00:00Association does maintain that the place where Mr. Zeicher parked.
00:03Association believes it's their private property. Do you have proof of that?
00:06When this homeowner fought back after an HOA towed his car from a street they claimed was private,
00:10the judge questioned whether they had any proof or deed showing they actually owned the property.
00:14Mr. Zeicher, what day was your car towed?
00:16The car was towed on June 6, 2026.
00:19Mr. Manning, is there any dispute here?
00:21In the CCNRs, it does provide Section 4.27 of the CCNRs of Bolding Creek.
00:25It does provide that the private streets, they are private streets, they're not public.
00:29We did have a tow-away sign, and we did post a to-move-the-car sign on the window
00:34of the car.
00:34I think it was parked there for about a month.
00:36Mr. Zeicher, where was your car parked on June 6?
00:38I was on the public roadway on the east side of South 2nd Street in front of 909 and 911
00:43South 2nd Street.
00:44The condominium community is on the west side of South 2nd Street.
00:47I was on the east side of South 2nd Street, and those are completely different properties.
00:51I was not on their parking facility, I was not on any other private property,
00:54and I was not blocking any driveways or drive aisles.
00:56Did you take the photo that I'm looking at?
00:58Yes, Judge, I took it on my iPhone.
00:59And is this your car?
01:00Yes, Judge.
01:01Was this before or after your car was towed?
01:03That was before my car was towed.
01:05What was the reason you took a picture of your car?
01:06To document the fact that I was parked on the public roadway.
01:09When I parked my vehicle on June 2nd, I took these photos,
01:12and the vehicle remained parked there until it was towed on June 6th.
01:16And how did you find that out?
01:18Well, I have an air tag in my car, and I saw it moving southbound,
01:21and then I called the Austin PD, and they informed me that it was taken to a tow yard.
01:26Prior to your car being towed on June 6th,
01:29did you receive any warnings of any type related to you parking your vehicle?
01:32Yes, Judge.
01:33I attached the exhibit of the orange sticker that was placed on my car.
01:36When was that sticker discovered?
01:38I believe it was May 21st.
01:40After you found your car with the orange sticker, did you move your car?
01:43Between May 21st, yeah, because I went to the grocery store on June 2nd.
01:46Cool. You drove your car and parked it on June 2nd in that spot,
01:50and then didn't move it until it was towed?
01:51Yes.
01:52So anything that came from before that, kind of irrelevant,
01:54because you'd already moved the car.
01:55Correct, yeah.
01:55Cool, then we can move along. I'm not worried about the orange sticker.
01:57Between June 2nd and June 6th,
01:59did you have been given any notice whatsoever that your car was going to be towed?
02:01No, Judge.
02:02Have you gone back and inspected the location where you'd parked?
02:05Yes, Judge. After being towed, I returned to South 2nd Street,
02:08and I took additional photographs of the street, a wider view of the street,
02:12as well as the entrance of 900 South 2nd Street,
02:15which is the Bowling Court Condominiums, and I supplied exhibits.
02:19So that's the entrance on the west side of the roadway with the fire lane and the arrow pointing inward.
02:23Mr. Zeicher, what did it cost you to get your car back?
02:25It was $321.45 at Reliant Towing.
02:29Mr. Vanden, what information would you like to show?
02:31As I stated earlier, Reliant Towing did place a sticker on Mr. Zeicher's car on May 22nd.
02:37The next day, he moved it.
02:38The Association does maintain that the place where Mr. Zeicher parked...
02:42Do you have any proof?
02:43I appreciate what you're saying. The Association believes it's their private property.
02:46Do you have proof of that? Can you show me a deed that says this land is included on their
02:49land?
02:50Because it looks like a public street to me, and there's absolutely no signage whatsoever around there.
02:54Your Honor, I do not.
02:55Okay. Judgment for plaintiff. Cost of corn, $321 for your tow fee.
