00:03One song, two stanzas and no change of stance from 1937 to 2026.
00:10Yes, the Congress Party has decided that only the first two stanzas of Vande Mataram
00:16would be sung at national gatherings of the party.
00:19The party says these stanzas acquired national significance
00:23and contained nothing objectionable, while the later portions carry religious imagery
00:28that could make some communities uncomfortable.
00:31The BJP sees this as appeasement politics.
00:34Home Minister Amit Shah has called the Congress decision anti-national.
00:38He has also linked the 1937 decision to the political developments that eventually led to partition.
00:45But there is another important point to this debate, that is the law.
00:50The Parliament, remember, has amended the Prevention of Insults to National Honour Act 1971,
00:55giving Vande Mataram statutory protection, similar to that enjoyed by the national anthem.
01:03The law makes intentionally obstructing its singing or disrupting an assembly engaged in singing a punishable offence.
01:11But the law does not make it compulsory for every citizen to sing Vande Mataram.
01:17And that's an important distinction.
01:18The government has set a protocol for official functions, including how the song should be sung.
01:23But protecting the song from insult or disruption is not the same as forcing every individual to sing it.
01:31How did a song meant to unite Indians become a debate over religion, identity and politics?
01:38Who is dividing us in the name of the national song?
01:41And has the national song itself become a test of nationalism?
01:45Before I bring in the guests on the show, let's listen in to who said what.
01:51I am very clear, the resolution of the 1937, Mahatma Gandhi Ji, Pandit Jawaharlal Nagar Ji,
01:59Devindranath Atagur Ji, Subharshan Chandraposthi, this type of Sardar Patel Ji,
02:04this type of topmost leadership of that point of time, decided that whatever the decision they took,
02:13we will abide that decision.
02:15The Congress Party has made a decision for the country and the country of the country.
02:48Joining me first on the show is our big newsmaker, Dr. Abhishek Manu Singhvi,
02:52fifth-term sitting member of parliament, member of the Congress Working Committee,
02:57eminent jurist and senior national spokesperson of the Congress Party.
03:00Dr. Singhvi, Home Minister Amit Shah says that the CWC's decision of which you are a part
03:06to sing only two stanzas actually repeats the 1937 mistake
03:12and directly fed the two-nation theory that led to partition.
03:17As a jurist and a CWC member, is that a serious historical claim?
03:23How do you look at it?
03:25Maria, thank you for the generous introduction.
03:27Let me start by saying that I am terrified and shivering
03:32that I will be called anti-national and seditious after doing this program with you.
03:39That is the state of the affairs today.
03:41Now, this is framing the issue in a distorted manner.
03:48Anybody who knows anything about history knows that the Congress has decided to continue doing
03:55what the Congress and the nation was doing from 1937 uninterruptedly till 2026.
04:04The Congress is not going to do it at an official government function,
04:08which is not the Congress function.
04:10What the Congress has proclaimed is what it will do in its own functions.
04:14Now, I would like to ask the Honorable Home Minister,
04:18who of course is very learned in history and in traditions,
04:22that in 1937 October, the people who first sat together
04:28discussed very much in detail about Mahatma Gandhi, Jawaharlal Nehru, Sardar Patel, Subhash,
04:33both in Mahatma Gandhi, Azad, and then they consulted Rabindranath Tagore.
04:39And after that detailed consultation, with a view to taking the country together,
04:44a decision was made, A, that Janagaraman should be the national anthem,
04:50B, that Vande Mataram shall be the national song, no less, very important,
04:56and see that the first two stanzas will be an opposite reflection of the prosperity,
05:04the momentum, and the direction of this nation.
05:07Now, according to Mr. Shah, they were all unpatriotic.
05:13According to the Honorable Home Minister,
05:16Mahatma Gandhi downwards, Bose upwards,
05:21Azad, Nehru, everybody is either anti-national or unpatriotic.
05:27And from then till today,
05:30Vande Mataram was elevated to the status of a national song.
05:34As you know, 15 years later, on 24th of January 1950,
05:39the president of the Constituted Assembly
05:41and the first president of India, Rajinder Prashad,
05:43proclaimed that this is a national song of equal status with Janagaraman.
05:48So all these people were doing what?
05:51They were, as he says, doing two-nation theory?
05:55Is that why we fought for independence and did not agree?
05:59They were doing appeasement?
06:02I think, you know, what the BGP is doing is,
06:06it is conflating consciously and deliberately.
06:13Patriotism into a six-tanzar test.
06:15It is deliberately conflating political convenience
06:20with historical veracity.
06:23The latter they are ignoring, the former they are moving on.
06:27They are moving only on political convenience.
06:29And let me last say,
06:31Mahatma Gandhi himself defended this on this discussion.
06:36Remember, Tagore came up with this idea finally.
06:39This group of people accepted it.
06:41And right from then onwards, Mahatma Gandhi repeatedly said
06:45that this is the national symbol which unites people across India.
06:49This is, you know, patriotism doesn't mean cultural uniformity.
06:53It doesn't mean my compulsion or my command to you
06:57to do what I say.
06:59It means what is truly felt for the nation
07:03and carries everybody along together.
07:05And that is something, an idea of India,
07:08which I doubt very much if BJP or its leaders
07:10will ever begin to understand.
07:12Dr. Singhvi, you have spoken about continuity
07:14and that is the Congress Party's defense.
07:17The same two stanzas sung by freedom fighters,
07:21including Congress's own processions before 1947.
07:25But Parliament has now passed a law
07:27putting Vande Matram on par with the national anthem.
07:33Isn't then this defying that law?
07:37Whatever your historical argument,
07:39this will be now seen as a defiance of a statute.
07:46Maria, that is an incorrect understanding of the law.
07:49First of all, the law has passed now, a few weeks ago.
07:53It is not the law from 1937 to 2026.
07:56Now, because this government believes
07:58that uniformity must be imposed by law,
08:02they passed the law.
08:03But even in the law,
08:05does the law tell you
08:06that when you have a function in your house,
08:10when you have a function in your hotel,
08:12or when you have a function in your institution
08:14or whatever entity,
08:17no law says that you are compelled
08:19to sing in a particular way.
08:21What this law does is
08:23for national official functions.
08:26Certainly, the Congress in its resolution yesterday
08:29and otherwise is not talking about that.
08:31That's the Government of India function.
08:33That's an official function.
08:36What will happen in the future
08:37if governments change?
08:39Law will have to be changed, maybe.
08:41I don't know.
08:41But certainly,
08:44a rendering of the Vande Matram,
08:48as it has been rendered
08:50from 1937 to 2026,
08:53just under 100 years.
08:55How can that be wrong
08:56for a private function
08:57or for a function
08:58intra-the Congress party?
09:01It's as simple as that.
09:02What is happening is
09:04that complete, distorted narratives
09:07are being spread,
09:09complete, distorted ideas
09:10that we are anti-national,
09:12we are appeasing,
09:13we are doing this,
09:13we are doing nothing new.
09:14Who created the Vande Matram
09:17to the national level
09:18and elevated it?
09:19The Congress.
09:20Who wrote all these 1937
09:22and 1950 resolutions?
09:23The Congress.
09:24Where were you that time?
09:25Nowhere.
09:26Who thought of the country
09:28as a whole
09:28and not of political convenience?
09:30So, be clear.
09:32We have said
09:33this is our understanding
09:34of the law
09:36for non-official,
09:38non-governmental functions.
09:39Okay.
09:40Now,
09:40otherwise what happens
09:41is a different matter.
09:43Okay.
09:43Dr. Singh,
09:44if the Congress
09:44objected this strongly
09:46to the full song mandate,
09:48where was that opposition
09:50when the prevention
09:51of insults
09:52to national honour
09:53amendment bill
09:54was actually debated
09:56and passed in Parliament?
09:57Why register the protest now?
09:59After the fact
10:01that instead of
10:02on the floor of the House,
10:03shouldn't that be
10:04being done
10:05on the floor
10:05of the House, sir?
10:06Very good question, Maria.
10:08Let me just turn
10:09your question around
10:10to yourself
10:10and get the answer.
10:13You know,
10:14the whole country knows
10:15that for the first week
10:16of Parliament,
10:17full seven days,
10:18the whole country
10:19on the students
10:20and the neat issue
10:21was on fire.
10:22There were two
10:23or three simple demands.
10:24Both the honourable
10:25Prime Minister
10:26and the Home Minister
10:26must come to the House.
10:28A particular
10:29Minister of Education
10:30must resign.
10:31And excesses
10:32which have happened
10:33by the police
10:33must be investigated,
10:34the broadly the three.
10:36For one whole week,
10:37seven days,
10:38nothing happened
10:39and Parliament
10:39was paralysed.
10:42Partly something
10:43was given,
10:43the Minister resigned
10:44and the paralysis
10:45continued because
10:46for the whole session
10:48on pure ego
10:49and we are not asking
10:50to come to our home,
10:51we are asking
10:52to come to Parliament,
10:52the Temple of Democracy,
10:54neither the Prime Minister
10:54nor the Home Minister
10:55came.
10:56Now, at that din,
10:57everybody knows
10:58that every day
10:59there was a walkout.
10:59My question to you is,
11:02would you,
11:02why did you choose
11:03to deliberately
11:04introduce it then?
11:05You deliberately
11:06introduced it
11:07as you did
11:08with some other bills
11:09because you wanted
11:10it passed
11:11without discussion.
11:12You knew that
11:13there was a walkout
11:14every day.
11:15In fact,
11:15for the first week
11:16you never agreed
11:16to the students' demand
11:18and you passed bills.
11:19In the second week,
11:21the first few days
11:21you did the same thing.
11:22So, really speaking,
11:24this is chickenery
11:25by the government.
11:26This is trickery
11:27by the government.
11:28Important measures
11:28like this,
11:29which they,
11:30the government runs
11:31Parliament,
11:31they have to introduce
11:32or not introduce bills.
11:33They could easily
11:34have deferred
11:34to the next session.
11:35They didn't want
11:36a discussion.
11:37Lastly,
11:38to suggest that
11:39because we have
11:39to walkout in that
11:40way to show
11:41solidarity with students,
11:43to show solidarity
11:44with the country
11:44on fire because
11:46of the need
11:46and the police excesses
11:48is not to say
11:49that we are not
11:49opposing this.
11:50Every time
11:51we've opposed this.
11:52Okay.
11:52Dr. Singh,
11:53as a lawyer,
11:54as a lawyer yourself,
11:56now that this is
11:56the law of the land,
11:57how do you see this?
11:59Are you not worried
12:00that this could,
12:01you know,
12:02open up
12:02almost like
12:04a sudden surge
12:05of cases
12:06around this
12:06will emerge now?
12:08I think you're right.
12:10I have no faith
12:12that the establishment
12:14which this government runs
12:15will be objective
12:17in the implementation
12:17of this law.
12:19They have shown
12:20their one-sidedness
12:21and their animus
12:23especially against
12:24political opponents
12:25in several misuse
12:26of several agency
12:27special laws
12:28from the PMLA,
12:30et cetera.
12:31I therefore do expect
12:32that this law
12:33will be misused
12:34and distorted.
12:36For example,
12:37the law itself
12:38has no such compulsion.
12:39It criminalizes
12:41obstruction
12:42of singing of
12:43Vande Matra.
12:43So if you are singing
12:44Vande Matra
12:45voluntarily
12:45and if I inhibit
12:47or obstruct you,
12:48then I may be
12:49it by the law.
12:50But if in a private,
12:51non-government,
12:52non-official function,
12:53I do my own singing
12:54of the first two standards,
12:55I read nothing
12:56in the law
12:56which prohibits.
12:57Now what the government
12:58will do
12:58is many things.
12:59It can issue guidelines.
13:01It can start relying
13:02on the guideline
13:02which is not the law.
13:03Guideline is your understanding.
13:05So this will lead to,
13:07I believe,
13:08some fracca
13:08where none is required.
13:09I believe some strife
13:11and division
13:11and distrust
13:12where none is required.
13:13But that's the way
13:14the government works.
13:15This government believes
13:16that a majority
13:18in parliament,
13:19Bahumat,
13:21is the answer
13:21to everything.
13:22Bahumat validates
13:23all wrongs.
13:24Bahumat validates
13:25all errors.
13:27So that's the way it is
13:28and it will have to be
13:28fought in courts.
13:29Okay, my last question
13:30to you, Dr. Singhvi,
13:31and for this you have to
13:32where your Congress
13:33leaders at.
13:34If the two stanza version
13:36was good enough
13:37for Gandhi, Nehru
13:38and the Congress
13:38of the Freedom Struggle,
13:40why has your party
13:41allowed the BJP
13:42to own the full song,
13:44full patriotism narrative
13:46for over a decade
13:47instead of contesting it
13:49head on?
13:51Maria,
13:51there is some
13:52misunderstanding.
13:53I mean,
13:53I don't,
13:53who else has contested
13:55this than us?
13:56You tell me
13:56who else in the country
13:57has consistently
13:59contested it?
14:00The Vande Matram
14:01controversy
14:02is in fact
14:03created by the BJP.
14:04Just like
14:05mandir controversy
14:06is created by them.
14:08Just like religion,
14:08their whole existence
14:11is to create divisions
14:13in society
14:13on two issues.
14:14Their whole system
14:15is that.
14:16Namely,
14:17one,
14:17that you must have
14:18this division in society
14:20on patriotism
14:21and nationalism.
14:22I must wear it
14:23on my sleeve,
14:24otherwise I am liable
14:25to be hung
14:26from the nearest post.
14:27Second is religion.
14:28So you think that
14:30if I go to a temple
14:31I am defensive?
14:33Do you think
14:34that if I wear
14:34one of my favorite colors
14:35is actually
14:36saffron and green?
14:38Saffron has a great
14:39tradition in India,
14:40far before the BJP
14:41was born.
14:42Do you think
14:43I let them appropriate that?
14:44No,
14:44I am a proud Hindu.
14:45But I am a true Hindu,
14:46I believe.
14:48You may have
14:48a different definition
14:49of Hindu.
14:49So therefore,
14:51according to the Congress,
14:52we speak up,
14:54we are the party
14:55which is the first speaker
14:56on the first podium.
14:58But obviously,
14:59we can't be there
15:00inside parliament
15:00when we are doing
15:01a concerted,
15:03consistent opposition
15:04for the cause of students.
15:06And that's when
15:07you choose to pass the law.

16:20once the problem
16:22would be resolved,
16:23the Vande Matram
16:24would come
16:26into its original form.
16:27So the Congress
16:29party
16:29is taking
16:30center of
16:31Gandhi,
16:32Nehru,
16:33Maulana,
16:33Ajad and others
16:34just to hide
16:36the shame
16:36of
16:37its
16:39reversal
16:39nationalist
16:40posture.
