No going home yet: ICC denies Duterte’s interim release request

00:10saying, quote, the court has put in place measures to ensure that Mr. Duterte's right to family life

00:15is guaranteed. The ICC Pretrial Chamber 1, which is handling the Crimes Against Humanity case

00:20against Duterte, believes all three risk factors were present. In the ICC, a suspect cannot be

00:26temporarily freed if he is found to have the following risks. On the first risk factor,

00:31the Pretrial Chamber considered Duterte's position of power and influence, as well as his and his

00:35camp's continued insistence that he was, quote unquote, kidnapped by the ICC. The fact that he

00:41won as mayor of Davao City in the last midterm elections, and that Vice President Sara Duterte

00:45is in office, led the Pretrial Chamber to say that Duterte, quote, appears to have the necessary

00:50political contacts, as well as to benefit from a network of support within that country.

00:54The Pretrial Chamber also says Duterte presented the second risk factor, which is that he may

01:00intimidate witnesses and jeopardize the investigation. It cites an instance where Duterte allegedly once

01:05briefed a Davao death squad witness before he appeared at the Senate in 2016. The ICC also cites

01:11the position of Davao City Acting Mayor Sebastian Duterte as one of the reasons why they believe Duterte

01:16presented the third risk factor, or the risk to kill or order to kill, more. Duterte is facing three

01:21counts of widespread murder before the ICC.
