The High Court has dismissed an appeal by Datuk Seri Najib Razak and his son, Datuk Mohd Nazifuddin Najib, to stay bankruptcy proceedings against them.

The bankruptcy proceedings were initiated by the Inland Revenue Board (LHDN) following Najib and Mohd Nazifuddin's failure to settle tax arrears amounting to RM1.69bil and RM37.6mil, respectively.

00:25The tax arrears were for the period between 2011 and 2017. Judicial Commissioner Suhendran
00:33Sokhanathan, alias Saharan Abdullah, made the dismissal on Monday after finding that there
00:39was no reason to grant a stay. In his dismissal, J.C. Suhendran stated that the merits of a tax
00:46assessment were to be determined by the Special Commissioners of Income, Tax SCIT, and not by a
00:53court of law. He added that the court's role is only to facilitate the collection and recovery
00:58of tax, and the formula of pay now, dispute later, is again, to facilitate the collection
01:04of tax. An appeal to the SCIT, the judge said, did not prevent the collection process as it
01:11is within the framework of the Income Tax Act. The court also ordered Najib and Mohammad Nazifuddin
01:17to pay RM7,000 in costs, each.
