03:47did not hear the conversation.
03:50After all, would it not have been an item of interest to all those present in that specific location
03:57that the President of the Republic himself had condescended to discuss matters of such a criminal nature
04:04by way of telephone?
04:07So, the ridiculous assertion stands solely on the word of one single individual.
04:14The only other corroborating witness, the one who heard nothing,
04:20acknowledged a personal resentment that he harbored for the then President, Rodrigo Duterte.
04:25Sa pagkamatay ni Albuera Mayor Rolando Espinosa at Raul Yap na binaril sa loob ng kanilang selda,
04:31sinabi ng depensa na hindi daw ito maaaring iugnay kay Duterte.
04:35Rodrigo Duterte gave Espinosa a 24-hour ultimatum to surrender.
04:41And surrender he did the following day.
04:44Four days later, Rodrigo Duterte commended Espinosa for surrendering to Ronald De La Rosa,
04:51commenting that it was just as well that he did.
04:54So, if we look at it from the point of view of Rodrigo Duterte,
04:58that is where the incident ended,
05:00despite Mr. Jeremy exhorting us to believe otherwise.
05:06What happened thereafter, as awful as it may be,
05:10had nothing to do with our client.
05:12And not one witness can say that.
05:14The exchange of fire, as reported, is supported by the fact that gunpowder residue was found on seven individuals,
05:30including on the mayor himself,
05:32and a paraffin test turned out positive on the person of one of the victims,
05:38indicating that he had discharged an hour a firearm,
05:42something totally negating the gun plant theory proposed by the prosecution's only witness.
05:49It is also worth stressing that four individuals were arrested alive following the operation,
05:55and that one of them was subsequently sentenced to life imprisonment,
05:59after the domestic courts rejected claims of evidence planting.
06:05That fact alone is not consistent with a theory of indiscriminate execution,
06:11but is rather consistent instead with arrest and prosecution within the boundaries of the law,
06:17and not indiscriminate use of force.

07:42Sa ikalawang sesyon, tumugun naman sa senior trial lawyer Julian Nichols sa ilang argumento ni Kaufman.
07:49Kaugnay sa pagkakaroon ng documentation, sabi ni Nichols kung bahagi umano ng trabaho ng chief of police
07:55ang pagpatay sa libu-libong tao, hindi raw katakatakang hindi ito ilalagay sa mga police record.

08:05bilang mga opisyal na mga tinukoy na co-perpetrator umano niya.
08:07And part of the chief of police's job is to kill thousands of people, it's not a surprise
08:14that the police reports don't reflect that.
08:19If they decide to murder Mr. Espinosa and Mr. Yap while they're held in jail, it's not surprised
08:28that that can be done when Mr. Duterte appoints the head of the Department of Justice.
08:34It's not unique to this case. In war crimes trials, crimes against humanity trials,
08:44where the very top leadership are the persons on trial and when they're committing their crimes,
08:51they don't put it in writing often. Let's go out and commit a crime.

10:16Muling iginiit ng prosekusyon na walang dahilan para hindi ituloy sa paglilitis ang kaso laban kay Duterte.
10:22Back to Mr. Duterte, he's proud of his killings. He wants to be remembered for them.
10:27Decades of murdering his own people, murdering the children of the Philippines.
10:32And he claims that he did it all for his country. He doesn't deny it.
10:37He says, as I said early on, it's a necessary evil. It's for the greater good.
10:41It doesn't matter how many kids I have to kill. I'll clean up the Philippines.
