01:20The estate maximum for you is $5,000 and that's what you're suing him for.

06:47Restaurant owner Gene Arganese is suing customer Charles Eldridge for leaving a $5,000 tip, then disputing the charge.
06:55Charles says he was drunk and only meant to tip $50, and anything more was just a simple mistake.
07:02So you didn't have four shots. You're saying you don't really drink, but even a light drinker who's eating, like
07:08you said, with your wings and everything else, I don't know why you're excusing your behavior for two drinks, but
07:15go on.
07:16Yeah, so, Your Honor, it's not that uncommon. People once in a while do give bigger tips.
07:21So even though it was kind of strange that someone's going to give a $5,000 tip.

07:27And part of my bartender, I said to him, I said, what happened that day?
07:31Okay. So now you're going to give me hearsay, and that's not going to work here, but I do think
07:36we have somebody here who might have a little more personal information about their interactions.

07:47Yes, Your Honor. I used to work with him on a farm when we were growing up.
07:50So have you been close friends?
07:53Not really close friends, no. I just used to work with him when we were younger.
07:56And you've been listening to the testimony in here, sir, during this time?

08:00So you're familiar with what's going on?
08:01So were you there with Mr. Eldridge at the bar?

08:05And tell me, how many drinks did you have?
08:07I believe I had two that night, just the two shots.
08:09And what did he have?

08:12And did you see his interaction with the bartender?
08:15Was he friendly? Was he warm? Was he flirty? Was he mean?
08:18No, he just, I wouldn't say he was belligerent or mean, Your Honor.
08:22But, I mean, he wasn't, you know, the best customer to have at the bar either.
08:28What did he do or say?
08:30So in Connecticut, we have this radio show, and one of their bits is that
08:35they named somebody a contestant, and you have to figure out who that contestant is.
08:40It's called the $5,000 fugitive.
08:42They give little clues every single day on the radio station,
08:45and you have to figure out who it is.
08:47It could be anybody in the community.
08:48So how did that play into this interaction?
08:51So Charles had come in that day, and he said, he told me,
08:55and Tasia, the bartender, she said, go ahead, you know, ask me if I'm the $5,000 fugitive.
09:01But she said, some along the lines of, you know, you're not going to pay me,
09:05so it doesn't matter.
09:07And she asked him, she goes, are you the $5,000 fugitive?
09:10He goes, yes, I am.
09:11And again, she reiterated, you know, it doesn't matter.
09:14You're not going to pay me.
09:15And he goes, watch this.
09:15When he gets his bill, he puts, you know, the $5,000 tip on there.
09:19Did you see it, or are you just saying that?
09:20Did you see him right in the tip?
09:22Yes, Your Honor.
09:23But it actually, it didn't go through the first time.
09:25The card didn't go through.
09:26He had to switch money from his Cash App over to his regular card.
09:31Is that true, sir?
09:32Did you have to make a switch over to make a payment?
09:35I don't know which card was I used for the first time,
09:37but Cash App was the only card I had.

10:36when you prosecute DWI cases
10:38is one of the first things that's affected
10:40by your overconsumption of alcohol
10:42are your fine motor skills.

10:47It's one of the reasons why police ask
10:48for your license and registration, right,
10:51when they pull over the car.
10:52Because it requires you to use your fine motor skills
10:54to reach into your wallet
10:56and to pick out and to hand over a license, right?

11:01You give them another card,
11:02then they know that you're likely intoxicated.
11:04So, looking at your receipt,
11:05that's your signature, right?

11:11So, does that make it more likely or less likely,

14:15is to ensure proper service.

14:23for four or five days.
14:24Our bartenders, our wait staff,
14:27they have their drink ready
14:28for them at a certain time.
14:29They have their newspaper.
14:30They have...
14:30They go out of their way
14:32to service these people.
14:33And sometimes people give
14:35a great tip.
14:36Yeah, and I'm just going
14:37to interrupt you
14:38because if you're someplace
14:40for a week
14:41and you've got these staffers
14:43who are really waiting
14:44on you hand and foot,
14:45they're making sure
14:46the drinks are ready,
14:47your table's ready,
14:48your beach chair's ready,
14:49your towels are ready,
14:50and you're not tipping
14:51as you go along,
14:52you know, it's not unusual
14:53to then give the staff
14:55a pretty significant tip
14:56at the end of it.
14:57But on a $23 bill...

15:04that do it, number one.

15:06as a business owner,
15:07all we can do legally, too,
15:09is make sure that
15:10it was signed,
15:11the receipt,

15:16by state law to pay
15:19because that's not our money,
15:20that's in our business account.
15:21We're mandated to pay
15:22that employee no matter what.
15:25And the defendant
15:25never called us to say,

15:28I slept on it,

15:31can we avoid that?

15:34done that.

15:36as to why it is
15:38you didn't call the bar

16:13called the business
16:14before the contract
16:16finalizes within one week.
16:17You know,
16:18once the money's sent out,
16:19it's almost impossible
16:20to get it back.
16:21And when did you first
16:22become aware of the fact
16:23that he was challenging
16:24the charge?
16:25When I got the money
16:26put back in,
16:27when we had a reversal,
16:29it was around the 23rd,
16:31I gave it back.
16:31So later in the month?
