00:00:00After the breakup, he assaulted you?
00:00:03Yes.
00:00:04I pushed her.
00:00:05She swung first, I swung back.
00:00:07She punched me in the face twice.
00:00:08After you put your hands on her.
00:00:10Judge.
00:00:11Hi.
00:00:11Case number 204, Brunello v. Trunell.
00:00:14Thank you, Kevin.
00:00:15Now, you have to tell me, are you Miss or Mr.?
00:00:19For the duration of this case, I will refer to as Mr. for legal terms.
00:00:23Mr. Trunell.
00:00:24Correct.
00:00:24Okay.
00:00:25Ms. Bumell, you and the defendant dated for how long?
00:00:29Two years.
00:00:29And according to what I read, during part of that period of time, you lived at your mom's house?
00:00:35Yes.
00:00:35From when to when?
00:00:36From January to May.
00:00:39Of what year?
00:00:392021.
00:00:40Had you lived with each other prior to that?
00:00:43Yes.
00:00:43Where?
00:00:44At his mom's.
00:00:45And how long had you lived at his mom's?
00:00:47About a year, once I turned 18.
00:00:49Prior to your moving into his mom's, were you ever together?
00:00:52Yes.
00:00:53Where?
00:00:53Well, we didn't live together.
00:00:55We were just, like, we were seeing each other, I mean.
00:00:57From when to when?
00:00:57From April to December of 2019.
00:01:01And then I moved in at the beginning of 2020.
00:01:03So, for a long time, did you have plans to marry and that you discussed it?
00:01:08Yes.
00:01:09True?
00:01:09We had those conversations, yeah.
00:01:10Great.
00:01:11This case actually has to do with funds that you put into a car that was supposed to be
00:01:18used by both of you, but since you didn't have a license, the car was put in your name.
00:01:23And the relationship took a bad turn, and you have the car.
00:01:27Is that right?
00:01:27Yes.
00:01:28And you, Ms. Pumel, want the money that you put into the car.
00:01:32Yes.
00:01:33We agreed that I would get my half of the money if he kept the car.
00:01:36Well, you didn't put in half the money.
00:01:38You only put in, according to you, a deposit.
00:01:40Yes.
00:01:40So, you're not entitled to half the car.
00:01:43At most, you're entitled to your deposit back, and that's what I have to determine.
00:01:47Now, Mr. Trunel, the allegation is that you filed a false restraining order against the
00:01:53defendant, and I believe you spent a little time in custody.
00:01:56Is that correct?
00:01:57Yes, they took me in and fingerprinted me.
00:01:59And that was after the breakup?
00:02:00Yes.
00:02:01All right, so let's go to the car.
00:02:02You were living with your mother when the car was purchased?
00:02:06Yes.
00:02:06Okay.
00:02:07Mr. Trunel, month and year the car was purchased?
00:02:09May of 2021.
00:02:11So, that was immediately prior to the breakup?
00:02:14Yes.
00:02:14What kind of car was purchased?
00:02:162014 Ford Focus SE.
00:02:18And the purchase price?
00:02:19We put down a deposit of $7,000.
00:02:22Total purchase of the car was just under $11,000.
00:02:25So, that was finance charge?
00:02:26Yes.
00:02:27On the car.
00:02:28Who financed the car?
00:02:29I did.
00:02:29Through what institution?
00:02:30My bank account.
00:02:31I was paying it through my debit card while I was working.
00:02:34I understand that, but what institution?
00:02:36Bank of America.
00:02:37What credit card?
00:02:37Bank of America.
00:02:38And what were the monthly payments?
00:02:39$200, around there.
00:02:40So, if the car was purchased immediately prior to the breakup, the plaintiff really didn't
00:02:46get any benefit or use of the car.
00:02:48Very little.
00:02:49Maybe at most 30 days.
00:02:51That'd be a fair statement?
00:02:52I'd say so.
00:02:53Fair statement?
00:02:54Yes.
00:02:54And how much, Ms. Buhlman, did you put into the car?
00:02:57I put in $6,000.
00:02:59Is that correct?
00:03:00Correct.
00:03:00I'd like to see proof that you put in $6,000.
00:03:03And then I also have bank statements.
00:03:15Sarah, would you do me a favor?
00:03:17Just add up these figures for me, please.
00:03:20I'd like to see the bank statement.
00:03:26There's one page that is not highlighted.
00:03:31Totals to $7,000, Your Honor.
00:03:33What is this that you gave me?
00:03:34My bank statements for what I paid at CarMax and then what I take out.
00:03:38I did because I did a cash deposit.
00:03:39So, everything I took out at the ATM, I put right in my cash flow envelope I had for savings
00:03:45for the car.
00:03:45But there are two CarMax transactions.
00:03:47I did it in cash because I was told that it would be cheaper if I did it in cash because
00:03:51it won't be taxed if it was compared to a card.
00:03:54Yeah, but these figures don't add up to the same thing as that.
00:03:57Well, he did pay a little because that is $7,000.
00:03:59No, no, no.
00:03:59But these figures, I have on the 13th of May, which is when this car was purchased, I have
00:04:07you took out $800, you took out $1,520, you took out another $100.
00:04:13Yes.
00:04:14I may be missing something, but that's all I see.
00:04:16No, and then, like I said, the ATM on the other two bank statements, it says $700, $800,
00:04:22and I believe in our $500 for everything I took out on cash for down deposit.
00:04:26I'm not following that.
00:04:27Are you understanding this?
00:04:28Take a look at this.
00:04:29Sure.
00:04:30You know.
00:04:30So she's saying that these PNC bank statements was cash withdrawals that she then used towards,
00:04:39I'm assuming, this large $5,380 first bill because the totals from this are only totaled
00:04:46to $2,420.
00:04:47Right.
00:04:48Well, that's all I have.
00:04:49That's your bank statement.
00:04:50This thing that you handed me first is actually unreliable because my 14-year-old child could
00:04:57make that up on a computer.
00:04:59I'm looking at your bank statement, which looks different from my bank statements, but I'm
00:05:03prepared to accept it.
00:05:04Do you have the invoice for the car that you purchased?
00:05:08I have the contract, the bill of sale.
00:05:10Contract.
00:05:11I'd like to see it.
00:05:20And I'd like to see your bank statement, please.
00:05:22I don't have bank statements with me.
00:05:24Any reason?
00:05:25In my search, there were no correlations on May 13th towards the purchase.
00:05:30Only records that came up were towards the insurance and car payments that followed after
00:05:35the date, so I did not believe it was reasonable for me to submit that as evidence.
00:05:38In the future, you should let the fact finder determine whether it's reasonable or not,
00:05:43right?
00:05:43Yes, Your Honor.
00:05:44Okay.
00:05:44Now, when you finance the car, what this requires you to do is to maintain insurance.
00:05:50Yes.
00:05:50And it requires you to maintain insurance for both liability and collision until the rest
00:05:56of the remainder of the loan is paid off.
00:05:58Yes.
00:05:58Did you?
00:05:59Yes.
00:05:59Good.
00:06:00Now, without going into anything else, the two of you are no longer together.
00:06:04We may have to get into that later on the protective order, but the car was totaled.
00:06:10Yes.
00:06:10After the breakup.
00:06:11Yes.
00:06:11And the car was totaled and insured so that there was payment by the insurance company.
00:06:16Yes.
00:06:17How much?
00:06:17$6,000.
00:06:18Do you have any proof of that?
00:06:20No.
00:06:20Now, when you received the $6,000, the balance of your loan was $7,000.
00:06:26When was the car totaled?
00:06:27September 29th of 2021.
00:06:29So you had the car for a few months and made a few payments.
00:06:32Yes.
00:06:33Okay.
00:06:33Well, this looks to me as if she put down most of the down payment.
00:06:38Yes.
00:06:39And that at most, you paid registration, tags, and a couple of car payments, which didn't
00:06:44total $6,000.
00:06:46Correct.
00:06:47Well, why didn't you give her the rest of the money?
00:06:48The...
00:06:49Are you following me?
00:06:50I mean, that doesn't seem like rocket science.
00:06:53It wasn't your money.
00:06:54The two of you broke up.
00:06:55And it's clear to me that you had a minimal investment in this dollar-wise.
00:07:02The reason I didn't was mainly because I was the only person that could hold onto the
00:07:06car and keep it legally.
00:07:08Because it was under my insurance, I was able to finance it from there.
00:07:11Okay.
00:07:12Well, what you should have said to me was, I got a check for $6,000, but the $6,000,
00:07:18didn't that have to go to Bank of America?
00:07:19Yes, it did.
00:07:20It went to Bank of America, went to my account.
00:07:22I used it towards paying off medical bills from the accident, and I used it towards rent
00:07:25from my home.
00:07:26Well, why didn't you use it towards paying off the car loan?
00:07:28The insurance company had paid off the rest of what I was owed to pay on the car to CarMax.
00:07:33They paid it off.
00:07:34Oh, so they paid it off, plus they gave you $6,000.
00:07:37No.
00:07:38Let me correct.
00:07:39I apologize.
00:07:40I'm very nervous.
00:07:41The insurance company, after the incident, had paid off the rest of what was owed to CarMax
00:07:46from me.
00:07:46Okay, so the insurance company paid off to the lender.
00:07:50Yes.
00:07:50Which was left, which was, let's say, $6,000.
00:07:53Yes.
00:07:53And in addition to that, they sent you a check.
00:07:56Yes.
00:07:56I used that check towards my bills, and I used it towards my rent.
00:08:00Okay, well, that you can't do, because that really wasn't your money.
00:08:02You didn't spend that money.
00:08:03Didn't you feel as if it was appropriate to give it back to her?
00:08:06I would have, if I wasn't in the situation that I was.
00:08:10What situation were you?
00:08:11I was injured after-
00:08:12Who is this?
00:08:13Is this your mother?
00:08:14Yes.
00:08:14Okay.
00:08:15Are you living with your mom?
00:08:16Yes.
00:08:17Okay, well, so you weren't on the street.
00:08:19I assume that you feed your child when you have to.
00:08:22He was actually taking care of me at that time.
00:08:25Oh, great.
00:08:26Well, if you had the money to take care of your mother, then you should have returned
00:08:29the money to her.
00:08:30So she's entitled to that money.
00:08:32You were compensated for it by the insurance company, and you had no right to keep it for
00:08:36your own bills.
00:08:37Okay.
00:08:38Got it?
00:08:39Yes.
00:08:39Easy.
00:08:41Easy peasy.
00:08:41Now, next is your allegation that he assaulted you and filed a false restraining order.
00:08:49Yes.
00:08:49Okay.
00:08:50So now let's jump to you are no longer living together.
00:08:53This is after May of 2021.
00:08:56You had an encounter, according to your papers, with the defendant.
00:09:00Tell me when and where that happened.
00:09:01So October 6th, at a Gloucester City Park, right down straight from where I was staying,
00:09:05so I walked there.
00:09:06And we both agreed for me to pick up my things, because he still has some of my belongings.
00:09:10Did you make the appointment to meet by text, by email?
00:09:15Yes.
00:09:15Text?
00:09:16Yes.
00:09:16Anybody have those texts?
00:09:18Um, let me see if I do.
00:09:19I do not.
00:09:20My phone was destroyed.
00:09:21I only have the text from when he texted me the car accident, when I said I was planning
00:09:25to take my car back.
00:09:26And right after that, I then plan to meet up with him to get the rest of my stuff back.
00:09:29Okay, well, you don't have the text involving that.
00:09:32Okay, so you did, in fact, meet at a park.
00:09:35Yes.
00:09:36How did you get there?
00:09:36I walked there.
00:09:37I was staying at a friend's house.
00:09:38How did you get there?
00:09:39I drove my mother's car.
00:09:40Okay.
00:09:40Now you're in the park.
00:09:41Tell me what happened.
00:09:42And this is in October.
00:09:44Yes.
00:09:44Go ahead.
00:09:45So we meet at the park, and he gives me my belongings.
00:09:47And then I asked him, because throughout the breakup and afterwards, I knew there were
00:09:53some things he was hiding from me.
00:09:54So I asked him if he was hiding anything, and to get some closure.
00:09:57I just wanted the truth.
00:09:58And so from then, he was getting a little frustrated about it.
00:10:01And I was just saying, I don't know what I did wrong.
00:10:03And then he threatened to hit me.
00:10:05And then I said...
00:10:06You said to him, I don't know what I did wrong.
00:10:08Yes.
00:10:08Because he moved out.
00:10:09Well, from the reason he told me we broke up, he said it was mental illness.
00:10:13And then I felt like I wasn't helping if I could do any more.
00:10:16I felt like I could have done more.
00:10:17Because I was very accepting of who he is now.
00:10:19And so since that happened, and I was so accepting of him, then he threatened to hit me.
00:10:24And I was very confused.
00:10:25And I just said, okay.
00:10:27And then he shoved it and swung at me.
00:10:29And at no time, did you hit him?
00:10:31After that, I did defend myself, and I did hit him.
00:10:33What did you hit him with?
00:10:34Just my hands.
00:10:35I pushed him just to get him off of me.
00:10:38Was he injured?
00:10:39By scratches, yes.
00:10:40Where?
00:10:41On the face.
00:10:41There was like two scratches I saw.
00:10:43And what about you?
00:10:44I had bruises on my shoulders, both shoulders.
00:10:46And then I had a swelling on my head.
00:10:48Either of you have photographs of the injuries?
00:10:50I do.
00:10:50I'd like to take a look at them.
00:10:51I told her that you need to understand that you did me wrong, too.
00:10:56She said, so what?
00:10:57I pushed her.
00:10:58She swung first.
00:10:59I swung back.
00:10:59We fought.
00:11:00She punched me in the face twice.
00:11:02So after you pushed her, according to you, she swung at you?
00:11:05Correct.
00:11:05Okay, well, you didn't expect her to give you a kiss after you pushed her.
00:11:09Did he discuss with you a co-ownership of the dog, which would mean that you would share
00:11:15the litters if the dog was bred?
00:11:17Yeah, he did.
00:11:18And you gave him no part of the $3,500?
00:11:21No.
00:11:21So, do you want to tell me what your defense is to this?
00:11:25Because your counterclaim is ridiculous.
00:11:28Ryan said he was the one assaulted.
00:11:31Either of you have photographs of the injuries?
00:11:33I do.
00:11:34I'd like to take a look at them.
00:11:39How did it end, the incidents in the park?
00:11:52So I just pushed him on the ground and I walked away.
00:11:54And where did you go?
00:11:55I first went back to his house.
00:11:57I did go to his house because he still had one of my big bags.
00:12:00Okay, so after this incident, you pushed him down.
00:12:02You went back to his house with him?
00:12:04No, with my friend.
00:12:06Well, your friend wasn't with you in the park.
00:12:07Yes, I walked to my friend's house.
00:12:09I let him know what happened.
00:12:10And then we drove to his house so I can get the rest of my belongings that I couldn't carry home.
00:12:15And what happened when you got to his house?
00:12:18So I told him, I said, hey, I'm sorry.
00:12:19I even put my hands up and I'm like, I just want the rest of my belongings back because I didn't think I would get it back.
00:12:24And so then he just told me, sorry, I told you I was mentally unstable.
00:12:27And I'm like, I just want my stuff back.
00:12:29And I grabbed it and I left.
00:12:30So you got your things back.
00:12:31Yeah.
00:12:32And you both said, I'm sorry.
00:12:33Does that sound correct?
00:12:34No.
00:12:35Tell me your version of, you had this argument in the park.
00:12:38We had an argument in the park.
00:12:39She was asking me questions about why the relationship had ended.
00:12:42I had explained that it was through emotional turmoil, mental illness, and that she was not being very supportive.
00:12:47She was very toxic and she was very aggressive with me.
00:12:50And when I had told her that I was going through all of this stuff and that I felt bad for things that happened in the relationship,
00:12:57I told her that you need to understand that you did me wrong too.
00:13:00She said, so what?
00:13:02I pushed her.
00:13:02She swung first.
00:13:03I swung back.
00:13:04We fought.
00:13:05We broke up the fight in the beginning.
00:13:06I apologized.
00:13:07Her items were on the ground.
00:13:08I picked them up.
00:13:08I handed them to her.
00:13:09She punched me in the face twice, post that, grabbed my hair, pulled it, and then we broke up the fight after.
00:13:15I got in my car.
00:13:16I went home first.
00:13:17She went back across the street to her friend's place.
00:13:19I was at the apartment.
00:13:21I was just talking to my landlords about some stuff that my mother and I had to take care of.
00:13:24I don't exactly remember.
00:13:25As I was coming back up from the apartment, her and her friend had walked up, threatened to charge me with assault,
00:13:32and demanded the $7,000 for the car then and there.
00:13:36I said I didn't have it.
00:13:37I apologized for what had happened.
00:13:38It didn't have it.
00:13:39You apologized for spending the money?
00:13:41Yeah.
00:13:41That's what part of the argument was about, back at your apartment.
00:13:44Well, there wasn't an argument on that.
00:13:46I apologized for it, but she still wanted the money.
00:13:48She demanded the money.
00:13:49Well, so the money was part of the argument.
00:13:53Yes.
00:13:53Did you both go to the police station?
00:13:55Yes.
00:13:55Yes.
00:13:56And who went first?
00:13:58I did.
00:13:58But you didn't go to the police station immediately after the incident.
00:14:02You went to the police station after she said she's going to charge you with assault.
00:14:07Yes.
00:14:07And do you have a copy with you of the police report that you filed?
00:14:11Yes, I do.
00:14:16You have a copy of the police report you filed.
00:14:24I do not.
00:14:24You do not.
00:14:25Okay.
00:14:26So, you were not injured.
00:14:28And what I'm putting together here is that you went to the police station and filed this
00:14:33because she had threatened to go to the police and charge you with assault.
00:14:37You went there, got there first.
00:14:40And you got there second.
00:14:41Is that right?
00:14:42And by the time you got there, is that the time they took you into custody?
00:14:45Yes.
00:14:46Okay.
00:14:46Did you ever, Mr. Trunel, seek medical attention for any of these injuries that I see in these
00:14:54photographs?
00:14:55No.
00:14:55The answer is either yes or no.
00:14:57No.
00:14:57And you do acknowledge, Mr. Trunel, that the initial aggressor, physical aggressor, which
00:15:05is what you testified to, let's go back to his initial testimony, Whitney.
00:15:09I believe he testified that, not sure, she was aggressive, she was loud, she wouldn't
00:15:15accept it, and he pushed her.
00:15:16But I'd like to get the exact wording.
00:15:19So, I told her that you need to understand that you did me wrong, too.
00:15:22She said, so what?
00:15:23I pushed her.
00:15:24She swung first.
00:15:25I swung back.
00:15:25We fought.
00:15:26Okay.
00:15:26So, after you pushed her, after you put your hands on her, according to you, she swung at
00:15:30you?
00:15:30Correct.
00:15:31Okay.
00:15:31Well, you didn't expect her to give you a kiss after you pushed her?
00:15:34No.
00:15:35All right, Ms. Buhlman, I really am looking at your complaint, and your complaint is seeking
00:15:41$6,000 in damages.
00:15:43Well, you already have, according to you, that money invested in the car, which he got
00:15:48back.
00:15:49So, you are entitled to that.
00:15:51And since that's the extent of your claim against the defendant, I'm granting your petition
00:15:56in the amount of $6,000 judgment for the plaintiff.
00:15:59We're finished here.
00:16:01This court is adjourned.
00:16:02There are a lot of factors going on, I believe, just between both of us.
00:16:05I'm just more than grateful to finally get this over with.
00:16:08I've been waiting too long.
00:16:09There's a lot of things that I had to work on, too.
00:16:12Fighting for it and put so much work and time into it.
00:16:15A lot of the things that were going on in my head was me being depressed, having to deal
00:16:18with a lot of what was going on in the world at the same time, too.
00:16:20Well, he was, like, trying on makeup and stuff when we were together, and I was showing him
00:16:25how to do makeup, and I was being very supportive and just telling him, you know, you should
00:16:28get help.
00:16:28Go get a therapist.
00:16:29I felt like she was pushing me away.
00:16:30And I don't know why he fought the other way around, because...
00:16:34We just both go our separate ways, and we both just try and be happy.
00:16:38I didn't know what to do, and what I was doing I thought was supportive.
00:16:42That must have been a very difficult breakup for both of them, after being together for
00:16:47a significant number of years.
00:16:49But that's tip number one of Judy Justice, is never put your hands on someone.
00:16:55And tip number two, never purchase property, dogs, cars, timeshares, with someone who's
00:17:03not your legal partner or without a contract.
00:17:06I mean, we've seen this time and time again.
00:17:08And those people who don't follow that advice have kept me in business for 27 years.
00:17:14We'll keep telling them that.
00:17:15You're right.
00:17:16Case number 2021, Parker v. Miles.
00:17:19All parties, please step forward.
00:17:21Frankie Parker is suing his tenant, Miranda Miles, for the cost of a French bulldog.
00:17:27Mr. Parker, this case is about a puppy that you allegedly sold to the defendant.
00:17:32Yes, ma'am.
00:17:33That you want to be paid for.
00:17:34She has some sort of nonsense counterclaim.
00:17:36Yes.
00:17:36Which I will get to and resolve quickly.
00:17:40Great.
00:17:41So, Mr. Parker, you have a home that has two units in it?
00:17:45We have a triplex.
00:17:46So I have a, it's a house, and then it's a triplex behind the house.
00:17:49So you live in the main house.
00:17:51Yes.
00:17:52Behind the main house, there are three units.
00:17:54Yes.
00:17:55When did you rent one of the three units to the defendant?
00:17:59I rented it to her around February.
00:18:02I think I put the ad in early February.
00:18:04Of what year?
00:18:05Of 2022.
00:18:07Is that correct, Ms. Miles, that you moved into the unit in approximately February of 2022?
00:18:14It was March, but...
00:18:15You put the ad in in February.
00:18:16Yes, ma'am.
00:18:17Moved in in March.
00:18:18And what was the rent that you had?
00:18:20$1,250.
00:18:21You have children?
00:18:22Yes.
00:18:22How many?
00:18:23One.
00:18:23How old?
00:18:24Nine.
00:18:25According to what I read, you decided to go into the dog breeding business.
00:18:30Yes, ma'am.
00:18:31You knew nothing about dog breeding.
00:18:33Well, I know about dogs, but I didn't know about French bulldogs.
00:18:36That was kind of new to me.
00:18:37What is your regular business, sir?
00:18:39Property management.
00:18:40Other than the property that you live in, do you have any other property that you manage?
00:18:44Yes, ma'am.
00:18:45You're really supposed to be sort of an expert before you go into the breeding business.
00:18:49Yeah, I had a lot of help.
00:18:50That's sort of a foolhardy thing.
00:18:52I had a lot of help.
00:18:53I wasn't by myself.
00:18:54I had people that was already breeding.
00:18:56They had 20 years, 30 years experience.
00:18:57Okay, so you had somebody to give you sort of instructions.
00:19:00I didn't just jump into it.
00:19:01Yes, ma'am.
00:19:02And you decided to breed French bulldogs.
00:19:04Yes, ma'am.
00:19:05You purchased your first two French bulldogs, a male and a female, when?
00:19:09I purchased them around January.
00:19:12Of 2022?
00:19:13Yes, ma'am.
00:19:13And then you bought another one.
00:19:15Yes, ma'am.
00:19:16Another good female.
00:19:16When did you purchase the other one?
00:19:18I bought the other female around February.
00:19:21Okay, that's about the same time that you posted an ad for this unit that you moved into.
00:19:27Yes, ma'am.
00:19:27All around the same time.
00:19:28And that dog, I believe, based upon my recollection and my memory isn't what it used to be, I think
00:19:34the dog's name is Dulce.
00:19:35Dulce, yes, ma'am.
00:19:36How old was Dulce when you purchased her in February?
00:19:39She was approximately three months.
00:19:42How much did you pay for her?
00:19:44I paid $3,200 for her.
00:19:46And did you have AKC papers for her?
00:19:48Yes, ma'am.
00:19:48Now, according to your complaint, when the defendant moved in, she moved in in March,
00:19:52she moved in with a nine-year-old daughter.
00:19:54The nine-year-old daughter saw this dog, Dulce, became attached to the dog, fell in love with
00:20:00the dog, and the defendant agreed to purchase the dog.
00:20:04Yes, ma'am.
00:20:04And you acknowledge that you agreed to purchase the dog.
00:20:07Yes.
00:20:08In March of 2022, how much did you agree to pay Mr. Parker for the dog?
00:20:15When I rented the apartment, he told me $2,500.
00:20:18No, that's not true.
00:20:20He said $3,500.
00:20:21Shh.
00:20:22He comes to my house, knocks on my door randomly all the time.
00:20:25He put cameras on my neighbors.
00:20:27Listen to me.
00:20:27I don't have the money.
00:20:28Listen to me.
00:20:28Well, that's, again, not his problem.
00:20:30He wants his rent on time, and he would like to be paid for his dog.
00:20:33Yes, ma'am.
00:20:37From when to when?
00:20:38From October 7th to April 1st.
00:20:41Actually, May, May, May.
00:20:42And it is your claim that Miss Carter vandalized a certain property of yours.
00:20:47Yes, ma'am.
00:20:48Most specifically, a very expensive couch.
00:20:50Yes, ma'am.
00:20:51Because you had an argument, and that during the course of this argument, her dog bit you.
00:20:55Yes, ma'am.
00:20:55And for breaching the lease, because she left.
00:20:58Yes, ma'am.
00:20:59Okay, but it was a good thing that she left, right?
00:21:00Yes, ma'am.
00:21:01You were happy that she left.
00:21:02Her dog bit you.
00:21:03She vandalized the sofa.
00:21:04You were very happy that she left.
00:21:05You were very happy.
00:21:06So we're going to eliminate that breach of the lease part.
00:21:09No.
00:21:10Oh, yes.
00:21:11We're going to eliminate the breach of the lease part because you were happy that she left.
00:21:14I didn't want her to live in the same situation as her, but being that the rent was so expensive,
00:21:20it wouldn't have been my best interest for her to leave.
00:21:23It's to stay with her dog that bit you.
00:21:26Right.
00:21:26I mean, I don't want you to sound ridiculous to me, okay?
00:21:28Right.
00:21:28All right.
00:21:29Let's not sound ridiculous to me.
00:21:30A normal person, if they were bitten by their roommate's dog, and if their roommate vandalized
00:21:36their property, that roommate would be happy to see them go.
00:21:39But I'm not happy with the expensive rent by myself.
00:21:43Well, of course, but your choice would be staying with her and her dog that bit you.
00:21:48But if her name's on the lease...
00:21:49Just a second.
00:21:50That's between her and the landlord.
00:21:52I just told you, I'm sticking with vandalizing and dog bite.
00:21:58So tell me when this dog bite took place.
00:22:01It's on March 29th.
00:22:04What kind of dog was it, by the way?
00:22:05It was a Belgian Malinois.
00:22:08What do they look like?
00:22:09It looks like a German Shepherd.
00:22:10Is that what you have, Ms. Carter, a Belgian Malinois?
00:22:13Yes, Your Honor.
00:22:14A Belgian Malinois, like a police dog.
00:22:16So it looks like a German Shepherd?
00:22:19Yes, ma'am.
00:22:19So it's a large dog?
00:22:21Yes, ma'am.
00:22:21And when you moved in together, you moved in with the dog?
00:22:24Yes, Your Honor.
00:22:25Okay, so tell me what happened March 29th.
00:22:28Okay, so before March 29th, Adrienne and I got in a petty argument.
00:22:32It was dumb.
00:22:33We made up.
00:22:34In the argument, she confessed to me that...
00:22:36No, just a minute.
00:22:37You engaged in a petty argument, and then you made up.
00:22:40Yes.
00:22:40And the petty argument was on what date?
00:22:42It was on March 27th.
00:22:43And you made up?
00:22:44Yes.
00:22:45Okay.
00:22:45On the 27th, what were you arguing about?
00:22:48My dog tore up the carpet, and she sent this long paragraph,
00:22:51and we were just going back and forth, and we realized it was dumb.
00:22:55So we decided to drop it, and that's when she confessed to...
00:22:59On the 27th?
00:23:00Yes, ma'am.
00:23:00So you were arguing about the dog, and then on the 27th,
00:23:04after you were over the argument about the dog,
00:23:07is that what you're telling me?
00:23:08Yes, ma'am.
00:23:09Be very careful.
00:23:10Yes, ma'am.
00:23:10Go ahead.
00:23:11She confessed that she gave the guy that I was seeing a lap dance.
00:23:15And?
00:23:16And I immediately cut all ties with her.
00:23:17So you cut all ties with her how?
00:23:19I stopped speaking to her.
00:23:21Even though you were roommates?
00:23:22Yes.
00:23:22Okay.
00:23:23After I stopped talking to her, social media posts were made.
00:23:27By whom?
00:23:28Agent.
00:23:29Okay.
00:23:29Social media posts were made.
00:23:31Do you have those?
00:23:32No, I do not.
00:23:32Do you have those?
00:23:34Yes, Your Honor.
00:23:35Okay.
00:23:35Why don't you have them if this is your case?
00:23:37They erased, but I have other things that I think you would want to see.
00:23:43I'm going in order.
00:23:44This is a case.
00:23:45Right.
00:23:45So don't try to creep into my mind.
00:23:48You've been saying your complaint a couple of days later,
00:23:50there were things posted on social media.
00:23:53And is what you're telling me that they were erased?
00:23:56Right.
00:23:56I didn't save anything that she posts.
00:23:58Oh, never mind.
00:23:59I don't have to see anything.
00:24:01Correct?
00:24:01Correct.
00:24:02So you didn't save anything?
00:24:03No, ma'am.
00:24:04Then you have no evidence of anything that happened late.
00:24:06So I saw that she had no remorse for what she did.
00:24:09Then I made social media posts.
00:24:10Adrienne was mad that I made social media posts.
00:24:13So the next morning, she's yelling at the top of her lungs at 10 in the morning.
00:24:17I wake up to see what she's yelling about.
00:24:19And she's just saying how I'm a...
00:24:22And I shouldn't have posted what I posted.
00:24:25And we were just arguing about the situation.
00:24:27And I asked, how could she do this to me?
00:24:29It was a very heated argument.
00:24:30She was yelling at the top of her lungs.
00:24:31I was yelling at the top of my lungs.
00:24:32During the argument, her dog is going crazy.
00:24:36And while we were arguing, we were pretty close.
00:24:38The dog bit me.
00:24:39And I said, you need to get your dog.
00:24:40She said, no, your dog is good.
00:24:42And we continued to argue.
00:24:43The dog came to bite me again.
00:24:45And that's when I grabbed what was behind me, which was a paper towel holder.
00:24:48And I chucked it at the dog.
00:24:49So the dog bit you on the arm?
00:24:51Yes, ma'am.
00:24:51Twice.
00:24:52Okay.
00:24:52I would like to see a medical report on that.
00:24:55Okay.
00:24:55All right.
00:24:56I have a photo of the bite, the antibiotics.
00:24:59And then this is the report.
00:25:02Would you show this to Ms. Carter, please?
00:25:16Your Honor, I know she has a video of the entire incident, if you'd rather.
00:25:19It's not her obligation to prove your case.
00:25:22As my law clerk so aptly told me, the last case, not her obligation, it's your obligation.
00:25:28Okay.
00:25:28So, go ahead.
00:25:33After her dog bit me, I immediately grabbed my dog and I go to the hospital.
00:25:37I filled out an animal.
00:25:38What kind of dog do you have?
00:25:39I have a Doberman.
00:25:40Where was your Doberman when this was going on?
00:25:42He was in the cage and he's still a baby as well.
00:25:44So I went to the hospital, got treated.
00:25:47While I was at the hospital, Adrienne called the police and she said that I attacked her dog.
00:25:52Don't tell me what she said to the police unless you have a police report.
00:25:55Yes, ma'am, I have a police report.
00:25:56Then I'd like to see the police report.
00:25:58That's an official business record.
00:26:00So this is the first police report for the dog bite.
00:26:11Okay.
00:26:12Go ahead.
00:26:13All right.
00:26:13So April 19th, this day Adrienne knocked on my door.
00:26:17No, April 19th?
00:26:18What was April 19th?
00:26:19I thought you moved out on April 1st.
00:26:21No, she moved out on April 19th.
00:26:23So is what you're saying, after all this altercation, she moved out?
00:26:28Yes, ma'am.
00:26:28And stayed in the apartment with her dog from the 29th to April 19th?
00:26:34Yes, ma'am.
00:26:35And I went to a friend's house the day the dog bit me and then I went home for a week and
00:26:40then that's when I came back and this second incident happened.
00:26:42So after the dog bit you, you did not go home.
00:26:45You took your dog and left?
00:26:48Yes, ma'am.
00:26:48And stayed at whose house for a week?
00:26:50I stayed at a friend that lives an hour away from my current apartment.
00:26:53On what day did you return?
00:26:54So I stayed one night at a friend's house and then I returned and then I went home for
00:26:58a week.
00:26:59So...
00:27:00When you went...
00:27:00Stopped playing with papers.
00:27:02Yes, your honor.
00:27:03When you went home for the day, was the defendant at home?
00:27:07Yes, ma'am.
00:27:07Did you have any conversations with her?
00:27:09No, ma'am.
00:27:10Just stayed out of her way and packed a few things and left?
00:27:13Yes, ma'am.
00:27:13And you went to stay...
00:27:14At home in Alabama.
00:27:16With your family?
00:27:17Yes, ma'am.
00:27:18Until things cooled down, basically.
00:27:19Okay, and when did you go back?
00:27:21I went back, I believe, April 17th.
00:27:23And what happened when you went back on the 17th?
00:27:25A few days later, April 19th, Adrienne was knocking on my door at 9 a.m. in the morning
00:27:31saying that I need to come to the leasing office because there's a new roommate here.
00:27:35I told her no and then that's when she started threatening me and calling me all these kinds
00:27:40of the names, so I take my dog again, I go outside and I call an officer and that's also
00:27:45when I call my mom and she convinced me to go up there to speak with a new roommate to
00:27:51see, you know, who they were.
00:27:52What new roommate?
00:27:52Just a second.
00:27:53She tried to get two young girls to replace her on the lease.
00:27:56And it was unsatisfactory?
00:27:58Yes, ma'am.
00:27:58So far, I have a dog bite.
00:28:00And?
00:28:01Yes, ma'am.
00:28:01Couch.
00:28:02So, after I said no to the two roommates, one didn't have a job, they looked young, I
00:28:07said no.
00:28:08I went back home.
00:28:09Ten minutes later, Adrienne comes.
00:28:10Home?
00:28:11You mean to your folks house?
00:28:11To our apartment.
00:28:12Oh, to your apartment.
00:28:13Yes, ma'am.
00:28:13Okay.
00:28:14So, ten minutes later, Adrienne comes in.
00:28:16I was in the room with my door locked.
00:28:18I hear Adrienne yelling, I hear her throwing things.
00:28:21She's saying, I can't believe you did that, you really just did that, I don't care, I'm
00:28:25still moving out, I'm still leaving, I'm not paying rent, blah, blah, blah.
00:28:29I didn't come out the room because last time it got crazy, so I just said I would let her
00:28:34do what she does and I will let the authorities handle it.
00:28:37She did come out the room, you're on.
00:28:39When I finally came out the room, which I have a video, and it came out, she had a
00:28:43move the couch in front of the door, so I couldn't get out of my room, and...
00:28:47Well, how did you get out?
00:28:48I jumped over it, and the trash can was flipped upside down.
00:28:52I have pictures of all the damage that she did to the house and videos.
00:28:55Well, I'd like to see them, please.
00:28:57And I would like to see the damage to the couch, which is your major complaint.
00:29:02Okay, so this is the damages, and then I have a video of the entire incident right here.
00:29:13Want to tell me how that happened?
00:29:15I did put chips and items that wasn't wet on the couch out of anger.
00:29:20I shouldn't have did it, but I did do it, and I didn't put liquid on it or anything.
00:29:24Literally, you can...
00:29:25I got your daughter.
00:29:25Don't speak.
00:29:26You had no right to even attempt to destroy it.
00:29:29At all.
00:29:30Later.
00:29:30So at that moment, I was like, you know what?
00:29:32I'll just do it myself so we can stop the confrontation.
00:29:34So then that's when the argument started, and he thought that I was kicking him out,
00:29:38which I never told him he couldn't come over, never told him he couldn't be a part of anything.
00:29:41It's a failed business venture where you both expect...
00:29:44It's not a business venture.
00:29:45Hey, this is not a tea dance.
00:29:48By the way, did you have any unreimbursed medical bills as a result of this dog bite?
00:29:53That's either a yes or a no.
00:29:54No, ma'am.
00:29:58When did you purchase this couch?
00:30:00I purchased it the day we moved in, so it was October 7th.
00:30:02How much did you pay for it?
00:30:03I paid $2,200 in total, and Adrienne and I were paying on it a little bit in the beginning,
00:30:09but there came a time where we had to make the final payment on it, which was $1,200.
00:30:13When we had the argument, she didn't pay anything, so I had to pay it all by myself.
00:30:16And the couch is in my name.
00:30:18Did the couch remain?
00:30:19Yes, ma'am.
00:30:20The couch is at the house.
00:30:21What does it look like now?
00:30:22It's black, but there's an odor coming from the couch, and there's some stains on it.
00:30:26Do you have a picture of it, what it looks like now?
00:30:28No, ma'am.
00:30:29I just have the pictures that I gave you.
00:30:30Okay, but you're still using the sofa.
00:30:33The answer is...
00:30:34It's a smell.
00:30:34No, ma'am.
00:30:35I don't sit on it anymore because it's a smell.
00:30:37So why don't you get rid of it out of the apartment?
00:30:38I'm moving October 6th, and that's when I plan to get rid of it.
00:30:41But you've been using it since April.
00:30:43It's just been sitting there, Your Honor.
00:30:45I haven't had time.
00:30:45Well, sitting in your apartment since April.
00:30:47Yes, ma'am.
00:30:47April May.
00:30:48I just haven't made the time to get rid of it because I know I'm moving soon,
00:30:51and that's when I plan to get rid of it.
00:30:52I wouldn't keep something in my house that smelled.
00:30:55I work a lot, and I...
00:30:56Would you please show this to the defendant?
00:31:02I don't know.
00:31:03I don't know.
00:31:04I don't know.
00:31:05You want to tell me how that happened?
00:31:13I did put chips and, like, items that wasn't wet on the couch out of anger.
00:31:18I shouldn't have did it, but I did do it.
00:31:20And I didn't put liquid on it or anything.
00:31:23Literally, you can...
00:31:24That's not your honor.
00:31:24Don't speak.
00:31:25You can get a napkin and wipe it off.
00:31:28But that's my couch, too.
00:31:30Maybe I didn't pay the whole thing on it, but I've made payments on that couch,
00:31:33and I decided not to do that full payment that she did, which was $600,
00:31:38because she was irresponsible and decided to rent a couch
00:31:41and found out that that couch was whatever amount.
00:31:44Well, I made payments on that couch, and I have proof for it.
00:31:47That's okay.
00:31:48You had no right to even attempt to destroy it.
00:31:51At all.
00:31:52At all.
00:31:52You had no right to do that.
00:31:54Right.
00:31:54Because that devalued the sofa.
00:31:56I agree.
00:31:57Okay, good.
00:31:58Okay.
00:31:59I'm actually finished with you.
00:32:01Your Honor, can we please go back over the lace portion of this?
00:32:03Can my mom speak about what happened?
00:32:05No.
00:32:05I said no.
00:32:06When there's that kind of acrimony, I actually think that before somebody gets seriously injured,
00:32:12when you have two large dogs and two people with hot tempers that can do this,
00:32:16it's a very, very good thing that they no longer live together.
00:32:20Being stuck with a rant and...
00:32:22Just a second.
00:32:23I've just answered you.
00:32:24This is not a back and forth.
00:32:26Yes, sir.
00:32:26On the dog bite, I am awarding you $1,000.
00:32:29It looks as if part of it was a black and blue mark.
00:32:32Certainly, I can't blame the dog for trying to protect its owner,
00:32:36but she's supposed to have control of her dog all the time.
00:32:38And she shouldn't start our argument.
00:32:39So, this is not a tea dance.
00:32:41I'm not asking you anything.
00:32:43And I'm awarding you $1,200 for the sofa.
00:32:45That's $2,200.
00:32:47Judgment for the plaintiff.
00:32:48We're finished.
00:32:49Thank you very much.
00:32:49What is your journey?
00:32:51She just did something messed up, and I cut her off, and she didn't like it.
00:32:54I literally cut her off.
00:32:55She's just mad that she's cut off.
00:32:56She's delusional.
00:32:57She's delusional.
00:32:58She's childish.
00:32:59She's irresponsible.
00:33:00And I was just sick of dealing with someone draining.
00:33:02Just don't get roommates with your friends.
00:33:05Just move in by yourself.
00:33:07I'm happy.
00:33:09You had a question about the lease.
00:33:11I did.
00:33:12So, I agree that it was best for the acrimonious situation for them to separate and not to live there.
00:33:17So, I understand your judgment saying it was better for you.
00:33:20You got the good end of the stick on that that she left.
00:33:23However, the law, if you breach a lease, she did get stuck with a higher portion of rent because her roommate,
00:33:29although a negative situation that should have probably ended right when it did, she was stuck paying her half as well.
00:33:35So, I thought you should have at least heard her claim on the breach of a lease because then anyone could just say,
00:33:40oh, well, I don't like the situation, and I feel like leaving would be a better thing,
00:33:44and stick their roommate with their portion of the rent, and that's not what the law says.
00:33:47Well, that's true, except that this wasn't just a situation where parties weren't getting along.
00:33:52There's no question that she was nipped by the defendant's dog.
00:33:57Well, I wouldn't want to stay in that situation anyway.
00:33:59Well, that would give her the right to maybe leave without paying her half of the rent, but that's not what happened.
00:34:04It's also sort of acknowledged that the defendant brought two other people to take over her piece of rent,
00:34:12and it was in the papers, and the plaintiff did not...
00:34:15She did say that she was the one that said no.
00:34:18She said, I don't want those two people.
00:34:19Well, then the onus really falls on her to mitigate her damages,
00:34:23and she had no proof that she went forward to try to get another roommate.
00:34:28Between the two of them, they may have had an agreement,
00:34:30but the dispute over rent really is the defendants and the landlords.
00:34:35She doesn't pay her rent, and if the plaintiff pays her half of the rent,
00:34:38the landlord is free to go against either or both of them.
00:34:41Sure, because both their names were on them.
00:34:42Right, and the lease.
00:34:43Understood.
00:34:44Case 2083, David v. Barun.
00:34:46All parties, please step forward.
00:34:48Joseph David is suing his former friend, Jonathan Borum, for podcast equipment.
00:34:54Mr. David, your claim that the defendant has acoustical equipment
00:34:59that you purchased for what looks to be a joint venture in Mr. Borum's music podcast.
00:35:06Yes, ma'am.
00:35:06You were making this music podcast in the basement of your house?
00:35:10Yes, Your Honor.
00:35:10Starting in what year?
00:35:12This year of March.
00:35:13And, Mr. David, you were friends.
00:35:15You knew each other, and you knew he was in this business.
00:35:17I don't know.
00:35:17What is your business?
00:35:18I deliver bread.
00:35:20I'm a bread vendor.
00:35:21What kind of interest do you have in music?
00:35:22Because that's what he was doing.
00:35:24Well, me and Jonathan have known each other for 20 years.
00:35:27Jonathan and I have known each other.
00:35:28Jonathan and I have known each other for 20 years, and he's always been in the music scene.
00:35:33He's an artist himself.
00:35:34Well, that's what I gather.
00:35:35What about you?
00:35:37I was just a supportive friend in it.
00:35:39Okay.
00:35:39Well, clearly, you spent some money on music equipment, so it was more than being a supportive
00:35:44friend.
00:35:45If you were just being a supportive friend, then you made a gift to him of this music equipment.
00:35:49No, ma'am.
00:35:50You decided you wanted to be part of this music podcast.
00:35:53That's what you said.
00:35:54Correct.
00:35:55When did you make that decision?
00:35:56Sometime mid-June after I had...
00:35:59June of this year?
00:36:00This year, correct.
00:36:01I had received a small amount of money, and I was able to...
00:36:05From where?
00:36:05A settlement.
00:36:07From what?
00:36:07From an injury, a car accident.
00:36:08Okay.
00:36:09How much did you receive?
00:36:10A little under 50 grand.
00:36:11And I seen an opportunity for me to invest and help out and help a friend and be able
00:36:17to invest into something that if we blew up one day, I could receive royalties from and
00:36:23money back in return.
00:36:24Did you have a written agreement with him?
00:36:26We did not have a written agreement.
00:36:28Well, I'd like to know what the agreement was.
00:36:30So, he was also in the car accident with me as well, and so he's got a settlement coming.
00:36:35He told me, this was all verbal, that once he received that money, he would pay me back
00:36:41at least half of the equipment.
00:36:43So, he would have a joint venture, and he would pay you for half the equipment you purchased?
00:36:47This was at the beginning, correct.
00:36:48Do you remember, Mr. Borum, that conversation?
00:36:51No, ma'am, Your Honor.
00:36:52Were you in the automobile accident with him?
00:36:54Yes, ma'am, Your Honor.
00:36:55You did not receive a settlement.
00:36:57Is there any reason?
00:36:58I wish they were going through the court process.
00:37:00Okay, so you're going to trial.
00:37:02Actually, yeah, that's what it was said to go to trial, because I didn't get the offer
00:37:05that my lawyer put in.
00:37:07So, it's going to trial on my side, but on his behalf.
00:37:10No, he's already settled his case.
00:37:12Yeah, mine's not settled yet.
00:37:13Okay.
00:37:13You indicate what you want is your equipment back.
00:37:16No, I'd like the money back.
00:37:17No, well, you get your equipment back, if it's yours.
00:37:20I want the money.
00:37:21I don't trust that he will give me the equipment back in good condition.
00:37:24Let me explain this to you, Mr. David.
00:37:26If that's what you want, then I'm going to let you withdraw this case and go back to
00:37:31small claims court.
00:37:32Do you understand what I'm saying to you?
00:37:34I'm going to dismiss your case without prejudice, which will allow you to go back to your small
00:37:39claims court, or do you wish to proceed with it today?
00:37:42I wish to proceed.
00:37:43Great.
00:37:46Why did you say, I'll do the editing myself?
00:37:49Because he was yelling at me, and I told him...
00:37:51What was he yelling at you?
00:37:52Because he said that the product wasn't up to par.
00:37:54He said, do...
00:37:55Just a second.
00:37:56Mr. Borum, this is your business.
00:37:58Right.
00:37:58Will you tell me?
00:37:59Did you think the product was up to par?
00:38:01When you decided to enter this, according to you, agreement that you would be in a joint
00:38:14venture, when he got his money, he would pay in his half of what the equipment costs, which
00:38:20you indicate, I think, is about $4,400.
00:38:23Correct.
00:38:24What I gather is there was a session set up that was supposed to take place in your basement.
00:38:29Yes, ma'am.
00:38:30And when was that?
00:38:31I believe it was around, like, early June, June-ish.
00:38:34Okay.
00:38:35And you have proof of the value of the equipment, I assume, and exactly what equipment there
00:38:40is.
00:38:40Correct.
00:38:41Is there, Mr. Borum, a dispute about what equipment he purchased?
00:38:46Is there a dispute?
00:38:46Yes, ma'am.
00:38:47Because he has a receipt.
00:38:48I just want to know if I have to go into this.
00:38:50Well, on the receipt, he purchased it on his card, but we're friends.
00:38:54We were going in together, so he bought it on his card because he had the money.
00:38:57Oh, just a second.
00:38:58I understand that, Mr. Borum.
00:39:00I'm asking you whether there is an agreement as to what the pieces he purchased on his
00:39:05card.
00:39:05Yes, ma'am.
00:39:06As far as the agreement, I'm not understanding the question.
00:39:09Okay.
00:39:09What pieces of equipment did he buy that's in your basement?
00:39:13Cameras.
00:39:14Camera.
00:39:15Chords.
00:39:15Chord.
00:39:16And probably the Black Magic.
00:39:18Black Magic?
00:39:19Black Magic.
00:39:19Yes, ma'am.
00:39:20It's a device that works.
00:39:21Do you know what he's talking about?
00:39:22I do.
00:39:23Anything else that's down there that you purchased other than those three items?
00:39:27Yes, ma'am.
00:39:28In total...
00:39:28Watch.
00:39:28Look at me.
00:39:29Tell me what else.
00:39:30In total, there's two Panasonic cameras.
00:39:33Are there two cameras that he purchased?
00:39:34Two cameras.
00:39:35Can I look down for...
00:39:37I can't hear you if you're mumbling.
00:39:38There's lighting.
00:39:40Three lights.
00:39:41There's...
00:39:41Three lights.
00:39:42Did he purchase three lights?
00:39:43Yes, ma'am.
00:39:44Okay.
00:39:45Wireless mics.
00:39:46How many?
00:39:47It was a set of two.
00:39:48Did he purchase those?
00:39:49Yes, ma'am.
00:39:49And I took a raise, but we purchased those.
00:39:51No, you didn't pay for it.
00:39:53I gave him the money.
00:39:54Just a second.
00:39:54I gave him cash.
00:39:55Oh, you did?
00:39:56You're going to show me proof of that in a moment.
00:39:58Well, I don't have proof that I gave him cash.
00:40:00No, ma'am.
00:40:01Because we were friends, so...
00:40:02Just a second.
00:40:03Okay.
00:40:03You have no proof?
00:40:04Did he give you cash?
00:40:05No, ma'am.
00:40:06He never gave me a dollar.
00:40:07Not a penny.
00:40:07Okay, let's go.
00:40:08We have three lights, two mics.
00:40:11What else?
00:40:12HDMI cord.
00:40:13He has a cord.
00:40:14Black Magic ATEM.
00:40:15He has that.
00:40:17256 gigabyte SD card.
00:40:19What is that?
00:40:20Memory card.
00:40:21It's a $50 memory card.
00:40:22It still adds up.
00:40:23Let's go.
00:40:24The card reader, 20-foot cables, a stencil and a table.
00:40:28Just a second.
00:40:29A stencil and a table.
00:40:30Describe that.
00:40:31It's for the logo that we made for the podcast.
00:40:34I purchased the stencil for the logo.
00:40:36How much did you pay for that?
00:40:37Between that and the table is $80.
00:40:39Let's stay with the big ticket items, sir, Henry.
00:40:41I was adding everything.
00:40:43Okay.
00:40:43Are we finished with the list?
00:40:44Yep.
00:40:45Very good.
00:40:45How much did you pay for these things minus the $50 card in total?
00:40:51Show me.
00:40:51Minus the $50?
00:40:53Yeah.
00:40:53$43.50?
00:40:54Okay.
00:40:55And all of that is in your basement now?
00:40:57Yes, ma'am.
00:40:58Okay.
00:40:58And what happened, according to what I read, there was a music session scheduled.
00:41:02And at the time that there was a music session scheduled, your daughter had COVID?
00:41:06Yes, ma'am.
00:41:07She lives on top of the house?
00:41:08Mm-hmm.
00:41:08Okay.
00:41:09And how old is she?
00:41:09That was in July.
00:41:10She's 10 months now, so probably about eight months.
00:41:12Okay.
00:41:13And she's cared for by both you and your wife.
00:41:16Is that correct?
00:41:16Yes, ma'am.
00:41:17And I gather, Mr. David, that when you found out that there was COVID in the house, you
00:41:21didn't want to go into the basement.
00:41:22Correct.
00:41:23And that was sometime in June.
00:41:24Correct.
00:41:25Okay.
00:41:25Can you tell me about that conversation?
00:41:27Well, he told me that she had COVID, and then he said that his fiance may possibly have
00:41:33it, and he may possibly have it.
00:41:34He even took off work, and I filled in for him at work for three days because he may
00:41:39have had COVID or not, and he said he wasn't feeling well.
00:41:40Well, he wasn't.
00:41:41He didn't want to go in and risk it.
00:41:42Correct.
00:41:42So I told him, I do not want to continue with this interview.
00:41:45He said he would continue on.
00:41:47You mean the interview that was supposed to take place in the basement?
00:41:49Correct.
00:41:49Correct.
00:41:50How much after Mr. David did you find out that the infant had COVID and that Mr.
00:41:56Borm and his wife were both exposed?
00:41:58Was the video podcast supposed to be made in the basement?
00:42:02Two, three days.
00:42:03Is that correct, Mr. Borm?
00:42:04From anywhere between two to five days, ma'am.
00:42:06And when Mr. David told you he didn't feel comfortable coming into the house, what did
00:42:10you say to him?
00:42:11I said, okay, I would have someone else fill in his position because I understood why he
00:42:15didn't want to come over.
00:42:16Okay.
00:42:16And did you have someone fill in his position?
00:42:18Yes, ma'am.
00:42:18And then what happened, Mr. Borm?
00:42:20The episode got done, and it wasn't up to par with Joseph's standards.
00:42:24So that's when the argument began.
00:42:26Okay.
00:42:26And the argument was what?
00:42:28The argument was the guy didn't do it right, so it was a lot of bickering.
00:42:32And so I told Joe, you know, I'll just do the editing myself.
00:42:35And he took that as I was cutting him out.
00:42:37Okay.
00:42:37So he was supposed to do the editing?
00:42:39Yes, ma'am.
00:42:40Okay.
00:42:40And why did you say, I'll do the editing myself?
00:42:43Because he was yelling at me, and I told him.
00:42:45What was he yelling at you about?
00:42:46Because he said that the product wasn't up to par.
00:42:49He said, do.
00:42:50Just a second, Mr. Borm, this is your business.
00:42:52Right.
00:42:52Will you tell me?
00:42:53Did you think the product was up to par?
00:42:55I did.
00:42:56Did you?
00:42:57I thought it was up to par, but I took his recommendation because I brought him in for production.
00:43:02So I was like, okay, if you don't feel like it's up to par, let's figure it out.
00:43:05But then we kept going back and forth.
00:43:07So at that moment, I was like, you know what?
00:43:08I'll just do it myself so we can stop the confrontation.
00:43:11Because you didn't want to tell the guy what he did wrong.
00:43:14So then that's when the argument started, and he thought that I was kicking him out,
00:43:17which I never told him he couldn't come over, never told him he couldn't be a part of anything.
00:43:21I just told him I wasn't going back and forth because that's why I brought you in.
00:43:24Okay.
00:43:24Before that.
00:43:25May I see the credit card statement from the purchase of this equipment?
00:43:29And, Mr. Borm, I want to see where you took out $2,200 from in cash.
00:43:35I want to see where you took.
00:43:36You said you paid him half.
00:43:37I didn't pay $2,200.
00:43:38I didn't pay half.
00:43:39Well, what'd you pay?
00:43:40I never stated that out.
00:43:41Just shh.
00:43:42If you're partners, that's what you have to pay.
00:43:44How much did you give him?
00:43:45I gave him money here and there, like on the order.
00:43:47That doesn't help me, sir.
00:43:50That doesn't help me.
00:43:51Bank statement, too.
00:43:51He's a bank statement.
00:43:52I didn't think I had to keep a record if we was best friends for 15 years.
00:43:56That's just...
00:43:57I can't help you, sir.
00:43:58I can't help you if you say you paid a little bit here and there.
00:44:01I can't help you with that.
00:44:02Never gave me a dime.
00:44:03So when you state that you're a friend, you're doing this to help me out as a gift for what I got going on.
00:44:08Never a gift.
00:44:09And then you try to bring it and take it back from me.
00:44:11And Mr. Borum, how many podcasts have you made since June?
00:44:15Since June?
00:44:16Yeah.
00:44:16I think, I believe, we on episode 15, 16, something like that.
00:44:2015, 16.
00:44:21Successfully.
00:44:22Yes, ma'am.
00:44:23And you intend to do this for profit.
00:44:25Yes, ma'am.
00:44:25Have you so far seen any profit?
00:44:28Not as now, because you know you got to build up.
00:44:30Just a second.
00:44:31So not as of yet.
00:44:32Yes, ma'am.
00:44:33Do you work?
00:44:34Yes, ma'am.
00:44:34Does your wife work?
00:44:35Yes, ma'am.
00:44:36So you have two incomes in the house.
00:44:38Right, right.
00:44:38And this is a side job for you.
00:44:40Correct.
00:44:40You have to buy your own equipment, because he's coming to get his equipment.
00:44:44That's going to be the court's order.
00:44:46So if I already have equipment.
00:44:48It's his equipment.
00:44:49The equipment that he...
00:44:50So he can't gift it to me?
00:44:51That's what he told me he was doing, because we were friends.
00:44:53Just a second.
00:44:54And he appreciated what I was doing.
00:44:55This is why we're here.
00:44:56Right.
00:44:56And now I heard you, and I heard him, and now I'm ruling.
00:45:00I am making an order that he, within five days of today, with a marshal or a sheriff,
00:45:06will come and pick up his equipment.
00:45:07So you're giving him my equipment back.
00:45:10I'm no.
00:45:11It's punishing what I got going on.
00:45:12You're giving him his equipment back.
00:45:13But he never used it, though.
00:45:15I don't care whether he used it or not.
00:45:17It was a failed business venture where you both expect...
00:45:20It's not a benefit.
00:45:21This is not a tea dance.
00:45:23He's getting back his equipment.
00:45:25You and your wife have a side business going.
00:45:27Go buy equipment.
00:45:29Do you understand?
00:45:30Five days.
00:45:30Wait outside.
00:45:31You'll get a copy of my order.
00:45:32You can go get your equipment.
00:45:33Thank you very much.
00:45:34This court is adjourned.
00:45:35A 15-year friendship, obviously, it don't matter.
00:45:38You know what I'm saying?
00:45:38Eventually, you see the real person in somebody.
00:45:40That's all I can say.
00:45:41You could be friends with somebody in 100 years, and they're going to change.
00:45:44I mean, I thought I had a good friend for a while, but really...
00:45:48Man, the show's going to go on, man.
00:45:49Y'all know.
00:45:50Make sure y'all watch.
00:45:51Tune in.
00:45:51I was just tolerating a really bad person.
00:45:54I've had understandings with my friends similar to what the plaintiff and defendant has.
00:45:59One of my friends will stay in my apartment from time to time for a few nights, and I always
00:46:03make sure, because you never want a holdover tenant or a friend staying longer than you
00:46:08had anticipated, and I'll text and I'll say, okay, you're good to stay there Thursday
00:46:12and Friday night.
00:46:13Let me know if there's any problems, but you've got to be gone by 9 a.m. on Saturday.
00:46:16Just to memorialize the understanding that I think I have, even with friends, it's just
00:46:21always smart to have some sort of record of a business, an understanding, a trade-off.
00:46:26I just think that it's good practice, even if it's just a text, something to memorialize
00:46:30what you believe the understanding to be.
00:46:33I agree with you.
00:46:33And that would make my job easy, but would eliminate this TV program.
00:46:38Potentially.
00:46:39Potentially.
00:46:39Potentially.
00:46:39Potentially.
00:46:40I shouldn't work.
00:46:42Court coming to order.
00:46:44All rise.
00:46:45Have a seat, please.
00:46:47Hello, Judge.
00:46:48Case 2115.
00:46:50Attar versus Rhodes.
00:46:51You're welcome.
00:46:53Mr. Attar, you were hired to do some, according to you, demolition work, another work at a
00:46:58property owned by Mr. and Mrs. Rhodes.
00:47:00You gave them an estimate for that work.
00:47:02I think the estimate was $11,500.
00:47:05Is that correct?
00:47:06Correct.
00:47:06And it was outlined what work you were supposed to do.
00:47:09You started that work, and according to you,
00:47:12at some point there was disagreement with either or both of the Roses,
00:47:16and they stopped payment on a check that they gave you.
00:47:20Correct.
00:47:21And the check that they gave you was $4,200,
00:47:24and then you stopped work for them.
00:47:26Yes, ma'am.
00:47:26Finished.
00:47:27So you're suing them for the canceled check
00:47:30and for other unpaid work that you did
00:47:32that you didn't get paid for.
00:47:34Mr. and Mrs. Rhodes say that they were not satisfied
00:47:37with the quality of your work.
00:47:39It cost them $9,000 to both replace things
00:47:43that were stolen from their property
00:47:45by either you or members of your team,
00:47:48something which I don't think that you question
00:47:51that somebody from your team, not you,
00:47:53somebody from your team may have taken metal property
00:47:56of theirs that they didn't own.
00:47:58So let's go back.
00:47:59Mr. and Mrs. Rhodes, is this a new property to you
00:48:02or is this a property that you owned for a while?
00:48:05It's a new property to us.
00:48:06That's what I thought.
00:48:07So is it a private house?
00:48:08Yes, and we were remodeling it.
00:48:11Okay, when did you purchase it?
00:48:13We purchased in January of 2020.
00:48:15I'm sorry, 2021.
00:48:16Is it a single-family residence?
00:48:18How much did you pay for it?
00:48:21$769,000.
00:48:23Describe the property to me.
00:48:24It's in northern Autoloma or Rancho Cucamonga.
00:48:28It's an acre property, has two levels on it
00:48:31and a single-family ranch-style home on it right now.
00:48:35And what we asked him to do was demolition the lower half.
00:48:39Do you have a photograph?
00:48:40I do.
00:48:41I'd like to look at the photograph
00:48:42of what you wanted him to do.
00:48:51That's what the lower half looked like before.
00:48:55So this whole portion you wanted him...
00:48:57Correct.
00:48:58To demolish and remove the debris?
00:49:01And grade flat.
00:49:02Is that correct, sir?
00:49:04I can't see you from here, ma'am.
00:49:04Okay, I'm going to show it to you.
00:49:07To demolish it, flatten it, fill it in...
00:49:11Remove all the debris.
00:49:12Mm-hmm.
00:49:13Yes.
00:49:14Okay.
00:49:15And did you have a written contract?
00:49:17We did not.
00:49:18Well, that's always a mistake.
00:49:20Always.
00:49:20How did you find him?
00:49:21I believe I got his business card.
00:49:23It was on my personal car, I think, at Home Depot.
00:49:27We had bought this house,
00:49:28and we tried to find somebody to do the work, but...
00:49:32Mr. Rhodes, let me tell you that the best way
00:49:34to find somebody is not somebody who leaves a card
00:49:36on your car at Home Depot or any place else.
00:49:40It was a difficult time to find contractors with COVID.
00:49:42And everything at that time.
00:49:44And at the time, I'm also going to add,
00:49:46because I read in the paper somewhere at the time,
00:49:49he didn't have a license.
00:49:51He did not.
00:49:51And you knew he didn't have a license.
00:49:53Yeah.
00:49:53That's the first thing I told him, Your Honor.
00:49:55Just a second.
00:49:56They didn't say no.
00:49:57We didn't know.
00:49:58They said we knew.
00:49:59So he got somebody who had no license
00:50:01to do what you wanted him to do,
00:50:03and you got his number from a card
00:50:05that he left on your windshield.
00:50:07Did you ask for references?
00:50:09That's either a yes or a no.
00:50:10No.
00:50:11I'm not really sure, actually, 100%
00:50:14on where I found that card.
00:50:15I think it was...
00:50:16It doesn't matter.
00:50:16Yeah.
00:50:17But he did tell us he was in the process
00:50:19of getting his license.
00:50:20That it was coming.
00:50:22Yeah.
00:50:23I know.
00:50:24What does that mean?
00:50:25It doesn't mean anything.
00:50:26You're too intelligent people.
00:50:27Okay.
00:50:28So you hired an unlicensed contractor
00:50:30to do work on your house
00:50:31and agreed to pay him $11,500.
00:50:34Now, Mr. Rattar,
00:50:36the $11,000 included labor and materials.
00:50:39Is that correct?
00:50:40There was no material.
00:50:41No material.
00:50:42It was labor and bins.
00:50:43Well, that's material.
00:50:44Labor and bins to remove...
00:50:45Yes, ma'am.
00:50:46...all the equipment that you needed...
00:50:48Yes, ma'am.
00:50:48...to complete the job.
00:50:50Yes, ma'am.
00:50:50Is that correct?
00:50:51...of before, too,
00:50:53of what I was supposed to do,
00:50:54and I took a picture.
00:50:54Well, no, I have that.
00:50:56You have the wrong picture, my dear.
00:50:57Okay, I'd like to see the picture that he has.
00:51:03I was supposed to do from the post
00:51:05all the way to the other post,
00:51:06remove everything.
00:51:07And the pool and the deck.
00:51:09Mr. Rattar,
00:51:10the $11,500 was an all-inclusive figure.
00:51:14Yes, Your Honor.
00:51:15One of the things that became an issue
00:51:17is a bobcat.
00:51:20Correct.
00:51:20From what I'm piecing together,
00:51:22you hired somebody in a bobcat
00:51:25to do a bobcat.
00:51:26That's a big piece of equipment
00:51:28that knocks down something.
00:51:29I rented a bobcat.
00:51:31And somebody who operated it.
00:51:33My worker.
00:51:34You didn't know how to operate the bobcat.
00:51:36I didn't know how to operate the bobcat,
00:51:38but I was controlling the demolition site, ma'am.
00:51:40I was, like, many things were going at the same time.
00:51:42I had to control everything.
00:51:43Mr. Rattar,
00:51:44something happened with the bobcat,
00:51:46the original one that you got.
00:51:48What happened with it?
00:51:49It broke down on us.
00:51:50No, it didn't break down on them.
00:51:52It broke down on you.
00:51:53On us.
00:51:53It broke down on you.
00:51:55Yes.
00:51:55So what did you do?
00:51:56I took it back,
00:51:58and the next day,
00:51:58it's supposed to deliver me another one.
00:52:00But they sent me a drunk driver
00:52:01and a broken down,
00:52:02another broken down bobcat.
00:52:03I returned it.
00:52:04At that moment,
00:52:05I asked Mrs. Rhodes,
00:52:06can you please go down Home Depot,
00:52:08which is, like, a mile away,
00:52:09so we close to stop wasting time,
00:52:11rent a bobcat or not?
00:52:12Just a second.
00:52:13Why should she rent a bobcat, sir?
00:52:15Your $11,500 included the bobcat.
00:52:19But I would pay for the bobcat.
00:52:20No, no, no.
00:52:21If you're going to pay for it,
00:52:22that's one thing.
00:52:23Then what are you sending her for?
00:52:24If your $11,500 figure
00:52:27included all materials,
00:52:30then she doesn't have to rent a bobcat.
00:52:31If you rented one that didn't work,
00:52:33rent one that works.
00:52:34How much of a down payment
00:52:35did they give you?
00:52:36Brazil was $4,000.
00:52:37When did you start the job?
00:52:39I started the job on
00:52:40the 15th of January.
00:52:43When did you leave the job?
00:52:45I was asked to leave
00:52:46on the 2nd of February.
00:52:48On February 2nd?
00:52:49Yes, ma'am.
00:52:49Not to go back,
00:52:50I'll call the cops on you.
00:52:52Between January 15th
00:52:54and February 2nd,
00:52:55other than the $4,000,
00:52:57did they give you any other money?
00:53:00Yes, Your Honor, they did.
00:53:00How much money did they give you?
00:53:02They gave me up to $7,000.
00:53:05So they gave you
00:53:06an additional $3,000?
00:53:08Yes, an $1,000 check.
00:53:09Shh.
00:53:10Your Honor, that was within
00:53:11the first week we gave him that.
00:53:13It doesn't matter to me.
00:53:14My question was,
00:53:15between January 15th
00:53:17and February 2nd,
00:53:18they gave you $7,000.
00:53:20Correct.
00:53:21Explain the other $4,200,
00:53:24which is the check that they
00:53:26stopped payment on.
00:53:28I'll happily explain to you.
00:53:29The Bobcat day she rented
00:53:31for me on her behalf,
00:53:33this cost $329 to rent per day.
00:53:36I rented for one day only,
00:53:37but they charged me $800.
00:53:39No, that's not correct.
00:53:40Just a second.
00:53:42I didn't ask you anything.
00:53:43Okay.
00:53:47Do you have a photograph
00:53:48of what the property
00:53:49looked like when you left?
00:53:51Yes, ma'am.
00:53:52The last picture I took
00:53:53before I was kicked out
00:53:54of the property.
00:53:55You're talking,
00:53:56I'm not listening to you.
00:53:59Mary and Michael
00:54:02are countersuing
00:54:03for lost wages,
00:54:05equipment rental,
00:54:06and missing property.
00:54:07Now,
00:54:08they paid you $7,000.
00:54:11Correct.
00:54:12They wrote you
00:54:12another check.
00:54:13The final check
00:54:14was supposed to be $5,000,
00:54:15but they only gave me $4,200
00:54:17because they mined $800
00:54:18for the Bobcat rental.
00:54:19Just a second.
00:54:21First of all,
00:54:22the total bill
00:54:23wasn't $7,500.
00:54:24$7,500,
00:54:25even my rudimentary math
00:54:26is $12,000.
00:54:28That would be $500 more
00:54:30than your agreed contract,
00:54:33which was for $11,500.
00:54:34They gave me $6,500
00:54:36because they gave me
00:54:37small checks.
00:54:38They gave me
00:54:38the first initial checks.
00:54:39Just a second.
00:54:39They gave me smaller ones.
00:54:41Sir,
00:54:41you're the businessman,
00:54:42whether you have a license
00:54:43or not.
00:54:44I asked you before
00:54:45how much money
00:54:46did they give you
00:54:46between January 15th
00:54:48and February 2nd,
00:54:49and you said $7,000.
00:54:51I didn't write it down,
00:54:52Your Honor.
00:54:52Well, you're here
00:54:54asking for money,
00:54:55and you have to
00:54:56write it down.
00:54:57You have to have some...
00:54:58I'm asking for work
00:54:58I've done,
00:54:58performed already.
00:54:59No, no, no, no, no, no, sir.
00:55:01And as I did the job,
00:55:02Your Honor,
00:55:02I did seven,
00:55:03eight other side jobs.
00:55:04I don't care
00:55:05whether you did
00:55:05seven or eight side jobs.
00:55:06Your original agreement
00:55:08with them
00:55:09was for $11,500,
00:55:11including all material.
00:55:13Now, what you said to me
00:55:14was that they gave you
00:55:15$7,000,
00:55:16and you said
00:55:17they're supposed
00:55:17to give me another five.
00:55:19Well, another five
00:55:20is more than your quote.
00:55:21Ma'am,
00:55:21the balance was five.
00:55:23How?
00:55:24The initials checked,
00:55:24then they gave me
00:55:25$1,000, $1,000, $1,000.
00:55:26How much money
00:55:27did you give them
00:55:27altogether that he cashed?
00:55:29$7,000.
00:55:30Then they owed you
00:55:31$4,500
00:55:32pursuant to your agreement.
00:55:35We agreed to $11,000,
00:55:36not $11,500.
00:55:37$11,500, Your Honor.
00:55:38Anybody have any proof
00:55:39of what the agreed amount was?
00:55:42We had a verbal contract
00:55:43of New Year, Mr. Rhodes.
00:55:44Fine.
00:55:45I will indicate
00:55:46that it's $11,500.
00:55:48If they gave you seven,
00:55:50they don't owe you five.
00:55:52They owed you
00:55:52the difference
00:55:53between $11,500
00:55:54and the seven
00:55:55that they gave you.
00:55:56Now, one of the things
00:55:58that you disputed,
00:55:59Mr. Attar,
00:56:00was this bobcat.
00:56:01Who paid
00:56:02for the bobcat?
00:56:05Show me.
00:56:06They minused it
00:56:06from the final price.
00:56:08Just a second.
00:56:09Was that an argument?
00:56:11The argument about it
00:56:12is, Your Honor,
00:56:13they rented for one day,
00:56:14but they charged me
00:56:15two days, $800.
00:56:17This is a bobcat rental
00:56:17for $800 for two days.
00:56:19Do you have a bill
00:56:20for the bobcat?
00:56:21I do, yes.
00:56:22And it was for two days
00:56:23because it was returned late.
00:56:26So they charged
00:56:27a second day.
00:56:28But in his text messages,
00:56:29he did request it
00:56:30for two days.
00:56:35Is that the total price?
00:56:36Yes.
00:56:37And I did not subtract it
00:56:38from his payment.
00:56:40Total contract
00:56:40was $652.74?
00:56:42Yes.
00:56:43Do you have a photograph
00:56:44of what the property
00:56:45looked like when you left?
00:56:46Yes, ma'am.
00:56:47The last picture I took
00:56:49before I was
00:56:51kicked out of the property.
00:56:52You're talking,
00:56:53I'm not listening to you.
00:56:54Just show me a picture.
00:56:55Yes, ma'am.
00:57:01This is not a picture.
00:57:02Mr. Attar,
00:57:03you're the businessman.
00:57:05Yes, ma'am.
00:57:05This is your company.
00:57:06Yes, ma'am.
00:57:07Company requires
00:57:08A, a license
00:57:09before you operate,
00:57:10which you didn't have.
00:57:11B, it requires
00:57:12a written contract.
00:57:15You're the businessman.
00:57:16They're people
00:57:17who bought a house
00:57:18who got your number
00:57:18off a windshield someplace.
00:57:21You're the businessman.
00:57:22And you want the parameters.
00:57:23You want them fixed.
00:57:24So I don't know
00:57:25if it's $11,000
00:57:26or $11,500.
00:57:28Do you understand?
00:57:29Very much, Your Honor.
00:57:29Right.
00:57:30Well, that's your mistake.
00:57:31You look as if
00:57:32you've probably been
00:57:32in business for a long time.
00:57:3414 years.
00:57:35And is what you're telling me
00:57:36you don't have
00:57:37written contracts?
00:57:38All my contracts
00:57:38are verbal.
00:57:39Then how many times
00:57:40have you been in court, sir?
00:57:41Never.
00:57:42Never.
00:57:42I've never had
00:57:43a stop payment check.
00:57:44Never ever paid me
00:57:44on time, Your Honor.
00:57:46It's a problem.
00:57:46Sir, when you finished,
00:57:47the debris wasn't all removed.
00:57:50That wood,
00:57:50they kept telling me
00:57:51don't touch it.
00:57:52Their neighbor,
00:57:53cousin, whoever
00:57:53is going to come pick it up.
00:57:54That would just cut
00:57:55quartz wood.
00:57:55No.
00:57:56There's brick.
00:57:57There's wood.
00:57:58There's cement.
00:57:59We cleaned all that.
00:58:00I can't personally clean all that.
00:58:01Just a second.
00:58:02What I asked you,
00:58:03Mr. Rattar,
00:58:04was show me a picture
00:58:06of the property
00:58:07when you left.
00:58:09This is the picture
00:58:10that you showed me.
00:58:10That was the last
00:58:11before I had more work.
00:58:12I came in and did more.
00:58:13I wasn't taking pictures.
00:58:14I wasn't expecting somebody
00:58:15to stop paying
00:58:16on a check, Your Honor.
00:58:17I was not expecting that.
00:58:19I have pictures of what
00:58:19it looked like when he left.
00:58:22What about after that?
00:58:27Well, what are you showing me here?
00:58:29This brick that's here?
00:58:30They piled it there
00:58:31and then left it there.
00:58:31Well, that's probably a good one.
00:58:32No, it was supposed to be removed.
00:58:38So this is the back.
00:58:39That's the picture
00:58:40of the sagging patio
00:58:42because he removed
00:58:43part of the supports
00:58:44that were holding up the patio
00:58:46that he wasn't supposed to.
00:58:47So it's now sagging.
00:58:49Now, this is the picture
00:58:50that you gave me
00:58:51when you told me
00:58:53this is what you wanted,
00:58:54leveled, cleared,
00:58:56and made flat.
00:58:57Right.
00:58:57Now, I want to see
00:58:58your picture
00:59:00of what this looked like
00:59:01when he left.
00:59:02You have it.
00:59:03It's in some of those photos.
00:59:04The flat's leveled.
00:59:05You're talking about this?
00:59:07Yeah.
00:59:07That's part of it.
00:59:08The close-ups,
00:59:09that's part of it.
00:59:09Well, it looks like
00:59:10most of the stuff is done.
00:59:11It looks like a lot
00:59:12of cleanup left.
00:59:13No, ma'am.
00:59:13We've done all the cleanup.
00:59:14Well, I haven't seen that
00:59:15so then what you're supposed
00:59:16to do is take a photograph.
00:59:17It was also buried underneath.
00:59:20These are the photos
00:59:21of when we did it ourselves
00:59:23and really leveled it out.
00:59:25And as we were doing that,
00:59:26we found so much
00:59:27buried underneath
00:59:28that should have been removed,
00:59:30but his bobcat person
00:59:31buried it all.
00:59:32Your Honor?
00:59:33All the debris,
00:59:34all the concrete brick.
00:59:35Okay, let me see the bill
00:59:37from the...
00:59:37No, we did it ourselves.
00:59:39We rented equipment
00:59:40and did it ourselves
00:59:41on his vacation.
00:59:42Oh, nice.
00:59:44Okay.
00:59:45$4,500 is so far
00:59:46what's owed on this contract.
00:59:48Now, your counterclaim
00:59:50is money owed
00:59:51for lost work,
00:59:52equipment rentals,
00:59:53labor,
00:59:54and missing damages
00:59:55to property.
00:59:56What money owed
00:59:57for lost work?
00:59:58During the second week
00:59:59that he was working,
01:00:00he called and said
01:00:02that his crew had left.
01:00:04This was the second day
01:00:05of use of...
01:00:05I fired him.
01:00:06Supposed to be use
01:00:06of the bobcat
01:00:07that I rented.
01:00:08I fired him.
01:00:08Okay.
01:00:09Second day.
01:00:09If you interrupt me again,
01:00:10I'm just dismissing your case.
01:00:11Do you understand?
01:00:12Thank you, Your Honor.
01:00:13Understand?
01:00:13Yes, ma'am.
01:00:14Very good.
01:00:15Just explain lost work.
01:00:17Who's lost work?
01:00:18His.
01:00:18Oh, forget it.
01:00:19Well, he called and said
01:00:20his crew left.
01:00:21Forget it.
01:00:21He can't finish the job.
01:00:22You weren't living there.
01:00:24Not yet, no.
01:00:25You weren't living there.
01:00:26Okay.
01:00:26He wants to go for gold.
01:00:27I'm not interested
01:00:28in his lost wages
01:00:29for taking care of his house.
01:00:31So far, you owe the man
01:00:32the balance on his contract
01:00:33unless you had somebody else do it,
01:00:35which is absolutely fine.
01:00:37And I would look at that
01:00:38removal of debris,
01:00:39what it costs you,
01:00:40and you're absolutely entitled
01:00:41to that.
01:00:43Deducted from what you owe him,
01:00:44which is $4,500.
01:00:46But he didn't finish the job.
01:00:48Just a second.
01:00:48You tell me,
01:00:50how am I supposed to gauge
01:00:51how much of the job
01:00:53he didn't finish?
01:00:54Did he not complete
01:00:55$2,500 worth?
01:00:56$3,500 worth?
01:00:58$1,500 worth?
01:01:00I think the seven
01:01:01we paid him was overpaid.
01:01:02He didn't have to end up
01:01:03removing an entire pool.
01:01:05He only had to remove...
01:01:06That's your problem.
01:01:07Just a second.
01:01:08I read that.
01:01:08You said it's not a big pool.
01:01:10It wasn't eight feet.
01:01:11It was only 24 inches.
01:01:12He gave you a price
01:01:14to level everything.
01:01:16Nothing delineated.
01:01:18Nothing in a written contract.
01:01:19The pool turns out to be
01:01:21two feet instead of six feet
01:01:23or two feet instead of eight feet.
01:01:25Well, if he was the contractor
01:01:27and he came out
01:01:28and he looked at the pool
01:01:29and he said,
01:01:29oh, this is an eight-foot pool
01:01:30and it turned out
01:01:31it's a 12-foot pool,
01:01:32he'd be stuck with $1,500.
01:01:34Just like you're stuck
01:01:35with $1,500
01:01:35because it was shallower.
01:01:37Now, you owe him $4,500
01:01:39unless you want to produce
01:01:41for me bills
01:01:42that you have
01:01:43for rental equipment, etc.
01:01:45And I will absolutely deduct that
01:01:46from the $4,500.
01:01:49Just give me the bills
01:01:51and the amount of equipment.
01:01:52Don't say nothing, Mr. Retard.
01:01:56Mr. Rhodes,
01:01:57did you rent a bobcat?
01:01:58The one that I cleaned up
01:01:59the yard with?
01:01:59Yes.
01:02:00I rented a piece of equipment.
01:02:01Jump up!
01:02:02Yes.
01:02:03And, you know,
01:02:07how do they pick up metal?
01:02:08No, I don't know that, sir.
01:02:09I'm a television personality.
01:02:11I don't know about people
01:02:12driving down the street
01:02:13to pick up metal.
01:02:14I've never had somebody
01:02:15drive down the street
01:02:16and say,
01:02:16I'm looking for metal.
01:02:17They don't even come down my street
01:02:18and ask if I want sharp knives.
01:02:20refusing to pay for demolition work.
01:02:27Mary and Michael claim
01:02:28he never finished the job
01:02:30and stole their property.
01:02:31Now, what did you rent?
01:02:33A skip loader.
01:02:34That's different from a bobcat.
01:02:35Yes, that's correct.
01:02:37Smaller?
01:02:37I would say bigger.
01:02:38Bigger.
01:02:39And do you remember
01:02:40how much it cost you?
01:02:41Uh...
01:02:42Did you rent it from Home Depot?
01:02:44No, no, no.
01:02:44It's from a local rental yard.
01:02:46I think it was, um...
01:02:47All the equipment we rent
01:02:48in Ontario...
01:02:49$1,300.
01:02:50Yeah.
01:02:50Find it.
01:02:51Yeah.
01:02:52Find the bill.
01:02:53They didn't print it,
01:02:54so now I got it.
01:02:55How many days did you have it,
01:02:57Mr. Rhodes?
01:02:58Four.
01:02:59I'm dismissing your counterclaim,
01:03:00Mrs. Rhodes.
01:03:01Do you want to know why?
01:03:02Because I asked him
01:03:03a specific question
01:03:04and you answered.
01:03:06Do you understand?
01:03:08Do you understand?
01:03:09That part of your counterclaim,
01:03:11because you don't have it,
01:03:12you can't find it,
01:03:12so so far you owe him $4,500.
01:03:14Not $8,600,
01:03:17but $4,500.
01:03:18Now, do you have any proof
01:03:20that Mr. Attar
01:03:22or someone from his team
01:03:24stole copper piping
01:03:25or whatever piping
01:03:26that you claim was missing?
01:03:28Do you have any proof
01:03:29that either Mr. Attar
01:03:30or anyone under his authority
01:03:32took property from you?
01:03:34Yes.
01:03:34We have text messages
01:03:35back and forth.
01:03:36Okay, I'll read them.
01:03:44Okay, so what you're referring to
01:03:56with regard to the stolen property
01:03:57is you send a picture
01:03:58and there's a little piece
01:03:59of pipe there,
01:04:00one piece of pipe,
01:04:01and you say,
01:04:01Mike, did you or you guys
01:04:03happen to grind off
01:04:04two metal poles
01:04:05and concrete blocks?
01:04:06The kids use those
01:04:07for volleyball nets.
01:04:09And he says,
01:04:09oh my God, no sir,
01:04:11but I'm guessing
01:04:12the person
01:04:12whom I gave my metal to,
01:04:15no problem, Michael,
01:04:16please give,
01:04:17and I don't see
01:04:19the rest of this message.
01:04:20Yes, so that was
01:04:21the beginning of things
01:04:22we noticed
01:04:23that were missing.
01:04:24Oh, I don't care.
01:04:25This is what
01:04:26you're talking about?
01:04:27Yes, he's saying
01:04:27he led a metal person
01:04:28onto our yard
01:04:29and they went and took
01:04:30everything that was metal.
01:04:31Okay.
01:04:32No.
01:04:35Okay.
01:04:36Now, Mr. Rattar.
01:04:37Yes, Your Honor.
01:04:38I want you to tell me
01:04:39about the missing metal
01:04:40on this property.
01:04:42She was standing right there
01:04:43and there was a metal guy
01:04:44that drove down the street
01:04:45and, you know,
01:04:46they pick up metal.
01:04:47No, I don't know that, sir.
01:04:48I'm a television personality.
01:04:50I don't know about people
01:04:51driving down the street
01:04:52to pick up metal.
01:04:53I've never had somebody
01:04:54drive down the street
01:04:54and say,
01:04:55I'm looking for metal.
01:04:56They don't even come down
01:04:57my street and ask
01:04:57if I want sharp knives.
01:05:00Okay.
01:05:01Do you understand?
01:05:01Very much, Your Honor.
01:05:02Do you understand?
01:05:02Very much, Your Honor.
01:05:03Okay.
01:05:03Who was this person?
01:05:04This person was picking up metal
01:05:06and I asked for permission.
01:05:07Just a second.
01:05:08He comes down the property.
01:05:09Just a second.
01:05:09Yes, ma'am.
01:05:10Was this person picking up
01:05:11metal for nothing?
01:05:12Yes, ma'am.
01:05:12Just a second.
01:05:13Yeah.
01:05:14You're a business guy,
01:05:16Mr. Rattar.
01:05:17Somebody drives down the street
01:05:18and says,
01:05:19you know,
01:05:19I see you're doing construction.
01:05:21Is there any metal around here
01:05:23that you want me to dispose of?
01:05:25Yes, ma'am.
01:05:26They do a lot.
01:05:26Yes.
01:05:27And then they look around.
01:05:28This is what you tell them.
01:05:29They look around
01:05:30and they take the metal
01:05:32for nothing.
01:05:33Yes, ma'am.
01:05:33This would be cheaper for me
01:05:34to set it loaded on my trailer
01:05:36and take it to the recycling
01:05:37metal yard.
01:05:38So what metal did they take, sir?
01:05:40I assume you watched.
01:05:41Everything that I gave them
01:05:42was right there.
01:05:43Nobody went up there
01:05:44and cut no poles, ma'am.
01:05:46Well, they sent you
01:05:47a picture of the pole, sir.
01:05:48And in response
01:05:49to the picture of the pole,
01:05:51you said,
01:05:51oh, my God,
01:05:52I'm guessing the person
01:05:53whom I gave my metal to.
01:05:55I'm guessing.
01:05:55No problem.
01:05:56And then you say later,
01:05:57tell me what it is
01:05:58and I will either look high and low
01:06:01to get it back
01:06:02or replace it.
01:06:04That's what you say.
01:06:05Yes, I offered to replace it.
01:06:06That's what you say.
01:06:06I offered to replace it.
01:06:07Now, next question.
01:06:09I need an itemized list
01:06:11and what the value was
01:06:12of the metal taken.
01:06:14I have,
01:06:15now there's a list of everything.
01:06:18They're listed in there.
01:06:26What is this?
01:06:27Those are all the damages,
01:06:28but the metal is listed in there
01:06:29separately of the items
01:06:31that are missing.
01:06:31No, it isn't.
01:06:32This is a whole bunch
01:06:33of other things
01:06:34that you prepared for this case.
01:06:35It's in there underneath.
01:06:36There's the horse feeder.
01:06:38Part of the corral was cut off.
01:06:39This is something
01:06:40that you wrote yourself.
01:06:43Yes, you said an itemized list.
01:06:44This isn't it.
01:06:45If they took six feet of pipe,
01:06:47get me a bill from Home Depot
01:06:48for the replacement of that pipe.
01:06:50Oh, I have.
01:06:51All the bills
01:06:52for the replacement of metal,
01:06:54not what you prepared
01:06:55for this litigation.
01:06:57I'm sorry,
01:06:57I misunderstood.
01:06:58Itemized list.
01:06:59Did you take down a horse corral?
01:07:08No, Your Honor,
01:07:09I did not take a horse corral.
01:07:11I have nothing to do with it.
01:07:11Horse corral,
01:07:11is that metal or is it?
01:07:13It's made out of galvanized metal,
01:07:14yeah.
01:07:14They cut pieces off of that
01:07:15that were sticking up
01:07:16to take to recycle, I guess.
01:07:18Just a second.
01:07:19Was there a four-sided horse corral?
01:07:22Yes.
01:07:22That looked like this?
01:07:24Yes.
01:07:24That they took down?
01:07:25They cut pieces
01:07:27that were sticking up
01:07:28above the horse corral,
01:07:30attached to the horse corral.
01:07:31You're being petty.
01:07:33You're being petty.
01:07:35$306, Ram's price,
01:07:36galvanized wall-mounted horse feeder.
01:07:39Did you take a horse feeder?
01:07:41No, Your Honor,
01:07:41I got no...
01:07:42Yo, Mr. Rattar,
01:07:43$4,500.
01:07:44Judgment for the plaintiff.
01:07:45Mounted claims dismissed.
01:07:46We're finished.
01:07:46This court is adjourned.
01:07:49Well, his equipment broke
01:07:52and he wanted us
01:07:53to rent the equipment for him.
01:07:54Equipment type,
01:07:54because...
01:07:55things break down.
01:07:56And then the next day
01:07:57he calls and says
01:07:58he can't finish it.
01:07:59At that moment,
01:08:00I didn't have a credit card
01:08:01to my name.
01:08:03And that's the honest truth.
01:08:04So we pretty much figured
01:08:05that was job abandonment
01:08:07at that point.
01:08:08I'm going to have
01:08:08a resident contract
01:08:09in the future.
01:08:10Don't hire him.
01:08:10Always hire a professional.
01:08:13I could not believe
01:08:14that your first question to him
01:08:16when he said
01:08:16that he'd been working
01:08:17as a contractor
01:08:18for 14 years
01:08:19was,
01:08:21and you've been working
01:08:21all 14 of those years
01:08:22unlicensed?
01:08:23Okay.
01:08:24I was waiting for the question.
01:08:25I was waiting
01:08:26at the edge of my seat
01:08:27and it never came.
01:08:28Different minds.
01:08:29Yeah.
01:08:29You should have
01:08:30slipped me a no.
01:08:31I should have.
01:08:31You should have
01:08:32slipped me a no.
01:08:32No, that actually
01:08:33didn't cross my mind,
01:08:34but that's a good question.
01:08:35Yeah.
01:08:36Oral contracts
01:08:37and no license.
01:08:38And no license.
01:08:39But there's no question.
01:08:39He did the work.
01:08:40Yeah.
01:08:40He did the work
01:08:41and they were
01:08:42really dickering
01:08:43over who was
01:08:45going to absorb
01:08:46the cost of the second
01:08:47bobcat that they had
01:08:48to get,
01:08:49which was really ridiculous.
01:08:50If they had had
01:08:51another contractor
01:08:52who came and completed
01:08:53the job.
01:08:54You would have
01:08:54awarded that.
01:08:55I would have
01:08:55deducted it
01:08:56from the $4,500
01:08:57that they owed him,
01:08:59but absent that,
01:09:00the fact that he rented
01:09:01some sort of piece
01:09:02of equipment
01:09:02and came and cleaned
01:09:03up the property
01:09:04was not important to me
01:09:05and the rest of their
01:09:06case was nonsense.
01:09:07Next time,
01:09:08they won't employ
01:09:09somebody for $11,000
01:09:12from a card
01:09:13from your windshield.
01:09:15At Home Depot.
01:09:16From, you know,
01:09:18from wherever.
01:09:19And not say,
01:09:20okay, listen,
01:09:20maybe I'll give him
01:09:21a shot.
01:09:22Give me three
01:09:23of your last references
01:09:24to call.
01:09:25It's a good lesson
01:09:26to people out there.
01:09:26I don't understand that.
01:09:29Yeah.
01:09:29Well, anyway,
01:09:31we're done.
01:09:34Have you been cheated?
01:09:35Go to Lawrence Claims,
01:09:37Wanda threatened his son
01:09:38and escalated the situation.
01:09:41Now, tell me what happened
01:09:42when he got there.
01:09:43When he got there,
01:09:44he was cussing,
01:09:45calling me every night.
01:09:46Got it.
01:09:47He was angry
01:09:48because you were
01:09:48blocking his son's car.
01:09:50Right.
01:09:50And he had to come back there
01:09:52because you were moving out.
01:09:53There's no question
01:09:54that he would have
01:09:54come back there
01:09:55because you were
01:09:55moving out anyway
01:09:56because he got a call
01:09:57from his house manager
01:09:59slash your niece's roommate
01:10:01who had her steal property
01:10:03from Walmart.
01:10:04Yes.
01:10:05I offered her a time
01:10:06to come back
01:10:06and get the stuff.
01:10:07It wasn't available
01:10:08at the moment
01:10:09because I thought
01:10:09some of it
01:10:10was at another location.
01:10:10There's no available.
01:10:12All she wanted
01:10:12was the hamper
01:10:13from the garage.
01:10:14I understand.
01:10:14That's what she said
01:10:15she wanted.
01:10:16That's not at all
01:10:17over the place.
01:10:18It's a...
01:10:18Okay.
01:10:19All she wanted
01:10:19was the hamper
01:10:20from the garage.
01:10:21Everything else
01:10:22was there and packed.
01:10:23She was ready to go.
01:10:24She just wanted the hamper.
01:10:25He had no authority
01:10:26to give her the hamper
01:10:27or couldn't get into the garage.
01:10:29He didn't know
01:10:29how to get into the garage.
01:10:30Actually,
01:10:31I'm sure your son
01:10:32said to you,
01:10:33if you're a smart man,
01:10:35well,
01:10:35what do they want?
01:10:36And I assume
01:10:37he said to you,
01:10:38they want a hamper
01:10:38from the garage.
01:10:39I assume he said
01:10:40that to you
01:10:41or he wasn't listening.
01:10:42That he wasn't listening to.
01:10:44Did he tell you
01:10:45that that's what they wanted?
01:10:47Not that I recall.
01:10:48I...
01:10:48Okay.
01:10:49So,
01:10:49now tell me
01:10:50what he did to your car.
01:10:51He opens the car door.
01:10:52Opened the car door.
01:10:53I thought he was
01:10:54going to hit me.
01:10:55My sister and niece
01:10:56were scared to death.
01:10:57They were hysterical.
01:10:58Let's go.
01:10:59He's going to kill us,
01:11:00you know,
01:11:00because he was
01:11:01out of control.
01:11:02And he grabbed
01:11:03my car door remote,
01:11:06slammed that door,
01:11:07hit my windshield,
01:11:08went to the back door.
01:11:10He had to have
01:11:10scratched it with this.
01:11:12Opened that door
01:11:13and threw her bags
01:11:15of belongings
01:11:16out in the street.
01:11:17And then,
01:11:18after he got
01:11:19his son's car out...
01:11:20Well,
01:11:21how did he get
01:11:21the son's car out?
01:11:22He went up on the curb?
01:11:23Yeah.
01:11:24And then he came
01:11:25head on at my car
01:11:26like he was going
01:11:27to hit us,
01:11:28head on.
01:11:28Matter of fact,
01:11:29the son in the driveway
01:11:30kept backing up
01:11:32like he was going
01:11:32to hit my car.
01:11:33Well,
01:11:33you should have
01:11:34let him out.
01:11:35Yeah.
01:11:35Yeah.
01:11:36You should have
01:11:36let him out.
01:11:37Yeah.
01:11:37You have no right
01:11:38to block him in.
01:11:39I know,
01:11:39but he should have
01:11:40let us in that garage.
01:11:41Just a second.
01:11:42It's not his responsibility
01:11:43to let you in the garage.
01:11:45Let's understand
01:11:46each other.
01:11:47It's not his responsibility.
01:11:49He's not in charge
01:11:50of that house.
01:11:50If it was a hamper
01:11:51and clothes
01:11:52you were looking for,
01:11:53you'd be smart.
01:11:53You'd get your niece
01:11:54out of there.
01:11:55You'd go to wherever
01:11:56you're going to take her
01:11:57and then you make
01:11:58a communication.
01:11:59Listen,
01:11:59we left a hamper there.
01:12:01Either you get it
01:12:01or you don't get it.
01:12:03But blocking him in
01:12:04is not what
01:12:06you're legally
01:12:06able to do.
01:12:08Do you understand that?
01:12:09Yeah.
01:12:09That's why
01:12:10he got frustrated.
01:12:12There's no question
01:12:12about that.
01:12:13He handled it all wrong.
01:12:14You can't put your hands
01:12:15on her car.
01:12:16You can't take out
01:12:17the bags from the car.
01:12:18You can't run over them.
01:12:20I did not run them over.
01:12:21You can't scratch her car.
01:12:23I didn't do that either.
01:12:24Well,
01:12:24she's going to show me
01:12:25pictures, sir.
01:12:26Of a scratch?
01:12:27And that's what
01:12:28she's here for.
01:12:29She has to convince me
01:12:30that you damaged property
01:12:31and you took property
01:12:33without permission.
01:12:34Well,
01:12:34as the video shows,
01:12:35the bags were not thrown
01:12:36or sprawled out
01:12:37or ran over
01:12:38as she's claiming either.
01:12:39Oh, no.
01:12:39She didn't say
01:12:40sprawled out, sir.
01:12:42She said I threw them.
01:12:42You touched
01:12:43somebody else's property
01:12:45and you have
01:12:46no right
01:12:47to do that.
01:12:49You were angry.
01:12:50You have no right
01:12:50to touch her car,
01:12:52scare her physically,
01:12:54and if you threw,
01:12:56not gently,
01:12:57put the bags of stuff.
01:12:59Oh, there's no question
01:13:00in my mind
01:13:01that if you're angry
01:13:02and you grabbing them
01:13:03out of the car,
01:13:04you're not grabbing them
01:13:04out of the car
01:13:05and gently putting them down.
01:13:06Whatever.
01:13:07Show me the car's damage, please.
01:13:09I did not throw them.
01:13:10All right.
01:13:12Shouldn't be taking care
01:13:13of challenged people
01:13:14in your house.
01:13:17Should get off
01:13:18every list.
01:13:20I know it's a business
01:13:21and I know people
01:13:21have to do it,
01:13:22not you.
01:13:27Okay.
01:13:29Damage to the car.
01:13:30Go ahead.
01:13:39Is this the damage?
01:13:41Is this the...
01:13:41Crack, yeah.
01:13:42Hmm?
01:13:43Uh-huh.
01:13:43Yes.
01:13:44Did you have it fixed?
01:13:45Yes.
01:13:46I'd like to see
01:13:46the bill for it.
01:13:47Okay.
01:13:47Okay.
01:13:47Okay.
01:13:48Okay.
01:13:48Okay.
01:13:48Okay.
01:13:48Okay.
01:13:48Okay.
01:13:48Okay.
01:13:50Okay.
01:13:50Okay.
01:13:50Okay.
01:13:50Okay.
01:13:50Okay.
01:13:51Okay.
01:13:52Okay.
01:13:52Okay.
01:13:52Okay.
01:13:53Okay.
01:13:54Okay.
01:13:54Okay.
01:13:54Okay.
01:13:55Okay.
01:13:56Okay.
01:13:56So is what you're telling me
01:13:59your out-of-pocket
01:14:01was $2.50?
01:14:02Yes.
01:14:03Okay.
01:14:03To fix your car
01:14:04was more money
01:14:05but that was your deductible,
01:14:07$2.50?
01:14:07Right.
01:14:08Okay.
01:14:08So we have $2.50.
01:14:09What else?
01:14:10He took my garage door opener
01:14:12so I had to buy a new one.
01:14:13How much was that?
01:14:14$134.95.
01:14:17I didn't touch
01:14:17a garage door opener.
01:14:19What else?
01:14:20And the rental car
01:14:21was $366.20
01:14:23that I was in
01:14:24while my car
01:14:25was getting worked on?
01:14:26Just a second.
01:14:26Did your insurance
01:14:27pay for that?
01:14:28Yes.
01:14:28They had to.
01:14:29Yeah.
01:14:30Yes.
01:14:30Of course they did
01:14:30because if you had
01:14:31a $250 deductible
01:14:33on your car
01:14:34then there's no question
01:14:35in my mind
01:14:36that you had
01:14:36a rental car.
01:14:38Okay.
01:14:38All right.
01:14:39$385.00.
01:14:40Judgment for the plaintiff.
01:14:41Thank you very much.
01:14:41We're finished.
01:14:43The court is adjourned.
01:14:49That was no problem
01:14:50as far as her moving out.
01:14:51That's a normal part
01:14:52of the business.
01:14:53What was very upsetting
01:14:54was somebody involving
01:14:55my son and trapping him
01:14:57from being able to move.
01:14:58Because what I wanted
01:14:59wouldn't have taken
01:15:00more than 30 seconds
01:15:01to get.
01:15:01I'm disabled
01:15:02so I always look
01:15:03for the easiest route.
01:15:04I do regret.
01:15:05I was pretty fumed
01:15:06but it was because
01:15:07you know that
01:15:08that papa bear part
01:15:10of me came out
01:15:10and I just
01:15:11somebody was attacking
01:15:12my kid in my head.
01:15:13So the way he was
01:15:14cussing and carrying on.
01:15:15I wanted to go full force
01:15:17and I went too far
01:15:18with verbalizing anyways.
01:15:20Just screen them good.
01:15:21A good point
01:15:24that this case highlighted
01:15:25that I actually
01:15:26couldn't believe
01:15:27that I want to look
01:15:27into a little bit more
01:15:29is that just anybody
01:15:31can rent or own
01:15:33a five bedroom
01:15:34however many bedroom
01:15:35home and just
01:15:36open their doors
01:15:37and get put on a list
01:15:38for rooms for rent
01:15:39for people with real
01:15:40challenges or disabilities.
01:15:42You've been in the business
01:15:43longer than me
01:15:43but you need a license
01:15:44to give a pedicure
01:15:45in most places.
01:15:46So the fact that this man
01:15:48can just open up a home
01:15:49that he was renting
01:15:50and be put on a list
01:15:51as a safe haven
01:15:52for these people to live
01:15:53secure living environment
01:15:55food, shelter
01:15:56all of that
01:15:57to me
01:15:58it's kind of outrageous
01:15:59that you don't need
01:16:00any sort of check and balance
01:16:01or any license
01:16:02Any sort of license
01:16:02or government oversight.
01:16:04Exactly.
01:16:05Especially with such
01:16:05a class of people
01:16:06that require extra care
01:16:08and help
01:16:08and I really couldn't
01:16:09believe that.
01:16:10Right.
01:16:10Yeah.
01:16:11It's problematic
01:16:12because for adults
01:16:14who have challenges
01:16:16there are so few
01:16:18facilities
01:16:19and it's such
01:16:22a vulnerable population
01:16:23and to force
01:16:25that vulnerable population
01:16:27into being
01:16:28in a place
01:16:29that is not
01:16:29carefully scrutinized
01:16:31by either a locality
01:16:33or the federal government
01:16:35because very often
01:16:36there are federal funds
01:16:37that filter down
01:16:39into these places.
01:16:40It's just so
01:16:41monumentally sad.
01:16:43All the way around.
01:16:44Yeah, it is monumentally sad.
01:16:46I think the plaintiff
01:16:47said it best herself
01:16:48when asked how to avoid
01:16:50types of problems
01:16:50like these
01:16:51she said you really have
01:16:52to screen them
01:16:52very well
01:16:53and to put that burden
01:16:55on an already vulnerable
01:16:56population of people
01:16:57I think someone else
01:16:58should be vetting
01:16:59these places.
01:16:59Agreed.
01:17:02Have you been cheating?
