00:00Keith Davis, prior to your retirement, your career was that of a P.E. teacher, but you have been very
00:09closely involved in the world of athletics since your 20s, and I accept you have dedicated much of your life
00:18to helping others through teaching and sport.
00:22For you to find yourself in the dock of a criminal court is unquestionably a personal tragedy.
00:31You had worked for UKA for many years, where your official title was Head of Sport.
00:39You were identified as one of the three members of the UKA Management Group, and were a member of the
00:47London 2017 Operations Oversight Management Group.
00:51That said, I acknowledge that your remuneration of £20,000 per annum was on any view modest, and I note
01:03that your authority level in terms of expenditure was limited to as little as £5,000.
01:09UK Athletics Limited pleaded guilty to corporate manslaughter, and on Tuesday was fined £350,000 plus £44,000 in costs
01:21to be paid over six years.
01:2379-year-old Keith Davis, who was Head of Sport for the 2017 World Paralympic Athletics Championships, admitted a health
01:32and safety charge, and was handed a community order of 175 hours of unpaid work.
01:39The judge noted failings by UK Athletics were not a one-off, but said any financial penalty would weaken its
01:48ability to support individual athletes and athletics in the community.
01:52He told retired PE teacher Davies that he knew, or ought to have known, base plates were an integral part
02:00of the cage construction.
02:02Following an earlier collapse of an identical cage, he was on notice, and the judge said this was an accident
02:09which sooner or later was waiting to happen.
02:13Steps 3 and 4, which I shall take together, given that they involve an element of overlap, I am prepared
02:21to discount that figure by 40%, leaving a sum of £420,000.
02:28From that figure, I propose to allow a figure in the region of 17% discount for the plea, making
02:38an overall sum, by way of a fine, of £350,000.
02:46In addition, UKAA will pay one-half of the cost, which I understand is an agreed figure with the prosecution,
02:55of £44,000.
