00:07 County Government Act on Wednesday 25th of October 2023, the Meru County Assembly
00:13 approved a motion to remove from office by impeachment Honorable Mwangaza,
00:19 the governor of Meru County. Whereas we are later reference M/K's
00:25 volume 4 stroke 43 dated the 26th of October 2023 and received in the office
00:32 of the Speaker of the Senate on Friday 27th of October 2023, the Speaker of Meru
00:39 County Assembly informed the Speaker of the Senate of the approval of a motion
00:44 by the County Assembly and further forwarded to the Speaker of the Senate
00:49 documents in evidence of the proceedings of the Assembly. Further, whereas pursuant
00:56 to article 181 of the Constitution section 33 of the County Government Act
01:01 and standing order 80 of the Senate, the Senate had the County Assembly on the
01:08 grounds for removal from office by impeachment of Honorable Kawira Mwangaza,
01:12 the governor of Meru County. And further, whereas pursuant to article 181 of the
01:20 Constitution section 33 of the County Government Act and standing order 80, the
01:26 Senate also had the Honorable Kawira Mwangaza on the grounds for a proposed
01:31 removal from office by impeachment as the governor of Meru County. Now
01:36 therefore Honorable Senators, pursuant to article 181 of the Constitution section
01:42 33 of the County Government Act and standing order 80, the Senate resolves to
01:47 remove from office by impeachment the Honorable Kawira Mwangaza, the governor
01:53 of Meru County on the following charges. Charge 1, misappropriation and misuse of
01:58 county resources. Charge 2, nepotism and related unethical practices. Charge 3,
02:05 bullying, vilification and demeaning other leaders. Charge number 4, illegal
02:11 appointments and usurpation of statutory powers. Charge number 5, contempt of
02:16 court. Charge number 6, illegally naming a public road after her husband. And
02:22 lastly, charge number 7, contempt of the Assembly. Honorable Senators, I further
02:32 guide that we shall have a separate vote for each charge. There will therefore be
02:39 seven separate votes. We shall now proceed to vote starting with charge
02:46 number 1, misappropriation and misuse of county resources. You may proceed to vote.

05:17 33-7 of the County Governments Act provide as follows. If a majority of all
05:24 members of the Senate vote to uphold any impeachment charge, the governor shall
05:30 cease to hold office. Honorable senators, the result of the
05:35 division indicate that the Senate has not upheld any of the impeachment
05:41 charges. Pursuant to article 181 of the Constitution, section 33-8 of the
05:47 County Governments Act and standing order 87 of the Senate standing orders,
05:54 the Senate has failed to remove from office by impeachment Honorable Kawira
06:00 Mwangaza, the governor of Meru County. And the governor accordingly continues to
06:08 hold office.
