00:58I can't care if he's been shot in the face or if somebody hit him with something in the face, but it's all bloody in hell.
01:10It was mid-morning.
01:12I was at home when dispatch contacted me.
01:17And there was some incident in the Cushing area.
01:19Cushing's a very small town.
01:26It's one of those communities where you pretty well know everyone else.
01:33The victim's stepfather called 911.
01:35They gave me the address.
01:41They said the James Kelly residence.
01:45I knew Mr. Kelly.
01:47James is a lifelong resident of Cushing.
01:49You have to prepare yourself and your mind on what you may see, especially when you know the victim.
02:01I arrived on scene.
02:03I met with investigator vault.
02:07I went into the bedroom.
02:09The television was on.
02:14And I walked over to the bed.
02:18It was laying there under the cover.
02:21And I had to get up there pretty close.
02:25And I pulled the cover back.
02:30It was a mess.
02:31A center point was punched in on the face, and everything exploded out, almost like putty.
02:45The gunshots have been fired in a very close range.
02:49Something unique has occurred.
02:52You see something horrific like this, and you realize you know that person.
02:58It becomes personal.
03:01It was a very, very terrible day.
03:15Very terrible day.
03:17My stepdad, David, he said, there ain't no way to put it, but I believe your brother is no longer with us.
03:23He said that he had been shot.
03:25So, I put my boot on and took off up there.
03:33And then, you know, all the questions started running through my head.
03:38Who would do something like this?
03:40We're dealing with an individual that has suffered a gunshot wound to the head and is deceased.
04:00Is this an accidental shooting?
04:01Is it a suicide?
04:02Or is it a homicide?
04:03When the deputies get to the crime scene, they start looking around.
04:12Nothing is out of order.
04:14There hasn't been any sort of assault.
04:17There's no sign of forced entry.
04:19As we're looking in the room, there was what appeared to be a handgun near the body.
04:30A gun laying on the floor in that position could lend itself to suicide.
04:38There is no way he would do that.
04:42He had too much going for it.
04:46But we're able to determine that's actually a pellet gun.
04:50It's not a firearm.
04:53There could not have been a suicide.
04:54It's very apparent that James was shot as he slept in bed.
05:00It's a murder.
05:02There's no way to call this anything else.
05:05But he pretty well got along with everybody.
05:09As far as I know, he did not have any enemies.
05:14It was time to go to work for the family.
05:22James was my little brother.
05:24We were 15 months apart, so pretty much where you've seen one, you've seen the other one.
05:31Everybody around here called us the Crazy Kelly Boys.
05:37We had a great childhood.
05:40We'd always go fishing, water skiing, kneeboarding.
05:46I've known him since he was a kid.
05:49He was kind of a daredevil.
05:50If James seen a mud puddle, he's going to step in it.
05:56That was James.
05:59If he loved you, he loved you.
06:01He was going to have your back.
06:02James and his wife, Marseille, met at the party.
06:13James was 19 and Marseille was 22.
06:17Marseille had a big attitude.
06:21Just like James, she liked to race and drive fast.
06:24And, you know, if he thought that was sexy.
06:28Marseille did find him attractive.
06:32They felt like they were a good couple when you seen them.
06:41Marseille, she's notified that James has been shot.
06:44She's at her place of employment when the call came in.
06:50A friend of the family picks her up.
06:54They're driving towards Cushing.
06:57When they get pulled over for speeding.
07:00We call her fast driving.
07:01They'll know the way style.
07:02They're excessive.
07:04Annie Mildner.
07:06She is the one that exits the vehicle
07:08and then approaches the deputy
07:10before he can get out of the vehicle.
07:12She is just hysterical.
07:28Yelling, screaming.
07:35The officer realizes something's happened to her husband
07:39and she needs to get to the scene.
07:42Then it allows them to continue on.
07:45She got back in the car and drove on to Cushing.
07:56James and Marseille,
07:58it was definitely an on-again, off-again relationship.
08:02Before they were married,
08:05they had both been in previous relationships.
08:08They were a blended family.
08:11James had two sons
08:13and Marseille had three daughters.
08:19Marseille was a child herself
08:21when the oldest child, Shana, was born.
08:26I guess you could say Shana was a typical teenager, you know.
08:31Stepkids always have a hard time being introduced to a new dad.
08:38But I could see the pride in his eyes
08:40when he talked about his stepkids.
08:42James kind of just treated them all like his.
08:46He tried to give them everything that they wanted.
08:51I could tell he loved them,
08:52and he loved Marseille.
08:53James and Marseille,
09:06they end up getting married.
09:10Oh, the wedding, it was real nice.
09:13All of his friends was there,
09:15but it was real good.
09:17He was growing up, settling down.
09:19Very proud of it.
09:21James started his own trucking business.
09:28They had a number of vehicles.
09:30They had four-wheelers.
09:32They had jet skis.
09:35They seemed like a real, real happy family, you know.
09:41But you're on the outside looking in.
09:44What you see and what it really is
09:47is kind of two different things.
09:51It certainly wasn't all flowers, hearts, and unicorns.
09:56James and Marseille seemed at times to be very tight,
09:59and then they seemed at times to be very apart.
10:03They may be arguing at each other at the mud park one night,
10:07and the next time you see them,
10:08they're lovey-dovey that day.
10:10Just a roller coaster for their kids.
10:13It wasn't necessarily a good thing.
10:14We believed that Mr. Kelly was executed
10:24with the gunshot to the face.
10:27As we're looking in the bedroom where Mr. Kelly was,
10:34we started taking photographs of the scene.
10:37We're still trying to determine clues.
10:40Then a spot in the cell phone.
10:44It was lying on the floor near the foot of the bed.
10:50And something uniquely stands out to me.
10:54That call line on the end of the cell phone was still open.
11:00This is not normal.
11:02Why is it still openly engaged?
11:07There's nothing to indicate that James was on the phone
11:10when he was killed.
11:12It's just plain weird.
11:14Maybe there was a conversation taking place during the killing.
11:20One possibility was that the killer had used that phone.
11:24When the police find James' phone with an open line,
11:40it's highly unusual.
11:44We're going to get that telephone analyzed.
11:48Those phone records could hold some valuable information.
11:54Marcee arrives at home.
11:59She gets out very calm and collected, very nonchalant.
12:05Her behavior is very different
12:07from the way she had been acting when they were pulled over.

12:17James is laying in the bed with his face shot half off.
12:21And she's just as calm as a cucumber.
12:25This was really bizarre.
12:28She's not even asking questions.
12:31The rest of the family is very distraught.
12:34And Marcee goes and feeds the dogs.
12:39It made me mad.
12:45Is that all you can think about is your dog?
12:49Maybe she's just in so much shock
12:52that the body and the mind
12:54hasn't comprehended what happened yet.
12:56We start talking to the witnesses and the neighbors
13:05and the family members.
13:07The detective, Doug Richardson,
13:10took Marcee in the house, set her on the couch,
13:13and was asking her questions.
13:17Marcee was employed at a local hospital.
13:20She tells me that she goes to work
13:246 o'clock at night,
13:28speaks to James two or three times,
13:30and James tells her,
13:32I want to wake up at 7.30.
13:34Call me.
13:36At 7.30 in the morning,
13:40Marcee said that
13:40she went to call the home phone,
13:43and once James didn't pick up the phone,
13:45she contacted James' stepfather.
13:51My stepfather,
13:52I think he dead in the bed.
13:55There is no doubt
13:57Marcee had a solid alibi
13:58for the time of this shooting.
14:01But James' death
14:02wasn't the first tragic death
14:04in Marcee's life.
14:12There was a massive heat wave
14:15here in Texas.
14:19Some sort of short
14:21in the electrical system
14:22caused the house to catch on fire.
14:27Both Marcee's mother
14:29and Marcee's middle child
14:31were killed in that fire.
14:35Shana was 6.
14:38Shana was so distraught
14:40that she tried to end her own life.
14:43Even as a child.
14:47To lose her grandmother
14:48and her sibling,
14:50that's just a tragedy
14:52that most of us
14:53can't even imagine.
14:56And for Marcee,
14:57I can only imagine
15:00the tragedy of a mother
15:01losing their child.
15:02After the fire,
15:10Marcee quit
15:11doing things
15:13that moms should do
15:13as far as guiding their child.
15:16She's just lost one kid,
15:18so she wants the other kid
15:19to be happy.

15:24But whatever Shana wanted
15:25wasn't what she needed.

15:28she was asleep at the wheel.

15:32a pretty sorry parent.
15:42Once we saw the scene,

15:44it was an execution-style shot
15:46for sure.
15:48When you're looking
15:49at the type of crime
15:50that we're looking at,
15:51everybody's a suspect.
15:53It's as important
15:54to see who is at the scene,
15:56but just as important
15:57as who's not at the scene.
15:59The family
16:00has gathered around,
16:02close friends
16:02have gathered around,
16:03but Shana's nowhere.
16:07As we are collecting
16:08information
16:09from the individuals
16:10that are on the scene,
16:12we start to hear
16:13details about
16:15rebelliousness
16:16on his stepdaughter's part,
16:19conflicts between
16:20Mr. Kelly and Shana.
16:23People started
16:24coming forward
16:25and telling us
16:27Shana hated James,
16:30hated him
16:30with a passion.
16:32We needed to find Shana.
16:43Shana wasn't
16:45the typical ideal student.
16:46She was a wild child.
16:52She was the cool kid.
16:54She smoked.
16:56She drank.
16:58She had a boyfriend.
17:00She was 15
17:02and had her own car.
17:05Driving around
17:06with no driver's license.
17:10She was just running wild.
17:11Shana didn't abide
17:15by nobody's rules
17:16but Shana's.
17:21Investigators
17:22pretty quickly realized
17:23that Marseille and Shana,
17:25they didn't have
17:26a traditional
17:26mother-daughter relationship.

17:39Shana's staying out all night,
17:41partying,
17:42not going to school.
17:45James was not okay
17:46with Shana
17:48hanging out,
17:50getting high,
17:50and drinking.
17:53But her mother's
17:54validating all that behavior.
17:57After that fire,
17:58the special relationship

18:40her 15-year-old
18:41to be in a sexual relationship
18:44with an adult.
18:46Shana started a relationship
18:48with a Dallas Christian.
18:50He was 23 years old.
18:52Dallas had a terrible reputation.
18:54Dallas was a sex offender.
18:57He was everything
18:58a mother would not
19:00want her daughter
19:01to be involved with.
19:04He was a wannabe,
19:06Billy badass.
19:08A macho man.
19:10I don't think Marseille cared.
19:12Whatever was keeping Shana quiet

20:28for assault family violence.
20:31But it wasn't
20:32with her stepfather, James.
20:34The incident was
20:36between her and her mother.
20:43There had been some blow up
20:45over whether or not
20:46Shana was going to
20:47clean her room.
20:48It was like a match
20:50to kindling.
20:51It just lit up.
20:52Shana lost her temper.
20:56She shoved Marseille,
20:57pushed her into
20:58a glass door.

21:04there's blows exchanged,
21:05pushing and shoving
21:06and punching.

21:13somewhere.
21:14She spent the night
21:18in jail.
21:20Shana ends up
21:21on juvenile probation.
21:25Shana was so out of control.
21:29She was getting closer
21:30to the edge.
21:33Shana became
21:34a huge source of tension
21:35for James and Marseille.
21:37James and Marseille,
21:41they butted heads
21:42more and more.
21:48Marseille was a rebel.
21:51She didn't change
21:52her lifestyle
21:53after she had the kids.
21:56She still, you know,
21:58went out and partied,
21:59smoking and drinking.
22:01It was getting bad.

22:08it was two against one.
22:11The whole dynamics

22:14ready to explode.

22:27We needed to find Shana.
22:29It's very imperative
22:30that we speak to her.
22:32Law enforcement

22:35with Dallas Christian.
22:37They're not aware
22:38that they're being looked
22:40at as potential suspects.
22:42The two of them
22:43go to the sheriff's department
22:45to talk to the investigators.
22:48I interviewed Shana first.
22:55When I called this morning,
22:57nobody would tell me
22:58what happened to her.

23:02Yeah, I went home
23:02last night
23:03about nine o'clock.
23:05He got my clothes.
23:06I sat down with my dad
23:07and we talked
23:09for a little while
23:10and I asked him
23:12could I go stay
23:12at a friend's house.
23:14He just talked.
23:17He was like
23:18apologizing to me
23:19for the way he talks
23:21to me
23:21and I apologized
23:22for the way
23:23I talked to him.
23:25And that's the last time
23:26I talked to my dad.
23:27Once I established
23:33the baseline story
23:34with Shana,
23:35I went and interviewed Dallas.
23:37He's nervous.
23:49We start to see
23:50anomalies in their stories
23:52where the accounts
23:53that they're giving
23:54don't match each other.
23:56To me,
23:57it just
23:57signs of deception.

33:35corroborate

33:43Shana.

33:45unquestionable
33:46that in the
33:47hours leading
33:48up to
33:49James'
33:49murder,
33:51that Shana
33:51and Marseille
33:52are talking
33:53to each other.

33:56out those
33:57calls are
33:57to see
33:58when James
33:59has actually
34:00gone to
34:00bed so
34:01that the
34:02plan can
34:02be acted
34:03out.
34:04And then
34:05there was
34:05this mystery
34:06of the
34:07open cell
34:08phone lying
34:09on the
34:09floor near
34:10the foot
34:10of the
34:11bed.
34:12The
34:13investigators
34:14pretty quickly
34:14realized a
34:16shocking truth.
34:17I don't even
34:19think the
34:19devil would
34:20be that
34:21evil.
34:21when the
34:30deputies are
34:31looking at
34:31the crime
34:31scene,
34:32one of the
34:34things they
34:34find is
34:35James'
34:36cell phone
34:36with an
34:37open line.
34:42It turned
34:43out to be
34:44a call
34:45to Marseille.
34:48But James
34:49didn't call
34:49anybody,
34:51Shana did.
34:54It is
34:55truly our
34:56belief that
34:58Marseille was
34:59trying to hear

35:08nothing.

35:46thinking,

35:48get rid
35:48of mom's
35:49problem and
35:49my problem
35:50once James
35:50is gone.

35:55stuff like
35:55that.

36:01how it all

36:49We're unsure if
36:50we have enough
36:50evidence to
36:51convict Marseille of
36:51this crime.
36:56But all of a
36:57sudden, people
36:58start showing up
36:58at the Sheriff's
36:59Department.
37:00These really
37:01shocking
37:01allegations start
37:03appearing.
37:06Marseille had
37:07solicited them
37:08with the same
37:09type of items as
37:10payment, money,
37:13jet skis,
37:1418-wheelers.
37:15There was one
37:16young man who
37:17said, she took me
37:18in the closet and
37:20we had this
37:21conversation where
37:22she asked me if I
37:23would kill James.
37:24She asked me if
37:27I would do it.
37:29And I told her
37:30she was out of
37:30her mind.

37:40sitting in a
37:40courtroom with
37:41basically her life
37:42on the line.

37:45was, I didn't have
37:47anything to do
37:48with this.

37:58hadn't anticipated.

38:36that's the guilty
38:38party.
38:38And yes, she inspired
38:39these others to do it.

39:13But it didn't work.
39:15we end up having
39:17more than sufficient
39:18evidence to convict

39:38she never,
39:40ever tried to take
39:42any of the heat
39:42off of her daughter.

40:41manipulators.
40:44But I put all
40:46the blame
40:46on Marseille
40:47as the mastermind
40:49of this.
40:51The buck started
40:52and stopped
40:53with her.
40:54Hopefully,
40:55they'll stay
40:56exactly where they're
40:56at the rest of their lives.
40:57And you don't need
40:59people like that out.
