06:19Well, quite simply, if my client is to be tried on charges of murder, the prosecution must prove malice aforethought
06:27in each instance.
06:28Or at the very least, the intent to commit grievous bodily harm.
06:32Neither of which can be proven beyond reasonable doubt with the evidence available.

06:38Well, we must come up with a plausible alternative, Your Honour.
06:41Which would be?
06:42Manslaughter.
06:43Now, in the first instance, my client arrived home to find his wife drowning their baby son in the bath.
06:52And obviously, he acted in a moment of passion.
06:57And in the second?
06:58During a course of threatening my client's son, the victim drew a gun, thereby instigating a tussle, which caused the
07:07fatal shot.
07:08In returning to the question of bail, Your Honour, I submit that my client is not a flight risk.
07:15He has deep roots in the community.
07:17And every reason to face the charges to defend the reputation he spent a lifetime building.

11:11I've reviewed the prosecution brief,
11:13and I am compelled to agree with the defence.
11:15There is no evidence to suggest any harm or malice was intended,
11:19and as such, I am directing that the charges in both cases against the accused be reduced to manslaughter.
11:27I also find myself in agreement with the defence in assessing the potential threat to the community posed by the
11:33accused,
11:33in that I don't believe there is one.
11:35And therefore, I am also willing to set bail.
11:40However, a charge of manslaughter is still very serious,
11:44and I feel it would be prudent to ensure that Mr. Hyde is strongly motivated to be present to answer
11:50the charges.
11:51As a result, I am here by setting his bail at $250,000.
