00:00Good morning. Are you Michaela Marcantel? And will your client wait the formal reading
00:06of the indictment? She really are. Let me get to it.
00:12Ms. Marcantel, in cause number 25, DCCR 0528, you're charged with the state jail felony offense
00:19of theft of property from May 28th of 2022, continuing through June 4th of 2022. And how
00:27do you plead to that charge? Are you pleading guilty freely and voluntarily? And are you
00:32pleading guilty because you did what they charged you with? I have here on the tab with some
00:37documents that have your signature on them that the state has marked as exhibit number
00:40one. Before you sign these, did you go over them with Mr. Rojas? Do you fully understand
00:46them? And do you understand if I follow the agreement that you've made with the district
00:50attorney that you'll be waiving or giving up any right to appeal? And it looks like the
00:55agreement that you've reached is for a five-year deferred probation. There would be $4,492.45
01:03to be paid back in restitution. And you would be required to follow all of the rules and conditions
01:08of probation. Is that your understanding? Yes.
01:10Do you also understand, if you're not a U.S. citizen, that a plea of guilty or no contest
01:15may result in your deportation, exclusion from admission to the country, or denial of naturalization
01:21under federal law? Yes.
01:23State tenors number one? No objection.
01:24It's admitted. Is there any evidence that Ms. Marcantel is not competent? No, you are.
01:28And any reason not to waive? She's never been arrested before, Your Honor. I don't have
01:32objection to waiving. All right, Ms. Marcantel, I'm going to find
01:35that you entered your plea of guilty freely and voluntarily. I find that you're mentally
01:39competent and you understand the nature and the consequences of that plea. I'm going to
01:44waive the pre-sentence report, find sufficient evidence to find you guilty. However, I'm going
01:49to follow the agreement that you made with the district attorney and defer all proceedings,
01:53place you on probation for five years. You're ordered to follow all of the rules and conditions
01:59of probation. I'm also ordering you pay back the restitution in the amount of $4,492.45.
02:06If you do everything that you're supposed to on this probation, this is an excellent opportunity
02:11because you are not a convicted felon. You don't have the conviction on your record. And
02:15if you successfully complete the probation, at the end the case actually gets dismissed and
02:19you'll never have a felony conviction. The other side of that though, is if you violate any
02:24condition of probation, you can be brought back into court, found guilty of the offense,
02:29and sent to the state jail prison for up to two years. Do you understand? That's a lot
02:33of money to pay back also. Five years seems like a long time to pay it back, but it'll sneak
02:39up on you. And so it is very important to me.
