Will we see new mail-in ballot restrictions during the 2026 midterm election, after the U.S. Supreme Court cleared the way for President Trump's administration to do so? Minnesota Sec. of State Steve Simon says it is very unlikely.

00:00The president issued an executive order in March, and what he's envisioning is a system where the Postal Service would
00:07run every mail ballot through a database that Homeland Security creates, and if it's not on the list, they won't
00:13deliver that piece of mail.
00:14The problem, from our standpoint, is that's kind of a black box, and we don't know what's in the box,
00:19how they got in the box, what the methodology is, and people make mistakes.
00:24And so, not to mention the fact that the Constitution's pretty clear. States are in charge of the time, place,
00:30and manner of elections. Congress can pass a law on that stuff, but the Constitution says nothing about a president,
00:36this one or anyone, just sort of waving a magic wand and issuing executive orders and trying to take over
00:41stuff in the election space.
00:42So, we're confident, we meaning the 25 states now, I think, that have joined together, that ultimately will carry the
00:48day, but I just want Minnesotans to know that for now, nothing has changed. Not a thing.
00:54All these rulings you're ruling about don't affect us at this point at all. You can still vote safely and
00:59securely by mail in the upcoming election.
01:01You talk about this black box that you're unsure about. As it stands right now, on August 27th, will that
01:08be in place in November? So, if people are listening right now, somebody who usually votes by mail, should they
01:14seriously consider maybe doing it another way? Or what is your advice to those voters?
01:19I highly, highly doubt that that system will be in place. Just standing up this new architecture, this new structure,
01:24these new systems, you know, I just want to put this in perspective.
01:28Three weeks from tomorrow, voting starts in Minnesota for the November election. On September 18th, voting starts. In some states,
01:35it's even earlier.
01:36So, I don't understand how the Postal Service and Homeland Security, in literally a matter of a few short weeks,
01:42is going to stand up this massive new logistical change.
01:45And I think the courts will see it that way. So, if I had to predict, I would predict, no,
01:49that this thing will not be in place for the 26th election.
01:52And maybe not ever. But for the 26th election, that's the outcome that we, the states who have gone to
01:57court, are trying to ensure.
01:59And right now, nothing has changed. Anyone planning to vote by mail, right now, you can still plan to vote
02:03by mail.
02:04It's okay to question laws, question me, question the office, anything like that.
02:09But in the end, we've got to focus on everyone's freedom to vote and not inject unnecessary chaos and confusion
02:16into the process.
02:17That's what we don't want. So, say what you want about this or that policy. That's everyone's right.
02:21This is America. But let's make sure that, as we're headed to the election, everyone's clear on what the rules
02:26are.
02:27And my objection to the President's interventions here and his consistent attempts to interfere with state-run elections
02:33is it is injecting that chaos and confusion and doubt, and we just can't have that.
02:39It doesn't matter to me how someone votes, red, blue, purple, polka dot, whatever.
02:42But we just want to make sure everyone who's eligible to vote has the freedom to vote
02:47and not be sidetracked by this swirl of accusations and allegations that can really confuse people.
