What was meant to be a joyful night celebrating her 32nd birthday turned into tragedy

00:12Seeing some of the footage, you know, I just remember thinking Peter was a strong man.
00:19And in the video footage, you see my husband just fall back and kneel over on his car.
00:26When do you learn that a second person had been shot?
00:29He goes up to his window, pulls the car door open, points the gun down to shoot him.
00:34He shot him in the leg.
00:36We believed that the suspect and that suspect vehicle were one and the same for the two investigations.
00:41I also found out that another person was robbed.
00:45For sure this is an Ultima.
00:47Back at the location of the very first crime, they watched and waited, but the suspect took off.

01:01A birthday is a time, of course, for milestones and memories.
01:06But imagine a night meant for joy suddenly dissolves into a living nightmare.
01:11Tonight we look at how one celebration ended in tragedy.
01:16Here now is Catherine MacDonald with Please Don't Leave Me.
01:25I remember when we were coming out.
01:26I was kind of busy talking to somebody and then I remember the sound.
01:32Like I'm not a pro with any kind of weapons or how they sound or whatever, but for me it
01:37sounded like fireworks.
01:38You know, I remember particularly telling my friend, oh wow, not even summer yet.
01:41People are starting to light up fireworks and that's when I kind of went towards this car.
01:47I used the washroom and I came out and I saw another friend that I was just speaking to and
01:52telling her have a good night and stuff like that.
01:54I was just in the lobby of the front doors right here where I was standing and saying goodbye to
02:00a friend.
02:01And then I look outside and I saw the guy that Peter was with.
02:06He came running up to the security guard and that friend was panicked.
02:12He was like flailing his arms and stuff like that and pointing outside.
02:15And he looks over and he sees me inside.
02:17So he opens the door and he says to me, Annie, run.
02:21Peter just got shot.
02:22Run, hurry, run.
02:23I was like, what?
02:26Peter got shot?
02:27What do you mean?
02:28I followed him out right through these doors here.
02:31And I just came around the corner right here, straight through.
02:36We ran around.
02:38I was running at this point, straight down these stairs.
02:41And when I looked over, I saw a couple of people kind of stood over by the car.
02:47So I was like, what's going on there?
02:50And I'm thinking like a gunshot?
02:51Like things like that didn't happen there.
02:53So at the time, I thought maybe he was overreacting.
02:59And as I'm rounding the corner, I can see Peter on the ground.
03:03And it was right somewhere about here, I just started screaming because I saw him right here.
03:10He was lying face flat.
03:13So his back was up.
03:14And I remember seeing his t-shirt.
03:16It was all bloodied.
03:17As I run up to him, I start seeing the blood now.
03:22And I start panicking.
03:27And I just ran right over to him.
03:30And I leaned down.
03:33And I just started screaming, no, no, no.
03:38I leaned next to him.
03:40And all I could see was a pool of blood.
03:46And I look at him.
03:48And I see that his shirt is soaked in blood.
03:52And then I just turned him around.
03:53And I remember the first thing that I kept saying was, who did this?
03:57Who did this?
03:58And he was actually holding on to Peter.
04:02He was kind of hugging him.
04:03And where he was shot, he was shot in his chest right here.
04:07And then I turned him around.
04:09And I tried to kind of revive him.
04:13And he was kind of like trying to press on the wound to stop the bleeding.
04:16But when he turned him over, we could see that the gunshot wound went through.
04:23It passed through him.
04:24So when you press here, it's coming out from the other side.
04:29It was hard because he was bleeding so much from two different wounds.
04:35We didn't know where to stop it.
04:37He was trying to tell me something.
04:39But then I couldn't figure it out.
04:41You know, like I remember like holding on to him with my legs.
04:43And I was kind of kneeling down.
04:45And I just remember holding on to one of his hands.
04:48He was fighting.
04:50He was fighting.
04:51We tried everything just to keep him conscious because I just, I was just fighting to keep him alive.
05:00With his T-shirt fully bloodied, I couldn't really tell if, you know, he had been shot or he had
05:05been stabbed.
05:05I just kept telling him to breathe, breathe, breathe.
05:10Peter Kahn's wife and friend were too focused on trying to save his life to even process the fact that
05:16the shooter could still be close by and on the hunt for their next victim.
05:21By this time, someone had called 911.
05:24The police showed up first.
05:26And when the police showed up, they basically cleared us out.
05:29They took over and they were waiting for the ambulance to come.
05:33When the police arrived, Peter was pretty much in my lap.
05:37I didn't feel comfortable leaving him just on the ground like that.
05:40But I had to respect the police officers.
05:43The police officer looks over into the crowd where I'm kneeling and says, is there anyone here named Annie?
05:50So I said, yes, that's me.
05:51That's me.
05:52I'm his wife.
05:53The police officer says, he's asking for you.
05:56So I go over and I lean next to him and he puts his hand out.
06:02I hold his hand.
06:05And he, because he's laying down, he lifts up a little bit to look at me.
06:10And he's holding my hand.
06:11And he squeezes my hand and he looks me in the eye and he says to me, I love, I
06:23love, I love you.
06:26The words couldn't come out because by this time, the blood was filling his lungs.
06:30So I just started screaming.
06:32I was like, I love you too, but please don't leave me.
06:34Please don't go.
06:35I can't live without you.
06:55Welcome back.
06:56Mahani Henry Khan's husband, Peter, is clinging to life after having been shot while out celebrating her birthday.
07:03And it turns out he wasn't the only one attacked that night.
07:09We return now to Catherine MacDonald and please don't leave me.
07:14When do you learn that a second person had been shot?
07:18So when we were trying to stop the bleeding before the police showed up,
07:22I remember somebody offered us a shirt to kind of soak up the blood because it was going everywhere.
07:29And I look over and I see this other guy there and he's holding his leg.
07:36It was at that moment I saw that that guy was also shot.
07:40Police were called to the parking lot for a double shooting.
07:43Officers arrived to find two men suffering from gunshot wounds.
07:46Police believe there is just one suspect who remains at large.
07:50Peter Khan was not the only person shot in that Scarborough parking lot.
07:54But only moments later, another man had also been fired at.
07:59He was shot in his car and then he drove around and came back out.
08:05It wasn't life-threatening.
08:07So he was still on scene right there witnessing us with Peter on the ground as well.
08:12Did anyone tell you that they saw anything?
08:15The guy that he was with, I think he was also in shock at the moment.
08:20He couldn't say anything.
08:21He wasn't saying anything.
08:23We didn't know anything about the scene at the moment.
08:25Or why.
08:26Or why.
08:27Or how even.
08:28And what about who did it?
08:29Did anyone say he looked like this or did you know anything about the suspect?
08:33No, absolutely nothing.
08:34So all you're thinking about is let's go to the hospital.
08:37Yeah.
08:38The moment they took him into the stretcher, I felt like a little bit relieved.
08:42Peter was, you know, alive and was fighting.
08:47The ambulance showed up and they took him.
08:50I was covered in his blood.
08:53I remember I looked down and I saw his blood on my hands and I just fainted.
08:59I woke up and the medical professionals were there and I said, where is Peter?
09:03They said the ambulance took him.
09:05I jumped up.
09:05I said, we got to go.
09:09When he went to the hospital, I felt that like, okay, he was going to be good.
09:15I felt like, okay, he's out of the hospital.
09:16You know, they're going to take good care of him.
09:18We went to Sunnybrook and I kept asking for updates.
09:21Like, is there anything?
09:22Is there anything?
09:23So all of our friends were starting to gather at the hospital now.
09:27Also at the hospital were relatives of the other shooting victim.
09:31I remember people were shouting at the other group.
09:34As soon as somebody had came and told me, hey, listen, I don't know why people are shouting at us.
09:40You know, we're kind of like the victims ourselves.
09:42We have no clue what's going on.
09:44They just kept telling me to wait and wait and wait.
09:47The surgeon took us into a private room and I sit down.
09:50And he said to me, we tried everything we could, but he didn't make it.
10:01And I just sat there screaming, no, no, no.
10:06Because I didn't want to accept that my husband, who I loved so much, was God.
10:19Why?
10:20Why?
10:23Like, this is a church.
10:26This is a church.
10:28This is a restaurant.
10:31That is tutoring classes.
10:34This is a safe area.
10:35This is an area that a lot of people come to.
10:38Peter and I came here all the time.
10:40All the time, all the time, we never had a reason to feel unsafe.
10:48I met Peter on Facebook.
10:50He's like, hey, what's up?
10:52And I clicked on his picture and I was like, oh, he's kind of handsome.
10:59We knew a lot of mutual friends and Peter was very well known in the West Indian Guyanese community.
11:07His Facebook name at the time was G.T. Baba.
11:10So I actually didn't know his real name.
11:13So I asked him.
11:14I was like, what?
11:15What is your name?
11:16And he says, oh, my name is Peter.
11:21Peter and Mohani started dating and their bond grows.
11:26This is the first picture we ever took together.
11:30Four years later, with plans to get married, the couple buys a home in Ajax, Ontario, and they move in
11:36together.
11:37December of 2018, it was Christmas Day.
11:41He proposed to me in front of my family.
11:46They start planning their wedding for the spring of 2020, but COVID lockdowns would force them to wait until the
11:53end of 2021.
11:54It was always my dream to have a winter wedding.
11:57We ended up getting a huge snowstorm that day.
11:59Huge snowstorm.
12:00So he actually made a joke and he was like, you always get what you want.
12:07So we had a beautiful winter wedding.
12:10So this is the actual wedding right here.
12:12So you see where he's placing his hand over my heart.
12:15This is where we're exchanging vows.
12:18It was so blissful.
12:21And at the time, like, we were just starting our lives.
12:25So everything was just in place and it was perfect.
12:29How old were you at that point?
12:30Oh, I was 31.
12:34We were only married for six months, but it was the best six months of my life.
12:39And then you had a birthday coming up.
12:42Yeah, my first birthday as Mrs. Peter Kahn.
12:47Yeah.
12:47You want to tell me about that night, your birthday that year?
12:50My birthday was on the Wednesday, so we decided to go on the Friday.
12:55So we used to go to this place called Tropical Nights in Scarborough.
13:00It's a very popular place, especially among the West Indian community.
13:04I was getting dressed and he was laying on the sofa.
13:06So I said to him, I'm like, you know, if you don't really feel like going, I'm kind of like
13:11indecisive of what I want to wear too.
13:13Like, why don't we just cancel and stay home?
13:15And he's like, no, no, it's your birthday.
13:17Like, we have to go out.
13:20I did have a little bit of a feeling, like an anxious feeling, but I just chalked it up to
13:26I was in my 30s and I didn't want to get older.
13:31We got there, I would say around maybe 10.30, around that time.
13:37And we met up with a couple of other friends.
13:40I called him, hey, I'm here.
13:42And he told me I'm also there as well.
13:44And I remember we met at the parking lot and gave the props and things like that and then wishing
13:49Mohani happy birthday as well.
13:53We were ready to party.
13:55It started off as a great night.
13:58So we just had a couple of drinks, kept it social, you know, listened to some really good music.
14:03We danced and stuff like that.
14:06He was driving that night, so he didn't drink.
14:09It was just me, but I'm also not a heavy drinker.
14:13Around like 12.30, I remember I made a social media post on Instagram and it was Peter and I
14:19together and I posted,
14:21I'm feeling so blessed right now.
14:22Life is so perfect.
14:26And the night progressed and we were getting ready to leave.
14:31Before I last saw him was when I think the lights was kind of coming on and it's kind of
14:36could be the last dance or two.
14:38And like, so, you know, I was casually dancing with Mohani and him and some of our friends.
14:41And that was the last time I saw him.
14:47When we were leaving, it was a little cold outside and Peter, he smoked.
14:53One of his friends was there.
14:54He goes, we're going to go outside.
14:55We're going to have a smoke together and I'm going to start the car, warm it up.
14:59And when you're ready, come out.
15:02I stopped and I was like, you know what?
15:04You go.
15:05I'm going to use the bathroom and then I'll meet you outside.
15:08So I had another friend with me.
15:09So he looked at my friend and he said to her, he says, take care of my wife.
15:16And he kissed me on my forehead and he said, I love you and I'll see you soon.

15:34It's May 2022 and Mohani Henry Khan's husband, Peter, was shot and killed while they were out celebrating her birthday.
15:43Investigators are now racing to identify the shooter before he strikes again.
15:50We return now to Catherine MacDonald and please don't leave me.
15:55When did you finally get to speak to police about, I'm sure you're wondering, you have all these questions.
16:00He was shot in the early morning at around 3 a.m. on Saturday, May the 7th.
16:05So this is still now Saturday midday on May the 7th.
16:08And we went to the police station and that now is the first time that I'm going to speak to
16:13the police and understand what's happening.
16:17I asked them, why?
16:20And they said, well, we also don't know.
16:23So that's what we're going to figure out.
16:27Mohani would learn that everything was caught on camera.
16:30And at that point they told me that it was a robbery and he was shot and killed because of
16:37the chain that he was wearing.
16:39It wasn't anything that was, like, really big or, like, blinged out with, like, big diamonds.
16:46It wasn't anything fancy.
16:47It was a simple chain.
16:48So when they said it was a robbery over his chain, it didn't make sense.
16:56Seeing some of the footage, you know, I just remember thinking Peter was a strong man.
17:02He particularly, you know, didn't want to give up the chain.
17:06It meant a lot to him.
17:07The other side of me also thinks that, like, you know, he could have just given up the chain and
17:11saved his life in a way.
17:13That chain, actually, I had gifted to him during our wedding ceremony.
17:16So in our culture, it's customary that we give gold jewelry.
17:21My mom gave him a chain and I also gave him a chain.
17:24And that exact chain that I gave him was the one that he was wearing that night.
17:28And I saw this video.
17:31You know, my husband did what any normal human being would do.
17:34Somebody invades your personal space.
17:35He pulled back and kind of just pushed him away.
17:39And because when he pushed him away now, he just pulled out the gun and just fired.
17:50And in the video footage, you see my husband just fall back and kneel over on his car.
18:00With no idea whether or not the suspect was planning on targeting other late night party goers in the area,
18:06police were moving fast to try and make an identification.
18:12The Sunday afternoon, one of the lead detectives came and she says, we have someone.
18:19They didn't tell me anything.
18:20They didn't give me the name.
18:21They just said they have somebody.
18:23Police have released images of a suspect they believe is responsible for a deadly shooting in Scarborough over the weekend.
18:30This is the person police would like to speak with about the shooting at a plaza near Morningside and Shepherd
18:35on Saturday.
18:36A suspect vehicle was also identified as a white Nissan sedan.
18:42Not only were both shootings caught on video, so too was the suspect's arrival just before 3 a.m., just
18:51as Peter Kahn was exiting Tropical Nights.
18:54From what I know, the suspect came here first, parked down there, came up these stairs right around here.
19:02And then he walked straight down.
19:05There was people smoking here outside because this is the general area where everybody comes out and they smoke.
19:13So he came here, looked around, a little shifty, stopped, looked back a little bit.
19:18And then he went back down to get his vehicle that was parked down at the bottom.
19:26Once he got his vehicle, he came around this corner here from the bottom parking lot.
19:33He drove around this way, went up this ramp here, and there's a dumpster just in the corner behind the
19:41trees.
19:42He stopped the vehicle right there, exited the vehicle, came down this ramp, walked down all the way here, and
19:53then this is where he approached Peter.
19:57Peter was shot at 3 a.m., and then the video shows the suspect approaching a Honda, idling nearby.
20:06While you were in the interview with the police, the other fellow that was shot, did you ask about him?
20:11At that point, I asked them, I said, was he robbed?
20:15And they said, yes.
20:17As soon as he finished shooting my husband, came back around here, went up this little hill.
20:24The other person was parked in the parking lot there, about three spaces down.
20:30The security footage shows the suspect walking through the parking lot, away from where Peter Kahn lies dying.
20:37The suspect heads towards a row of vehicles.
20:41He doubles back and approaches a dark-coloured car.
20:44The man inside that vehicle was Dante Rupchand.
20:49You've learned that he was shot over a gold chain.
20:53He goes up to his window, pulls the car door open, snatches the guy's chain, points the gun down to
20:59shoot him, but at the same moment, that guy was getting up.
21:03So the trajectory ended up being that he shot him in the leg.
21:07People were saying that if he didn't get up or move in that moment, it could have potentially been even
21:12worse.
21:14Then he jumped back into the car, sped around, and exited that way.
21:21Two men were robbed.
21:22Two men.
21:23Actually, I also found out that another person was robbed prior to Peter at a different location.
21:30They told you that?
21:31Yeah.
21:31So they said that the motive was robbery throughout this whole, I would say, crime spree.
21:37And your husband was the second victim?
21:39Yes.
21:40And that earlier incident, outside a nearby pizza place, would turn out to be a critical piece of the puzzle
21:47for investigators.
21:48When we compared the images of the suspect vehicle, as well as the suspect, from our homicide to the images
21:55of the suspect vehicle from the robbery in 41 Division at Kennedy and Ellesmere that happened earlier that morning,
22:01we believed that the suspect and that suspect vehicle were one and the same for the two investigations.
22:07At 1.11 a.m. on Saturday, May the 7th, as Mohani and Peter were enjoying their time at Tropical
22:14Nights, less than 10 kilometres away,
22:17a man named Vernon Facey had just bought a pizza and was waiting outside for an Uber with his girlfriend.
22:23Vernon would testify that a man wearing a black, shiny winter jacket and light blue jeans grabbed his gold chain
22:29from behind.
22:30He said he felt someone tug on the back of his chain.
22:34And then he realised his attacker had a gun.
22:37Quote,
22:38After that, he said,
22:39Take the rings off.
22:41When he resisted, Vernon said the suspect threatened to kill him.
22:45Quote,
22:53Vernon said the suspect then showed him the ammunition inside the gun before making off with his chain, rings and
23:01a bracelet.
23:02When investigators saw the CCTV footage, the scenario looked eerily similar to the two incidents at Tropical Nights.
23:10Similar looking suspect and similar looking vehicle.
23:13It was a very distinct vehicle.
23:16Because it was a white Nissan and the driver's side mirror.
23:22Cap on that side of the mirror was missing.
23:25So it was black.
23:27So the whole car was white, but the one side, the driver's side mirror, was black.
23:33So it was a very distinct vehicle in that sense.
23:37And that's when she had told me that they had put out a bulletin amongst the police
23:42that this vehicle is of interest in the homicide.
23:46And there was a police officer that was doing his rounds in Scarborough on Sunday.
23:52And he noticed that exact vehicle with the cap missing, it being black, at a plaza.
24:00For sure this is an Ultima, as you can see.
24:03And a very keen-eyed officer from 41 Division's crew located our suspect vehicle, parked in the parking lot at
24:11Kennedy and Ellesmere,
24:12just down the way from where the first robbery occurred.
24:14No front plate, as you can see.
24:16And maybe either Tuesday or Wednesday, she said that they were going to release a press release
24:20and they were going to let us know who did it.
24:23I couldn't believe it.
24:25I said, are you sure?
24:26She said, yeah, we have a pretty good idea that this is the person.
24:42What's up, my brother?
24:43Good to see you.
24:44Me too.
24:48The first thing that comes to mind when you think of him is?
24:51Absolute beauty, man.
24:52Love?
24:54Yeah, happiness.
24:55Always happy.
24:57Smiling, yeah.
24:59Do you miss him?
25:00Every day.
25:01Every day.
25:03Devon Persaud had known Peter since elementary school.
25:06When he came up from Guyana, yeah, I was one of the first friends that he made there.
25:10And Wade Del Grande met Peter working at the grocery store.
25:14No frills.
25:15He started as my manager.
25:17No frills.
25:18No frills.
25:18Back in the day, yeah.
25:19Probably, you know, 20 years ago.
25:20Look at his smile, man.
25:22One thing he loved, DJing, you know, he was working on that.
25:26And then he'd have his little table, he'd have his DJ stuff set up.
25:29The one and only GT Baba.
25:31Oh, yeah.
25:32The GT is short form for Georgetown.
25:35And Baba is kind of a term of endearment that most family members use for young kids.
25:43It could also kind of mean what we call a sweet bite.
25:47I still haven't deleted his number out of my phone.
25:49No.
25:50It's still there.
25:50And, you know, it's even weird because when we go and tag him on something on Instagram,
25:55we still tag him.
25:55Yeah.
25:57My brother.
26:03By Sunday, May 8th, police were certain they had identified the shooter and that they had enough evidence to link
26:10him to all three incidents.
26:14They had spent the weekend piecing together CCTV footage, tracking the suspect as he allegedly traveled to and from the
26:22Domino's Pizza on Kennedy Road to a residence on Rowena Drive and then to Tropical Nights.
26:27So when an officer spotted a white Nissan Altima matching the suspect description vehicle.
26:33For sure this is an Altima, as you can see.
26:37Back at the location of the very first crime, they watched and waited.
26:41All right, brother.
26:42And then moved in to make the arrest.
26:45But the suspect took off.
26:48Yeah.
26:58And police allege he tried to hide the car keys as he was trying to escape.
27:30We all gathered at his mom's house, family and friends.
27:33We sat and we put on the news and we were waiting for the news release.
27:39And I remember I sat on the sofa in complete silence and we were listening.
27:45And they were talking about the case and they showed Peter's picture and they said that they've arrested someone.
27:52And that's the first time that I saw his face.
27:56Javon Waldron.
27:59This was a very, very tragic incident.
28:03A senseless act of violence where Mr. Khan lost his life and two people were robbed and victimized here in
28:08our city.
28:09Over a few pieces of jewelry, a man is now facing several charges.
28:1327-year-old Javon Waldron was arrested on Sunday in connection with several robberies in a shooting that left 36
28:20-year-old Oscar Peter Khan of Ajax dead.
28:24And the first thing I thought in my mind, I said, do I know him?
28:29Have I ever seen him anywhere?
28:32Acquaintance?
28:34Could this be a friendship, something gone wrong?
28:37Like, but no, we had nothing to do with it.
28:41We didn't know him in any shape or form.
28:43Police say Waldron approached Khan in a Scarborough parking lot near Morningside Avenue and Shepherd Avenue East on Saturday morning
28:50around 3 a.m.
28:52He then allegedly reached for and ripped a chain off of Khan's neck, holding him at gunpoint before shooting him.
28:58How much was that worth, that chain?
29:01About $350.
29:03He lost his life for $350?
29:05Yeah.
29:06That's what that person valued his life at, $350.
29:14To track the suspect's movements the night of the crime spree, police also needed phone records to try to place
29:21him at the scenes.
29:23So Javon Waldron was not far from where he allegedly shot and killed Peter?
29:28No.
29:30It was all within less than a week of everything.
29:33So imagine processing that he died and then processing that they found the person and then seeing this person's photo
29:42just three or four days later.
29:45And at this point, he's just a suspect.
29:46He's only been charged with second degree?
29:49Second degree.
29:49So you had to wait three years for justice?
29:54Yes.
29:54To see justice done?
29:55Yes.
29:56What did you find out when you went to the trial?
29:58The trial was October and November of 2024.
30:04Still a lot of things were unanswered.
30:07Peter Kahn's wife came to court on the opening day of the second degree murder and attempted murder trial for
30:12Javon Waldron.
30:13So I went to court from the first day, jury selection, all the way through to the end.
30:21The Crown told the jury the suspect, who was captured on video surveillance wearing a black puffy jacket and light
30:26pants, arrived and fled in a white Nissan Altima with distinctive features.
30:32Javon Waldron pleaded not guilty.
30:34The defence argued that the man seen in the videos was not him.
30:38This man, the first witness for the Crown, testified that less than two hours before the fatal shooting, he too
30:44was robbed of his jewellery.
30:47Defence called into question the memory of some of the eyewitnesses, flagging, quote, inconsistencies about the height and weight of
30:55the assailant.
30:56That friend testified Monday, quote, right then and there, the individual pulled out his gun and shot Peter, he said.
31:03Kahn died of a gunshot wound to the chest.
31:05This man, Dante Rupchand, who does not want to appear on camera, also testified.
31:10Rupchand testified after being shot, the suspect walked away and he drove off.
31:14Defence pointed out there wasn't any, quote, uninterrupted surveillance of that vehicle, end quote.
31:20That someone else may have entered the car or exited undetected.
31:25And they questioned whether the phone number connected to Waldron was in fact his.
31:30Since his actual phone was never recovered.
31:33It's nerve-wracking, scary, a little bit daunting.
31:37Mohani Henry-Kahn has spent the last three days at the Superior Courthouse watching the trial for Jovan Waldron.
31:45We also saw video.
31:46Yes.
31:47What was that like to have to watch?
31:49I actually had to leave the courtroom the first time they showed it because I saw my husband's last moments.
31:56Because from when he kissed my forehead and he went outside, that's the last that I saw of him until
32:02I went outside.
32:03But the last moments of him laughing and joking with his friend, walking outside, going to the car, standing there.
32:11You had his chain.
32:12You snatched it.
32:13You had it.
32:13You pulled out the gun.
32:15Why did you need to pull that trigger?
32:18You remember the footage from the first victim.
32:21He robbed him at gunpoint.
32:23He had the gun.
32:25He didn't shoot him.
32:26So why shoot my husband?
32:28Did you ever get to hear from him?
32:30No.
32:30He never spoke.
32:32He never testified on his own behalf.
32:34He never addressed the court, ever.
32:39But even though the accused never told his own story, Mohani would come to learn a lot more about him.

33:04Welcome back.
33:05Javon Waldron was on trial, charged with the second-degree murder of Peter Kahn and the robbery and aggravated assault
33:12of Daunte Rupchand.
33:14He had pleaded not guilty.
33:16But this wasn't his first brush with the law.
33:20We now return to Catherine MacDonald and the conclusion of Please Don't Leave Me.
33:30Javon Waldron has been arrested and every single time he was let back out.
33:38Unbeknownst to the jury was the fact that Javon Waldron had a criminal record, including a conviction for possession of
33:44an unauthorized firearm.
33:46And in 2019, convictions for dangerous operation of a motor vehicle and possession for the purpose of trafficking.
33:53He was on the news for a high-speed police chase in Durham region.
34:00And I specifically remember this because Peter and I were watching that on the TV, on the news.
34:07160 kilometres an hour on Kingston Road, 160 on Kingston Road.
34:11A Pickering man facing multiple charges after running away from a traffic stop.
34:15Durham police say the officers tried to stop the suspect shortly after midnight near Harmony Road in Oshawa.
34:21And I said, oh my God, this guy is crazy.
34:23Not knowing that a year or two later, that same person that was on the news for the high-speed
34:29police chase would then kill my husband.
34:32But that's not all Mohani would learn about the accused.
34:36The Crown told the jury after Waldron's arrest the canine unit was brought in and retraced his steps when he
34:43was fleeing.
34:43They found a key fob to a Nissan motor vehicle and returned to the car believed to be the suspect
34:48vehicle.
34:49And the key fob opened the vehicle.
34:51It was registered to Javon Waldron's late brother.
34:55At the sentencing hearing, court heard that Waldron had three brothers.
34:58One died during COVID, and another was murdered when Waldron was only 14.
35:04Javon Waldron, his brother, was shot and killed.
35:10Waldron witnessed that shooting, and his brother died in his arms.
35:15The irony.
35:16So if you're a product of your environment and this happened to you by logic,
35:21then that means I should also hurt someone or hurt somebody else.
35:25No, that's not right.
35:28When the trial came to an end, Peter's family waited anxiously for the jury to make its decision.
35:35Actually, the night that they were deliberating, they came back with a question.
35:38The question was something along the lines of, if shooting a man close range in his chest,
35:46if that is not a determining factor of a murder to charge.
35:52So it seemed like they were looking for clarification of a second degree murder charge.
35:57An intent.
35:58An intent.
35:59Correct.
36:00Yeah.
36:01Soon after, the jury returned with its verdict.
36:04And we were sitting there, and the silence was deafening.
36:11You could hear not even a pin, like anything.
36:14It was so silent in that courtroom.
36:16And the foreman for the jury gets up, and the judge asks them on the murder charge, how did they
36:25find him?
36:28And I just dropped down and burst into tears, and they were tears of joy, but tears of sorrow as
36:39well.
36:40A Toronto man who stole gold chains from two strangers before shooting them both outside a Scarborough nightclub
36:47has been found guilty of second degree murder, aggravated assault, as well as robbery.
36:52Justice has been served here today for Peter.
36:55He didn't have to kill my husband.
36:57That was a choice that he made.
37:00And I'm glad that I get justice from my husband, because he didn't have a choice in all of this.
37:11It sucks, and it hurts, because he shouldn't have been out to murder my husband.
37:18He wasn't supposed to have a weapon.
37:20He was out on probation.
37:22And I feel like maybe if the right thing was done, and he was behind bars, we wouldn't be filming
37:30this year today.
37:31It's just not fair.
37:33It's not fair.
37:36He took $350 worth of a chain, shot him, and left him here to die like he was nothing.
37:45But he wasn't nothing.
37:48He was my everything.
37:55And I hate him for that.
37:58I'll never forgive him.
38:03In November, a jury found Waldron guilty of second degree murder, aggravated assault, and robbery with a weapon.
38:09And he will be sentenced to life in prison.
38:11The issue the judge must decide is a parole ineligibility period between 10 and 25 years.
38:16The Crown is asking for 20 to 25 years.
38:20The defence is suggesting a more appropriate period of parole ineligibility would be 12 to 15 years.
38:26The defence was trying to say that he was a product of his environment.
38:31I guess, being a person of colour, where he lived, being raised by a single mom.
38:38But that is the furthest thing from the truth, because Peter and I were also people of colour.
38:44Peter and myself, we were not raised in the greatest neighbourhoods, and we were both raised by single mothers.
38:50If somebody had a troubled past, then I would assume that they would want their future to be good.
38:57Sometimes it's not easy to kind of go through, you know, the memories and the flashbacks of what had happened
39:04to you.
39:05But I always feel like sometimes the best way to let go of a past is to actually create a
39:10good future.
39:11That argument of being a product of your environment, it's an excuse.
39:16Something has to be done.
39:17My personal opinion on it is right now that the punishments no longer fit the crime.
39:23People are just committing crimes because they know that the punishment is lenient.
39:29It has been almost three years and I do not celebrate my birthday.
39:33Your Honour, how can I celebrate my life when it resulted in my husband's death?
39:39I remember in your victim impact, you said that you could never celebrate your birthday again.
39:44Is that still the case?
39:46Yes, Catherine.
39:48I don't celebrate my birthday because I feel like it was my fault that, you know, basically the day I
39:57was born was the day he was sentenced to death.
40:01Like, I feel if I celebrate my birthday, I'm celebrating me coming into this world and him leaving.
40:05My husband and I did nothing wrong.
40:07He was a construction worker.
40:09He worked for everything he had.
40:11He didn't deserve to have his life snatched from him for this reason.
40:17Near the end of March 2025, almost three years after Peter Kahn's murder, Javon Waldron was sentenced to life in
40:25prison with a parole ineligibility period of 18 years.
40:29All of a sudden, one day, you wake up and they're not there anymore.
40:36Now we have just memories and pictures.
40:43Sorry, man.
40:49Like, I keep thinking I'm over it, right?
40:53I keep thinking I've come to terms with everything that's happened.
40:58But then, you know, when we do his birthday, things like this, it kind of reminds me that there's still
41:04a part of me that hasn't healed yet.
41:07And I don't know if it ever will.
41:18I'm sorry.
41:22We sit down now as brothers because of him to reminisce and honor his legacy.
41:29Definitely one of a kind for sure.
41:31Yeah, missed and loved.
41:35I think a couple of weeks after he had passed away, I would kind of dream.
41:39It wasn't his face.
41:40It would just be a kind of mumbling voice that I heard when I was trying to revive him.
41:45I would like to know what Peter was trying to tell me that night.
41:50I think that's one thing that stayed with me.
41:52I do often think about him.
41:55His greatest asset was keeping people together.
41:57He would want us to love each other.
42:00I went through a very hard point in my life in 2023 of April.
42:06I had a successful suicide attempt in which I did actually die for six seconds.
42:15And the paramedics on scene were able to, of course, perform life-saving measures and bring me back.
42:24But in that moment, I decided, I said, okay, I can't go on like this.
42:29Peter wouldn't want this for me, so I have to do better.
42:32And that was when I decided that I will honor him, I will love him, and I will move forward
42:40with his memories.
42:43I received my wedding videos about two days before Peter passed away, so he never got to see them.
42:51We had made a plan that on Sunday, we were going to come to my mom's house and have dinner
42:55and celebrate my birthday with my family.
42:58And we were going to all watch the videos together.
43:01And unfortunately, he didn't get to see it.
43:03So the first time the wedding video was played, for anyone to see, was at his funeral.
43:10I ache for that love because I don't have him anymore.
43:15I wear my wedding ring every single day, and this is also Peter's wedding ring.
43:20This, it's called the Mangal Sutra.
43:22This is gifted to me by Peter on our wedding day.
43:25It basically signifies the union between a husband and a wife.
43:29He got mine done in infinity.
43:31Traditionally, it's not to have a clasp, so the chain is all the way around.
43:36So when you get married, your union has no end.
43:42That scene of Peter saying, I love you in that moment, it never leaves me.
43:48Prior to getting married, it was always my lifelong aspiration to go to law school, become a lawyer.
43:53And in 2024, I decided to chase my dreams.
43:57And I will be trying to see if I can get accepted in September.
44:03In law school?
44:03Yes.
44:05I do it in honor of him.
44:07He's my inspiration.
44:13At sentencing, the judge said, quote,
44:20There is no hint of self-defense or provocation in either crime.
44:27Javon Waldron is appealing those convictions.
44:30His appeal is based on the argument that the judge improperly cautioned the jury about a witness's testimony
44:37and a claim that a witness for the Crown lied.
44:40In addition, Waldron was convicted of robbery in relation to the first Domino's Pizza incident
44:46and given a 10-year concurrent sentence.
