00:13Justice Jamil Husin said Najib's lawyer, Shafi Abdullah, did not file a formal application,
00:19adding that the prosecution must be given the opportunity to file an affidavit in reply.
00:24He also questioned if the court could give the discharge not amounting to acquittal
00:28sought by former Treasurer-Secretary-General Irwan Sirigar Abdullah rather than the prosecution.
00:33Najib and Irwan, who were jointly charged with the offence, applied for a DNAA
00:38as the prosecution had yet to supply key documents to the defence.
00:42Irwan's lawyer, K. Kumar Rendran, applied for the DNAA today,
00:46while Shafi'i sought a permanent stay as the prosecution had failed to comply with the court directive issued four months ago.
00:53Deputy Public Prosecutor Saifuddin Hashim Musaymi said the prosecution had no control over this
00:58as the declassification of documents under the Official Secrets Act was up to the respective ministries.
