AOTR URGENT ALERT: Family Separation — Immigrant Mother Detained, Newborn in State Custody

We stand with families, advocates, and community protectors demanding visibility, urgency, and accountability after the separation of Esther Lopez‑Sanchez from her newborn U.S.‑citizen daughter. Esther, who gave birth while in custody in Rutherford County, Tennessee, is now being held in an ICE detention center in South Louisiana — while her baby remains under the control of the Department of Children’s Services.

Esther reportedly had only two and a half days with her child before being transferred without her newborn. Advocates speaking with her daily say the separation has devastated her. Though her own charges were dropped, her fight to regain custody has been met with legal barriers, rejected family placements, and a system that routinely fails migrant and Indigenous mothers.

Attorneys emphasize that parents — regardless of immigration status — have the right to be heard in court and to advocate for their children. Yet Esther’s attempts to place her baby with relatives were denied due to their undocumented status, leaving her daughter in state care while Esther remains detained hundreds of miles away.

We take care of each other. We amplify the silenced. We demand justice, safety, and restoration for every parent fighting to be reunited with their child.

00:06Esther Lopez Sanchez is being held in ICE custody in Louisiana, while her newborn U.S. citizen
00:11daughter remains in the care of Tennessee's Department of Children's Services. She's
00:16pleading to be reunited with her baby. Advocates say Lopez Sanchez gave birth after going into
00:21labor inside the Rutherford County Jail, but was transferred to ICE just days later, without her
00:26child. Migrant advocate Zainab Al-Mathkor, who speaks with her daily, says the separation has
00:31devastated her. Lopez Sanchez was arrested in 2024 alongside her then-partner on drug and firearm
00:38charges. Her charges were later dropped, though he was convicted. Advocates argue she's fully capable
00:43of caring for her child, despite the father's record. Legal experts say custody decisions hinge
00:49on the child's best interest, and that parents, including migrants, must be given a chance to
00:54make their case in court. Lopez Sanchez has asked for her baby to be placed with relatives,
00:59but DCS reportedly rejected those options because the family members are undocumented.
01:04Lopez Sanchez has also raised concerns about conditions in both the jail and the ICE facility.
01:09ICE says a statement is forthcoming. DCS and the district attorney declined to comment due to
01:14confidentiality rules. Say her name, Esther Lopez Sanchez. This has been a message from AOTR.
