00:14pinahirap nito ang paghahay ng impeachment complaint.

00:29ang mga kinatawan ng makabayan at mass leaders.

00:33Hiniling nila na baliktarin ang naunang desisyon ito

00:36na nagsasabing unconstitutional ang impeachment complaint laban kay Vice President Sara Duterte.

00:42There is no grave abuse of discretion on the part of the House of Representatives.

00:49They are presumed to have acted regularly and in good faith.

00:52A presumption that petitioners failed to rebut with any contradictory evidence.

00:59Unanimous ang desisyon ng Korte Suprema.

01:02Kaya sa deliberasyon ng Senado bago nila i-archive ang reklamo,

01:05sinabi ni Sen. Rodante Marcoleta na imposibleng magbago pa raw ang desisyong ito.

01:10Ito pong ganitong klaseng desisyon,

01:13talaga pong wala na pong kaduda-duda na kahit po mag-file pa tayo ng motion for reconsideration.

01:24It is as if we are wishing for the moon.

01:25Pero giit ni retired Supreme Court Senior Associate Justice Antonio Carpio,

01:30hindi ito imposible.

01:32May mga kaso raw na kahit unanimous desisyon ay binabaliktad pa rin ng Korte Suprema.

01:37Isa dito ang 2016 ruling na pansamantalang nagpatigil sa field testing ng genetically modified organism o GNO.

01:44That was a unanimous decision by the NBank and was also reversed.

01:48So, may president dito.

01:52Ayon naman sa presidente ng Integrated Bar of the Philippines na si Atty. Alan Panolong,

01:57totoong may binabaliktad na unanimous desisyon pero bihira lang daw ito.

02:00There are instances that the court reverses itself.

02:04But it is very, very seldom.

02:10Isa sa pinagbatayan ng Supreme Court sa desisyon nito ay ang Aniline News Report

02:14na hindi raw pinagbutohan ng plenaryo ng Kamara ang Articles of Impeachment bago itransmit sa Senado.

02:21Pero sa isang pahayag nilinaw ng ABS-CBN na wala silang sinabi sa kanilang ulat na

02:26na itransmit sa Senado ang Articles of Impeachment ng hindi napagbutohan sa plenaryo ng Kamara.

02:31Sa inihaing motion for reconsideration sa Korte Suprema ng Kamara,

02:36ipinunto nilang malinaw sa House Records na pinagbutohan ito sa plenaryo bago itransmit sa Senado.

02:42Pagkatapos ito ay pinagbutohan naman nilang i-archive ang mga naunang impeachment complaint.

02:48A lawyer student would know that you don't cite news reports to establish a fact.

02:55Sinabi rin ng Korte Suprema na nalabag ang due process

02:58ng hindi binigyan ng kopya at pagkakataong sumagot si Vice President Duterte.

03:04Sabi naman ng Kamara, walang nakasulat na ganyang proseso sa 1987 Constitution.

03:09Kaya sabi ni Carpio kung ganito ang gusto ng Korte Suprema,

03:12dapat ipatupad sa mga susunod na impeachment complaint,

03:15hindi sa mga natapos na.

03:16The Supreme Court imposed this new requirement retroactively.

03:23How could the House have complied with this new requirement

03:28when it never existed when the House took up the first four complaints?

03:38ang dinesisyonan ng Korte Suprema at walang diskusyon sa mga merito ng reklamo.

03:42Let me clarify that.

03:44The merits of the case were not examined by the Supreme Court.

03:47It just talked about procedure.

03:50So the procedure was faulty, was lacking.

03:53So yun ang assessment ng Supreme Court.

03:56They're not saying that there was no wrongdoing.

04:01All they're saying is that you did not handle it properly.

04:04That's it.

04:04Ayon sa Pangulo, may iba pang paraan para investigahan ang mga allegasyon.

04:08We have already COA, we have already all of this.

04:12I'm sure the House and the Senate will start to conduct further investigations on this.

04:18We have all of the mechanisms that are available to us in terms of checks and balances.

04:24Sabi ni Vice President Duterte, gusto niyang iharap ang lahat ng ebedensya.

04:28Pero wala na raw pagkakataon dahil na-archive na ang impeachment complaint.

04:32Pero paghahandaan daw niya, sakaling isang pa itumuli.

04:34I wanted a bloodbath, meaning I wanted all the pieces of evidence from the prosecution

04:44and all the pieces of evidence from the defense presented for everyone.

04:49But unfortunately, wala na siya sa pagkakaroon.

04:53And of course, as I said, kinahanglan pangandaman ang tandaan na posibleng maitabo.

04:59So possibly, wala takipalo, 2026, 2027, 2028, na ay mga mag-file na quote of impeachment.

05:09That will be another opportunity to answer.

05:14May mga nagsasabing sa desisyon ng Korte Suprema,

05:16pinahirap nito ang paghahain ng impeachment complaint na kontra sa nilalayo ng 1987 Constitution.

05:22I think the Supreme Court should be reconsidered because the rules that they provided now, the new rules,

05:30will practically make it impossible to file an impeachment complaint.

05:34The highest form of integrity is to correct yourself if and when you are wrong.

05:39Ang IBP, sinabing bagamat ang hindi pagsangayon sa pasya ng Supreme Court ay hindi masama

05:44dahil mahalaga ang dissent para manatiling buhay ang demokrasya.

05:48Nagbabala ito laban sa pagkwestiyon sa otoridad ng Supreme Court

05:51dahil ito ay nakakahina sa pundasyon ng ating legal system.

05:55Yeah, we support for the decision because when the Supreme Court decides a case,

06:02especially when it involves issue on constitutionality,

06:07it is not asserting its superiority over a equal branch of government,

06:11but it is simply invoking the Constitution.
