00:25Jessie Fry gave birth to their daughter Evie in 2022 and the women say their clinic assured them Kate Cantrell
00:32could carry their second child.
00:34However, after Queensland Health issued new guidance in February, Miss Cantrell was told she can no longer use their donor
00:41due to family limits.
00:43It's hurtful that the government is changing, that the world is changing in a way that affects our family.
00:49In Queensland, sperm from donors cannot be used to create more than ten families to avoid unintentional relationships between donor
00:58-conceived people.
00:59The legislation defines a family as a parent, their children and their spouse, if any.
01:04But Queensland Health sees two women in a relationship who both conceive with the same donor as two families.
01:11For our family, it's a political nightmare.
01:13Queensland Health and Health Minister Tim Nicholls say the legislation was amended in 2025 to allow providers to apply for
01:21an exemption to exceed the family limit.
01:24But advocates say exceptions shouldn't be necessary in the first place.
01:27For some reason, Queensland Health is interpreting the laws, we think, incorrectly.
01:31I think the law is actually quite clear that ten families, the limit is for ten families and not for
01:37ten women.
01:37Ms Cantrell may still be able to give Evie a genetic sibling.
01:41There's one vial of donor sperm under her name and the fertility clinic has told her it may count as
01:47one family spot.
01:49It told the ABC it could not comment on individual cases.
01:53We really feel that we're still in limbo.
01:55So we don't know if it's too soon.
