00:00When this sovereign citizen claimed his case was no longer under Ohio's jurisdiction and had been moved to federal court,
00:05the judge looked at his paperwork and found he had filed documents with a completely different court in New Jersey.
00:09In the state of Ohio versus Jeremiah Mackey Jr., the defendant's charged with two counts involving driver's license violations.
00:16One is driving under a OVI suspension and the other is driving under a forfeiture.
00:21Mr. Mackey, what do you have to say about that?
00:23I have documents, you know, if in fact, if I could serve the court.
00:26Why don't you just tell me what you have there first?
00:28The document that I have is referring to a removal that's been posted from the clerk.
00:33And as well, my case is, in fact, on an appeal at the moment.
00:37On appeal where?
00:38It's on an appeal.
00:39In what court is what I'm saying? Where have you filed an appeal?
00:42The Court of Appeals.
00:42Okay, which district?
00:43The 10th District.
00:44Okay, now that covers Franklin County and we're in the 5th District Court of Appeals.
00:47I'm sorry, it's the 5th District. You're absolutely right.
00:50The documents are unique in that they're gray and they're typed in all caps.
00:53And one of them, it looks like, from what you just filed this morning, was filed in the United States
00:57District Court in the District of New Jersey in the Newark Division.
01:00And this is obviously Newark, Ohio.
01:01Your Honor, if it pleases the court, motion that this case be continued on or stay because the case is
01:07now on an appeal.
01:09Also, the case has been petitioned, moved to the Ohio District Court, to the New Jersey District Court.
01:15The court's jurisdiction is divested until those courts determine otherwise.
01:20Well, actually, none of that is true.
01:22What first drew your attention to the defendant's vehicle?
01:25As he was traveling northbound, making a left turn onto the State Route 161 westbound, I observed he had dark
01:31tinted windows, which initially drew my attention.
01:32And then as he passed me, I made the right-hand turn and drove behind him and entered his license
01:36plate.
01:36Did his license plate, when you ran that, return anything?
01:39It did.
01:39I observed that his license plate had expired, registration, I should say, expired.
01:43Were you able to then go back to your mobile unit and run his driver's license status?
01:47Yes.
01:47And what did that return?
01:48I observed, again, through my computer system that it showed he had multiple active suspensions,
01:53one of them being the OVI suspension that he was sided with, as well as the two non-compliance suspensions.
01:58All right.
01:58So, Mr. Mackey, do you have any questions for the officer?
02:00No, no.
02:01Well, the court's heard testimony from Officer Coors, which finds to be credible, and upon reviewing the information provided by
02:07the Bureau of Motor Vehicles,
02:08determined that he was under both an OVI suspension as well as a Financial Responsibility Act suspension.
02:13So, I do find that the state has met its burden on all three counts, and I'll go ahead and
02:17enter guilty findings.
02:17Driving under the OVI suspension charge, the court's going to impose a three-day jail term.
02:21Do you have a job?
02:21Yes, Your Honor.
02:22What kind of work do you do?
02:23HVAC, she met him.
02:25Do you work Monday through Friday?
02:26Saturday, Your Honor.
02:27Monday through Saturday.
02:28If I order that you report to the jail on a Sunday, at least one of those days of the
02:32three days, you won't be missing work, okay?
02:33I'm going to have you report directly to the jail on Sunday.
02:36You're not the first person who's come through court with these arguments that you're making regarding jurisdiction and the right
02:41to travel and things of that nature.
02:42I'm here to tell you that it's not the law.
02:44Folks who espouse these arguments just continue to find themselves in court, and they don't win against the system.
02:49You know, you can be as frustrated and angry at the system as you want.
02:52The law is what the law is.
02:53The only thing that you need to do is comply with the driver's license laws, and you won't have to
02:57worry about having to listen to guys like me anymore.
