00:00 A chemical company has been ordered to pay its former division manager 543,552 ringgit
00:10 after he was found to have been dismissed without just cause four years ago.
00:15 The Industrial Court ruled that Chempro Technology's Sundarian Berhad had constructively dismissed
00:20 Chew Chee Siong after his wages dropped by 70 per cent following the reassignment of
00:25 his customers to another staff.
00:28 Court Chairman Augustin Anthony ordered the firm to pay Chew wages amounting to 16,986
00:34 ringgit per month for two years, as well as compensation in lieu of reinstatement equivalent
00:40 to another eight months' salary worth 135,888 ringgit.
00:46 In an award dated March 18, Anthony said the court found that the reallocation of Chew's
00:52 customers' accounts was done unjustly.
00:56 The court chairman also found that Chempro had failed to engage Chew in any discussion
01:01 before the reassignment of the accounts and merely notified him of the matter by email.
01:07 In response, Chew sent an email to the company's management protesting their actions, adding
01:13 that he would treat his employment as terminated if the accounts were not restored to his portfolio.
