00:01A former soldier convicted of killing his nine-year-old daughter has escaped the gallows,
00:06the federal court commuting his death sentence to 40 years in prison and 12 strokes of the cane.
00:11In a two-to-one majority decision, a three-judge panel upheld Muhammad Abdullah Muhammad's murder conviction,
00:17but split on sentencing.
00:19The 44-year-old was found guilty under Section 302 of the Penal Code for the 2018 death of his
00:26daughter, Noor Aina Nabiha.
00:29Justice Nurdin Hassan dissented on sentencing, saying he would have kept the death penalty.
00:34But Justices Vazir Alam Maidin Meera and Muhammad Nazlan Muhammad Ghazali ruled otherwise,
00:40substituting it with 40 years jail, backdated to his arrest in January 2018 and caning.
00:46The case dates back to August 2023, when the Seremban High Court first sentenced Muhammad Abdullah to death.
00:52The Court of Appeal upheld that decision in June last year.
00:56The defense had argued the conviction was unsafe, questioning the competency of a key prosecution witness,
01:02the victim's teenage brother, who testified without a formal assessment.
01:06Deputy Public Prosecutor Datuk Wan-Shaharuddin Wan-Ladin counted that the witness was 15 when he testified
01:13and clearly understood the questions posed during the trial.
01:17He also said that the victim suffered a ruptured pancreas, broken ribs and more than 20 external injuries.
01:23He argued the brutality of the abuse and the appellant's lack of remorse meant he did not deserve a second
01:29chance,
01:30adding that the public expected the death penalty in such circumstances.
01:34Speaking to reporters after the proceedings, Wan-Shaharuddin said the prosecution accepted the federal court's decision
01:41and that the appellant living with what he did to his child was worse than the death penalty.
