00:01This program documents actual homicide investigations.
00:05Criminal charges are often dropped or reduced,
00:07and all suspects shown are presumed innocent unless proven guilty.
00:24911.
00:25This is an on-fire emergency.
00:27There's a good Samaritan call.
00:29He said he was flat down by someone,
00:33stating that someone was in the woods on East 11th Street.
00:38It's gonna be towards the west of the woods.
00:41The caller says he was in his taco truck
00:43when a man ran up and said he'd just found a body in the woods.
00:47Have you gained contact with the body at all?
00:50Yeah.
00:52He looks to be defeated.
00:55No way.
00:56No way.
00:57No way.
00:59First responders race to the scene.
01:03He's down in this little camp, man.
01:06And discover a man lying in a tent within a small patch of woods.
01:11There's a lot of blood.
01:14Shot dead.
01:23Got a call about a suspicious death over in the area of 11th Garnet.
01:27Detective Vernon McNeil will lead the case.
01:31It's a mix of hotels and businesses,
01:33but you have a large transient population out there.
01:36A lot of them live in camps in the woods surrounding the intersection.
01:41A lot of times what they'll do is get room at one of the hotels,
01:44and that gives them a place to shower and clean up.
01:48The victim was found deceased in a tent.
01:51So that's where we're going to head to.
02:09He's next to a tent.
02:11The tent's there.
02:17What's his name?
02:19David Drywater.
02:2442-year-old David Drywater was born in Claremore, Oklahoma, and raised in Tulsa.
02:32The oldest of eight children, David was a member of the Cherokee Nation and worked as a day laborer.
02:39He leaves behind his mother, three daughters, and three sons.
02:48He's got facial trauma.
02:51It's hard to see for sure.
02:54It looks like a gunshot wound inside the mouth of me.
02:59So, like, suicide?
03:01Suicide?
03:01Suicide?
03:01Mm-hmm.
03:02McNeil will have to wait for the medical examiner to determine the cause of death.
03:07Where's the gun?
03:07Where's the gun?
03:09It's probably got the legs by now.
03:12Everybody walked up and they go up there.
03:15It's possibly a suicide or homicide.
03:27For homicide detectives, their chance of solving a murderer is cut in half if they don't get a lead within
03:35the first 48 hours.
03:48I have two witnesses that saw him dead.
03:51I'm Dr. Daniel.
03:53That's the guy that lives down here.
03:57I think I was saying he's the one who found him first.
04:01The other witness is the man who discovered David's body.
04:13The man told officers that he saw someone in the camp point a gun at Daniel yesterday.
04:20I'll have somebody transport them.
04:23Both witnesses agreed to talk at homicide.
04:27Man, that's pretty much what they have now.
04:31It's inconclusive on whether it's a suicide or a homicide.
04:34The wound was in his mouth.
04:36So it could be an intra-or gunshot wound.
04:39But since his head was so bloody, we couldn't tell on the rear of his head if there was an
04:44exit wound.
04:46They didn't find a gun, but it's a transient camp, so if somebody stumbled across them, they could have picked
04:51the gun up and took off with it.
04:53McNeil will head back to homicide to question the witnesses.
04:57Hope they could put us on the right path.
05:01Take it easy?
05:01Yep, see you later.
05:10Two hours in.
05:11Thank you very much.
05:14McNeil starts with the man who discovered David's body.
05:18Kind of what I want to talk to you about is what's going on tonight.
05:21Where are you currently staying?
05:22Um, I live at the garden there.
05:25Okay.
05:25I'm staying up there in the tent, in the woods.
05:28In that same little camp where this happened at?
05:30It's a different camp.
05:31He says his camp is a half mile east of the crime scene.
05:35What's your familiarity with that camp over there, right by the creek?
05:40I go by there sometimes to, like, score or just to smoke.
05:45They're friends of mine.
05:46He says he's friends with the other witness, Daniel, who lives in the camp where David was found.
05:53He works about everybody, he opens the door for others.
05:56And that earlier that night, he spoke to Daniel outside a nearby business.
06:01I said, you know, I'm going to go down to camp for about 10 minutes of his school.
06:05He said, yeah.
06:06And as soon as I got down there, I see that guy in that tent.
06:10Do you remember what time he might have been?
06:12Oh, it was about four or five or something.
06:15When you got to the camp, who was all at the camp?
06:17My wife.
06:18So when you got to the camp, dead man.
06:21I ran back out of there.
06:22I started saying someone needs to call an ambulance.
06:25He says he ran back and got Daniel.
06:28He went down there to the camp and he came right back out.
06:31Okay.
06:33There was a car wash going on in that parking lot of our bodies in the taco truck.
06:37And when I asked the guy in the taco truck, I said, will you call number one?
06:41He says the owner of the taco truck called 9-1-1.
06:45And he went and looked at the body.
06:48While you were over by O'Reilly's, did you hear any gunshots?
06:51No.
06:52No.
06:53Okay.
06:54When you went to the tent, man, you're not in trouble, just be honest.
06:57I will.
06:58When you went to the tent, did you see a gun in there next to the dead guy?
07:02No, I did not see a gun. No.
07:06All right.
07:06Sit tight, man. We'll try to get you back out there, all right, buddy?
07:08Thank you very much.
07:19Hey, I'm Detective Warren.
07:20Need you to sit up for me?
07:22McNeil and Detective Reggie Warren turn to Daniel, who lives in the camp where David was found.
07:29How long have you lived over in that camp?
07:31Three years.
07:32Well, that's a long time, man.
07:33Yeah, man.
07:35Okay.
07:36Man, tell me what happened.
07:38I was in front of O'Reilly, bro.
07:40And he came running, you know?
07:42He says he was opening the door for people at a nearby auto barn store when the man who found
07:47David ran up to him.
07:50There's a dead body, you know?
07:52I went and go check it out.
07:54And I grabbed his hand, you know?
07:56Like, hey, what's going on?
07:59Was that your friend?
08:00Yeah.
08:03Did you see a gun?
08:05Mm-hmm.
08:07Mm-hmm.
08:07Okay.
08:09Let me ask you this.
08:10Did you take a gun from his tent?
08:13Mm-hmm.
08:14Did you go sell it or anything?
08:15I'm not saying you did it.
08:17Mm-hmm.
08:17I was just saying, did you take anything from his tent?
08:19Did you take the gun from his tent?
08:21Maybe to go sell it to get some money?
08:23Mm-hmm.
08:25I didn't see nothing, you know?
08:26I just got the dead, you know?
08:28I saw the dead, you know?
08:31When was the last time you saw that guy live?
08:34Like, around five.
08:36Okay.
08:37So, have you ever seen him with a gun before?
08:40Mm-hmm.
08:41No?
08:42Do you ever see him like he might be a little sad or depressed?
08:47Or something like that.
08:47Yeah.
08:48Did he ever act like he didn't want to be alive anymore?
08:53Mm-hmm.
08:55But he did kind of look like a little frightened, you know?
08:59Like something wrong.
09:02Um, yesterday, did somebody point a gun at you?
09:07Yeah.
09:08Okay.
09:09Who pointed a gun at you yesterday?
09:12It's old school.
09:15Old school?
09:17What's his name?
09:19I don't remember.
09:20It's old school.
09:23Okay.
09:24Why did he point the gun at you?
09:26It was a horse plane.
09:29He says old school was spinning a .22 caliber revolver on his finger.
09:34But did he ever just get the gun and point it at you?
09:37Yes, sir.
09:37Mm-hmm.
09:39Are y'all decent friends?
09:42I thought we were.
09:44He says he asked to see the gun, but then it broke while he was holding it.
09:48And old school got angry.
09:51Is it possible that this guy was so mad at you that he might have came back over to your
09:56camp?
09:57And must have took the guy in the tent as being you and maybe that did something bad to him?
10:05I think so.
10:05Mm-hmm.
10:07All right.
10:09Yeah, sit tight, man.
10:14I think Daniel was holding back.
10:16Probably because he's scared he lives out there.
10:18And so I think that he doesn't want to tell me everything he knows.
10:23But he referred to gentleman that goes by old school.
10:26McNeil circles back to the first witness, hoping he can give him old school's real name.
10:32Do you know a guy that kind of hangs out over there that has a gun?
10:38The only guy that I know with a gun is a dog.
11:01The witness says Todd's last name is Hibner.
11:06But at the same time, I don't know that Todd frequents that play.
11:09I don't know.
11:12I don't know.
11:13I think I killed him, son.
11:21Do you know if Todd and the dead guy at the camp maybe got into it the last few days
11:26or anything like that?
11:28I have not heard that.
11:30No.
11:32Does Todd stay in camps over there or is he usually at one of the hotels?
11:35Whenever I've gone to see Todd, he's always in the hotel room.
11:39So this is what I'm going to do, man.
11:40I'm going to give you one of my cards.
11:41Okay.
11:43If you hear anything else or can't think of anything else, people are going to call me.
11:49Yeah, because whoever did this, I want them to spend the rest of their life in prison.
11:53Because it's not going to be able to matter time for what it did done to me.
11:58All right, brother.
11:59Sit tight and I'll get you out, okay?
12:08So I think old school was going to be Todd Hibner.
12:12I think they're the same person.
12:15He's never been to prison.
12:17Never been convicted of a felony.
12:21Todd Hibner was detained, referencing a flare gun incident last year.
12:26This is some of the body cam footage of that incident.
12:29And this is Todd Hibner.
12:3155-year-old Todd Hibner was born in Wichita, Kansas, and moved to Broken Arrow, Oklahoma as a child.
12:39He's an independent fence contractor, and he has two adult sons and a daughter.
12:46Todd is known to have a gun in that area.
12:48But as of right now, we don't know if this is a murder or if it's a suicide.
12:52Hopefully, by tomorrow, the ME will have done the examination.
12:55If the ME says it's a murder, then that's going to be a person of interest we need to speak
12:58with.
13:06The next day.
13:08When the victim was found and our crime scene people went out there and looked at him,
13:13they couldn't tell if he had an intraoral gunshot wound to his mouth or not.
13:17And so we had to wait for the ME to rule.
13:20This morning, the ME did an examination of the victim
13:23and concluded that the victim had been shot once right above his left eye.
13:28So he ruled it a homicide.
13:31We're going to head back kind of to the area of the scene.
13:33As McNeil and Warren head out to talk to the taco truck owner who called 911.
13:40This morning, it's definitely a homicide.
13:43The rest of the team heads back to the crime scene to search for the second witness, Daniel.
13:49We really do need to re-interview the guy with this new information.
13:53It's not ideal, but we haven't really lost that much time.
14:11The tent's still here.
14:14Looking inside, it's cleared out. There's nothing in there at the moment.
14:19Mark and I may run back behind these hotels, kind of in the northeast of the Quick Trip.
14:24Kennedy and Brown will search other campsites in the area for Daniel.
14:28We have to find out who is mad at David.
14:38Okay, thank you.
14:40An hour later...
14:41Mark and I tracked down these urban campers and they told us that they actually saw David in his camp.
14:48They also told us that David had a girlfriend that was staying at his camp.
14:54They even went as far as to say that they heard gunshots and then heard this girl scream.
15:01They didn't know whether the girl was screaming due to David getting shot or maybe she had something to do
15:08with it.
15:15Hey.
15:16McNeil calls in with an update.
15:19The taco truck owners said Hibner came and bought a Coke and then walked over to the camp.
15:24And then a few minutes later walked westbound towards 169.
15:28And that would have been about 445 to like 515 or 530.
15:35Okay, that's pretty good information.
15:38John and Mark went over to another encampment and said they heard the gunshot.
15:43Around the 5 o'clock time period.
15:47Okay.
15:48Okay.
15:49I understand he usually stays around the hotels in this area.
15:52So we're over here at the OYO.
15:54We're going to talk to the manager at OYO.
15:57But I don't know if he came back to the hotels or he walked west and is out of camp
16:00somewhere.
16:01Alrighty.
16:03Thanks, man. Bye.
16:10Alright.
16:1018 hours in.
16:12How y'all doing?
16:14McNeil talks to the manager of one of the hotels near the crime scene.
16:26So Todd has a room over here at the OYO.
16:31Copy.
16:32I was going to get eyes on it and then try to catch him either going in or coming out.
16:42Minutes later.
16:43Alright, we're parked on the east side.
16:46Watkins and Ryden arrive with patrol officers as backup.
16:50What about just knocking and talking?
16:52And if he's in there, we'll pull him out and take him in and interview him?
16:56Alright, now he's just a person of interest.
16:58Yep.
16:59Yep.
17:00Let's do that.
17:02There we go.
17:12There's one down here.
17:20Come on, are you in there?
17:24Hey!
17:25There we go.

21:19they sit here and said that you got a drink from a taco stand and then they watched you walk
21:25over
21:26to where his camp was
21:29absolutely inaccurate never went to that camp that's a fact
21:36okay so why would people have nothing to gain
21:39about anything sit here and say that they watched you do this
21:42I don't know why people do anything out there anymore

22:41yeah
22:43you just don't have a witness that says
22:45hey I was there when this happened
22:46you just have a couple tents
22:48and a dead guy in the woods
22:51I mean this is a difficult case
22:54we'll need to find Daniel again and re-interview him
22:57then I need to figure out who the victim's girlfriend is
23:06we'll see
23:10then
23:12crime scene's back out at the scene
23:15McNeil gets a text from major crimes detective Stephen Boren

23:46Sherry I'm Detective McNeil
23:49so sorry for what you're going through
23:51kind of talk to me about your son
23:53because I've never met him
23:57he was a father and a dad
23:59and he turned into an alcoholic
24:02okay
24:03he would stay with me
24:06but then he wanted to drink
24:07and I wouldn't let him do that
24:09you know
24:10I said you need to quit
24:14hard kicking him out
24:16and he just ended up living on the streets
24:19but I kept telling him
24:21you're drinking
24:22and drugs
24:23I'm going to end up burying you
24:28did he ever say
24:29he was having any issues
24:29with people in his camp
24:30no
24:31no
24:32no because he wouldn't be there
24:33he was
24:34okay
24:35did he have a girl
24:36like a girlfriend
24:38that was staying
24:38yeah
24:40she gives him the name
24:42of David's girlfriend
24:44she always
24:46would hit him and stuff
24:49when she got drunk
24:50it got bad
24:54he's got scars all over him
24:57she had these little chickens
25:00and one of them kept taking off from her
25:02so she cut his foot off
25:05that kind of made me wonder about her
25:08you know
25:22but he would go back to her
25:24they act like they was in love
25:32okay
25:33when was the last time you actually
25:34talked to your son
25:37last week

25:51and he had asked if I would come pick him up
25:54I said I can't come pick you up
25:55I got physical therapy
25:58man
26:02I should have went

26:12all right
26:14thank you
26:18you can tell she's heartbroken
26:20probably wishes she could have tried
26:21done more to help her son
26:23but there's a lot of reasons
26:24why homeless people are homeless
26:26sometimes it's alcohol
26:28sometimes it's drug addiction
26:30but those people actually have loved ones
26:31they have mothers
26:32some of them have kids
26:33that love them and care for them
26:35so they're not going to look at
26:36their loved one
26:37as somebody that's been transient
26:38that lives out on the streets
26:39they're looking at
26:40that's my dad
26:40that's my son
26:41man
26:42you know that they're hurting
26:44it's a sad deal
26:50so
26:51more leads
26:52I got the name of the
26:53victim's girlfriend
26:55I'm trying to get a picture
26:56of this girl
26:56so we can go look for
26:57and try to grab her
26:58and bring her up here
27:05there she is

27:09witnesses said
27:10that they heard a female yelling
27:11just before they heard
27:12some gunshots
27:13so it's possible
27:15that the victim's girlfriend

27:19do you think the girl's a suspect?
27:21a suspect or a witness

33:37that dude
33:38he was like
33:39creeping around
33:40the woods
33:40I heard him
33:41I know he had been
33:42sitting there
33:42for a minute
33:43she says
33:44she and David
33:45saw a man
33:46outside the tent
33:48and
33:48they probably
33:49know each other
33:50or something
33:51because David
33:52said something
33:52about
33:52he had a gun
33:53or something like that
33:54and David warned her
33:56that the man
33:57had a gun
33:59and
33:59he just
34:00pulled it out
34:01and shot

34:21what did the gun look like
34:22I think it was
34:24I think it was
34:25like a revolver
34:2522 maybe
34:27he walked out
34:29and he walked
34:29towards the O'Reilly's
34:31and I walked home
34:32and I didn't tell
34:34him right
34:36can you remember
34:37any
34:37of the words
34:39that the guy

34:54that's crazy
34:55you know
34:55you're sitting
34:56in a tent
34:56and all of a sudden
34:56some guy walks up
34:57and she's
34:57David
34:58that's nuts
34:59that's somebody
35:00that'll probably do

35:02let that happen
35:04okay

35:38you
35:40she spit that out
35:42like what
35:42thirty seconds
35:44I believe what she's saying
35:46when you put
35:47everything together
35:49it clearly points
35:50to Todd
35:53she's saying
35:53it's a heavyset guy
35:54in his fifties
35:56everybody knows
35:56he carries a revolver
35:57the day before
35:59he's at the same camp
36:01messing around
36:01with the revolver

36:03a photo lineup
36:04containing Todd
36:05Hibner

36:42she picks out
36:43Todd Hibner
36:47I just signed
36:48that right there for me
36:52that's good enough
36:53for PC to snatch
36:54your mouth
36:54and bring him in
36:55yeah
36:55I think we're good
36:58she's saying that Todd
36:59didn't say much
37:00he pulled out the gun
37:00and just shot
37:02I gotta do some warrants
37:04but the search begins
37:16as the first 48 slips away
37:19and that witness says
37:20picked out Todd
37:21so we're gonna go
37:22over here
37:23and take a look
37:24the team checks the hotel
37:26where Todd Hibner
37:27was staying
37:37according to the manager
37:38Hibner left the hotel
37:40shortly after Kennedy
37:41and Brown
37:42brought him back
37:44we'll see what

38:00sir
38:02hey Tulsa police
38:03see if you know this guy

38:14okay
38:15take care
38:17the team
38:18will turn the search
38:19over to the fugitive
38:20warrants squad
38:21I think he may have
38:22called somebody
38:23and had a ride
38:24pick him up
38:30so he's flagged
38:32if patrol
38:33or anybody
38:33gets him tonight
38:34he will be arrested
38:35and then
38:37I'll give him
38:38opportunity to tell me
38:39why what happened
38:39happened
38:50in the first 48
38:52Tulsa homicide
38:54responded to the killing
38:55of 42-year-old
38:56David Drywater
38:57found shot
38:58in an urban encampment
39:00spoke to two witnesses
39:02who said Todd Hibner
39:03spends time around the camp
39:05and owns a gun
39:07interviewed Hibner
39:08who denied any involvement
39:10in David's murder
39:11tracked down David's girlfriend
39:13who said she witnessed Hibner
39:15shoot David
39:16and searched for Hibner
39:18but had been unable
39:20to find him
39:24the next day
39:32he had warned people
39:33we'll be able to locate Todd
39:34at another hotel
39:35a few miles away
39:36from where the murder happened
39:38and so
39:39we are now going to
39:40see if he's willing
39:41to talk to us
39:41and then if he is
39:42we'll go from there
39:47hey Todd
39:48how you doing buddy
39:50so my plan is to
39:52try to talk to you
39:53again about
39:54what happened that day
39:56I've talked to
39:57this guy's family
39:58and the question
40:00they keep asking me
40:00is the why
40:02okay
40:04you be willing to do that
40:10okay buddy
40:16he wouldn't talk
40:16with that as attorney
40:17so that's where
40:17we're going to leave it
40:19he is golden
40:20thank you guys
40:42it's very frustrating
40:44Dave is dead
40:45and the most important thing
40:46that people want to know
40:47is the why
40:48why Todd killed
40:49the victim
40:51unfortunately
40:51Mr. Hidmer
40:52decided to ask
40:53for an attorney
40:54and wouldn't say
40:55anything to us
40:57Dave's girlfriend
40:58told us what happened
40:59and so
41:00you know
41:00that's kind of
41:01what we have to go
41:01is what the girlfriend said
41:03I think David
41:04probably said something
41:05to Todd
41:06that set Todd off
41:08and then Todd
41:09just had a split reaction
41:10out of anger
41:12it's clear that
41:13Todd was a threat
41:14to a lot of people
41:15in that community
41:16it's good to have him
41:17off the street
41:26two months after David
41:28was killed
41:30my son Dave
41:32he could do anything
41:33except get sober

41:48I would tell him
41:49just get sober
41:50I'll help you get sober
41:52but he wasn't ready
41:55and his addiction got him
41:58never judge like a book
41:59by its cover
42:00because you never know
42:00what someone's going through
42:02deep down
42:03my dad was a good person
42:04no matter how much you make
42:06what kind of house you have
42:07everyone's still a person
42:08at the end of the day
42:12everybody out there
42:13living on the streets
42:14they all have a story
42:16and you know
42:17they're people
42:19they need help
42:25man
42:26it's really hard
42:28but I think he's at peace
42:30you know
42:33I love you David
42:35I love you David
