Legal team says police ignored court directive in Dutch model case

The Kuala Lumpur High Court heard on Tuesday  (June 10) that the police failed to properly investigate the death of Dutch model Ivana Smit, despite a court ruling issued six years ago instructing further action.  Appearing on behalf of Smit’s family, lawyer SN Nair said a 2019 High Court decision had determined that her death had resulted from the actions of “persons known or unknown,” and had directed the authorities to pursue additional investigative steps. 00:35police did not make any attempt to bring in the key individuals last seen with Smit, Alex Johnson

00:41and Luna Almaz, both of whom have since left Malaysia. He adds, the police should have gone

00:47beyond standard procedures by taking further witness statements and re-examining forensic evidence.

00:53Smit, who was 18 at the time of her death, was found dead after falling from a 20th-floor

00:59apartment in Kuala Lumpur on December 7, 2017. She had reportedly spent the night with the couple

01:06prior to her death. The family is now suing the Royal Malaysia Police and the Malaysian government

01:11for negligence and breach of statutory duties. In reply, Senior Federal Counsel Noor Esdiani Roleb,

01:19appearing for the government and police force, said investigations into Smit's death are still

01:24ongoing. She said that the police had not breached their statutory function, but had performed their

01:30investigative duties properly. The court fixed July 15 for its decision. Dutch Ambassador Jacques Werner
