00:20From the media reports, apparently there have been four months of secret grand jury proceedings.
00:27We believe that Mr. Burke is entitled at the earliest opportunity to an open preliminary hearing
00:35and the proceedings not be done in secret.
00:38So we are asking for a preliminary hearing to be set at the earliest possible date.
00:44So David Burke did not murder Celeste Rivas Hernandez, nor was he the cause of her death.
00:52And we would like to be able to have the evidence come into the light of day
00:57at the earliest opportunity over the last several months.

01:04Plead 1905, the matters were assigned to Judge Charlene Almeida in Department 105
01:10for all purposes by the judge of the supervising judge of criminals.
01:18The people arrived, delivered an informal discovery request consistent with Penal Code Section 1054.
01:26We have been given almost no discovery thus far.
01:31We received a three-page follow-up report, no autopsy report.
01:37The coroner's report was sealed in this case in order to prevent it from hampering truthful testimony
01:46from witnesses that testified at the grand jury.
01:48So an order will also have to be obtained.
01:51Mr. Burke is entitled to discovery.
01:54We have served the people with notice.
01:57They have 15 days to produce discovery.
02:01In this case, we would ask that they do that.
