01:20:37This is an initial parole consideration hearing for Darren West, CDC number J23239.
01:20:44On June 13th of 1994, the prisoner was received in the CDC pursuant to Penal Code section 1168.
01:20:52For violation of Penal Code section attempted murder on 187, first degree, Alameda County case number 114846.
01:21:02That was count one.
01:21:03There were two additional counts that were stayed.
01:21:06One was 12022.7.
01:21:09That was great bodily injury with the same case number.
01:21:12And also the use of a deadly weapon, 12022B.
01:21:16Again, the same case number.
01:21:18Mr. West, how do you feel about the act you committed?
01:21:24I don't feel good about it at all.
01:21:30Can you explain why?
01:21:32It was a selfish and inconsiderate thing to do.
01:21:36Do you now have insight into what happened and the tools necessary so that you don't act that way again?
01:21:42I do.
01:21:43I get counseling from my pastor who comes up to see me once a week.
01:21:47Let's take a look at your psychological evaluation.
01:21:51Inmate West takes full responsibility for stabbing his wife repeatedly.
01:21:59He showed good insight, noting his inability to communicate his feelings and self-centeredness.
01:22:06This inmate did seem genuinely penitent for his crime.

01:22:28The victim in this case, Lisa Aguilar, has traveled a great distance and at considerable cost to address this hearing.

01:22:45I think that with all this talk about counseling and repentance,
01:22:52it's easy to forget the reality of what happened.
01:22:56So, I brought pictures.
01:23:17And this is me today.
01:23:19This is what Darren did to me.

01:23:24I will never get paroled from this.
01:23:31Coming here today, I had to relive it all over again.
01:23:39Darren might not have succeeded in taking my life,
01:23:42but that doesn't mean he didn't change it forever.
01:23:45You see, when the police came to me after the attack,
01:23:49they had to convince me of his guilt long before he ever faced a judge and jury.
01:23:57And for the longest time, I didn't believe them.
01:24:00How could this man, who I thought cherished me,
01:24:03how could he hurt me, let alone want to kill me?
01:24:06After all, the last time I saw him, he was a loving husband.
01:24:10What the police were telling me seemed inconceivable.
01:24:13But I came to see it was true.
01:24:18This parole application, it's his attempt to make me again, a victim.
01:24:25But not only me.
01:24:37He's making a victim of his son as well, who is surely as innocent as can be.
01:24:42If Darren is released, we'll be looking over our shoulders every day of our lives.
01:24:52Is Darren going to finish what he started?
01:24:56Is he going to shadow his son's life for years to come?
01:25:00By commuting his sentence, you are sentencing us to live with that fear and uncertainty.
01:25:07Darren's crime is not over.
01:25:09We live it every day.
