00:00What is this Anti-Photo and Video Voyeurism Act of 2009?

00:08This is Republic Act No. 9995.

00:11It aims to protect the privacy of each individual

00:14by prohibiting the collection, copying, and distribution of private photos and videos without permission.

00:23What are the prohibited activities here?

00:25First, taking a photo or video of a person's private activity or private part of the body without permission.

00:36Second, copying or reproducing such photos or videos without the authorization of an individual or consent.

00:45Third, selling, distributing, or broadcasting such materials without the consent of an individual.

00:55Oh my, this is being criticized a lot, not only in the Video Voyeurism Act of 2009.

01:00Because if you are violating the privacy of a person,

01:05you can also violate it in the Data Privacy Act of 2012 or Republic Act 10173.

01:12Of course, this is also a crime.

01:15This can also be a violation in the RA 10175 on Cybercrime Prevention Act of 2012.

01:22Not only that, if you broadcast a video that we made malicious,

01:30that can also be a violation of the libel or cyber libel.

01:33Oh my, there can be a lot of violations if you make a video like this and you were caught.

01:39As for the punishment, you can be imprisoned from here in the Republic Act 9995 for 3 to 7 years.

01:47And the fine is a minimum of Php 100,000 to Php 500,000.

01:54It still depends on what will be the court's decision and how heavy the case will be.

02:01What are the important points of the law?

02:03The law stipulates the cases where a person is allowed to take a private photo or video,

02:10but he is not allowed to spread it or publish it.

02:15That's different if you two made a video, but spreading it is not included.

02:21There are several cases where a partner has consent to take a video,

02:26but it is not shared online, so the man was punished.

02:31Those who upload or send scandal videos online can also be counted here.
