The Jammu and Kashmir State Investigation Agency (SIA) has carried out multiple raids in central Kashmir on August 12 as part of a reopened probe into the 35-year-old murder of Sarla Bhat, a Kashmiri Pandit woman. The raids targeted individuals linked to the banned Jammu and Kashmir Liberation Front (JKLF) and are part of wider efforts to resolve long-pending cases from the violent early 1990s.

00:00We have some news just coming in. Let's begin this edition with that, with the BJP now giving instructions to all its MPs to stay in Delhi from the 6th of September to the 9th.
00:10All MPs will be asked to assemble them at one place. The process of vice presidential election will be explained to all the MPs.
00:18Asperia is getting in more details on that story. The BJP is preparing essentially for a fight and asking the MPs to be in Delhi's city, of course.
00:31Is there a whip of sorts? What more can you tell us? This, of course, because it wants to get the numbers intact, isn't it?
00:37Ahead of the vice presidential elections in India.
00:39Just recently we saw how the MPs, their flow leaders had met in the parliament and it was being decided that everyone will be told what exactly is the process for the vice presidential election.
00:52Because there are a lot of first-time MPs also. The BJP does not want that there should be any kind of goof-up.
00:57That's the reason why few of the three days, 6th, 7th and 8th, these are the days when the BJP is asking all the MPs to stay in the national capital.
01:06They will mostly be assembled at one place. They will be told what exactly needs to be done.
01:12This is also a show of sense that we will see coming in from the BJP.
01:16And in that party, it was decided that JT Nanda and Prime Minister Narendra Modi, they are the ones who will finalise the names of the candidates.
01:22The last date of the nomination is on the 21st. 22nd is when the withdrawal can take place.
01:27So we will see a name also coming out in the next couple of days with regards to who the BJP, the NDA as a whole will be pitching as its vice presidential candidates.

02:35Meer, this comes after the investigations were opened up after 35 long years.
02:41What more can you tell us about the direction in which it is headed?
02:45Well, it's a very significant day because the Lieutenant Governor's administration, if you remember,
02:54just 10-15 days back, in various functions, the Lieutenant Governor distributed job letters
03:01as well as compensation to the terror victims in the Kashmir Valley.
03:05Now, at that time, the LGA administration had also said that they will reopen, reinvestigate cases of targeted killings of Kashmiri pundits
03:15because that's been the longstanding demand of the Kashmiri pundit community who have said time and again that justice has not been delivered.
03:23These cases were investigated, but they were never completely investigated with conviction.
03:28So, today is significant because the first such case has been reopened.
03:32Sarla Bhatt, who was a nurse in the Shri Kashmir Institute of Medical Sciences,
03:38in April 1990, she was abducted by terrorists and four days later, her bullet-ridden body was found.
03:44So, this is the first case that has been reopened.
03:47The State Investigative Agency has been handed over the case.
03:50And already, this morning, eight locations in Srinagar have been raided.
03:55All ex-operatives, commanders of the Jammu Kashmir Liberation Front, which is a proscribed organization,
04:01and importantly, also the residence of Yasin Malik, who is in Tehar Jail,
04:05and his residence in Maish Suma was also raided.
04:08These raids happening early morning, and investigations have been started.
04:13Though, there are many observers who feel that already 35 years have passed,
04:17so this seems to be a symbolic gesture, but then, nonetheless, this was the demand of the Kashmiri Pandit community.
04:24And, Sneha, in the coming days, we will see more such cases being opened,
04:28and we will see more raids and more investigation as far as these killings are concerned.
04:33Interestingly, it is happening at a time when, on 10th of November,
04:37the NIA court will hear the plea of the NIA, who have advocated death penalty for Yasin Malik.
04:44Now, one can clearly connect the dots, but as far as Yasin Malik is happening,
04:51as far as Yasin Malik is concerned, these things happening simultaneously,
04:55and the raids also on the residences of other J.K.L.F. commanders.
05:00Also, talk to us about, apart from this one case, of the gruesome rape and murder of Sadla Bhattarwa,
05:06other cases as well.
05:08So, in that sense, are all of these cases going to be opened up, just to give more clarity on that front?
05:13Well, Sneha, we, as of now, don't know how many cases the LGBT administration has decided to reopen.
05:22Now, obviously, these cases will be judged on the basis of the kind of investigation that has happened at that time.
05:28Now, as far as this case is concerned, this is an FIR of 1990 in the Nagin police station.
05:34So, you have to understand, it's 35 years later that these case files, which would have been gathering dust in some police station, have been reopened.
05:43And this will require a painstaking investigation, because probably most of the witnesses or many people would have expired since,
05:51and this case would be a difficult one.
05:54But they have started investigations, and the first step has been raids on the residences of the accused.
06:01Now, there are many more such cases.
06:03There are some gruesome ones, as you rightly said.
06:05And it seems that, obviously, the priority will be to reopen them first, reinvestigate, and give a sense of closure to the victims' families,
06:14obviously, who have been fighting since, to ensure that these cases are reinvestigated and just as done,
06:21because the allegation has been that they were not investigated, or the attention that they deserved was not given to them.
06:28And that's why they need to be, these files need to be reopened and reinvestigated.
06:33So, you will see more such cases being reopened.
06:35But, obviously, the more gruesome ones, the cases where the families have been after the government to reopen them, would be given priority.
06:44But the first step, and as I said, it's happening at a time when Yasin Malik,
06:49a plea from the NIA for death penalty or advocation for death penalty for Yasin Malik,
06:54will be heard by the special NIA court on 10th of November.
06:58You know, also, talk to us, Miri, you spoke about Yasin Malik.
07:01Who are the others and the role of the other people that's being looked into in this entire matter?
07:08Well, there are, in total, eight commanders and operatives of the Jammu Kashmir Liberation Front.
07:13Now, apart from Yasin Malik, Abdul Hamid Sheikh, who was, again, an ex-chief of the JKLF.
07:20He was killed in an encounter in the late 90s.
07:23Then you also have Nurul Haq, also known as Air Marshal.
07:27He was, again, a top commander of the proscribed JKLF.
07:31There are at least three more who may not be as significant as far as the hierarchy of JKLF at that time is concerned.
07:39But as far as various murder cases against Kashmiri pundits and otherwise are concerned,
07:44they have been accused and they are wanted in these cases.
07:47So, they will also be investigated.
07:50But it is, in many ways, the top leadership of the proscribed JKLF, which was operational in the early 90s.

08:19How do you respond to this?
08:21Good morning.
08:22I think it is very sad that a community which has faced genocide is awaiting justice for the last 36 years.
08:30We have seen zero conviction till date on any of the killings of Kashmiri pundits,
08:36on the ethnic cleansing as well as genocide.
08:40I honestly don't know what raids are being carried out and what the investigative agency has found.
08:49But what I know is that the perpetrators of the heinous crimes,
08:53Yasin Malik, Bitta Karate, Javid Nalka, continue to go unpunished till now.
09:02Long years.
09:03So my question has got to do with the fact that there are investigations that will be carried out.
09:08But what can the teams, what can the investigating agencies find really after 35 long years
09:13in terms of destruction of evidence?
09:15And of course, these 35 years have gone by.
09:19There's this hope for justice.
09:20But many believe that this is just a symbolic sort of a move.
09:24What's your thought?
09:26See, when I had gone to the Supreme Court demanding justice,
09:29that was almost seven, eight years back,
09:31the Supreme Court back dismissed the petition saying that it is too long a period
09:36and then nothing will come out of it.
09:38So honestly, I don't know after 35 years what a policeman will find by raiding certain places.
09:48It's a case of a murder and a rape.
09:51And the family of Sarla Bhatt and the entire Kashmiri Pandit community is awaiting justice.
09:56So either the Supreme Court was wrong when they dismissed the petition of roots in Kashmir
10:01or the police is out to prove the Supreme Court wrong.
10:05Only time will tell.
10:07But honestly, the way things have progressed is very disappointing for the committee.
10:11It is very disappointing for the entire judicial system and justice mechanism of this country.
10:16Who would you say is responsible for the situation in the sense that this matter has had to be investigated after 35 long years?
10:27I think that both the judiciary as well as the executive is responsible for such a pathetic state of justice.
10:34Also, an honourable court which finds time to find the true motor cognizance on how BCCI should conduct
10:46and has not broken up the last 30 seconds to a particular committee to an ethnic cleansing
10:55which has happened right in front of their eyes.
10:56So, judicial is equally responsible and the executive are failing to constantly ensure the justice to the community.
11:09I think everyone is equally responsible for it.

12:05You see, it's very well known that what role does Asin Malik play on the genocide of an ethnic cleansing of Kashmiri pundits,
12:1735 years back.
12:18We all know that Asin Malik was responsible for killing of air force officers, army, people.
12:26And his constant effort to keep Kashmir and Kashmiri pundits issue burning.
12:34He is responsible for killings of not only Sarla Bhat, but many, many, many Kashmiri pundits there.
12:42Now, what I, as a Kashmiri pundits, we are all hoping since the last 35 years for justice.
12:49Picking up one case of Sarla Bhat is a welcome sign.
12:53And we also expect that so many killings and so many rapes and murders of Kashmiri pundits are there on records.
13:04We want every case to be open.
13:08It's not that just, you know, you just pick up a case and then you follow it up.
13:14On the total sum, on the whole sum, the entire race has been suffering and still suffering the genocide and ethnic cleansing of ours.
13:23So, it's a welcome sign, no doubt about it.
13:26At least there is a hope which has been created for justice of Kashmiri pundits, nearly 5 lakh Kashmiri pundits.
13:33And we hope that this case will, this reopening of this case of the murder and rape of Sarla Bhat will take Yasir Malik to gallows.
13:44And he will get the worst possible punishment, which will create an example that, and as less to Kashmiri pundits,
13:52that one terrorist like him who is responsible for such a major crime has got, you know, a closure and he has been punished.
14:02And that is what we as Kashmiri pundits hope for.
14:06You know, what I want to ask you, Ashok Pundit, is that this comes after 35 long years, you know.
14:11So, what really is the hope for justice in terms of the investigators and the kind of dots that they can join after so many years,
14:17in terms of the evidence that they can perhaps find, I don't know, after 35 long years?
14:24You see, you know, it's catharsis.
14:28Yasir Malik is in jail since a very long time.
14:32His house being graded now, after so many years, is also a Christian mark for us.
14:38We fail to understand because we don't have that kind of a knowledge why it's been graded now.
14:44And they must have got a clue and they have graded the house fine.
14:48There is no, you know, issue on that.
14:50But the point is, as I already said, that it's not only Sarwana Bhatt.
14:56Sarwana Bhatt is one of the main victims.
15:00We have Premna Bhatt.
15:02We have Lassa Kool.
15:03We have Sarwana Premi.
15:06We have, you know, so many.
15:09Justice Ganju.
15:09We have so many people in the line who have been killed, murdered, raped.
15:17We want justice to be given to every victim who has been killed and raped, killed like this.
15:23Why there is no inquiry against Farukadullah?
15:27Farukadullah was responsible for our genocide.
15:30Because he left Kashmir when the ethnic killing was happening.
15:35When we were killed and raped, he went away to London.
