00:22The guy's late.
00:25He's coming.
00:27I promise.
00:29See, you hand over a credit card to pay for cards.
00:33It's a promise too, right?
00:36So your ward doesn't mean a whole lot around here right now.
00:39You understand?
00:44What are you two doing here anyway?

01:26Then we have two choices.
01:29Educate me, please.
01:31I give you the four grand that they owe you.
01:34Or you're gonna ask me for six again.
01:37And when you do,
01:39make sure you got those guys by your side.
01:56Okay, officer, what do we got?
01:58It happened up there.
02:00No way he's surviving that.
02:02You sure he didn't fall?
02:04Or jump?
02:05That's a different department.
02:06No, he was pushed.
02:09That lady called 911.
02:11At 1035, she was walking down the air.
02:14Heard arguing between two men.
02:15Next thing she knew, this guy went over the side screaming.
02:18Grabbing at the air.

06:44of the actual crime
06:45mhm
06:46i mean the quality's not great but if you step through it it tells a story
06:50there's kane
06:53here comes another guy can't quite make out his features

07:24okay let's figure it out and find him
07:28alternative bad for all
07:30i'm no genius mr mazio but it feels like the alternative in this case was murder
07:35no
07:36it was
07:37i was
07:39wally and i have known each other forever it was a little dispute
07:42dispute about what
07:43business
07:45wally kane was in the navy
07:46we were talking about investing in a new venture
07:49i own and lease ports all over the country
07:51so his skill set was useful to me
07:54well when was the last time you saw vice admiral kane
07:57i don't know
07:58a few months
08:00hmm
08:02frank
08:03we tracked his fitbit
08:05we know you were with him last night
08:08at bob o'malley's bar 8 30 p.m
08:10it's really not a good look
08:12it's not what you think
08:14no
08:15because it seems pretty simple to me
08:16wally owed you money you tried to resolve it at the bar it didn't work out
08:20so you hunted him down on the elevated walkway and then you pushed him overboard
08:24no
08:25no
08:26that's not
08:26we met up to talk about business and then i went home
08:29i swear

08:33hey
08:34we'll meet you out here a minute
08:36now
08:37hey dick's here
08:39who is here
08:40this is the director in charge
08:41the fbi
08:52he needs to release frank mazio
08:54why is that
09:25i can't get into the details at the moment
09:25and be leaving town anytime soon
09:28he's not
09:34fine he's all yours
09:42time to go
09:43time to go
10:01thank you
10:02thank you
10:03frank mazio's alibi holds up he was home at the time of the murder
10:05but he admits talking business with wally kane and then send him a nasty text afterward
10:09apparently he's so important that he's so important that the fbi can just rip him out of the middle of
10:12an interrogation
10:13well just because mazio's alibi
10:15well just because mazio didn't commit the murder doesn't mean he's not involved somehow
10:17let's track his movements from the time he left the bar at 8 30 until the 911 call
10:24mr campesi is that your vehicle sir
10:28that's my vehicle
10:29so you know frank mazio
10:32i do
10:32how
10:33we work together
10:35you own in lease ports too
10:38no
10:39work for the fbi
10:42so mazio's working undercover
10:44no
10:45he's an informant
10:47and you're his handler
10:48that's why i was over at bub o'malley's that night
10:50was wally kane involved in this
10:53look
10:54we're on the same team i get it
10:56but
10:58this needs to stay off the record
10:59got it
11:01wally kane
11:03was our target
11:05can you be more specific
11:08look we don't need chapter and verse here
11:10we just want to know if your operation has anything to do with our murder
11:12i don't know
11:14sorry
11:15what kind of case is it
11:17rivalry
11:19mazio controls a big chunk of the waterfront around here
11:21and he was paying people off
11:23so they would dock their boats in his ports
11:25and wally kane was one of those people
11:28so he's taking bribes to dock navy vessels with this mazio guy huh
11:32yes
11:34anyone else involved
11:38what is your business with the admiral
11:39well we need to discuss that with him
11:41flag officer on deck
11:45as you were
11:47detectives and it's lieutenant brady
11:50have you made an arrest
11:51no but we think we might be close
11:54could we have a word with you in private
11:55anything you need to say to me you can stay in front of them we don't keep secrets on this
11:58shit
12:01okay
12:03we think you were taking bribes
12:05we think you met with wally kane to talk about frank mazio because you knew the feds were
12:09get the hell out of here
12:10sorry that's not how this works
12:12now what is this is a united states navy vessel a protected federal enclave under maritime and territorial jurisdiction law
12:21no one comes aboard without my express permission
12:37where's my evidence that's seventeen cash deposits made to admiral gravey's account over four months or just less than ten
12:44thousand dollars to avoid detection
12:46okay but we need more
12:47okay but we need more
12:47i got some video
12:49haven avenue a quarter mile from the murder scene six minutes after the 9-1-1 call
12:54you know it looks like garvey
12:56yeah that's that scar from the walkway video
12:58i couldn't get a hit on facial wreck but
13:01he stops and talks to this guy who's in uniform a sailor
13:05and we can see his face clear as day
13:06and every member of the military is in facial wreck
13:10great track him down
13:13you bet
13:14that's me
13:15and you're positive you were talking to admiral garvey
13:18are you kidding
13:19to guys like us admiral garvey is a celebrity
13:22i never even talked to him before
13:24i wasn't gonna miss my chance
13:26how did he seem
13:27when you talk to him
13:30a little shaken up to be honest
13:33wasn't interested in a long conversation that's for sure
13:45state your business
13:47don't bother
13:48pursuant to MRE 315
13:50NCIS has determined that probable cause exists for these authorities to conduct the search of this vessel
13:57this is a legal order all hands will cooperate and will not interfere
14:08shoot me
14:24you wanna tell me just what the hell it is you're trying to accomplish
14:28i can read
14:29i can read
14:30this is goddamn outrageous
14:31the law
14:32yeah it's wild stuff
14:35look
14:40so
14:41so
14:44this is you
14:46wearing that scarf and pushing your friend to his death
14:48can you turn around admiral
14:51press your hands behind your back desk sir
14:54rustin garvey
14:55you're under arrest for the murder of vice admiral wally cain
15:04take off my handcuffs
15:06so i can return the salute
15:07enough theatrics let's go
15:09i will be back on this deck
15:13and you
15:14are gonna regret this
15:17okay
15:18okay
15:18we'll talk soon
15:20are you really doing this
15:24how's it going jack
15:25i can't believe you're out and about seeing how dangerous this city is and all
15:29admiral garvey is a legend
15:32a war hero and you're gonna put him on trial for murder
15:34the evidence against him is significant
15:37doesn't look like that to me
15:39or the people i work with
15:40he's set to be the next secretary of defense for god's sake
15:43irrelevant
15:46to charge garvey with murder
15:47is a slap in the face to a lot of very important people nick
15:51not if he actually did it
15:58the people's case is strong your honor
16:00we have video of the admiral at the crime scene
16:02and we believe the defendant presents a significant flight risk
16:06he is an admiral in the u.s navy
16:07and if released he will retake the helm of his naval fleet
16:10and set sail for the middle east
16:12mr banks
16:13we plead not guilty and look forward to clearing admiral garvey's reputation
16:18as for bail
16:20this man has served our nation for three decades
16:24we request reasonable bail
16:26this is a murder case
16:27defendant is hereby remanded
16:29your honor this is a political witch hunt
16:31you can't penalize the defendant for the da's office
16:34you can't penalize it mr banks
16:35next case
16:40you're challenging your video evidence
16:49just selling the video that people claim places my client at the crime scene
16:54was obtained from a bodega
16:56it employed extremely dated technology
16:59this is an analog dvr based system
17:02first generation of black box recorders
17:04back then storage was at a premium
17:07they saved space by using compression
17:10and the storage is nearly full which it always is
17:13at this little shop
17:14the frames per second rate drops to ten per minute
17:17this is not reliable evidence
17:20what say you
17:21your honor the law does not require perfect technology
17:24it requires reliable authentication and relevance
17:27and we have both
17:27now yes the system is older
17:29but it doesn't mean that these images are unreliable
17:32i'm worried that the jury might give undue weight
17:34to what appears to be visual confirmation
17:37but it is visual confirmation
17:38clearly with demonstrable deficiencies
17:40the video is out
17:42your honor this is
17:43and that's the end of the conversation
17:45mr price
17:49can we win without the video
17:52yes the evidence is strong
17:53motive
17:55admiral garvey was trying to cover his own ass
17:57what does that mean
17:58wally kane knew that masio was coming for him
18:02that he was wearing wire
18:03so he called garvey
18:04told him what was going on
18:05they met up presumably to talk about the vine they were in
18:08and garvey got upset
18:10and pushed kane to his death
18:11something like that
18:12yeah
18:12do the phone records and cell data support all that
18:14yes
18:15okay good
18:17so we're still on solid ground
18:20we are
18:21yeah
18:22but
18:23this whole video thing
18:24it was a pretty routine matter
18:26i mean we're talking about surveillance video
18:28it's the foundation of modern police work
18:30and as a result
18:31it's the foundation of most criminal trials
18:33so for sullivan to flat out suppress it
18:36based on the simplistic argument that attorney banks put forth
18:39it
18:41it's hard to fathom
18:42huh
18:42judges have a lot of discretion
18:45and like you said the surveillance system's outdated
18:47so
18:48let it go and move on to jury selection
18:50build a case with what you have
18:51not with what you wish you had
18:53just make sure you put together a solid jury
18:56and they're not paying too much attention to all that fake news out there
18:59yeah
19:01came across this little gem a few hours ago
19:04thought you might appreciate it
19:06oh god
19:08it doesn't stop does it
19:13in our system of justice
19:14a defendant is presumed innocent
19:17and that doesn't change
19:18unless and until the people
19:20that is myself and
19:21Ms. Maroon prove our case
19:23beyond a reasonable doubt
19:25if we don't do that
19:26the law requires you
19:28to return a verdict of not guilty
19:31so
19:32is there
19:33anybody here
19:34who feels that
19:35if a person has been charged with a crime
19:38they probably did something wrong
19:43very good
19:44A plus so far in civics
19:46another issue that we run into is media coverage
19:50information is everywhere
19:51in the newspapers, our phones, social media
19:53this case has garnered some publicity
19:56has anyone here read or heard anything about this case?
20:01it's perfectly understandable
20:04juror 211
20:05could you describe what you've read or heard?
20:07this thing's been all over the talk shows and stuff
20:10my understanding is that the cops might have arrested the wrong guy
20:14goodness
20:16anyone else heard anything like that?
20:18yeah juror 214
20:19yeah I heard the same stuff
20:21like this whole thing is political
20:22a witch hunt
20:23right
20:24that's the word they used
20:25thank you
20:25your honor the people moved to excuse jurors 211, 214 and 216
20:30and thank them for their service
20:32approach
20:42Mr. Price
20:43Admiral Garvey is a southern white male
20:46yes correct
20:47will you move to excuse three white men from this jury
20:50sorry your honor I'm not falling
20:51as a matter of integrity
20:53it's my job to guard against any impression that we might be stacking the jury
20:58Batson tells us that these strikes
21:00could be viewed as eliminating white men in favor of minorities less inclined to sympathize with the defendant
21:08your honor I am not moving to strike because they are white men
21:11I'm moving to strike because they acknowledge digesting literal fake news about this case
21:18help us out here fellas
21:20could you still be objective about this case despite what you might have heard on the news
21:26yeah sure
21:28you didn't walk in here today with your mind made up regarding this man's guilt or innocence
21:34I don't guess so
21:36there you have it
21:38your honor we're not impugning the character of these jurors
21:41but there's no question that they've been exposed to material that would never be admissible in this courtroom
21:46this creates an unacceptable risk of prejudice
21:49trial by jury does not require us to seek jurors who have lived in isolation in this world
21:55motion to strike these men is denied
22:02these are two of the most aggressive pro-defense rulings I've ever seen
22:06video compression? nonsense
22:09and this Batson ruling
22:10it's absurd
22:12Batson was designed to protect black defendants who used to get railroaded by all white juries
22:17not powerful white men
22:18it makes
22:19no sense
22:21unless
22:21of course
22:23that is the whole point
22:25meaning what?
22:26meaning
22:26unless Sullivan knows what he's doing
22:28makes no sense
22:29wait are you suggesting
22:30I can't prove
22:31that he is in Garvey's pocket
22:33but
22:35it definitely feels that way
22:37are you seriously accusing Sullivan of being corrupt?
22:40he's been on the bench for 20 years
22:42he was a prosecutor for 15
22:43he started out right here in this office
22:45he held your job to like 5
22:47exactly
22:48that is why this is so concerning
22:49because he knows better
22:51I think he should recuse himself
22:53on what grounds?
22:54does he know the defendant?
22:56his family members?
22:57not to my knowledge
22:57does he have any special relationship with Attorney Banks?
22:59with the Navy?
23:00not to my knowledge
23:01so what are you going to ask him to step aside because you think he's a prick?
23:05for starters he's going to tell you to go to hell
23:07and then he's really going to jam you
23:10going to war with a judge is bad business, Nolan
23:13so you want me to pretend this isn't happening?
23:16I want you to pretend that he doesn't matter as much as you think he does
23:18the jury makes the decision, not him
23:30Kenneth
23:32Nick
23:32hey
23:34you know as you might expect I've been following this Garvey case pretty closely
23:37is that right?
23:38yeah, a lot of eyes on this one
23:41guessing you're pleased with that?
23:44is that what this is all about?
23:47me getting the nod for the DA position instead of you?
23:50I know you wanted it
23:52your people weren't very subtle about it
23:54I have no idea what you're talking about
23:56well let me be a little more direct
24:00you've made two questionable legal rulings and I'm trying to understand why
24:04every decision I make is based on the law
24:07I sure hope so
24:08that's the whole point of this isn't it?
24:10follow the law
24:13to get justice
24:15I'm gonna give you the benefit of the doubt on this one, Kevin
24:18for the time being
24:19is that a threat?
24:21no, it's a compliment
24:23I have too much respect for you and your career to ask for an accuser
24:29ask me, you're the one acting unethically
24:32excuse me?
24:33reaching out to me on an ex parte basis
24:36trying to influence a case
24:38oh
24:41we're just two people trying to do the right thing
24:43who happen to bump into each other outside the courthouse
24:47have a nice evening
24:53Vice Admiral Wallace Kane was a hero
24:56but
24:58like all of us
25:00he was far from perfect
25:02two years ago
25:03the FBI discovered that a man named Frank Mazio
25:06was bribing naval officers to dock their vessels at his slips
25:10the FBI asked Mr. Mazio to cooperate
25:13to implicate the men that he was paying off
25:16Vice Admiral Kane was one of those men
25:20on the night of the murder
25:21Mr. Mazio met with Kane
25:23wearing a wire, hoping to incriminate him
25:26but Wally Kane was nobody's fool
25:29he clammed up, he rushed out
25:32and the first thing he did
25:33was to call his partner in crime
25:37the defendant
25:39it was clear to Admiral Garvey
25:41that their secrets might be exposed
25:43that this whole mess had to be put to bed
25:46loose ends tied up
25:47so he pushed Wally Kane off the side of a walkway
25:51and watched him fall to his death
25:54this is the story of two good men
25:57two brave men doing bad things
26:01one of those men is now dead
26:03and the other
26:04is the killer
26:10as Mr. Price just stated
26:13Admiral Garvey
26:15is a brave man
26:17a hero
26:19in several wars
26:20Admiral Garvey
26:22did not kill Wally Kane
26:24he loved Wally Kane
26:25they were roommates in Annapolis
26:27they worked together
26:28for 20 years
26:31the sad truth here is
26:35the NYPD
26:37and the district attorney's office
26:39knew they were under a political scrutiny
26:42that the world was watching
26:45and judging them
26:47for allowing something like this
26:49to happen in the first place
26:50objection
26:52overruled
26:53and the cherry on top of course
26:54was the chance
26:55to embarrass the federal government
26:58the Navy
26:59as this trial
27:01moves forward
27:02please pay attention
27:04to the lack
27:06of specific evidence
27:08and the far-fetched narrative
27:10the prosecution is attempting to craft
27:13if you do that
27:15you will come to two conclusions
27:17one, that Admiral Garvey did not kill Wally Kane
27:20and two, the DA's office
27:23cares more about politics
27:25than the law
27:27thank you for your time
27:29for your service
27:32and your fairness
27:33we will break for lunch
27:35all parties back here in 90 minutes
27:42call Nazio
27:43now?
27:44now we're gonna kick this thing off in style
27:46make it clear right from the start
27:47that despite the fancy title and uniform
27:50Garvey is not a knight in shining armor
27:54Navy ships are big
27:56they need a lot of dock space
27:58especially during fleet week
27:59when a bunch need to park at the same time
28:02so
28:03you know, I would
28:06incentivize certain people
28:07to use my ports
28:09here in New York, New Orleans, San Diego
28:11by incentivize, you mean paying them cash?
28:14yeah
28:15and Wally Kane was one of those people
28:18yes
28:18when was the last time you saw him?
28:20the night he was killed
28:21we met for a drink at a bar on 18th street
28:23what was your agenda that evening?
28:25to get Wally to say something stupid
28:28can you elaborate?
28:30I was wearing a wire
28:32a listening device
28:33I was trying to get him to acknowledge
28:34that
28:35we were doing business together
28:36and he was being paid
28:39he didn't
28:40he didn't bite
28:41he would do business
28:42with the defendant?
28:43no
28:43not directly
28:44but Wally said
28:46he shared the bribes with his boss
28:47objection
28:49hearsay
28:50sustained
28:50nothing further
28:53this uh
28:54this bribery scheme
28:56was your idea?
28:57correct
28:57and you obviously knew
28:59what you were doing was illegal
29:01correct?
29:02so
29:03breaking the law
29:04doesn't bother you?
29:06no
29:06it bothered me
29:07it bothered me
29:09just not enough
29:10I suppose
29:12was that meant to be funny?
29:14no
29:15just honest
29:15so you're honest
29:17about being a criminal
29:18about your willingness
29:19to deceive people
29:21skirt the law
29:23that's one way to put it
29:25is it also true
29:26that you were arrested
29:29nine years ago
29:30for domestic assault?
29:32objection
29:32it goes to the witnesses
29:34credibility
29:34this is outrageous
29:35relax
29:36no need for hyperbole
29:38let's discuss this in chambers
29:40court is adjourned
29:46yeah
29:46mazio was arrested
29:47but never convicted
29:48hell he wasn't even charged
29:49but even if he had been
29:51and was then convicted
29:52it still isn't admissible
29:53it has absolutely nothing
29:55to do with his propensity
29:56for truthfulness
29:57i don't know about that
29:58excuse me?
29:59people who commit crimes
30:01are inherently less believable
30:02than people who don't
30:04that's not
30:08okay
30:09um
30:10alright let's
30:11let's say that you're right
30:12but the defense
30:13has already made that point
30:15and they already established
30:16that the FBI
30:16was investigating mazio
30:17for bribery
30:18and that they gave him immunity
30:19in exchange for his cooperation
30:20and that all makes sense
30:22that is directly related
30:23to this case
30:24and to the defendant's motive
30:25but this alleged domestic assault
30:27from nine years ago
30:28has absolutely
30:29nothing
30:30to do
30:30with whether or not
30:31Admiral Garvey killed Wally Kane
30:33sure it does
30:34it speaks to who this man is
30:36in full
30:38I agree
30:39the jury has a right to know
30:41that the man accusing
30:42a war hero
30:43of fraud
30:44and by implication murder
30:46is not only a career hustler
30:47but a wife beater
30:50and they proceed
30:58I don't know what to say
31:01other than this is a highly unusual decision
31:03no it's more than that Nick
31:04he is jamming us at every turn
31:07it can't be a coincidence
31:09it is not a coincidence
31:11I know you don't want to hear this
31:12right now or accept it
31:15but he's in Garvey's pocket
31:17there is no other explanation
31:18there is no other explanation
31:21the question is
31:23can we prove it
31:29I'm not sure I understand where you're coming from
31:31I'm just trying to
31:34this case has been unusual
31:38in many ways
31:39no how so
31:41there have been a series
31:42of questionable rulings
31:44but I
31:46I'd prefer not to bring you
31:47into the weeds on this
31:48I appreciate that
31:50I think
31:51to put my paranoia to bed
31:53I need to know how Sullivan
31:55caught this case
31:56you're the chief administrative judge
31:58the docket flows through your office
32:00was this case assigned to Sullivan
32:02or did he ask for it
32:05oh you're really saying
32:06what I think you're saying
32:08I don't know what to tell you Charles
32:11other than I wouldn't be here
32:12if this weren't a serious matter
32:20off the record?
32:22of course
32:24Sullivan asked for it
32:25claimed he had some expertise
32:26handling cases involving the military
32:33I kept hoping I was wrong
32:35that I was overthinking it
32:36but you bastards are really doing this
32:39you're really trying to fix this damn thing
32:44that's
32:45that's a hell of an accusation
32:47Sullivan requested this case
32:50he's now on a short list for the Federal Court of Appeals
32:53he's made pro-defense ruling after ruling that make no sense
32:57unless of course you look at them through a different lens
32:59and then they make a whole lot of sense
33:00why are we really here Nick?
33:03I guess I just wanted a chance to look you in the face and say I know
33:07and then I'm coming for you
33:09and Sullivan and everyone else involved in this damn thing
33:12that would be unwise
33:14but I don't care
33:16I am done
33:18with this nonsense
33:21does everything have to be so damn political?
33:25us versus you
33:27can't it just be about the law?
33:30Garvey was taking bribes
33:32he was afraid he was going to get caught and he killed a guy
33:35that's what happened
33:37does it really matter?
33:39what the hell does that mean?
33:41it means we want what we want
33:43and if I were you
33:44I would find a breathed legal reason
33:47to give it to us
33:48to dismiss the case
33:49win-win
33:51we get the Secretary of Defense we want
33:53and you get to wrap yourself in the Constitution
33:56and reassure the voters that you are a noble prosecutor
34:00who would never convict someone without sufficient evidence
34:04it's not going to happen
34:05our case is still strong
34:08despite your attempts to undermine
34:20you were right Nolan
34:23you were right all along
34:24I wish that weren't true
34:25I'm going to demand a mistrial
34:28really?
34:29and then I'm going to file criminal charges against Sullivan
34:31and everyone else involved in this damn conspiracy
34:34I'm not so sure if that's
34:35what's the alternative?
34:37to stand by and let them make a mockery of the judicial system?
34:40no, but
34:41you're the one who told me
34:42not to get emotional
34:43that attacking judges is a bad business
34:45stop
34:46just stop
34:48I'm not here for a conversation
34:50or a lecture
34:50just send me the file
34:52I'll handle it from here
35:09ah
35:11is this what I think it is?
35:17well, I'm happy to talk
35:20but we're feeling pretty good about where we stand
35:24good enough to toss a coin
35:26heads, regardless if he walks
35:28tails, spends the rest of his life in prison
35:42criminally negligent homicide?
35:44you really cut a deal with Admiral Garvey without my consent?
35:53ah, yes I did, given the facts
35:55he'll be out in a year
35:57he'll be out in a year
35:57hell, I might even suspend his sentence
35:59yeah, maybe
35:59but at least we got something
36:01we didn't have the cards, Nick
36:02we just didn't
36:03that is my decision
36:05not yours
36:09I just couldn't stand there and watch you destroy your career
36:15you should worry about you
36:18about your career
36:20well, that's what I'm doing, Nick
36:22and how's that?
36:23you go after Sullivan
36:24you will get blown up
36:25you'll lose the election
36:26and I will lose my job
36:27and I like what I do
36:29and I'm good at it
36:29so if it makes you feel any better
36:31I did this for me
36:33not you
36:36it doesn't
36:37it doesn't
36:43someone needs to hold the line
36:46why not us?
36:50why not now?
36:56this morning, Admiral Rustin Garvey
36:59pleaded guilty to one count of criminally negligent homicide
37:03based on the evidence
37:05and the specific facts and circumstances of this case
37:09we believe this is a just result for all parties
37:13in this country
37:15we do not prosecute to please a crowd
37:18and we do not neglect to prosecute to appease one
37:22the courtroom is a place
37:24where facts still matter
37:27where evidence still matters
37:29where the law, quietly and deliberately
37:32does its work
37:35and we must fight as hard as we can
37:37to protect the sanctity of this hallowed institution
37:40because if we don't
37:42this whole thing
37:44this grand experiment
37:46will crumble
37:50when we feel ill
37:54when we feel that lies
37:56and injustice
37:57are beginning to invade our collective well-being
38:01law is the medicine
38:03that can help us heal
38:04which is our relationship
38:07and we need to keep our flame
38:07and pain
38:10to the other people
38:11as well as possible
38:13the one who wants us to kill us
38:25for the rest of our life
38:28with liposomenal
38:42Oh, oh, oh, oh, oh.
