00:00The Kuala Lumpur Sessions Court has dismissed a negligence lawsuit
00:05filed by the family of Navy cadet officer J. Susaimanikam
00:10against the Malaysian Armed Forces Council,
00:12the government and others over his death.
00:15The family's lawyer Zaid Malik said Sessions Court Judge Ida Ismail
00:20ruled that the plaintiff failed to prove the claim
00:22on the balance of probabilities.
00:24The court also awarded RM10,000 in costs to the defendants.
00:29Zaid added that the family will appeal the decision,
00:32which was delivered via e-review on Tuesday.
00:35Susaimanikam's father, S. Joseph, filed the lawsuit on May 19, 2021,
00:40alleging negligence in monitoring his son's health
00:43and failing to provide emergency treatment during training.
00:46The graduate cadet officer was pronounced dead
00:49at the Armed Forces Hospital in Lumut on May 19, 2018.
00:54In 2023, the Ipoh Coroner's Court returned an open verdict
00:58on the cause of death, which was later revised to homicide
01:01by the Ipoh High Court on July 29.
