00:00:00Your dog grabbed her dog in the mouth.
00:00:03I yelled at my dog.
00:00:05No.
00:00:05No.
00:00:06I didn't see any blood or anything.
00:00:07Her head was punctured.
00:00:09Your dogs came running up to my dog.
00:00:11No, no, no.
00:00:12It was across the way, but, um.
00:00:13It's across?
00:00:14Yeah.
00:00:15My side of the door faced her side of the door,
00:00:18and there was a grassy knoll in between.
00:00:21Do you have a photograph of the area?
00:00:23No, I don't.
00:00:23Do you?
00:00:24I'd like to see it.
00:00:28That's mine.
00:00:29And this is where hers would be.
00:00:31Okay, thank you.
00:00:32Mm-hmm.
00:00:35Okay, so this is whose trailer?
00:00:38Hers.
00:00:39It's career.
00:00:40Is there a street in between this area?
00:00:43That's where hers would be.
00:00:45Where?
00:00:46In that area where the rocky thing, right after the grass.
00:00:49Kevin, give this to the defendant.
00:00:51Maybe this one's better.
00:00:52Where the plaintiff's trailer would be.
00:00:56Okay.
00:00:56And where hers was.
00:00:58This is where hers is.
00:00:59Would have been right here.
00:01:01Just put plaintiff and show me where yours was.
00:01:04Mine is right here.
00:01:06Put it down.
00:01:08Let me see if that makes it clear to me, Kevin.
00:01:16Yours is here.
00:01:17Plaintiff's is here.
00:01:19And this large grass area is a common area.
00:01:22Yeah.
00:01:23It's a common area because you're all the way down here.
00:01:25This is a relatively large space.
00:01:27It's only like-
00:01:28I wasn't talking to you.
00:01:29Sorry.
00:01:30Okay.
00:01:30And the incident that involved your pet, Miss Highland, happened on October 8th, 2021.
00:01:37Yeah, it was actually October 9th after going back through the paperwork.
00:01:41You are no longer in this trailer park.
00:01:44No, it's an RV park, but yeah.
00:01:46An RV park.
00:01:47How long were you there?
00:01:48Four or five months.
00:01:49It was like mid to end of May.
00:01:52And this happened in October and within three weeks I-
00:01:57You left.
00:01:58And that's your dog?
00:01:59Yeah.
00:01:59That's the dog that was injured that day?
00:02:01Yes.
00:02:01And what kind of a dog do you have?
00:02:03A Vizsla Mix Boxer.
00:02:05A Vizsla.
00:02:06Vizsla.
00:02:07So tell me what happened to Miss Highland on October 9th.
00:02:10I had gotten up and I was taking my girls out to go potty.
00:02:15How many of those do you have?
00:02:17Two.
00:02:17I have a puppy that's almost two years old and then Faith.
00:02:21So I was taking my girls out to go potty and I'd been looking to make sure that the
00:02:28dog was inside and I didn't see the dog and it was on its chain under her trailer apparently
00:02:36because when we came outside.
00:02:38No.
00:02:39Was your dog on a chain on a leash?
00:02:41Yeah.
00:02:41Well, what kind of leash?
00:02:43That's not right.
00:02:45Yes.
00:02:45That's not true.
00:02:46Well, that's a leash.
00:02:47Right.
00:02:48That's a leash.
00:02:49She says the dog was on a chain.
00:02:50No.
00:02:51Do you have-
00:02:51Yes, it was.
00:02:52I don't have a chain.
00:02:53Shh.
00:02:54Okay.
00:02:55I don't have a chain.
00:02:55Never had a chain.
00:02:56It's been a leash.
00:02:58Okay.
00:02:58Were you outside on October 9th at the time of this incident?
00:03:03Yes.
00:03:03Were you outside when it started?
00:03:05No.
00:03:05Yes.
00:03:05I was outside on top of my stairs.
00:03:08No, you weren't.
00:03:09Okay.
00:03:10You're not allowed to answer her.
00:03:11I'll come back to you.
00:03:12Okay.
00:03:13Okay.
00:03:13So you're taking your dogs out to potty.
00:03:16Were they on a leash or off leash?
00:03:18They were on a leash.
00:03:19But she didn't have them-
00:03:20They go outside.
00:03:20Don't speak.
00:03:21Okay.
00:03:22I always have them on a leash whenever they go-
00:03:25Were they on a leash on October 9th?
00:03:27Yes.
00:03:28Okay.
00:03:28So you were taking them out.
00:03:29Although you did say, Ms. Hyland, that you let them out in your front yard is what you said,
00:03:35I believe, in your complaint.
00:03:38Let me see.
00:03:38You didn't say I took.
00:03:41You said I let my dogs out in the front yard to go to the bathroom.
00:03:46Mm-hmm.
00:03:46Well.
00:03:47When I say let them out, let me clarify.
00:03:50Okay.
00:03:51I'm always with my dogs.
00:03:52I know that you say you were always with them.
00:03:55Yeah.
00:03:56That's not my question.
00:03:57My question to you was a simple one.
00:04:00Were they on leash or off leash?
00:04:02Yeah.
00:04:03Yes, what?
00:04:04They were on their leashes.
00:04:06Mm-hmm.
00:04:07Be careful.
00:04:07You took them out on leashes in the front grass.
00:04:11Mm-hmm.
00:04:12And what happened?
00:04:13When we got down to the bottom of the steps, her dog came out from underneath the trailer
00:04:20and grabbed Faith.
00:04:22Well, she was on a leash.
00:04:24Yeah, but she grabbed her.
00:04:26The puppy started to go one way and I had Faith and dropped her leash.
00:04:32And the puppy was going like she got out of my hand and was taken off.
00:04:36And her dog was under the trailer.
00:04:39Didn't know it because I had been watching to make sure she had been inside,
00:04:44but didn't see her or the dog out.
00:04:47And she came out of the trailer after the dog grabbed Faith.
00:04:51In what location did her dog grab Faith?
00:04:54Right by my trailer.
00:04:56Right by my steps where I had my steps.
00:04:58The chain was long enough for the dog to go past the tree that was right there in between
00:05:04the two properties.
00:05:05And she came out and started beating up to my dog.
00:05:07No, no, no, no, just a second.
00:05:09You didn't have a hold of the leash.
00:05:11You're not.
00:05:11That's because the dog broke free.
00:05:14You want to continue with this case or you want to go?
00:05:16No, I want to continue.
00:05:18Then let's understand we don't talk to each other.
00:05:20Okay, so your version of the events is that her dog was chained under her trailer.
00:05:26You came out with your dogs on leash.
00:05:29The puppy ran away.
00:05:30You dropped her leash.
00:05:32Her dog got your dog and took your dog back to her trailer.
00:05:36Yeah.
00:05:36At what point did she come out of the trailer?
00:05:39After the second time, her dog had picked up Faith and Faith was screaming and I was screaming.
00:05:45Okay, Ms. Carrillo, have you ever had an incident with your dog before?
00:05:50No.
00:05:51With another dog?
00:05:52No, I haven't.
00:05:52That's a lie because you're-
00:05:53Shh!
00:05:54I want you to think carefully.
00:05:56Have you ever had another incident with your dog and another dog?
00:06:01No.
00:06:02How long have you had your dog?
00:06:03Since she was a puppy?
00:06:04Nine years?
00:06:05Since 2013?
00:06:07And this is the first time she aggressively bit another animal?
00:06:12Yes.
00:06:12Okay.
00:06:13You have information to the contrary, Ms. Hyland?
00:06:15Yeah.
00:06:16Okay.
00:06:16Because when I-
00:06:17I'd like you to tell me.
00:06:18Okay.
00:06:19When I first moved in, she even told me about how her dog had killed a couple other dogs.
00:06:25Okay.
00:06:26Tell me about that.
00:06:27She just told me to make sure I was careful with my dogs because her dog has a history of
00:06:33attacking and aggression towards other dogs.
00:06:36Well, those are conclusions.
00:06:37You first said that her dog killed two dogs and then-
00:06:40She did.
00:06:40She told me that her dog was aggressive and that it has a history of killing other dogs and
00:06:47that it had already killed other dogs and that's why she got kicked out of her last RV park.
00:06:53I've never lived at another RV park.
00:06:55That's not-
00:06:56That's my first RV park ever living at.
00:06:59Where did you live before?
00:07:00At my mom's on Ming Avenue.
00:07:02Did you ever indicate to Ms. Hyland that she should keep her dogs close to her?
00:07:07We've never spoken prior to the incident. We never, I mean, just maybe a hi. She just had moved in. I
00:07:13never spoke to her.
00:07:14You want to tell me your version of what happened on the 9th of October?
00:07:18Yes.
00:07:19I was outside on top of my stairs. I was sweeping. My dog was at the bottom of the stairs.
00:07:24I have her tied up to the stairs. There's a ring where I clip her leash to,
00:07:29so she can't go far. It's just this distance while I was sweeping.
00:07:32Would you hand that to me, please?
00:07:33And I can hear her dogs barking while they were inside.
00:07:38Would you open it up for me?
00:07:42Okay, what you're telling me is that this is what you tied onto under the stairs.
00:07:49Where did you tie it?
00:07:50This part right here, and then I have to show you how I have it put it on.
00:07:56Can you give it back?
00:07:57Yeah, let her show me.
00:08:03I'll clip it onto her harness, and then this would clip onto the bottom.
00:08:07What harness?
00:08:07My dog's harness.
00:08:09Are you telling me that your dog was on a two-foot lead?
00:08:12Yes. I have her right there when I'm right there.
00:08:15Yes.
00:08:15Okay.
00:08:15Yeah.
00:08:16Okay.
00:08:16Yeah.
00:08:17A neighbor can vouch to that.
00:08:20Yeah.
00:08:20Can I read the Bible?
00:08:21Mm-hmm.
00:08:25So you did see part of this incident?
00:08:27Correct.
00:08:28Careful.
00:08:29You saw it from your trailer?
00:08:31Correct, Newhouse.
00:08:31Mr. Newhouse, how long have you been the defendant's neighbor?
00:08:35Two, three years.
00:08:36Did you see the dog on that gizmo?
00:08:39Yes.
00:08:40How far do you live from the defendant?
00:08:43I'm directly behind Sierra.
00:08:44I'm just right behind her.
00:08:46Behind hers.
00:08:46So you face the back or the front of her trailer?
00:08:49The front of my trailer faces the back of her trailer.
00:08:51The door is the same direction towards the yard.
00:08:54So that you don't see her front door?
00:08:57Her trailer is angled so that I can see her front door.
00:09:00Okay.
00:09:01You want to tell me your version of what happened on the 9th?
00:09:04I was outside on top of my stairs.
00:09:06My dog was at the bottom.
00:09:08On this thing?
00:09:09On the bottom, I have a hook that I clip her leash to.
00:09:13And she was sunbathing right there.
00:09:16I moved her other places, but while I was there sweeping on top,
00:09:20she was right there.
00:09:21So then I hear her dogs inside.
00:09:24They were barking.
00:09:25And then all of a sudden, I hear the door open,
00:09:27and the dogs just come rushing both of her dogs.
00:09:30They had leashes on, but she wasn't holding the leashes.
00:09:34And then my dog grabbed her dog.
00:09:36And I yelled at my dog and whacked her in her head.
00:09:39And she dropped the dog.
00:09:40And then that's when she was on her way.
00:09:42How did that happen?
00:09:44What do you mean?
00:09:44Your dog is on a two-foot lead.
00:09:46You heard her dogs coming out.
00:09:48You were on top of the stairs.
00:09:50Yes.
00:09:50You saw her dogs, according to you, running.
00:09:53And your dog is on this much.
00:09:55This much.
00:09:55This much.
00:09:56Yes.
00:09:57No, actually not that much, because you made a loop.
00:10:00Yeah, that's the way I do it.
00:10:03Well, not a moment ago.
00:10:04I did it the wrong way.
00:10:04You made a loop.
00:10:05So it was on about this much.
00:10:07And on about this much lead,
00:10:10your dog picked up her dog in the mouth how many times?
00:10:13Just that one time.
00:10:15And it's this long.
00:10:16You can see where the area is all dirt,
00:10:19where she stays on and runs around or misses in the dirt.
00:10:24The grass is still right there where it's nice and green.
00:10:27And the area that she sits in is right there,
00:10:29right in front of my stairs.
00:10:31And so your dog grabbed her dog in the mouth,
00:10:35well, close to your trailer.
00:10:37At my trailer, yeah.
00:10:37At your trailer.
00:10:39And then you hit it on the rear end and she spit out the dog.
00:10:43Yes.
00:10:43And then?
00:10:44And then she ran towards her and she came towards her dog.
00:10:48This little dog ran towards the plaintiff.
00:10:51The plaintiff ran towards her.
00:10:53And what did you do?
00:10:54She went to get her dog and I grabbed my dog.
00:10:57What did you do?
00:10:57How did you grab your dog?
00:10:58I took her off her leash and put her inside.
00:11:01And then I went to see if her dog, you know,
00:11:03is your dog okay?
00:11:04You know, you should have had a hold of her leash.
00:11:07And what did you say to her when you came out?
00:11:09Is your dog okay?
00:11:11Okay.
00:11:11Is your dog okay?
00:11:12And what did she say to you?
00:11:13I can't remember.
00:11:14She was just, you know, your dog, got my dog.
00:11:17I'm like, how come you didn't have the leash?
00:11:19They were on leashes, but she wasn't holding them.
00:11:21And she said because of her legs that she couldn't.
00:11:24And I told her, then you shouldn't have dogs
00:11:26if you can't take care of them.
00:11:27Just a second.
00:11:27Is that what you said to her?
00:11:29You shouldn't have dogs if you can't take care of them?
00:11:31If you can't take, I mean, they can't be loose.
00:11:33There's a leash lock and she didn't have the leash.
00:11:35She had leashes on them, but she didn't have a hold of them.
00:11:37I'm just asking you.
00:11:38Yeah.
00:11:38That's what you want me to believe you said to her.
00:11:40That's what I said to her, yeah.
00:11:42You know, you shouldn't have dogs if you can't take care of them.
00:11:44That's what I said, yes.
00:11:45Okay.
00:11:46And did you see her dog injured in any way?
00:11:49No.
00:11:49Can I see the records from the vet, please?
00:11:52Yeah.
00:11:53And here's even photos.
00:11:55And was there a report made to either the RV?
00:11:58There was photos.
00:11:59Shh.
00:12:00I didn't finish my question.
00:12:01Was there a report made to the RV park or to the police department?
00:12:06Yes.
00:12:07May I see that too as well?
00:12:08I don't have the RV park or the police report.
00:12:12They could not.
00:12:13Okay.
00:12:13Not they could not.
00:12:14They were sending me all over.
00:12:15The answer is I don't have them.
00:12:17Yeah.
00:12:17But that's just photos from the injuries.
00:12:25Now, I'd like to see the vet report, please.
00:12:27This is the neurology.
00:12:29This is all the other vet stuff.
00:12:32Don't give me a whole bunch of stuff.
00:12:34I'd like to see the reports and the bills from the vet.
00:12:40And I am correct.
00:12:41So you did not see any of this incident.
00:12:43Is that correct?
00:12:45The commotion.
00:12:46I'm asking you when she smacked the dog.
00:12:48I'm asking you.
00:12:49No, no, no, no, no, no, no, no, no, no.
00:12:50Stand up.
00:12:52Let's be very careful about your answer.
00:12:54Am I correct that you didn't see any of this incident?
00:12:58Only after she had smacked the dog and he dropped the dog and they were,
00:13:03that little commotion right there where she picked up the dog and went in the house.
00:13:05You saw it from your trailer, from your RV?
00:13:08Sitting outside my trailer.
00:13:09So I want you to tell me exactly what you saw.
00:13:14Now, look at me.
00:13:14Her?
00:13:15Who's her?
00:13:16Um, Sarah.
00:13:18Her picking up her dog and going back to her house.
00:13:21Where was she when she picked up her dog?
00:13:24No.
00:13:25I tell you what you're going to do.
00:13:26You're going to show me right here.
00:13:27Like half of the thing, her house and her house.
00:13:30I mean, her house.
00:13:33Put a mark where you saw her, where she picked up her dog.
00:13:37Oh, may I have that, please?
00:13:41Strike it somewhere.
00:13:44Like a couple feet away.
00:13:49So she picked up her dog right near Miss Carrillo's RV.
00:13:54Correct.
00:13:55Yes.
00:13:56And where was Miss Carrillo?
00:13:57She took the dog and put it up the stairs, put it in the house,
00:13:59and shut the door and came back out to see.
00:14:01And at that time, were you listening to what the two women were saying to each other?
00:14:05Not really.
00:14:06Were they yelling at each other or were they calm?
00:14:08It was yelling.
00:14:10So if they were yelling, could you hear what the yelling was?
00:14:13I didn't know either one of them at that time really that well.
00:14:16I think I went back in the house at that point.
00:14:19You've been most helpful.
00:14:21Okay, you have the report for me from the 9th of October?
00:14:24Yeah.
00:14:25I'd like to see it.
00:14:33Okay, so there was one set of stitches that the dog had.
00:14:35That was her first surgery.
00:14:37Okay.
00:14:38Let me see the second time she was there.
00:14:40This is the stuff for that one.
00:14:48And that's what the, why?
00:14:51Well, this was the day afterwards.
00:14:53And when did she go back?
00:14:54It was June 30th because she was having grandma seizures and they had to keep her
00:15:00because they had to start her on phenobarbital because of the eye injuries and the head injuries.
00:15:07Well, it doesn't really talk about those injuries.
00:15:10That's in the pictures.
00:15:11It shows where her head was punctured.
00:15:14I see one wound and I don't see a photo.
00:15:18On the picture itself, if you see her head, there's a mark right here on her head by her eye.
00:15:26That was a puncture wound that they had to clean out.
00:15:29Okay.
00:15:30The defendant says both dogs had a leash on, but the leashes weren't attached to your hand.
00:15:36Is that correct?
00:15:38I, honestly, I don't remember because most of the time when I'm coming down the steps,
00:15:44I have their leash in hand and sometimes like going down the steps, I lose the leash
00:15:51or I drop it and they are at the bottom of the steps waiting for me because
00:15:56they know it takes me a minute to get down the steps.
00:15:59Okay.
00:16:01If you're standing on your steps sweeping, you see her dogs running across,
00:16:06then you jump down, run across the lawn.
00:16:09No, she was right by the steps because the tree is right there.
00:16:14It was like in between our spaces isn't even as big as this.
00:16:19In between here and your front of the bench.
00:16:23Of the bench.
00:16:24And literally she was grabbed right by my steps.
00:16:28Was any report made by you to any animal control?
00:16:32I'd called 911 and reported it and they can't find the report, but it was done over the phone
00:16:39and I waited for them to come out for a week and I kept calling them.
00:16:44Did you?
00:16:44But I did it over the phone with them.
00:16:47Did you ascertain from the defendant whether her dog was up to date in rabies shots?
00:16:53I didn't ask any questions.
00:16:55Afterwards, I was just trying to make sure and find out what was going on with her.
00:17:00Did anyone from the RV park come and discuss the incident with you?
00:17:04They just asked me what happened.
00:17:05Just a second.
00:17:06So the answer is yes.
00:17:08Do you have any sort of documentation of that discussion that they had with you?
00:17:13There was no documentation.
00:17:14Do you remember the name of the person that you spoke to?
00:17:16Yes.
00:17:17Are you still at the RV park?
00:17:19Yes.
00:17:19Did you tell the RV park that there was a witness to this event?
00:17:24No.
00:17:25Well, there were two different versions of the event.
00:17:27One says that your dog came and attacked hers.
00:17:30And you say that her chihuahua came and was aggressive towards your dog.
00:17:35But you have allegedly an independent witness who saw part or most of it who you brought to court today.
00:17:41I assume that the plaintiff communicated to the RV park that your dog was at fault.
00:17:47Correct?
00:17:47Yes.
00:17:48And you say your dog was not at fault.
00:17:50Is there any reason why you didn't tell the RV park that there was a witness?
00:17:54Oh, because I didn't know yet.
00:17:56When did you find out that he had seen anything of the event?
00:18:00Maybe like three weeks after.
00:18:02Tell me about that.
00:18:03How did you find out that he had seen any part of it?
00:18:07Because I was talking to him about what was going on, that she was going to take me to court.
00:18:11And then he said that he had seen.
00:18:13So now you were talking to your neighbor.
00:18:15Right.
00:18:16Which meant that you must have been at least somewhat friendly towards him.
00:18:21At that time, yes.
00:18:22At the time of the incident on the 9th of October.
00:18:25We didn't know each other that well.
00:18:27But you had lived there for a long time.
00:18:29How long did you live there?
00:18:30Since July 20th.
00:18:32And how long has he been living there?
00:18:35How long have you been living there?
00:18:37A long time, 20 years.
00:18:38Long time, 20 years.
00:18:39So my question is, what prompted you three weeks later to have a discussion with him?
00:18:44Because I started to get to know him by then.
00:18:46I worked.
00:18:47I worked at that time.
00:18:48I worked a lot.
00:18:49You know, so I started to conversate with my neighbor.
00:18:53That's, mm-hmm.
00:18:55Okay.
00:18:55How much were your vet bills?
00:18:57This point, it's over $10,000.
00:19:00Have they been paid?
00:19:01Most of them.
00:19:02Okay.
00:19:03I'd like to see the bills.
00:19:04The last bill.
00:19:06And can I say something about what she said?
00:19:08Yeah.
00:19:09First of all, she was in there way before I was.
00:19:12She had already been there over a year.
00:19:14And second of all, the thing is, is she couldn't have said anything three weeks after,
00:19:20because it wasn't after until my leg recovered from having to have emergency surgery from falling
00:19:26right after the incident happened that I even decided to file court papers.
00:19:31So the court papers weren't even filed until June.
00:19:35I didn't say they were filed.
00:19:36You said three weeks after.
00:19:38But anyways, so like all that happened back in October.
00:19:47And I literally couldn't get to the courthouse to be able to drive to the courthouse.
00:19:54How much do you owe the vet?
00:19:55What I've already paid is over $2,000 or right around $2,000 in cash that I've paid.
00:20:02But to get her MRI, I need to pay $3,000.
00:20:06Just, there is no nexus that can be drawn between the seizures that she's having now,
00:20:12other than the, I'm speaking, other than the vet saying that it's possible that it can be caused by trauma.
00:20:19Other than that, that's the only thing I saw there.
00:20:21There was not a full report that said the trauma that she had six months before was the basis for these seizures that she's having.
00:20:30Seizures, she's 11 years old.
00:20:32She was having seizures right after the attack.
00:20:34Ms. Hyland, you have to understand that you need an expert witness that you don't have to demonstrate
00:20:41that the seizures that your dog is currently having is a direct result of this dog attack.
00:20:47Right.
00:20:47Do you understand?
00:20:48Faith is 11 years old and it's possible, just a second, it's possible that it comes from that.
00:20:55It's possible it comes from something else.
00:20:57I don't deal in possibilities.
00:20:58All I want to know is what vet bills you paid for October 9th and October 10th.
00:21:06The actual total was $1,526.62 without her medicine being involved.
00:21:15Okay, well that's a reasonable vet bill for those two dates.
00:21:19She did have two different surgeries and the medications that you're talking about were
00:21:24also included in that $1,526 other than for the seizures that you want me to draw a connection
00:21:31with if I'm not.
00:21:33And nothing more is owed to the vet for those two days, October 9th and 10th.
00:21:38Okay, Ms. Carrillo, I have to make a determination as to whether or not I believe the story that her
00:21:45two little dogs rushed up to your dog that was being chained to a step on a very, very short lead
00:21:52with you standing right there and whether or not I believe that you stood there while your dog that
00:21:58was on a very short lead that has never had any problems with aggression before picked up her dog twice.
00:22:05Because once she had puncture wounds in the stomach and once she had puncture wounds around the head.
00:22:10And I don't believe you.
00:22:12Quite frankly, I don't believe you.
00:22:14I think you're responsible for her vet bills.
00:22:16I think you would have indicated.
00:22:18Didn't she say that she didn't have the leash?
00:22:20That she wasn't sure if she was holding the leash?
00:22:22Absolutely.
00:22:23I don't answer your questions.
00:22:26If you're standing on your steps sweeping and your dog is now chained and you see her dogs running across,
00:22:35then you jump down from the step and you grab your dog.
00:22:39That's what you do.
00:22:40You have a very big dog that you keep on a very short, according to you, chain.
00:22:45And there's a reason for that.
00:22:46So if you're standing for that, this is not a question and answer.
00:22:50You're responsible for our vet bills.
00:22:51I believe her.
00:22:52One thousand five hundred and twenty six dollars.
00:22:55Judgment for the plaintiff.
00:22:56We're finished.
00:22:57This court is adjourned.
00:23:00They behave like even in the courtroom.
00:23:03She did get bitten by my dog, but you know, they listen.
00:23:08Like if I start counting to three with them.
00:23:11It was about her not having them on the leash and having control of her dogs.
00:23:15They go and do what they're told.
00:23:17About her dog getting hurt.
00:23:18I mean, I went to see if it was OK.
00:23:21Because that's how she is.
00:23:22That if my dog bites another dog, I'm going to have to pay.
00:23:27So one thing I found interesting about that defendant's testimony was that when you were in your
00:23:31line of questioning about whether or not her dog had ever been in another fight or
00:23:37with any other dog, any interaction, she said no.
00:23:41I thought I remembered when I was reading her answer, she stated that she had a mutual
00:23:46understanding with the plaintiff that when her larger dog was outside, the plaintiff's dogs
00:23:51would be kept inside.
00:23:52Why would you need to have that sort of mutual understanding unless you knew that your larger dog
00:23:57had a propensity for violence towards other dogs?
00:24:00That's true.
00:24:00You know, I forgot that you mentioned it.
00:24:03I remember that I read about this mutual agreement.
00:24:07Yeah.
00:24:07Yeah, I wouldn't think that she was afraid that the chihuahua would attack her dog.
00:24:11Probably not.
00:24:12Probably not.
00:24:13Hi, Kim.
00:24:14So everything started here.
00:24:16We eventually tried separating the dogs towards this way.
00:24:18Mr. Alonzo was dragged from this area down.
00:24:21The car was parked here.
00:24:22So we managed to put the dog on top of the car.
00:24:25And Mr. Alonzo was on the floor wrestling his dog to control him.
00:24:30You took your dog to the vet?
00:24:32Immediately, yes.
00:24:33You have the vet report and bill.
00:24:34I do.
00:24:35May I see it, please?
00:24:36Of course.
00:24:36Kevin.
00:24:42So your vet bills look in total to be about $4,600.
00:24:53About $58, if I'm not mistaken.
00:24:55OK, I may have missed one.
00:24:56He suffered a level four bite wound and from the...
00:24:59He was very seriously injured.
00:25:00There's no question.
00:25:01He was very seriously injured.
00:25:03Spent a long time in the hospital.
00:25:05OK, Mr. Alonzo, the ball is in your courts.
00:25:08I'd like to hear your version of what happened.
00:25:10The day on April 28, what happened,
00:25:12I was walking my dog with a leash.
00:25:14That's what I usually do every day before I go to work.
00:25:17That's not true, Your Honor.
00:25:19Shh, don't speak.
00:25:19That's what I usually do.
00:25:20I don't care.
00:25:21Mr. Alonzo, I want you to understand something.
00:25:24Yes.
00:25:24I don't care what you usually do.
00:25:26OK.
00:25:27And there are certain things that are common sense.
00:25:29All right.
00:25:30Do you understand?
00:25:30Yes.
00:25:31OK, I was on April 28, I was walking my dog on a leash.
00:25:34And I also want to tell you to be very careful what you tell me.
00:25:38OK.
00:25:38Very careful.
00:25:39April 28, I was walking my dog on a leash.
00:25:42Show me where you are.
00:25:45I was walking to the left, right here.
00:25:47That's my house on the green.
00:25:49I know where your house is.
00:25:50OK.
00:25:50I was walking to this.
00:25:51When I noticed that the gate was open,
00:25:53and then when I was getting close by,
00:25:55her dog started coming out, barking to the sidewalk,
00:25:58biting my dog in the legs.
00:26:01OK?
00:26:02Biting my dog in the legs.
00:26:03Then when I started pulling out my dog from their dog,
00:26:07that's when Juan and Grecia came out.
00:26:09They start, so they start grabbing their dog, too.
00:26:12OK?
00:26:13Grecia even apologized after the dog to the bed.
00:26:16And then later on, when she received the bill,
00:26:18she wanted me to pay her back.
00:26:20I said, shh, shh, shh, shh.
00:26:22I said, I wasn't going to pay her back,
00:26:23because it wasn't my fault or my dog's fault.
00:26:26That they leave the gate open, and their dog unattended.
00:26:29I want to tell you something.
00:26:30I do not believe you.
00:26:31Why not?
00:26:32I don't answer questions.
00:26:34I get answers to questions.
00:26:36And then I have to say to myself, these two people,
00:26:39they were going to work at 4.30 in the morning.
00:26:42You were out of the same hour.
00:26:43Do you work at that hour?
00:26:45Yes, ma'am.
00:26:45I was about to go to work, too.
00:26:48That's what I was taking my dog out.
00:26:49There are other adults in the house?
00:26:51Yes, I have two more.
00:26:53OK.
00:26:53They were all sleeping at 4.30 in the morning?
00:26:55Yes, ma'am.
00:26:56OK.
00:26:56So you opened your door,
00:26:58and you have to understand, sir,
00:27:01I am particularly unabashedly sensitive to pit bulls
00:27:07who are unleashed or not watched.
00:27:10Your dog is four years old.
00:27:11I don't know.
00:27:12I assume you have had no prior incident with your dog.
00:27:16No, ma'am.
00:27:17OK.
00:27:17That's not true.
00:27:18We'll get to it.
00:27:19Last article I keep them in my desk drawer about pit bulls was
00:27:24a baby, a three-month-old baby,
00:27:26left alone for a second with a pit bull.
00:27:28The pit bull gnawed off his hands.
00:27:30That was last week.
00:27:32So you have to understand that I'm particularly sensitive
00:27:36to a large animal that's capable of causing serious injury,
00:27:40being unattended for a second.
00:27:43You answered my question very quickly
00:27:46whether your dog, Max, had had any prior incidents.
00:27:49You said no.
00:27:50Plaintiff seems to say that that's not true.
00:27:54Now, she's going to tell me about a prior incident,
00:27:57unless you want to tell me about it first.
00:28:06Your answer is you don't know about a prior incident
00:28:11with your dog.
00:28:12Yes.
00:28:13I don't know about it.
00:28:13Is that right?
00:28:14Yeah.
00:28:14Why don't you tell me what you know?
00:28:16First things first, I have an animal control report
00:28:19that proves his statement of his leashed dog incorrect.
00:28:23May I see it, please?
00:28:24This is the second attack.
00:28:37Well, this recites your version of the events.
00:28:40Correct.
00:28:41And the report indicates your Reuben, is that correct?
00:28:45Yes.
00:28:46That you ran out to the scene to try to separate your dogs.
00:28:51Did you speak to animal control?
00:28:53Yes, I did.
00:28:53You spoke to them on what date?
00:28:55Two days after, Linda.
00:28:57May 1st.
00:28:58Yes.
00:28:59So you spoke to them?
00:29:00Yes.
00:29:00Then this write-up incorporates what you told them,
00:29:04which is consistent with what Ms. Galvin testified to, sir.
00:29:08Okay. I don't know where you are showing me
00:29:12that this was not the first instance.
00:29:15So the first instance was about a little bit over a year ago,
00:29:18where his dog attacked my dog and he didn't break skin.
00:29:23So animal control refused to create an actual incident report.
00:29:26Tell me when that was.
00:29:28That was about a year ago?
00:29:29Yes. So it was actually my mother who was walking my dog.
00:29:33I was out of state at the time.
00:29:34I have a witness statement, if that helps for anything.
00:29:37But my mother was walking the dog, where his dog was...
00:29:39You were not there.
00:29:41No, but...
00:29:41But I can't take that evidence because it's hearsay.
00:29:44Okay.
00:29:45Do you understand?
00:29:46Okay. I understand.
00:29:47The second attack was on a 10-year-old German shepherd
00:29:49walking in front of our house, walking on a leash by his owner.
00:29:52And again, the dog was out loose,
00:29:55without a leash or collar, where he attacked the German shepherd.
00:29:59Was that within the year?
00:30:00That was late January, yeah.
00:30:02Late January of this year?
00:30:04Correct. Only five, six months ago.
00:30:05Did you observe that?
00:30:07I did.
00:30:07I assisted in separating and keeping the German shepherd safe.
00:30:11Who came out of the Alonzo house to retrieve their dog?
00:30:15Was it Mr. Alonzo, or his son, or one of the other children?
00:30:18I think it was his younger daughter.
00:30:20What's your younger daughter's name?
00:30:21No, I got two. They're twins.
00:30:23So I don't know which one she's talking about, because I never...
00:30:26Well, you know them both, right?
00:30:27Yeah, I know them both.
00:30:28Just a second. Listen to me carefully.
00:30:29Okay.
00:30:30You know them both.
00:30:31Mr. Alonzo, I don't want you to play with me.
00:30:33I'm not playing with you, Your Honor.
00:30:35So there's no question that if anything happened with a German shepherd and one of your twins,
00:30:41who were not babies, came out and retrieved your dog, they would have told you about it.
00:30:47I haven't heard nothing from that.
00:30:49Really?
00:30:50He was involved, Your Honor.
00:30:51What?
00:30:52I spoke to him about the situation just days after the last incident with him.
00:30:56I brought the German shepherd and the owner and I...
00:30:58It was the proof.
00:31:02Now it's documented that your dog has attacked at least once.
00:31:07And if you let that dog or any of your other dogs out,
00:31:11they're going to take that dog and destroy it.
00:31:14You do know that.
00:31:15Yes, we do.
00:31:15And that will be your fault.
00:31:19Ruben claims their dog was off leash and started the fight.
00:31:23Just a second.
00:31:24He said, your dog barks a lot.
00:31:27That's why my dog attacked him.
00:31:28Your Honor, if my dog knew how to talk, we wouldn't be here.
00:31:31Just a second.
00:31:32When you say that after this attack on your dog, the serious one.
00:31:37Correct, yeah.
00:31:37You brought the German shepherd.
00:31:39Whose German shepherd was it?
00:31:40Somebody that lives in our community.
00:31:42And the owner?
00:31:43Yes.
00:31:44To see Mr. Alonzo.
00:31:45Correct.
00:31:45Because Mr. Alonzo said that my dog was barking too much and that's why Max attacked him.
00:31:51Okay.
00:31:52So now you bring the German shepherd.
00:31:54Your dog, Yogi, is it the vet?
00:31:56No, this is a few days post-op.
00:31:58My dog was recovering inside, indoors.
00:32:00Okay.
00:32:01So your dog is indoors, but it wasn't with you when you went to confront Mr. Alonzo with the German shepherd.
00:32:06Yes.
00:32:07And the owner of the German shepherd.
00:32:08Correct.
00:32:09Okay.
00:32:09And can you tell me what Mr. Alonzo said during that confrontation about the German shepherd?
00:32:17Not your dog.
00:32:18What did he say about the German shepherd?
00:32:20Nothing.
00:32:21His demeanor was very aggressive.
00:32:23He turned.
00:32:24He was up putting on some cameras in his home.
00:32:27He turned, did not say a word, and turned back around.
00:32:30And his son was there as well.
00:32:31Really?
00:32:32Yeah.
00:32:33Stand up.
00:32:35Over there, please.
00:32:36Your first name?
00:32:37Jason.
00:32:38Jason.
00:32:39Do you remember Miss Galvin coming to the house?
00:32:41Your father was there.
00:32:42She was there with a German shepherd and its owner.
00:32:44That's a yes or a no?
00:32:45Yes.
00:32:46Okay.
00:32:46Were you close enough to hear the conversation?
00:32:48That's a yes or a no?
00:32:49Yes.
00:32:50Did you hear the conversation about your dog at some point having a confrontation with the German shepherd?
00:32:57Yes, I did, Your Honor.
00:32:58Tell me what you heard.
00:32:59The plaintiff ended up bringing the owner of the dog over and he...
00:33:02The owner of the shepherd?
00:33:03Yeah, the owner of the shepherd.
00:33:04And he said he didn't want to start no problems or nothing.
00:33:07He didn't want to?
00:33:08He didn't want to start any problems.
00:33:09Who said?
00:33:10The owner of the shepherd?
00:33:11The owner of the shepherd.
00:33:11The owner of the shepherd said, I don't...
00:33:13He said it was an accident and stuff happens and he didn't want no problems with this.
00:33:16That's not true.
00:33:16I want to know, before he said that, what was said about Max attacking the shepherd?
00:33:24The plaintiff was claiming that...
00:33:25Plaintiff said...
00:33:26...that Max bit the German shepherd.
00:33:28Okay.
00:33:29And the German shepherd and the German shepherd's owner was there.
00:33:32Correct.
00:33:33What did your father say?
00:33:35He was just quiet during the instance.
00:33:36Just a second.
00:33:37So he said nothing?
00:33:39Correct.
00:33:39Did you say anything?
00:33:41At the current moment, I was actually holding the ladder stand because he was on a 10-foot ladder
00:33:44installing cameras.
00:33:45That is very unsafe for me to try to tell him anything.
00:33:48Just a second.
00:33:49Did he come down from the cameras?
00:33:51He was still installing the cameras as they came up.
00:33:53Well, now there are two people there.
00:33:55One person there with a dog that he knows has been seriously injured by his dog.
00:34:02And a German shepherd who I'm absolutely positive that one of your sisters discussed with him had an
00:34:11incident some months before.
00:34:13Don't say no, because I have to tell you something.
00:34:15You lied to me once.
00:34:17You lied to me once, sir.
00:34:18Yeah.
00:34:18The accident wasn't a...
00:34:21Nobody said nothing to me about it.
00:34:22That's why I didn't talk to the guy, because I don't know if she...
00:34:25Well, you talked to her.
00:34:26What I'm telling you, Mr. Alonzo, is you lied to me once.
00:34:29I believe nothing else.
00:34:31Certain things are common sense.
00:34:32I have children.
00:34:34I've had dogs.
00:34:35If one of my dogs was involved in an incident, and I was involved in separating them, and I was
00:34:40involved in making the situation better, when my parent came home from work, I would say,
00:34:45let me tell you what happened.
00:34:47And they would tell you.
00:34:48Or they would tell their older brother what happened.
00:34:52And the older brother might tell you, but somebody would tell you.
00:34:57It wasn't brought to my attention.
00:34:58It wasn't brought to your attention.
00:34:59I'm going to bring something to your attention.
00:35:01Do you have homeowner's insurance?
00:35:03Do you own your house?
00:35:04I don't own a house.
00:35:04I rent the house.
00:35:05You rent the house.
00:35:06Do you have renter's insurance?
00:35:08Yes.
00:35:08Does the renter's insurance that you have know that you have...
00:35:11Not a French bulldog, because that's what it says here.
00:35:14Somebody identified your dog as a French bulldog.
00:35:17French bulldog is different from a bully.
00:35:20I have a license that says it's not even a people.
00:35:23It's an American bully.
00:35:25It's classified in its own.
00:35:26I actually know what an American bully is.
00:35:30It's not a French bulldog.
00:35:31Do you have a French bulldog?
00:35:33We do not.
00:35:34Your Honor, he has three in his garage at the time.
00:35:36And sometimes when he illegally breeds, he has seven or eight at a time.
00:35:40It's not illegal.
00:35:40Not true.
00:35:41We've got papers to prove that.
00:35:42We're licensed breeders, Your Honor.
00:35:44All of our dogs are purple ribbon UKC show dogs.
00:35:47That doesn't make this dog any less vicious.
00:35:50Correct.
00:35:50Do you understand?
00:35:51Yes, I do, Your Honor.
00:35:52Dog caused serious injury.
00:35:55And either your father is just in a total state of denial or he hasn't been introduced to the truth.
00:36:01I don't know which one it is.
00:36:03Either way, I'm entering a judgment for them for the full amount of their vet bills.
00:36:08Now it's documented that your dog has attacked at least once.
00:36:13And if you let that dog or any of your other dogs out, they're going to take that dog and destroy it.
00:36:20You do know that.
00:36:21Yes, we do.
00:36:21And that will be your fault because you're the owner and the responsible person to make sure
00:36:27that a dog that is capable of serious physical injury, serious physical injury, doesn't injure a
00:36:34person or another animal. That's your responsibility and any other adult who lives in the house.
00:36:39Judgment for the plaintiff in the amount of $6,500. We're done. Thank you.
00:36:43This court is adjourned.
00:36:44Taking the decision was bad. I mean, they tried to like, um, consider my dog a pit bull.
00:36:54He's not a pit bull.
00:36:55She was just, she followed the truth and that's all we could have asked for.
00:36:59Their dog got out and started biting my dog. So my dog defended himself.
00:37:03It's a lie. It, he never, he came and there was never a leash, no, neither a collar.
00:37:18And that's when, that's when the dog started attacking the dog and myself.
00:37:21Probably set up another fence in front of our yard, probably established something
00:37:25a little bit more secure than what we have now.
00:37:27I've had him for more than half my life. I mean, that's my companion, my bud, my best friend.
00:37:31And to see him in pain from like weeks after was even equally as traumatic as the incident itself.
00:37:38I definitely would say be avoided. We will be taking precautions going forward,
00:37:42make sure this doesn't happen again.
00:37:43The truth always comes to light.
00:37:46I always say if you choose to get a breed of dog, that's your choice. And if the dog,
00:37:53for some reason, and dogs can go off, tax you, that's, you're a grownup, you've made a conscious
00:37:58choice. But when you bring a dog that has the potential of causing serious physical injury
00:38:04or death into a house with young children, I actually think that that should be an absolute
00:38:09liability for people who do know that certain dogs have the capacity to maim. And despite that,
00:38:17they choose that dog and bring a dog into a house with toddlers and infants. I just think that that's
00:38:25so irresponsible. I have a draw full of those. I have seen it. I know you too.
00:38:31Of those cases that just are heartbreaking. If I could give you the reader's digest of what he was
00:38:38saying and tell me if that's what you understood, would you do that for me? They ordered 320 t-shirts
00:38:45for all intents and purposes. And because of our easy math, he sent them half. They paid for 320.
00:38:52What he's saying is because they kept making changes, they spent more time on the half
00:38:58half that they got. So they didn't feel that they had to send them the other half. Is that what you're
00:39:06getting? Yes. That's a duh. Do you understand? That's a duh. You know, I'm trying to think of an
00:39:13analogous situation for you. I'm a dentist starter. And I know that sometimes in my father's business,
00:39:19somebody would come in and he'd look at a tooth and he'd say, you know what? It's a simple filling,
00:39:26you know, and I'm going to charge so much. And then he started to work. The patient said,
00:39:32okay, you know, that's a reasonable figure. And he started to work. And all of a sudden,
00:39:35he found, well, there was a little something else in there that he really had to do in order to do
00:39:41what he said he could do for 20 bucks. And so it took him more time. You think he charged the
00:39:47patient for that? No, he didn't. So you at least owe them half of what they sent you.
00:39:54They sent you $8,000. Let's make it nice and easy because I'm an easy girl. And you didn't send them
00:39:59half the t-shirts. Now we're going to talk about the t-shirts that you did send them. Because are we
00:40:05finished with the ones that he didn't? Yep. Yep. Now we're going to go to the ones that they did send.
00:40:11And you have to show me why they were unsatisfactory. Pick it up. Perfect. So this is the
00:40:19sample that we received from him. So like the way samples work is he'll send us the clothing.
00:40:23We'll A-OK it. So we A-OK this. This is a large, by the way. Everything's perfect. Everything's great.
00:40:27Okay, good. So let me show you the XL and the small. So this right here I'm holding is an XL.
00:40:34The difference. You want to see another thing? Dramatically smaller. This is what I'm holding
00:40:40is a small. We would have four small sizes. Small, medium, large, and XL.
00:40:44Hold on. Can I see the smalls? Yeah. Can I see?
00:40:47Still sorry. Still sorry. Here you go.
00:41:00Well, this could be a small. A big small. But small. Can I see the extra small, please?
00:41:05Uh, extra large. Extra large? Yeah. Yeah.
00:41:10Same exact size. They're the same size. The small and the extra large,
00:41:14if you hold them up together, they're exactly the same size.
00:41:17Lexi, hold these up together, would you please?
00:41:20Let me see. He said they're the same size.
00:41:27I don't think so. Could I?
00:41:30One certainly looked bigger to me. But not, not a small and an extra large.
00:41:40Okay. Now, this is what I'd like you to do, Cassandra. I want you to send these over to the
00:41:48defendant. And I'd like him to explain to me why these are the same size. One is labeled small.
00:41:56One is labeled extra large. This has nothing to do with a change of design.
00:42:01Mm-hmm. This has to do with almost math, which, as we all know, is not my strong suit.
00:42:08Okay. So now give me an explanation, sir. This has nothing to do with changing of the design.
00:42:13That has to do with two t-shirts that are exactly the same. One says small, one says extra large. Explain it.
00:42:19This is a very simple fix. So there was just an issue with the tag in the labeling.
00:42:23Just a second. That's what you sent them. Yeah, that's exactly my explanation. No,
00:42:28well, this is for the actual garment. What I was referring to was the print on the design.
00:42:32No, no, no. I'm talking about the actual garment. Did you send that to them?
00:42:35I did. Just a second. You sent that to them with a label that was mislabeled.
00:42:41Correct. Okay. How many of the mislabeled t-shirts did you send them?
00:42:47It's a very common mistake in manufacturing. Don't give me.
00:42:50I'm not sure. They didn't give me a number of how many. How many? How many?
00:42:54Exactly 73. You see, what the problem, Mr. Garcia, is they can't sell those online because if somebody
00:43:02calls and orders a small and they send them a small, it's an extra large. Or if somebody calls
00:43:09and orders an extra large and they get it and it's got a small. And that could be easily fixed by just
00:43:14changing. Oh, Cass, you know, my face can be easily fixed. Both. Not so easily anymore.
00:43:21These are all just fixed. Yeah. I mean, they can all be fixed. Yeah.
00:43:24When it happens, it doesn't always like have to be sent.
00:43:27Oh, yada, yada, yada, yada, yada. Okay. So half you didn't send them and 73,
00:43:32you sent them wrong. Of the other half, 73, you sent them wrong.
00:43:34Labeled wrong. Correct.
00:43:35You sent them wrong that they can't resell as you sent them online. I mean, they could send them
00:43:41to a pop-up store and sell them for nothing. You know, you try it on and see whether it fits you,
00:43:48but you can't sell them online. Otherwise, their business would be destroyed. Okay. What about the
00:43:52rest? Now we're finished with the sizes. So he has claimed to sent us over 180 shirts. That's
00:43:58incorrect. He sent us 123 exactly. You have any proof that you sent them 180 shirts?
00:44:03Uh, I had them in text messages, but I don't have that phone. But I mean, I'm sure that...
00:44:07Everybody, you know, everybody that has no case has no phone. I mean, I have...
00:44:10Mr. Garcia, everybody that has no proof, everyone then show it to me that you sent them 180 shirts.
00:44:18Well, I don't have all 180 in the picture. I have, I mean, I don't know if you'll be able to count them,
00:44:23but... You want me to count them? You're in business. Mr. Garcia.
00:44:28I don't know. You're in business, sir. That's not the way you run a business. 120.
00:44:35They sent them. Of the 120, how many were you able to sell?
00:44:39Out of the 120? Just a second. And out of the 120,
00:44:43does that include the 73 that were wrong size? Yeah.
00:44:47Yeah. Oh, that includes... So we're left with only 50 that weren't labeled incorrectly.
00:44:52How many shirts did he send you that you were able to sell?
00:44:58Zero. We sold none of his shirts.
00:45:01Because they were mislabeled or you didn't get them?
00:45:03Mislabeled or misprinted and didn't get them. Great.
00:45:05Do you have any text messages between the two of you?
00:45:09Just so many. Anything in specific?
00:45:12I'd like you to show me one where you say to him,
00:45:16we cannot sell these shirts. They're the wrong size.
00:45:19We'll show you the demand letter.
00:45:20So we sent him a demand letter, hoping that he'd still like try to solve it outside of court.
00:45:27But he never replied to it and just never senses anything.
00:45:29It'd be us telling him that the items received were not as promised,
00:45:32and the other side would be the lawsuit issue.
00:45:34Okay.
00:45:41You say in this demand letter that you are requesting a...
00:45:46First of all, he doesn't communicate with you when you send him information back and forth.
00:45:49So you say, sir, since you do not wish to communicate us, here's an official demand letter.
00:45:54Yes.
00:45:54You say that you paid him $15,986.
00:45:59Correct.
00:45:59Correct.
00:46:00Well, that's not what your lawsuit is here.
00:46:04Is your company incorporated in California? I forgot the answer to that question.
00:46:08Well, I have like an LLC. Is that what you're referring to?
00:46:10Do you have an LLC?
00:46:11I do have an LLC, yes.
00:46:12What's the name of it?
00:46:13MSP Studio. But it probably won't be under that name. It would be under all hills.
00:46:17Why?
00:46:20...is suing his son, Marvin Navas Jr., for bail and attorney fees after his son was arrested.
00:46:27Court come to order.
00:46:28All rise.
00:46:31Have a seat, please.
00:46:34Hello, Judge.
00:46:35Case 3087, Navas v. Navas.
00:46:38You're welcome.
00:46:39How old are you, Mr. Navas?
00:46:4125.
00:46:42How long have you been living at home with your mother and father?
00:46:45All my life.
00:46:46Are you still living there?
00:46:47Not right now at the moment, no.
00:46:48Where are you living?
00:46:49With my grandma in Van Nuys.
00:46:51And you left because you had a disagreement with your father?
00:46:53A huge argument, yes, ma'am.
00:46:55Shh.
00:46:55Some time ago, you're going to tell me the date, police stopped you in your car, correct?
00:47:00Correct.
00:47:00On what date was that?
00:47:03About two years ago, Super Bowl Sunday, on February 14th.
00:47:06On Valentine's Day?
00:47:07I believe so, ma'am.
00:47:082022?
00:47:092022, yes.
00:47:11And you were stopped because, according to what I read, you were smoking, but you must
00:47:15have been smoking something other than cigarettes.
00:47:17Uh, marijuana, ma'am.
00:47:19Yes, sir.
00:47:19Okay.
00:47:20In what state do you live?
00:47:21California.
00:47:22Was smoking marijuana in a car?
00:47:25You were the driver of the car, correct?
00:47:27Yes, ma'am.
00:47:28Wow.
00:47:28Is that illegal in the state of California?
00:47:30I believe so.
00:47:32I would say so, just like you can't have a bottle of vodka and
00:47:37drinking it while you're driving.
00:47:41And when the police stopped you for committing a crime, which endangered a lot of people because,
00:47:48you know, when you're not totally together, you're not supposed to be driving a car,
00:47:53they found two handguns.
00:47:54Correct.
00:47:55Who else was in the car?
00:47:57It's not funny.
00:47:58I happen to not think it's funny.
00:48:00I know that you think it's funny, but it's not funny.
00:48:02I mean, I got off scot-free, so...
00:48:03How many...
00:48:04I'm not thinking 10 years, ma'am.
00:48:07How many other people were in the car?
00:48:10I believe four other people.
00:48:12I had a full car.
00:48:13You know how many other people were in the car.
00:48:15You were driving.
00:48:16I just said four, ma'am.
00:48:18Four others?
00:48:19Yep.
00:48:19Full car.
00:48:20And where were the guns found, sir?
00:48:22I don't know.
00:48:23I was not the police, so...
00:48:24No, but you were in the car.
00:48:26Don't be a wise guy with me because I eat people like you for breakfast.
00:48:29I don't think you're either cute or accomplished.
00:48:33You're neither cute or accomplished.
00:48:35I know I'm cute.
00:48:35At age 25, you don't live on your own.
00:48:38You either live with your mother or your father.
00:48:40Then when they throw you out, you go and live with your grandmother.
00:48:42I neither think that you're cute or accomplished.
00:48:45Maybe young girls do.
00:48:47I'm an old lady.
00:48:48I fail to see your attractiveness,
00:48:50and I fail to see how any of this is funny.
00:48:52You ever see my smile, ma'am?
00:48:53That's pretty attractive.
00:48:54It depends.
00:48:55Let me ask around.
00:48:56You find that attractive?
00:48:58No.
00:48:59Whitney, you're younger than I am.
00:49:01A little bit older than Sarah.
00:49:03You find that attractive?
00:49:04They want to get the job.
00:49:06It's not only not attractive, but when your grandmother watches that,
00:49:12she's going to think you're a fool, along with a lot of other people.
00:49:15And it's going to be my joy, my absolute joy, to fill in the blanks.
00:49:22So you don't know where the two other guns were found,
00:49:25and everything got thrown out.
00:49:28So now you have no adult criminal record.
00:49:32Correct.
00:49:32Did you have a juvenile criminal record?
00:49:36Answer the question.
00:49:38Did you have a juvie record?
00:49:40Of course you did.
00:49:41I know everything.
00:49:43Wise guys like you always have a juvie record.
00:49:46So when they booked you, they put you in jail.
00:49:50Now, as a juvie, you had been taken into custody before,
00:49:53but I don't think that you had been put in an adult kind of situation,
00:49:58in an adult facility.
00:50:00So let me ask you a question.
00:50:03Did you call your girlfriend?
00:50:06Nope.
00:50:06Did you call your priest?
00:50:09Nope.
00:50:09Did you call your family physician?
00:50:12Nope.
00:50:12Yeah, I'll assume, for the record, Whitney,
00:50:16I'm going to assume that this accomplished 25-year-old
00:50:20who lives under the auspices of his parents or his grandma
00:50:24doesn't know how to say no, or no, ma'am, or no, Your Honor.
00:50:28He says no.
00:50:30I assume, sir, that you are not a graduate of any university.
00:50:34Nope.
00:50:35No.
00:50:36Let's see.
00:50:38So you didn't call any of those people who...
00:50:41They gave you a phone call.
00:50:42Who did you call?
00:50:43I thought I'd call my dad, tell him to get me out.
00:50:45Just a second.
00:50:46You called your dad.
00:50:51I'm 24 years old, and I live with you.
00:50:55My God, I was smoking in my car, and they called me over,
00:50:59and they had two guns, and I'm in jail now.
00:51:01Yeah.
00:51:02What did you call your father for?
00:51:05To get me out.
00:51:05Why?
00:51:07That's...
00:51:07It's a job to protect me, right?
00:51:09You have kids, ma'am?
00:51:09What?
00:51:10You have kids, ma'am?
00:51:11Five and 13 grandchildren, one great-grandchild,
00:51:15and I want to tell you something.
00:51:16This is one of them, and the last person they would call,
00:51:23any of them, if they got pulled over, smoking a joint,
00:51:28and there were guns found, the very last person that they would call is me.
00:51:35That's the very last person they would call,
00:51:38and they actually consider me a pretty good mother and grandmother,
00:51:42but they know you're going to act like a fool. Call somebody else.
00:51:46So you called your daddy.
00:51:49You called your dad.
00:51:50My father.
00:51:50No, you called your daddy.
00:51:51My father.
00:51:52You called your daddy, and you said, come and get me out.
00:51:58And he did, and he got you out. He paid a bail bondsman,
00:52:02which is what this case is about. You think this was going to be easy?
00:52:06Not easy. You don't mind my doing that to him, do you?
00:52:08No, ma'am.
00:52:09Great. Are you his mother?
00:52:10Yes, ma'am.
00:52:11Is he your only son?
00:52:13He's my only son.
00:52:14He's your only son. I could tell.
00:52:19I could tell.
00:52:20It's nothing against you, but you can always tell when a little boy has been pampered by his mother
00:52:25and thinks that he's the cat's meow, even though he's unaccomplished.
00:52:29He got you out, and he got you a lawyer, and that's what this case is about, Mr. Navas.
00:52:34Yes, ma'am.
00:52:35This is about the bail and the money that you spent on a lawyer.
00:52:39That he spent.
00:52:39Jump, jump.
00:52:40Don't speak.
00:52:41That he spent.
00:52:42If you speak, if you speak unless I speak to you, sir, I'm going to throw you out.
00:52:47Do you understand?
00:52:47I'm sorry.
00:52:48Or I'm going to tell Kevin to put you in your seat.
00:52:51Sorry, ma'am.
00:52:51Very good.
00:52:52So when I speak to you, like I did before, you can answer me. Now I'm speaking to your daddy.
00:53:02You got a tax return, and you gave it to your father. That's either a yes or a no. That's not
00:53:07I don't remember. I don't remember means that you're dull-witted. Are you dull-witted?
00:53:11No, ma'am.
00:53:12Okay. You're not dull-witted. You're a wise-ass, but you're not dull-witted.
00:53:17Okay, so you are suing him for the $2,800 or whatever it was for the bail bondsman,
00:53:24and you also paid an attorney $14,000.
00:53:28Yes, ma'am.
00:53:28Now, when you pay this money to the lawyer and to the bail bondsman, what kind of work was your son
00:53:36doing?
00:53:36Before that, he was working for a security company.
00:53:40Okay. As a what?
00:53:42In the warehouse.
00:53:43So he was working at a minimum wage kind of job.
00:53:45Yes, ma'am.
00:53:46And so you knew that he didn't have $14,000 or $16,000. You knew that he didn't have that.
00:53:53And he's living with you instead of living on his own, because he's not even earning
00:53:57enough money to have his own apartment or to pay for his own gas, electric, utilities,
00:54:03water, heat, air conditioning. So he's living in his room, in his old room.
00:54:10Yes, ma'am.
00:54:11Ultimately, the case was dismissed.
00:54:14It's not completely dismissed, ma'am. The statute of limitations hasn't expired.
00:54:20So is the case still pending?
00:54:21Yes, because I have this e-mail there.
00:54:24Can I see what he's got?
00:54:25Yes, ma'am.
00:54:37So the case has not been dismissed?
00:54:39No, ma'am.
00:54:39The DA just hasn't filed on it?
00:54:41Yes, ma'am.
00:54:42Oh, got it now.
00:54:43Okay. So I can't ask him anything else about these pending charges.
00:54:47He goes, right now, his attorney's not here. And his attorney would not like for me to do that.
00:54:53Now, was your son still working in the warehouse when you had this incident with him that caused
00:55:02him to move out?
00:55:02No, not when he moved out, ma'am. No.
00:55:05Where was he working?
00:55:06He wasn't. He got laid off.
00:55:08When did he get laid off?
00:55:09I got to say, probably like August.
00:55:12August of 2023?
00:55:142022.
00:55:1522?
00:55:16Oh.
00:55:17That's 23, actually.
00:55:18Shhh.
00:55:1923, actually.
00:55:20Well, but this is interesting, sir.
00:55:22That's all right.
00:55:22Because you say in your complaint that the charges were fully dropped against him in March of 2023,
00:55:31but that's not so.
00:55:32That's what I assume, ma'am.
00:55:34Well, no, but it wasn't, not according to this letter.
00:55:37Yeah, no.
00:55:37And the reason I got that email from the lawyer, ma'am, is because I reached out to her to ask her
00:55:44about the Bales Bond exoneration letter, because my name was on the, on the Bales Bond.
00:55:52And then that's when she sent that email stating that.
00:55:54Okay.
00:55:55So now I want you to tell me, sir, you see, the boy.
00:55:59The man.
00:56:00The boy says that he never had an agreement with you.
00:56:05Never did.
00:56:05To pay.
00:56:08He never had an agreement with you to pay you back.
00:56:12And that what you did, you did because he's your son and you're his father.
00:56:17And the reason that you threw him out of the house was that you came home from work one day.
00:56:22What kind of work do you do?
00:56:24I'm in sales, ma'am.
00:56:25That you came home from work one day.
00:56:27He was not working.
00:56:29And he was, according to you, according to your papers, he was lying on the couch and smoking marijuana.
00:56:35Well, uh...
00:56:37That's what you say here.
00:56:38What happened, ma'am, is it was on a weekend.
00:56:43I was drinking, I was drinking a beer and he went out, he left, came back and he smelled like marijuana
00:56:51in front of me.
00:56:52And I said, then that's when I asked him, I go, if you got money to buy marijuana,
00:56:58how come you're not making me whole on this?
00:57:01You made some payments on this because when he, he filed the, when he filed his income taxes
00:57:07on the years before, we will keep his, his returns to put towards what he owned.
00:57:13Just a second.
00:57:14Is what you're telling me that you had an agreement with him for when he got a refund
00:57:20on his taxes that he would give you that money?
00:57:23He was, he was making payments before.
00:57:24He was making payments.
00:57:26Yes, ma'am.
00:57:27How much did he make in payments?
00:57:29He made a, uh, a total of about $2,500.
00:57:32Can I see the document that you're looking at?
00:57:35Yes.
00:57:42Okay.
00:57:43This says that you did in fact make some payments to your father.
00:57:46Income tax return. And that was in April of 2023 that you did in fact make a payment to him
00:57:52of $1,222. Is that correct?
00:57:56I believe so.
00:57:57Just a second. I'm asking you a question, boy.
00:58:00If it says right there, I don't recall that, so.
00:58:02Okay. Do you recall that you got a refund on your taxes?
00:58:06Um, maybe. It could have been a stimulus check. I don't know.
00:58:09All right. Well, I can see I'm not getting anywhere with you because you're a moron.
00:58:12And what you really don't know, sir, is how to read the room. And, you know,
00:58:21sometimes people learn that when they're very young. Sarah learned how to read the room when
00:58:26she was three. It doesn't require an education. It requires listening to what's going on around you.
00:58:34So if you listen to what I was asking you before, it's perfectly logical that your father might
00:58:41think that because you had money to go out and buy weed, you should be paying him. But in reality,
00:58:49he had no expectation of being repaid because you had either no job or a low paying job.
00:58:55That's a perfectly reasonable thing for me to think as a parent. Do you understand?
00:58:59Yes, ma'am.
00:59:00Okay. But when I ask you, and I'm sure that you remember because we're not talking about
00:59:06something that happened 10 years ago, but a few months ago, you got a tax return,
00:59:11$1,200, and you gave it to your father. That's either a yes or a no. That's not I don't remember.
00:59:18I don't remember means that you're dull-witted. Are you dull-witted?
00:59:21No, ma'am.
00:59:23Okay. You're not dull-witted. You're a wise-ass, but you're not dull-witted.
00:59:26Then you made several other payments. In April of 2022, you again gave your father $1,123.
00:59:38Does that sound familiar?
00:59:40Nope.
00:59:40No.
00:59:41He could have tied that up yesterday.
00:59:42He could have. Just a second. He could have. So what you're telling me is that you never made
00:59:49any payments to your father.
00:59:51That's not a recall, ma'am.
00:59:52No, no. That's not an I don't recall. That means that you're dull-witted.
00:59:59Somebody's going to hurt him one day.
01:00:01Who?
01:00:01Somebody's going to hurt him one day.
01:00:02Who?
01:00:03Yeah. That kind of wise guy always gets himself into trouble. Always.
01:00:09I want you to understand that I believe...
01:00:16Yes, ma'am.
01:00:17...that you didn't put in a kennel for the dogs...
01:00:20I hear you.
01:00:21...until April of 2023. You hear me?
01:00:25Yeah.
01:00:25Okie dokie.
01:00:28Okay. When was the next one?
01:00:31The next is so many, Your Honor.
01:00:34Oh, that's okay. I'm telling you, you were still there and you didn't put in a kennel until April of 2023.
01:00:39You were in violation of your lease for a very long time.
01:00:43Yeah.
01:00:44Yeah.
01:00:45You were in violation of your lease for a very long time.
01:00:47Because I wouldn't like to live next door to you with two pit bulls roaming around the backyard.
01:00:51Right.
01:00:52Anything else?
01:00:53Not with the eviction.
01:00:54Great. So your next cause of action is slander, defamation of character. Tell me what that was.
01:01:02Um, she made a few Facebook posts using my name.
01:01:05In what way?
01:01:06Saying how much I owed in rent, um, saying that I was unable to pay it.
01:01:12And then there's another one where she said that I tore her house up.
01:01:16That's what she's counterclaiming for.
01:01:18Yeah.
01:01:18So far none of that is slanderous.
01:01:20Yeah, she lets her animals tear up the property.
01:01:23Miss Bell?
01:01:24Yes, ma'am.
01:01:25She says back here in August of this year, she lies about it but fails to inform the magistrate landlord
01:01:34she lets her animals tear up the property.
01:01:37But does she want repairs done? No.
01:01:39Why, you say?
01:01:40She engineers lies on Facebook to justify her actions in not giving me access to the property
01:01:47so it can look like I'm not doing the repairs.
01:01:50What she put on Facebook.
01:01:52Yeah, I know it's what she put on Facebook.
01:01:55Your case is dismissed.
01:01:57All right, so we're finished with you.
01:01:58Money owed for defamation, property damage.
01:02:00How did she damage your property?
01:02:02That's all I'm interested in.
01:02:03She lit the self-igniting hot water tape.
01:02:06Okay, what else?
01:02:07I had the attorney's fees from her.
01:02:10What attorney's fees?
01:02:11The attorney's fees about this case.
01:02:13They were $875.
01:02:15For what?
01:02:16For what case are you talking about?
01:02:18I'm talking about the Smalls Claims Court case.
01:02:21And we also talked about tenants issues.
01:02:23We talked about, you know, what I would be liable if she filed an answer for this case.
01:02:26All right, very, very nice.
01:02:27It's all very, very nice.
01:02:28You're living someplace else now?
01:02:31Yes, ma'am.
01:02:31You have another tenant in the house?
01:02:33No, ma'am.
01:02:34She hasn't released Tennessee from the property,
01:02:36which is why I have to keep putting notices on the door.
01:02:38So I can stay legal.
01:02:40Stop for a second.
01:02:41What do you mean she hasn't released?
01:02:43She hasn't given me the keys back to the property.
01:02:45She hasn't told me that she was moving from the property.
01:02:47My attorney called and, you know, made contact to ask,
01:02:52and had me ask her, and she hasn't moved anything.
01:02:54You mean she still has property there?
01:02:56Oh, yes, ma'am.
01:02:57She still has property there.
01:02:58What does she have?
01:02:59She has a bed, a dresser.
01:03:01Just a second.
01:03:02Do you still have any property that you want in the house?
01:03:04No, ma'am.
01:03:05You don't?
01:03:06No.
01:03:06When you moved out, did you leave things of yours there?
01:03:09No.
01:03:10What about a bed?
01:03:11No.
01:03:11A dog?
01:03:13What?
01:03:13She left a dog there for 10 days with no heat,
01:03:17and said that I exposed the dog to 20 degree weather on Facebook.
01:03:22She said that.
01:03:23Did you leave a dog there?
01:03:24No, ma'am.
01:03:25You took a dog with you?
01:03:26Yes.
01:03:27Do you have any proof?
01:03:28I have both.
01:03:29Did she have three dogs?
01:03:30I have two.
01:03:31No, did she have three?
01:03:32She actually had nine.
01:03:34She had two dogs.
01:03:35Those dogs had puppies.
01:03:36And she ran a little farm out of my house.
01:03:39Listen to me.
01:03:40You both submitted yourself to my jurisdiction.
01:03:42Yes.
01:03:43Say nothing.
01:03:44She has now gone from the house.
01:03:46I find that she is acknowledged that she is no longer a tenant of yours.
01:03:50Cool.
01:03:51Anything in the house that you do not want to keep, that you think was hers, you can dispose of.
01:03:58Sell it, throw it away, change the locks on the door, the tumbler.
01:04:04If she didn't give you the keys back, change the tumbler.
01:04:07I will prepare that order, and I will sign it.
01:04:10And you agree with it, correct?
01:04:12Yes, ma'am.
01:04:12Yes, ma'am.
01:04:13She's going to dispose of any property that's there.
01:04:17She's going to change the tumbler this week, because he should do that anyway.
01:04:21Yes.
01:04:22Mm-hmm.
01:04:22Okay?
01:04:23She don't own the house.
01:04:24I don't care who owns the house.
01:04:26She was your landlord.
01:04:27That's what she says.
01:04:28So if she wants to do that, she can do that.
01:04:30But you have nothing there that you claim is yours anymore, and you are no longer a tenant
01:04:36in that house.
01:04:37Correct.
01:04:38So whoever owns the house could get rid of whatever they want,
01:04:41can change the locks on the doors.
01:04:44Do you understand?
01:04:45Oh, yes, ma'am.
01:04:46Perfect.
01:04:46We're finished.
01:04:47We'll prepare the order for you.
01:04:49Bye.
01:04:49This court is adjourned.
01:04:55Overall, I think it was fair.
01:04:57I like Judge Judy.
01:04:58I think that she is fair, which is why I agreed to call.
01:05:01It was ongoing harassment, the everyday coming home with a paper posted to the door.
01:05:07I got a 24-hour notice that I put on the door,
01:05:10so I could go in and check the heat and discover that she had left the dog there
01:05:14after she had moved, after she had transferred her utilities.
01:05:19The only dog that was in the house was her.
01:05:21She left the dog there 10 days.
01:05:24My daughter was burned by a stove that was on the property, third-degree burns.
01:05:28You know, I'm sorry your daughter got hurt if she got hurt.
01:05:30I wasn't there.
01:05:31I think stoves are usually user-friendly.
01:05:35She said that she's not on the lease, so she wasn't going to replace it.
01:05:38The stove was her responsibility.
01:05:40I will never rent from her again, and hopefully anybody that sees it runs.
01:05:45I am so elated that she's gone.
01:05:47I'm just in a better place.
01:05:49What I would say is, America, you know, don't do drugs.
01:05:53So I have to tell you one of my pet peeves as both somebody on the bench, but more than that,
01:05:59just a citizen, there is a swath of people who are Americans, who live in this country,
01:06:04that need assistance, who work, some can't work, but who work and can't quite make it.
01:06:12I can't tell you how it bothers me when somebody has three employed adults
01:06:18in their house and applies for and accepted for government-assisted housing.
01:06:26She knew she wasn't entitled to it.
01:06:28Mm-hmm.
01:06:29You know, you could tell from her look that she knew she wasn't entitled to it.
01:06:32And it's just too bad that the government is so inept that it can't ferret out those people who need
01:06:42and those people who want.
01:06:44Mm-hmm.
01:06:44Well, there's a big difference.
01:06:46Need and want are two different things.
01:06:48It just constantly surprises me the inefficiency of government.
01:06:53And really, the way some people will spend more time scheming to get what they're not entitled to
01:07:00than they will spend moving their lives forward in a positive direction.
01:07:05It is a very tricky system.
01:07:07You know, I've dabbled in just seeing what the process would be like
01:07:10of applying for any sort of government assistance and just to try and understand
01:07:14litigants a bit better who have gone through it.
01:07:17And it's complicated.
01:07:18It's nuanced and complicated and online and there are multiple forms
01:07:23and this one has to go before this one.
01:07:25I feel like if you're able to complete that, you have a skill that could be used
01:07:29in a productive way to make it so that you don't need to figure out that whole scheme.
01:07:35That's a good point.
