00:00Reddington just said the police investigation was lousy and that they did not prove that Lindsey
00:05was even guilty of the crime, so he asked for a Bowden charge. I mean, this is huge. So today,
00:12Reddington asked for a Bowden charge because of the inadequate police investigation, and I'll
00:16explain what a Bowden charge is at the end, but first, let's get into what he said. He explained
00:21that in order to have a lack of criminal responsibility, you have to admit involvement
00:25in the crime, but when trying a case like this, the government still has the burden to prove beyond
00:30a reasonable doubt that the defendant is guilty of, based on the evidence, that particular crime.
00:36If there's evidence that a police investigation is deficient, the jury does have a right to consider
00:40that as a basis of acquittal, and he said they can consider that for the purpose of finding reasonable
00:45doubt upon the, quote, lousy investigation, and he said, quote, it wasn't just a lousy investigation,
00:51it wasn't just an atrocious investigation, it was no investigation at all. He talked about the fact
00:58that the police just accepted the claim that Lindsey took the life of her kids. They found
01:02the kids in the basement, they said she's guilty, and just moved on. He said the police didn't
01:06investigate anything, they didn't test the screen, they didn't even take a picture of the screen,
01:11they didn't see if there was any blood on the screen, etc. He also said there was no pill crusher,
01:16there was no residue left from crushing pills, and there was no proof that she did that so that
01:20she could ingest them. He said there's just so many unanswered questions like the blood spatter,
01:25the blood on the door, the siding, and that the police came in the court six months later and
01:30talked about it when the siding had already degraded, and they couldn't even test it. He said,
01:35I can go on and on and on about the horrific investigation, and I think it's fair to instruct
01:40the jury on Bowden. Now, essentially, what a Bowden charge is, is a legal instruction that allows a
01:45jury to consider the gaps and flaws in the police investigation when weighing the prosecution's
01:50evidence. Basically, reminds the jurors that they can evaluate the quality and completeness of the
01:55police work when deciding on guilt or innocence. In this case, the judge denied his request but said
02:00he is free to talk about the gaps in the police investigation in his closing argument. I mean,
02:05the fact that he is saying they did not prove her guilt and he is even bringing this up in
02:09court
02:09is monumental, but let me know what you guys think about this. Rest in peace to her poor children,
02:13and as the trial continues, I'll keep you guys updated.
