00:13Justice Everall Marriott Peters said there was no evidence the device was intended for the woman involved,
00:19nor any proof of sexual intercourse between them.
00:23She ruled that adultery requires proof of voluntary sexual intercourse and that mere innuendo or intimate gifts do not meet the legal threshold.
00:33The judge also dismissed the wife's claim that her husband's past affair in 2010 showed a pattern of infidelity saying it was legally inadmissible and unfairly prejudicial.
00:44In delivering her decision, Peters said both husband and wife contributed to the collapse of their 22-year marriage,
00:52with the wife displaying controlling tendencies and the husband aggravating her insecurities through neglect and emotional distance.
