00:25On 25th March 2024, 6 judges of the Islambad High Court, Justice Mohsin Akhtar Kiani,
00:30Justice Tariq Mehmood Jahangiri, Justice Babur Sattar, Justice Arbaab Mohammad Tahir,
00:34Justice Sardar Ishaq and Justice Saman Rifat Imtiaz wrote a letter to the Supreme Judicial
00:39Council regarding the interference in the court.
00:41Out of the 6 judges who wrote the letter, 4 judges including Justice Mohsin Akhtar Kiani,
00:46Justice Tariq Mehmood Jahangiri, Justice Babur Sattar and Justice Arbaab Mohammad Tahir
00:51have been referenced in the Supreme Judicial Council.
00:55Now, let us read them one by one and see what allegations are there and which important
01:00cases are there in front of these judges.
01:03Let us start with Justice Mohsin Akhtar Kiani.
01:05The allegation on him is that there is interference in the development of judicial officers and
01:10more than the income.
01:12This is his allegation on Justice Mohsin Akhtar Kiani.
01:15Who is the person to put the allegation?
01:17It is the lawyer of KP Bar Council, Mr. Murtaza Qureshi.
01:20Now, what are the important cases in front of Justice Mohsin Akhtar Kiani?
01:24The important case in front of him is the case of missing persons.
01:28I have seen that there are a lot of smokey remarks coming from Mr. Kiani.
01:32The second judge is Justice Tariq Mehmood Jahangiri.
01:35The allegation on him is that there is a complaint about the defamation of the degree and the
01:39person to put the allegation is a common citizen whose name is Irfan Mazhar.

02:25Former DG Housing State, Muhammad Ayub.
02:28In this whole matter, we have seen that we are seeing complete silence from the senior
02:33officials, from the various Bar Councils and Associations.
02:38The allegations have come from two places.
02:41In short, there is Islamabad High Court Bar in which the allegation has come.
02:45And they have called for a social media campaign against Justice Tariq Mehmood Jahangiri on
02:49the 9th of July.
02:51And they have said that Justice Tariq Mehmood is a capable and responsible judge.
02:55The social media campaign against him is credible.
02:58And his career is very successful.
03:01Apart from this, Islamabad Bar Council has also issued an allegation against the judges.
03:06So these are two different allegations that have come in front of us.
03:09Apart from this, we have not seen any reaction from the big Bar Councils, the Supreme Court
03:13Bar Association.
03:17We have with us Mr. Hassanat Malik.

03:20He follows all these cases.
03:22What is the context of these various references that have come in front of us?

03:26And if we go one by one, how much is there in the references?
03:30If we start with the reference against Mohsin Qiani, he says that he has made more assumptions
03:35than the average person.
03:37And has given improvements to the judicial officers out of turn.
03:42Look, this will be a matter of merit later.
03:46First, what we see is that the government has issued a reference against Iftikhar Mohammad
03:51Choudhary.
03:52The second reference was issued against Chief Justice Qazi Faisal.
03:55That was from the government.
03:56And now he is the Chief Justice.
03:58Both the cases have not reached merit.
04:01When the Supreme Judicial Council received a notice, especially when the notice of the
04:07show came, they challenged the Supreme Judicial Council's proceedings in the Supreme Court
04:12and said that these are references based on politics.
04:15We have made some decisions because of which these references have come against us.
04:20Like Qazi Faisal said that I gave a judgment in Faizabad in the Faizabad protest case.
04:25This is why these references have come against me.
04:27So the majority of the judges agreed with this and said that there are references based
04:32on politics.
04:33And there is no reference against Chief Justice Qazi Faisal in this case.
04:37And it was quashed.
04:38The Supreme Judicial Council's proceedings also ended on merit.
04:41Similarly, all the allegations against Iftikhar Choudhary were not seen on merit.
04:45Now, if you look at the details of these judges, then these are also very important sensitive
04:52cases for the last one year.
04:58So we have seen that a complaint has been filed against them.
05:02But this time the method has been kept separate.
05:04References have not been filed by the government.
05:06The complaint has not been filed.
05:08This time the complaint has been filed by some lawyers.
05:11But you will remember when Abdul Waheed Dogar was there, then Qazi Faisal said that
05:19he is a proxy complainant against me.
05:21So I think this government is digging a hole for itself.
05:27When all these judges will appeal to the Supreme Court.
05:30First of all, the case will be taken up in the Supreme Judicial Council.
05:33There you will have to see whether they will take notice or not.
05:38Because there too, judicial politics matters a lot.
05:42And it seems that the complaint that has been filed, it does not mean that more action
05:47has been taken against them.
05:48Rather, it is to give message to others.
05:50To give message in the case of reserve seat.
05:52In Lahore High Court, it is obvious that the Chief Justice has come.
05:55In addition to this, the judges who have to listen to important cases, they have to give
05:58message.
05:59So this message has to be given more instead of getting them removed.
06:04But if this complaint is filed by the Supreme Judicial Council, then if all these judges
06:09appeal to the Supreme Court, then as seen in the past that the full court sits and
06:14those judges who are a part of the Supreme Judicial Council are not there.
06:17And when this matter will come that it is illogical and all these letters of six judges
06:22and the incidents in it and the things that have been reported, even the Attorney General
06:26who is present, Mansoor Aman, he confirmed that Umar Atta Banjal, who was the Chief
06:31Justice at that time, he called me and said that the incident with Mohsin Akhtar Giani
06:36and Arbaab Tahir's father who was called from Quetta, see this matter and resolve this
06:43matter.
06:44So all these things have been going on for a year and are being reported.
06:48So I think this will open a very big Pandora's Box.
06:52And the biggest beneficiary of this will be the PTA when it will proceed in the Supreme
06:56Court.
06:57How will it be a PTA?
06:58Because if they succeed in putting pressure in it, then how will justice be achieved
07:01in this?
07:02What pressure will the judges take?
07:03I don't think the judges will take pressure.
07:05What will happen is that when these things will open and when such a matter comes to
07:09the Supreme Court, there will be a proceeding in the open court.
07:12The conduct of the government institutions there will also be questioned.

07:18I don't know if there will be live streaming or not.
07:20It is possible that Chief Justice Qazi Faiza himself will not be able to preside over the
07:24bank because he is a member of the Supreme Judicial Council.
07:28So at this time, the biggest advantage of the government to the institutions is that
07:32Chief Justice Qazi Faiza is with them.
07:36And we are seeing that what they should have made a detrimental change when the judges
07:40wrote the letter.
07:41So it seemed that they thought that he is a traitor against me.
07:44And the way they should have given a message to the government that there will be no compromise
07:48on the independence of Jurisprudence.
07:49That was not done.
07:50In fact, they were left at the mercy of the government.
07:53For the inquiry commission, the Prime Minister is met with Shobha Sharif, Attorney General
07:58is met with Ram Nishan.
07:59And the government against whom there are allegations, who have allegations against
08:02them.
08:03But I think that at this time, everything is going on.
08:07There is a lot of question on Chief Justice Qazi Faiza.
08:10There is a lot of question on him.
08:12But there is another aspect to it.
08:14In the same way, there was a reference of Justice Sajjad Ahsan, Muzair-e-Naqvi.
08:20They will give a statement as a result of the pressure.
08:23So there is also an option that the pressure will increase and they will leave and give
08:27a statement.
08:28But I think that if they had to leave, they would have left.

08:33So it doesn't seem that it can be done that way.
08:35Muzair-e-Naqvi could not tolerate the pressure and resigned.
08:38And the second thing was that he fought with all his judges.
08:41And he was also a victim of judicial politics.

08:45And the second thing is that he did not give a statement to anyone.
08:48And in the past, those people who were more tired of him, they took him out.
08:54So their matter is a little different.
08:56He resigned.
08:57If these judges also resign, then that is a different matter.
08:59But his possibility is not visible.

09:12There is apparently no silence so far.

09:19Apart from the Islamabad Bar Council, there is the Supreme Court Bar Association.
09:22There is the Pakistan Bar Council.
09:24There is also silence there.
09:25What is the reason for this?
09:26Look, at the moment, the leadership of the Pakistan Bar Council and the Supreme Court Bar
09:30is an independent group.
09:32And the leaders of the independent group are Azam Tariq Sahib, who is the law minister,
09:37and Ahsan Bhun Sahib.
09:38So they are on the same page with the government.
09:41In every case, you must have seen that when the Prime Minister was Imran Khan, when he
09:46was no confidence, he had to complete all the proceedings against him.
09:50This group was the one who turned to the Supreme Court at that time.
09:54But when it comes to non-legal matters, this group gives full support to their interests.
09:59Independent group.
10:00So they are on the same page.
10:02And this is a big advantage for the government.
