00:26Before former President Rodrigo Duterte was allowed to fly to The Hague, Netherlands
00:33to confront the International Criminal Court,
00:35his camp and Senator Bato de la Rosa filed a petition
00:39before the office of the Supreme Court closed yesterday.
00:42They requested a Temporary Restraining Order or TRO
00:45that prohibits the follow-up, coordination, and assistance to the ICC and Interpol.
00:52But just a while ago, the court issued a decision after the virtual deliberation of the magistrates.
00:58According to the court, the petitioners are confused that there is a clear evidence
01:02and there is no right or need to issue a TRO immediately.
01:07But the respondents were given up to 10 days to comment.
01:11This is separate from the sleep in the Supreme Court today
01:14of his children, Mayor Baste and Duterte.
01:18They feel that the Philippine government should order them to return and confront the former President Rodrigo Duterte.
01:25They are against the separate petition for habeas corpus
01:29since the Philippines has long abandoned the Rome Statute.
01:32The arrest and detention of the former President Duterte cannot be considered as a violation
01:38of the ICC Warrant of Arrest because the ICC has no jurisdiction in our country.

01:55They brought him to another country.
01:58In the separate petition filed by Mayor Duterte yesterday,
02:02he denied the rights of the former President,
02:05as well as the principle of due process and sovereign authority of the judicial system of the Philippines.
02:11Respondents to both petitions were the Executive Secretary,
02:14Justice Secretary, PNP Chief, and CIDG Director.
02:18There were also additional respondents to Mayor Duterte's petition.
02:22We are continuing to get more respondents.
02:25The Supreme Court immediately held a special raffle for the petitions
02:29and assigned it to a member in charge to start the discussion and deliberation.
02:36Although the Justice Department has already condemned the legal procedures in the arrest,
02:41as well as the protocols to ensure due process and protection of Duterte's rights.
02:47Another former President's lawyer himself said that
02:50the petitions for habeas corpus of Duterte's children will not be violated.
02:55I think that the petition for habeas corpus is not workable anymore
03:00because it has already been transferred.
03:02The petition for habeas corpus went with each prayer for a temporary restraining order
03:08so that they can stop the arrest of the former President Duterte.
03:14But nothing, they did not wait.
03:16According to a legal expert, the court may consider the petitions as moot or not valid.
03:23If it should be stopped, what else can we stop?
03:26I mean that's the simple way to look at the mootness of that.
03:30Even so, this is a chance for the court to clarify a few questions about the ICC
03:36and the direction of the Philippines here, even if it is not a member.
03:40There are matters that are to be resolved.
03:43We cannot just leave questions unanswered by the Supreme Court or our law.
