House prosecution spokesperson Zia Alonto Adiong on Thursday, September 17, said the Senate impeachment court must apply the sub judice rule equally to all parties, including Vice President Sara Duterte.

Adiong said the court should call out Duterte over reported statements expressing distrust in the impeachment court and alleging presidential influence over the Senate. He said the prosecution is also reviewing whether to formally raise the matter before the court. (Video courtesy of House of Representatives)

00:00Was it clear that the VP, for example, the VP Sarah,
00:06the VP Sarah, she doesn't trust the courts anymore,
00:11the President's house, the Senado,
00:14they were saying that they attacked the integrity of the impeachment court.
00:18Why here's the show cause?
00:21Well, first of all, we don't want to see that.
00:26We don't want to see that.
00:27First of all, the prosecutors,
00:31especially when we're explaining the case,
00:36we don't want to see that.
00:42Second, not outside the cases.
00:46Third,
00:46what I think is,
00:51if we are really to set the standard for all parties involved in this impeachment trial,
00:58to observe with due diligence,
01:01avoiding violating the subjudicia,
01:03it would also be applied to the respondent herself.
01:07because she has the defense there.
01:10And I think the defense panel should also advise her
01:14to avoid saying things that insults on weekends the integrity of the court.
01:23That's the reason of the subjudicia rule.
01:27Unfortunately, she has been uttering words that not only attacks the case,
01:33in fact, it does not attack the case of the prosecution,
01:37but it actually attacks the integrity and assail the integrity of the court
01:41by saying na wala siyang tiwala,
01:44by saying na yung mga nakaupo doon ay mga hawak
01:48or may influensya ng Malacan.
01:50Those kinds of statements should be called out by the court.
01:58Kapati, don't seem to think that way,
02:01na parang hindi nga po nakupo na.
02:03Again, I don't want to advise whatever the court would do
02:06because that's their prerogative.
02:08But it seems to me, personally,
02:11that if we are really to maintain,
02:14universally applied that subjudicia rule,
02:16it should be applied universally.
02:20Do you think by special treatment,
02:21itong Senate impeachment court presider officer kay VP Sara?
02:25I think it should be applied universally.
02:29Thank you, Pa.
02:31Ito ma-manifested ba yun?
02:32All right.
02:34Follow up.
02:36Sir, yung pagtingin po na kailangan i-apply universally
02:41yung subjudicia rule and yung mga observations po ninyo
02:44sa mga statements ng vice,
02:45will that be manifested by the prosecution before the impeachment court?
02:49Well, pag-usapan pa nga po yan,
02:51what would be the course of action.
02:53Again, just to be fair also,
02:54the court is also giving way naman po
02:57to both panels to err their side.
03:02If that requires, for example,
03:04if it necessitates for the prosecution panel
03:07to also make this as a formal manifestation,
03:10then that could possibly be done.
03:12What is important is also the court allows for both panels to err their side,
03:18you know, make manifestation in an open trial,
03:22in the open trial.
03:23So, pag-usapan po yan sa prosecution panel.
03:26How about, sir, yung show cause order issued
03:29against some members of the prosecution,
03:31will that trigger changes, adjustments sa prosecution panel po
03:37when it comes sa...
03:38Again, we would still see the details
03:41as what the Congressman Chua earlier explained,
03:46pag-usapan, pagtitingnan po yung detalye.
03:48Natanggap po natin yung show cause order,
03:50pero titignan pa rin po yung detalye.
03:52The response of the House prosecution panel
03:55would depend on the merits,
03:57on the details of the show cause order.
04:12You
