01:23Looking at it, you can tell if she wasn't hit by a car,
01:25she would be beaten up.
01:27It looks like it's gonna be a homicide.

01:39For homicide detectives, their chance of solving a murder is cut in half
01:44if they don't get a lead within the first 48 hours.

02:24We deal with a lot of high-end situations
02:26that perhaps a cop in a smaller town wouldn't get that kind of experience.
02:30I do like that about North Charleston, that you never know what's gonna happen.
02:35I feel that the community interacts very well with police.
02:38We've spent a long time building that trust.
02:42Well, I would say at least 50% of the people that we get in contact with
02:45I either know a family member or went to school with a family member
02:49or we actually grew up in the same neighborhood.
02:52And then be able to help these moms and dads and families members.
02:55I feel great about that.
02:57You have to have a servant's heart somewhere down inside of you.
03:00You have to come in here to say that I'm gonna serve people
03:02and that I'm going to be the one that's going to fight for those who can't fight for themselves.
03:07The team has a 73% solve rate, 20% higher than the national average.
03:13First thing that pops in my head when I think of the unit is unity.

03:19We all work together, always have each other's back.
03:22We're always there to help each other to accomplish the same goal.
03:25We all come from different backgrounds of life.
03:30We all have different years of experience in law enforcement.
03:34Sergeant Bailey just told me this morning he's got a pair of socks that are older than I am.
03:39Unlike some departments, North Charleston doesn't immediately assign a lead detective,
03:44approaching each case as a team.
03:46When we have a homicide occur, it could be a day or two later that we'll assign a case agent to it.
03:53And a lot of things come into factor with that.
03:56The connections that could be made on scene, you'll see that one detective has a stronger connection with the family than another detective.
04:04If it's going to be solved relatively quick, you're going to want to assign that to somebody that's going to be able to get everything together in a timely fashion.
04:11We're here trying to do the right thing, get justice for people.
04:14So right now we're heading over to the Tanger outlet area.
04:26We've got a female that's deceased in the bushes over near one of the hotels in between.

04:34So, you know, vulnerable people in bad situations.

06:45She said her friend left and never returned last night.
06:48The two witnesses are taken to homicide for questioning.

07:57She had three daughters, ages 29, 28, and 13, and a 16-year-old son who thought of her as the cool mom who loved to paint.
08:0613 years ago, she opened a carpentry store but struggled with drug addiction and ended up living on the street.

14:22She says when she was across the street, she heard the man yelling at someone near the hotel.

15:25They responded to an incident where the crazy guys were doing a fire extinguisher.
15:30Corporal Rob Van Tyn finds a police report about a recent disturbance at the hotel near the crime scene.
15:36So there's a call at some point last night involving somebody out there spraying people with a fire extinguisher.

15:47Robert Gardner.
15:48A hotel resident identified 42-year-old Robert Antonio Gardner as the alleged offender with the fire extinguisher.
15:57He wasn't caught.
15:59Matches the description of our suspect.
16:02Gardner was born and raised in Charleston.
16:05He has previous misdemeanor convictions for drug possession and shoplifting.
16:10Then, detectives get another lead.
16:14Female let us know that, hey, I have information about what happened last night.
16:18While canvassing for surveillance video, another resident of the hotel approached Corporal Tim Holley with possible information about the murder.

19:27A lot of times with a lot of these young ladies, they'll give us a little bit of information, but they won't always give us everything just because they don't want to be labeled as a rat or they don't want to get beat up or anything like that.
19:40So we can't push them too hard.
19:42Then they'll just shut down and then they'll walk out.
19:45So sometimes we have to kind of be careful.
19:49We want him in a lineup for Robert Gardner.
19:52We'll get a person who doesn't know anything about the case to create a lineup for us.

22:11So her statement combined with that statement combined with the video that we got, we can piece it all together to say that the person who said, I just got that bitch is the same person who ran into the wood line saying, I'm going to kill you.

22:34With all signs pointing to Robert Gardner as their suspect, the case is assigned to rookie detective Cam Miller as lead.

35:56A lot of people will just look at, like, she's just a homeless person that's around here.

36:04She had this whole life and got addicted to stupid shit that she just couldn't get off of.
36:10I've been on the side of that, the family members that have the addictions and stuff like that.
36:15And you want to be angry with them and tell them to get their shit together and sometimes they just can't.
36:22The victim's daughter, she's going to think about, like, had she just sucked it up and had her mom living with her and stealing from her, then maybe she would still be here.
36:31She doesn't have to take care of everybody else right now.
36:33She needs to make sure she takes care of herself and let other people take care of her when she needs it.
36:46Still lacking any direct evidence that Robert Gardner killed Kelly.

38:12He does go back to the hotel for killing her.
38:14I believe the video is great evidence for court.
38:20It's just frustrating not knowing exactly why this happened.
38:24But right now, I don't have a motive for why Rob did this to Kelly.
38:28She probably was in the wrong place at the wrong time.
38:31I don't think we'll ever know the exact reason of why someone would do something like this
38:37to someone who appears to be completely innocent and just be brutally beaten for no reason.
38:44With all the evidence and the witness statements that we have,
38:47I feel like we bring justice for Kelly.
39:01One time, for science class, she made slime.
39:20And she did it.
39:23And she came into the classroom dressed like a mad scientist.
39:35She had, like, wire hangers in her hair, braided it up into crazy little things,
39:41and then different colored socks and, like, a mad scientist trench coat.
39:46And was like, hey, kids, we're going to make slime today.
39:50And, like, everybody's like, man, your mom's so cool.
39:53When I was one years old, this was my birthday party,
39:58and my mom was helping me open all my birthday presents.
40:03And that's me.
40:05This was hers.
40:06She was a witch one year, and I put it on.
40:10I always wore her, like, shoes and hats and sunglasses.
40:15And she would catch me in her high heels sometimes,
40:18and she'd be like, better get those high heels up.
40:23I miss the way she laughed.

40:28I miss her, like, before she got, like, back into drugs.
40:33I miss her, like, being happy.
40:35I miss the moments before that when she was trying to be a mom.
40:39She was very loving and caring.
40:42It does suck that she wasn't in our lives, like, as much.
40:47I really do miss my mom and, like, the woman that she could have been.
40:52I was hoping that she would get better eventually, and that we would get to see her and stuff, and that she would, like, be more of a mother figure for us.
41:05I don't have a lot of, like, early memories of her before she started doing drugs and stuff.
41:12When she was in jail, she used to draw us pictures and put them in letters and then mail them to us.
41:18Like, Philip got, like, a little Iron Man.

41:22I feel like I did.
41:24A big sunflower, maybe?
41:25Yeah.
41:36This is my mom's urn, and I put a beautiful plaque on it.
41:42It says, I love you to the moon and back, because that's something she would always say.
41:45And she kept pictures of us to try and remind herself to do right.
41:52Mom seemed so happy with all of us kids around her.
41:57That's when she was the happiest.
42:01Whatever had a hold of her, she wasn't strong enough to fight it.
42:05But, you know, I never got that opportunity to see if my mom would actually stop with the things that she was doing.
42:17And because he took her life, I'll never know.
42:21But I like to hope she would've.
