
00:57:05It's.
00:57:07Okay.
00:57:07Okay.
00:57:07Can I wave my client's appearance, though?
00:57:09Sure.
00:57:10Okay.
00:57:10Thank you, Judge.
00:57:11I appreciate it.
00:57:12Good morning, Judge.
00:57:18I was here on Friday on two cases, which is Manuel Cooch, C-O-C, and then C-U-Z.
00:57:27Yes.
00:57:28And he's in custody, Judge, but right now he's in the 177.
00:57:32Okay.
00:57:32We'll roll with you tomorrow.
00:57:33Yes, sir.
00:57:34And then another defendant is Neil White, and he was in custody and being processed
00:57:40on Friday, but it appears he made bond over the weekend, and he's not here, Judge.
00:57:47And he's got a bond violation, Mr. White, bond violation report, and the state has filed
00:57:54a motion to revoke and raise, and he didn't check in, Judge.
00:57:58There are bonds on all these cases.
00:58:00Neil, what?
00:58:01I'm trying to explain why he's in custody, right?
00:58:04No.
00:58:05No, I don't.
00:58:06It's going to send him to custody.
00:58:09It's going.
00:58:10You got Neil White?
00:58:11I'm showing bond mate.
00:58:12I mean, who's supposed to be here for these cases today?
00:58:24I mean, I guess maybe they get him a seven-day setting.
00:58:27I don't know.
00:58:28And then you need another shirt on White.
00:58:29They just haven't made an image yet.
00:58:32I just...
00:58:32So what's probably going to happen is he got a seven-day setting.
00:58:36He still holds it?
00:58:37He got...
00:58:38When they bond out, they get seven-day settings normally, okay?
00:58:42I'm assuming that they probably gave him seven-day settings on everything.
00:58:45What I'd like to do is put him on for Friday.
00:58:48So if you have a good number, please reach out to him and let him know that we're going to
00:58:51put him on the doctor for Friday.
00:58:53He has to be here.
00:58:54Okay?
00:58:54Hello.
00:58:54And the other gentleman carry till tomorrow.
00:58:58Thank you, Judge.
00:58:59I am approaching on an off-docket matter.
00:59:02Okay.
00:59:02This is for...
00:59:05Call's number is 2535421.
00:59:09On Ms. Treadwell.
00:59:12Ms. Treadwell.
00:59:12Okay.
00:59:13Yes, Your Honor.
00:59:14So we are close to getting an agreement.
00:59:20However, I wanted to revisit, Your Honor, on this.
00:59:24Well, no.
00:59:24I know what you're going to do.
00:59:25No, no, no, Your Honor.
00:59:26It's more so of we're not trying to get out of inpatient.
00:59:29That's not what she's trying to do.
00:59:31Okay?
00:59:31She's been working with the Hoop Santa Maria the past two months now, and they've been
00:59:35sending me all letters and everything.
00:59:37I just had not had a chance to send it to the state.
00:59:40They offer the type of facility that she can bring her children, and that is much more
00:59:46so what we would want to do.
00:59:47I don't know that they recommended Hoi.
00:59:51They did.
00:59:52I'm okay with Hoi.
00:59:54So...
00:59:54No, but she has a small, she has a small three-year-old, and she's three years old.
01:00:08And she's three years old, autistic.
01:00:11You know, she is...
01:00:11I'm okay with Hoi's Santa Maria.
01:00:13Okay, you're okay with Hoi's Santa Maria.
01:00:14Okay, there we go.
01:00:15That's what we're doing.
01:00:16Okay.
01:00:17All right.
01:00:19I didn't want to know so fast.
01:00:20No, no, no.
01:00:21I just, I want to make sure that it doesn't, you know, if they're okay with the Santa Maria,
01:00:26I'm okay with it, too.
01:00:27Okay.
01:00:27Yeah.
01:00:27All right.
01:00:29Yes, sir.
01:00:30Oh, this is what you were asking?
01:00:31Yes, sir.
01:00:32Yeah, Michael.
01:00:33Mr. Antin Lopez.
01:00:35Yeah.
01:00:35It seems like he needs to pay out of pocket $1,500.
01:00:38Okay.
01:00:39So, can we get 30 days, Your Honor?
01:00:43Oh, once time's served.
01:00:44Yes.
01:00:48How much do you want?
01:00:4930 days.
01:00:50Well, I'm not going to do 30 days.
01:00:51This case is 210 days old.
01:00:53I mean, this should have been a long time ago.
01:00:56I'll give him a couple weeks, but Michael, that's right.
01:01:00So, here's the deal.
01:01:02We don't, you've got to understand that the business that we're in, we don't trust people,
01:01:06right?
01:01:06I understand.
01:01:07We've got to have this stuff up front because we've been burned plenty of times.
01:01:10So, if that's the route that you want to do, take the time served.
01:01:13You have to pay restitution first.
01:01:15Can you generate the bill, if you don't mind?
01:01:17Yes, it's already generated.
01:01:19We can give you the bill to you.
01:01:20I will give you two weeks.
01:01:21Your case is 210 days old.
01:01:23So, I'm not giving you much time.
01:01:24I'll give you two weeks.
01:01:25If you've got it paid, great.
01:01:27If you don't, we can do a probation, and then you can pay it as, while you're going on the
01:01:31probation.
01:01:31So, don't stress.
01:01:32If you don't have it, then, you know, don't do anything you shouldn't do, right?
01:01:37Yes, sir.
01:01:37At the worst is the worst.
01:01:38We can always do it through a probation, okay?
01:01:41You've got two weeks.
01:01:42I can get it done.
01:01:43Okay.
01:01:44All right.
01:01:45Thank you, Harvey.
01:01:46Absolutely.
01:01:47And then, I have Mr. Lewis Lemus, Your Honor.
01:01:52We submitted a mitigation packet.
01:01:54Ashley's waiting to see if he has proof for college before she makes a decision.
01:01:59Can I get a week or so?
01:02:01I mean, all he has to do is get proof of college, right?
01:02:03Yeah.

01:02:38I'm not getting the sign.
01:02:40If you look on the TV, this is the lawyer that's been appointed to represent you, Mr. Pruitt.
01:02:48It is your responsibility to stay in touch with him.
01:02:51If he tells me he cannot get a hold of you, if you pick up a new case, if you become a danger to my community, it's just not going to go well for you.
01:02:59Do you understand?
01:03:00I'm not asking much.
01:03:01All I want you to do is be a productive citizen.
01:03:05Do as much as you can to help out everyone and be nice.
01:03:08Do you understand?
01:03:09Sorry.
01:03:09No problem.
01:03:10So, do you mind getting his cell phone number?
01:03:14Do you have a pen?
01:03:15I need you to write down your cell phone so I can give it to Mr. Pruitt, and then I'll have him reach out to you here momentarily.

01:04:12Yes, Judge.
01:04:12But I just want to make sure you waive the DPS fine for Mr. Garza.
01:04:16Is it a first, or is it a second?
01:04:17The first, Judge?
01:04:18Yeah.
01:04:18But let's get this done, because I need to take off.
01:04:20Yes, Judge.
