The Federal Court has fixed Feb 10 to deliver its decision on the prosecution’s appeal to reinstate nine corruption charges against former Felda chairman Tan Sri Mohd Isa Abdul Samad.

A three-judge panel, chaired by Justice Nordin Hassan, set the date after hearing submissions from parties, Putrajaya on Thursday (Feb 5).

00:00The Federal Court has set February 10th to deliver its verdict on the prosecution's
00:05appeal against the acquittal of former Felder chairman Tan Sri Mohammed Isa Samad on nine
00:12corruption charges involving 3.09 million ringgit.
00:17A three-member panel, led by Federal Court Judge Datuk Nordin Hassan, said the court
00:23required time to consider the submissions from both parties and to review the earlier
00:29Court of Appeal judgment.
00:32The appeal stems from the Court of Appeal's ruling on March 6th, 2024, which overturned
00:38the High Court's conviction of Mohammed Isa and the subsequent sentence of six years'
00:43imprisonment and a 15.45 million ringgit fine.
00:48On February 3rd, 2021, the High Court convicted Mohammed Isa on nine corruption charges linked
00:56to offences allegedly committed at Menara Felder in Kuala Lumpur between July 2014 and December
01:032015.
01:04Earlier, Deputy Public Prosecutor Afzai Nizam Abdul Aziz said the prosecution had established
01:13that Mohammed Isa accepted gratification on nine separate occasions from Ikhwan Zaidel through
01:20his former special officer, Mohammed Zahid Mohammed Arib.
01:26The prosecutor further submitted that evidence showed Mohammed Isa had indirectly instructed
01:32Mohammed Zahid to solicit a bribe from Ikhwan following a meeting between them and that the
01:38instruction was subsequently carried out.
01:41Meanwhile, Isa's lawyer, Ems Athimulan, maintained that the Court of Appeal was right to acquit
01:47his client, arguing that the prosecution failed to prove its case beyond reasonable doubt due
01:53to inconsistencies in Mohammed Zahid's evidence.
01:57As far as the defence is concerned, we argued that there is no appealable error by the Court
02:04of Appeal Judgement and therefore that there is no merit in the prosecution's appeal.
02:10The appeal ought to be dismissed.
02:13That's our argument.
02:14And the rest, we left it to the court with our written submission.
02:17And that written submission will be considered by the court in making the decision.
02:22The former Negeri Sembilan Mentri Basar was accused of receiving 3.09 million ringgit
02:29in gratification from Ikhwan, then a director of Gegasan Abadi Properties Senderen Bahad, through
02:36his former special officer, as an inducement to approve Felda Investment Corporation Senderen
02:41Bahad's 160 million ringgit purchase of the Merdeka Palace Hotel and Suites in Kuching.
