00:05In the criminal justice system, the people are represented by two separate yet equally
00:10important groups.
00:11The police who investigate crime and the district attorneys who prosecute the offenders.
00:15These are their stories.
00:45Okay, girl, your favorite man picked out his favorite song, so let's do this.
01:02Come on, come on, come on, come on, me and you.
01:08What's that?
01:10Just one song.
01:11Five song is usuallyáh.
01:14I usually hear word pro from the room from Salie Rairen.
01:27All right.
01:30Come on, come on, come on, come on.
01:33Okay, baby.
01:39God.
01:58Hey. Hey, sorry. Is it okay if I steal her for a sec? Thank you.
02:06Hey, look. I don't want to make, like, a big deal about this or anything, but I think I'm just
02:10going to head out.
02:11What? Oh, it's early. I know. I know. It's just... Yeah.
02:18No, it's fine. Go. But we'll celebrate again tomorrow. Just me and you.
02:25Okay. I love you.
02:26I love you, too. More than anything.
02:32Okay.
02:36Where is he going?
02:38He, um... He's tired.
02:41He's always tired.
02:43No, Dad, don't start.
02:44He needs to grow up, Angela. Fast. He knew what he was getting married into.
02:55Victim hasn't been dead for that long. I'd say 90 minutes or so.
02:59Dick's name is Angela Cole.
03:03All right. Any witnesses?
03:05There's a guy over there. He saw the body.
03:08Called 911, but didn't see anyone nearby, so...
03:11Okay. Let's get some boots on the ground. Start canvassing for witnesses' video.
03:16Hey, that's a crime scene. Understand?
03:18I need to know whose body that is. Can we help you, sir?
03:21Look, I need to know whose body that is.
03:23I can't reveal any information at this time.
03:25Is it Angela Cole?
03:29It's her, isn't it?
03:31It's Angela. Oh, my God.
03:33She said that. That's my wife.
03:36What?
03:36What?
03:38What?
04:30I can't imagine how hard this must be for you right now, but we do need to ask you some
04:35questions, if that's okay.
04:39How did you know that your wife was here?
04:42I-I-I tracked her on my phone.
04:45And where were you before this, 30 minutes ago?
04:49It was at my apartment.
04:51Before that, we were at a party.
04:53It was Angela's 30th birthday.
04:55But I, uh, I left early.
04:58Why is that?
05:02Angela's family is, um, difficult.
05:07They're very involved and-and controlling, and I-I couldn't take anymore, so I told Angie that I needed to
05:14leave.
05:15Did she get upset?
05:16No.
05:17No, no, no.
05:17She-she totally gets it.
05:18She knew how frustrating it would be.
05:20So you went home?
05:22What time did you get there?
05:24Oh, I don't know.
05:2511.30, 11.45.
05:26I-I tried to go to bed, but I was so wound up, so I-I called Angie, and she
05:31didn't pick up, which made me nervous.
05:34So then I-I pulled up the location on my phone.
05:37So other than all this, uh, family drama, did anything unusual happen at the party?
05:41Any arguments, fights?
05:44No.
05:46Angela was really happy.
05:53Okay.
06:02Talked to the M.E., which will cause the death is hypoxia due to manual strangulation.
06:07Lots of facial fracturing, too.
06:09Cheek bone, hyoid bone.
06:11Anything else?
06:12There's third-party DNA on the victim.
06:13Saliva.
06:14Lots of it, too.
06:15Seven different samples.
06:16Mm-hmm.
06:17She was at a party.
06:18Lots of kissing.
06:20Any hits on CODIS?
06:21Negative.
06:23Okay, what about the family drama?
06:25We think that's connected?
06:27I don't know, but there's a lot of tea.
06:29Please share.
06:31Okay, so the father, Evan Cole, has millions of followers, and he's super weird, like, obsessive,
06:36constantly posting really intimate photos of him and his family.
06:39It's sort of sweet, but mostly gross.
06:42Okay.
06:42So, a week ago, things got really heated.
06:45Angela tweeted that she was done with social media, TV, etc., that she wanted to live a simple
06:49life away from cameras.
06:50But her father flipped out and said that she had lost her way and needed psychological
06:54help.
06:55Is any of this real?
06:56Or did they just put it out there to get a bigger audience?
06:59Who knows?
07:00I got something.
07:02All right.
07:02Okay.
07:03After leaving the party, Angela gets into an argument with her parents, Evan and Sophia
07:08Cole.
07:09And the parents leave together.
07:11But, a minute later, Evan Cole reverses direction and walks after her.
07:17And what time is that?
07:1812.22.
07:2013 minutes before the 911 call.
07:22Maybe the drama is real.
07:23Go talk to the parents.
07:27I'm confused.
07:28Why are you showing me this?
07:30Well, this is 13 minutes prior to when your daughter was killed, so we're just trying to
07:33figure out what happened.
07:34You're not suggesting I had anything to do with her.
07:35No, no, we're not suggesting anything.
07:37We're just trying to figure out what happened.
07:39Well, Angela was upset with me, apparently.
07:44Her husband was, too.
07:45So she stormed off at the end of the night.
07:48So I went after her.
07:50Did you catch up to her?
07:52End up talking to her?
07:53Yeah.
07:54I told her I loved her very much.
07:58And that I wanted to fix things.
08:01And then we hugged.
08:10And then I walked away.
08:11And I flagged down a cab.
08:14When you say, uh, fix things.
08:17We've just had some, some family issues.
08:22Her husband is brainwashing her.
08:25Okay.
08:25Trying to convince her that we are bad people.
08:28He hates the media business.
08:30He does.
08:31And he hates us.
08:35I'm sorry.
08:39The truth is, I should never have let my daughter walk home alone.
08:45I know this is hard.
08:46And I apologize for even having to ask.
08:50But do you happen to have a receipt on that cab ride?
08:54Sure.
08:55Yeah.
08:55One last question, if you don't mind.
08:57Can you think of anyone who may have wanted to hurt Angela?
09:00Oh, yeah.
09:04Keshe White.
09:06The singer?
09:07He went to see her yesterday to wish her a happy birthday.
09:12And it did not go so well.
09:17So what happened there?
09:19I, I cut it on some glass.
09:22Any chance you cut it putting your hand through a window?
09:25A window ten inches from Angela Cole's face?
09:27Look, man, I admit it.
09:29I acted like a total idiot yesterday.
09:31I wanted to wish Angela a happy birthday.
09:33It was her 30th.
09:34That's a big deal.
09:34So I went down to her art studio and she...
09:37And what?
09:38She wasn't really happy to see me.
09:40You mean she kicked you out?
09:42More or less.
09:43Yeah, and that pissed you off.
09:44Yeah, I wanted to patch things up, you know, talk it out.
09:47But she wasn't into it.
09:50So you put your hand through the window next to her head?
09:52That is correct.
09:54It just happened.
09:55But I would never hurt Angela.
09:57It's kind of a stupid thing to say, don't you think?
09:59What's that mean?
10:00Well, we know about your arrest for assault.
10:03Saw the photos, too.
10:04So I think it's pretty stupid for you to say that you would never hurt Angela
10:07when we know that you already did.
10:09I was in a really dark place back then.
10:12I was drinking a lot and doing drugs.
10:14What were you doing on 15th Street last night?
10:18I was going to stop by Angela's party real quick to apologize.
10:22I didn't end up going.
10:24I sent her a text instead.
10:26Here.
10:29Sorry about today.
10:31I hope you have a great birthday.
10:32I'll always love you no matter what.
10:34Great.
10:35You'll always love her.
10:36What were you last night after 12, 14 a.m.?
10:39Grabbed an Uber and headed home at, uh...
10:4312, 19 a.m.?
10:49Uber receipt looks legit, which means our guy was in a car heading south 16 minutes before
10:54the 9-1-1 call.
10:55So if he hit her at, say, 12, 15, then she would be lying on the pavement for, like, 20
11:00minutes
11:00before someone called 9-1-1?
11:02Not likely.
11:03Found this near the crime scene.
11:04What are we looking at?
11:06Some dude who just so happens to be hanging out near the party venue.
11:08He's there for, like, 20 minutes.
11:10Okay, that's Evan Cole walking after Angela.
11:13But this guy watches, then walks in the same direction toward Angela at 12, 27.
11:18So, eight minutes before the 9-1-1 call.
11:21Does it ever show his face?
11:23He does not.
11:24What about the jacket?
11:25Looks like there's writing on the back.
11:31Thank you for joining us today.
11:33The reason we're here is a woman was killed last night.
11:36We saw a guy wearing a coat that had your company's name inscribed on it.
11:40So if somebody here was down on 15th Street last night around 12, 30 a.m., please raise your
11:45hand. We'd love to talk to you.
11:48Nobody?
11:50Okay, nobody was there. Good to know.
11:51So I suppose none of you would object if we collected your DNA.
11:54What do you mean?
11:55Well, we're trying to eliminate as many suspects as possible, and since none of you guys were
11:59in the vicinity at the time of the murder, you got nothing to worry about.
12:02Now, just to be clear, this is voluntary, so you were under no legal obligation to do this.
12:07And if your DNA doesn't match, which we expect it won't, then we'll destroy it.
12:12So who's with us, guys? Who's going to help us solve this thing?
12:14Okay. Hands.
12:20All right. Great. Okay, so for the one, two, three, four, five of you who did not raise
12:28our hand, we need to get your names, which is standard procedure, and then you'll be free
12:31to go.
12:33No matches.
12:34Makes sense. Who would volunteer their DNA if they were guilty?
12:37Which gets us to the five employees who refused.
12:40Guys, I got something.
12:42I found video of one of the holdouts leaving his apartment at 1045 the night of the murder.
12:48And he's wearing the same pants and boots as the guy we saw hanging around the murder scene.
12:52Let's get a warrant for his apartment and his DNA.
12:55Yep.
12:58NYPD, open up.
13:01Alan Ross, this is a warrant to search your apartment and to procure your DNA.
13:06You don't have a choice this time, Al. Excuse me.
13:09I'd like to show this warrant to it.
13:11You can show that to whoever you want, but that is a valid warrant, which means they're
13:13going to search your apartment and I'm going to collect your genetic material, so open up.
13:17I'm not comfortable sharing my DNA with the world.
13:19Don't care.
13:19Open.
13:29Jimmy.
13:31Mmm.
13:42Jimmy.
13:50Jimmy.
13:50Let's pack this up, Jimmy.
13:52Hey, Walker.
13:55You got anything?
13:58Sure do.
14:03What the hell?
14:12I think we're in the right place.
14:25Gotta be honest with you, Alan, the facts don't look good.
14:34We have video of you leaving your apartment at 10.45 PM
14:37and walking south in the direction of the restaurant
14:40where Angela Cole's birthday party was happening.
14:43We have video of you lurking outside the venue
14:47for 20 minutes or so, and then going off and following Angela.
14:51And we can see your face clear as day.
14:56There's no question it's you.
14:59The only thing stopping us from arresting you is the DNA test,
15:03and we both know it's going to match the DNA on Angela's body.
15:08And when that happens, it's game over.
15:10So now is the time to talk to me.
15:14Now is the time to tell me your side of the story.
15:20I want a lawyer.
15:23Okay.
15:27You're gonna need a good one.
15:29Actually, you're gonna need a magician,
15:31someone who can make evidence disappear.
15:33I just wanted to say hi.
15:38Tell her that I admired her, but she was rude.
15:41She...
15:43She called me a loser, and I just...
15:49I went nuts.
15:54Alan Ross, the defendant, was arraigned and remanded.
15:57Evidence?
15:58Strong, he confessed.
16:00What?
16:01He told Brady he just wanted to tell Angela how much he admired her.
16:04She didn't reciprocate his admiration.
16:06So he got upset and went nuts, direct quote.
16:10And the defense still wants to take this to trial?
16:12Sounds like a waste of time.
16:13Yeah.
16:14Maybe not.
16:15They're filing a motion to suppress the confession and the DNA.
16:24Detective Brady's quip about Mr. Ross needing a magician is in effect
16:28a backdoor interrogation technique and should be suppressed.
16:30Or perhaps it was just a quip.
16:33Also, when Detective Brady uttered said quip, she was exiting the room,
16:37which proves that she wasn't expecting or even hoping for a response.
16:40In Rhode Island v. Inez, the Supreme Court ruled that an interrogation includes any
16:44words or actions police should know are reasonably likely to elicit an incriminating response,
16:49such as using humor to mock a suspect's potential guilt.
16:53She simply said that Mr. Ross needed a magician.
16:56Which implies that the evidence was compelling enough that he'd be better off confessing.
17:02The confession is out.
17:04I also moved to suppress the evidence resulting from the detective's improper DNA dragnet.
17:09Uh, your honor, the police made it emphatically clear that this was a request, not a demand.
17:13Moreover, Mr. Ross rejected this request. Police procured his DNA pursuance to a lawfully obtained
17:19warrant.
17:19With evidence procured as a result of Mr. Ross's refusal to volunteer his DNA.
17:24There were four other innocent men who also refused to volunteer their DNA.
17:28And guess what? They're not complaining. Why?
17:30Because they did nothing wrong.
17:33Constitution is designed to ensure innocent men don't go to prison,
17:36not to ensure guilty men go free.
17:39I agree. The DNA is in.
17:43So this monster confessed, but...
17:45The judge ruled that it is inadmissible.
17:48Because he'd already asked for a lawyer?
17:49Correct.
17:50But the case is still strong, even without the confession.
17:53Yes, we're in a good position.
17:55Do we know why this lunatic did it?
17:57He was obsessed.
17:58He had 30 framed photos of Angela in his apartment.
18:03He followed her every move on social media, and, uh...
18:08Well...
18:08There it is.
18:10That's what we've been trying to tell you.
18:12Sharing your life with the public is dangerous.
18:14Please, now is not the time to discuss this.
18:17Oh, yeah, you're right.
18:17We probably should have had this discussion before Angela was killed.
18:20Who the hell do you think you are?
18:22Oh, Evan, Evan, please.
18:23You're the one that left the party.
18:24No, you're the one who posted that stupid video of YouTube dancing.
18:27You told that maniac where she was.
18:28This is on you.
18:29Please go.
18:30Please.
18:35I'm sorry.
18:38I'm sorry.
18:38But before all the drama, you were saying it's a very strong case.
18:43Then why is he going to trial?
18:44What can he possibly say that will make him look innocent?
18:52You're Honor, we believe there is substantial evidence suggesting that someone other than
18:56Alan Ross killed Angela Cole, and that someone else was Cash White.
19:00Uh, he had the evidence says otherwise.
19:02Not necessarily.
19:03I need more than that, Miss Potter.
19:04What proof do you have this man committed the murder?
19:07He got into a heated argument with the victim on the morning of the murder.
19:11And in a field of rage, he punched his piece through a window, inches from her head.
19:15But do you have any evidence connecting him to the actual crime?
19:18We have video evidence putting him near the crime scene around the time of the murder.
19:22Uh, except that Mr. White was in an Uber 1219 that morning, five blocks from the crime scene.
19:28The 911 call came in at 1235 AM.
19:31Which proves my point.
19:32He was near the crime scene around the time of the murder.
19:34He was in a car.
19:36You don't know when the crime was actually committed.
19:38Your Honor, the facts are the facts.
19:40Moreover, Mr. White was arrested two years ago for assaulting the victim.
19:44The police report states that he repeatedly punched and slapped Miss Cole following a verbal
19:51argument involving his infant daughter.
19:53Mr. White's horrific behavior that evening might be a convenient defense,
19:57but it hardly meets the evidentiary threshold required under New York law.
20:01There is no clear link between Mr. White and this murder.
20:04Not to mention, we all know Cash didn't kill Angela because the defendant himself confessed to killing her.
20:10And that has been ruled inadmissible.
20:12It doesn't mean it's not relevant.
20:14How's that?
20:18Everyone in this room knows Alan Ross confessed and Cash didn't commit this murder.
20:24So why should the defense be allowed to accuse a third party of a crime the defendant himself has
20:28already confessed to?
20:29Because, as Miss Potter said, I've already ruled that confession inadmissible.
20:34But that's not fair to Mr. White or the jury.
20:37You are basically giving them a choice of killers, even though we know only one of them committed the crime.
20:43We don't know a damn thing, other than that the police elicited a false confession,
20:49that Mr. White has a history of abuse, and that he was near the scene at the time the murder
20:54took place.
20:55Uber or no Uber, you may proceed with your defense.
21:14Hines is letting the defense present an alternative suspect.
21:17There is just enough ambiguous evidence that it is possible Cash could have committed the crime,
21:23even though we know with a high degree of confidence he did not. Alan Ross confessed.
21:29So it's a two-horse race?
21:31One of those horses is a known abuser.
21:34Good news is we can pretty much prove that he didn't kill her.
21:36Bad news is he is just horrible enough, the jury might not care.
21:40Well, do what you can do, and whenever possible humanize this Cash White.
21:44Not sure it's possible.
21:45I get it, but we can't let the defense turn this into a referendum on domestic abuse,
21:49which means you need to make clear that the real killer, Alan Ross,
21:52is the only person on earth who could have committed this murder.
21:58Can you please tell the jury what you found when you searched the defendant's apartment?
22:03We recovered clothes to match the clothing the man spotted near the crime scene
22:06at the time of the murder was wearing.
22:09What else did you find?
22:1130-frame photos of Angela Cole in a closet.
22:14It was like a creepy shrine in her honor.
22:17Objection.
22:18Sustained. Just answer the questions, detective.
22:21Can you please read the highlighted portion of the forensic DNA report?
22:26The DNA sample provided by Alan Ross is consistent with the DNA profile found on the victim.
22:32Can you please tell the jury what this means in layman's terms?
22:36But Alan Ross's DNA was found on Angela Cole's body.
22:40The odds of that DNA belonging to someone else is pretty much zero.
22:48There is nothing illegal about building a shrine.
22:52Correct.
22:53And the fact that a man's DNA is present on a dead woman's body doesn't mean that person killed her.
22:59Because there are lots of ways DNA can end up on someone's body.
23:03Like if someone sneezes in the proximity of the other person or kisses her.
23:08Correct.
23:08So the fact that Mr. Ross's DNA is on Angela Cole doesn't mean a damn thing.
23:14In fact, there were six other different DNA samples found on her person as well.
23:19Yeah, but those samples belonged to family members and friends.
23:22People who were at the birthday party.
23:24But the fact remains, there were six other DNA samples found on her body.
23:30Correct.
23:33Nothing further.
23:35Mr. Price?
23:38People rest.
23:39Ms. Potter?
23:41Defense calls Evan Cole, the victim's father.
23:46Uh, Your Honor, um, Mr. Cole is not on the witness list.
23:51People request that we adjourn for the day so that we can't prepare.
23:56Sounds good to me.
23:57We are adjourned.
24:00I probably should have given you the heads up.
24:03But, uh, it would have been nice.
24:05So, uh, why are you doing this?
24:08Testifying.
24:09Testifying for the defense.
24:11I'm not taking sides.
24:12Uh, you are.
24:14And you picked Alan Ross's and, and we're just trying to understand why.
24:23Like I said before, the evidence is, is, is compelling.
24:27He was stalking Andrew.
24:28Cash was right there too.
24:29And he's a very violent man.
24:31I've seen it with my own eyes.
24:32That doesn't mean that he...
24:33And he's still madly in love with Angela.
24:35Talk about stalking.
24:36Every birthday, every holiday, he would reach out to let her know how sorry he was.
24:44What is really going on here?
24:50Excuse me.
24:51Why are you trying to help the man who killed your daughter?
24:55I'm just doing what I believe is right.
24:58No, you're ignoring the facts.
24:59Like I told you, we are...
25:02I believe what I believe.
25:04And there's not a damn thing you can say that's going to change my mind.
25:18Mr. Cole, can you please tell us what happened to your daughter Angela on December 26, 2024?
25:25Cash White beat the hell out of her.
25:27That's what happened.
25:28How do you know?
25:28Because she called me, screaming.
25:31So I rushed over to her apartment and she was...
25:37Her face was swollen and bleeding.
25:42Are you referring to this incident in which Mr. White was arrested for assault in the second degree?
25:48Yes, ma'am.
25:49Your Honor, I'd like to present the photos associated with this report, exhibit H, I, and J.
25:56Is this what Angela looked like when you got to her apartment?
26:03Yes, but even worse.
26:14After they split, did Angela express some concern about Mr. White?
26:20Yes.
26:21Was she still fearful of him?
26:23Very much so, yes.
26:25Did you have occasion to talk to your daughter on her 30th birthday around 11 a.m.?
26:30Yes, I did.
26:31Can you describe the conversation?
26:33I called to wish her happy birthday, and while we were speaking, Cash White showed up.
26:41I heard Angela say she was on the phone, and then Cash started yelling, very loudly yelling.
26:48And then I heard the sound of glass shattering.
26:52What did you do?
26:53I ran over to her art studio to see if she was okay, but she was terrified.
27:00She was shaking, and there was broken glass everywhere.
27:04Cash had put his fist through a window, inches from where Angie was standing.
27:10I tried to comfort her, but she was a mess, as you might imagine.
27:17She begged me not to call the cops or tell her husband.
27:23Why was that?
27:25Because she didn't want to ruin her 30th birthday.
27:28Did she say anything else?
27:30She did.
27:31She did.
27:31She said, Daddy, I think Cash might kill me one day.
27:44Nothing further.
27:49Despite your belief that Cash White is a cruel and violent man, you and your wife sat front row at
27:56his
27:56concert two months prior to the murder?
27:58He invited us, and we went.
28:00And you posted this message to your social media account from the concert, People's Exhibit 13.
28:07Forgiveness is much harder than hatred and more rewarding, too.
28:12I did, and I believed that.
28:15So you forgave Cash White?
28:18You believed that he had changed, that he was a good person?
28:20I was hoping he might change, but obviously I was wrong.
28:26You and your wife spent a lot of time on social media.
28:28You have approximately 13 million followers.
28:31Yes.
28:32On the night that Angela was killed, you posted video of the two of you dancing at her 30th birthday
28:39party?
28:39I did.
28:40I just wanted to share some of the joy and happiness that we were feeling with my followers.
28:48And you included the name of the restaurant where the party was being held.
28:53I don't remember.
28:55People's Exhibit 14.
28:57Here we are at Lila's Cafe, celebrating the 30th birthday party of the greatest daughter on earth.
29:05This post is the reason the defendant knew where Angela was that evening.
29:12This is the real reason that you were here testifying for the defense.
29:17I'm sorry.
29:18I don't know what you mean.
29:19If the defendant killed Angela, the murder is your fault.
29:25If Cash White did, it's not.
29:28That is outrageous.
29:29But it's true.
29:29You are testifying for the defense to mitigate your own guilt.
29:33That's not what I'm saying.
29:34He's putting words in my mouth.
29:35Objection.
29:36Sustained.
29:40Nothing further.
29:47That phony bastard.
29:48How dare he suggest that I killed Angela?
29:51Well, there's nothing we can do about that.
29:52You just need to focus on your testimony and make sure that you are ready.
29:56The defense lawyer is obviously going to bring up the prior arrest.
30:00The fact that you punched a window.
30:02She can go to hell.
30:03Well, see, that's the exact reaction she's hoping for.
30:06So if you can please just try to stay composed.
30:09And try not to sugarcoat the past because the jury will see right through that.
30:13If they think you're lying about the past, they will think you're lying about the present.
30:17I'm not testifying.
30:19What?
30:21My lawyer wants me to take the fifth.
30:23Your lawyer?
30:24No, no.
30:25No.
30:25Um, the jury will assume that you are hiding something.
30:30That you actually did kill Angela.
30:31I don't care.
30:32I'm going on tour soon.
30:34It's, it's 24 countries.
30:35Look, uh, taking the fifth will not change the past.
30:39I'm done talking.
30:41So if you don't mind.
30:42Look, Mr. White, please, you need to think this through.
30:45Yeah, I thought it through.
30:46Now, please, get the hell out.
31:01We need to talk.
31:03I told you I'm taking the fifth.
31:05You're granting Mr. White immunity from any and all crimes that may result from today's testimony.
31:11What's that mean?
31:12It means taking the fifth is no longer an option.
31:15I told you I'm not testifying.
31:17I don't give a damn what you want.
31:20Just get on the stand and tell the truth.
31:22You understand me?
31:27You physically attacked Angela Cole on December 26, 2024, correct?
31:32We got into a heated argument and, yes, I assaulted her.
31:39Punched her repeatedly.
31:42It was two years ago.
31:43She needed stitches to stop the bleeding, correct?
31:47I don't recall that.
31:48She had a fractured orbital bone.
31:50Like I said, it was a while ago.
31:53Okay.
31:55Let's talk about something more recent.
31:58On the day of the murder, you visited Angela at her studio and asked her to have lunch with you.
32:04Yes.
32:04And when she said no, you got upset and you put your hand through a window.
32:12Yes.
32:13Defense exhibit K.
32:15This took place on the morning of Angela's birthday and eight hours before her birthday party.
32:26That is you, correct?
32:29Yes.
32:30It's not exactly my finest moment.
32:33Certainly not your worst either.
32:36Defense exhibit L.
32:38Mr. White.
32:39That is you.
32:40On 15th Street, a few blocks away from Lila's Cafe, the location of Angela's 30th birthday party,
32:47at 12.15 a.m. on the night of the murder.
32:50Yes, I went there to apologize.
32:52But I realized I was being selfish, that I might cause a fuss.
32:56So I went home instead.
32:59You went home.
33:02You didn't linger, you didn't follow her.
33:04No.
33:05You didn't confront her.
33:06No.
33:07Why the rage, Mr. White?
33:08Because you're accusing me of killing someone I loved.
33:10You love her, and yet you beat the hell out of her two years ago.
33:13I was different back then.
33:15I was drinking and doing drugs, but she...
33:20But what?
33:24She wasn't perfect either.
33:26Are you suggesting it was her fault that you beat the hell out of her?
33:30That's not what I mean.
33:32Look, I wish I could take it all back, obviously.
33:35But I can't.
33:36I...
33:37I still get angry.
33:38It...
33:40It just happens sometimes.
33:41It just happens.
33:43Like when you beat Angela the day after Christmas two years ago.
33:46Yeah.
33:47And when you punched that window on the day of the murder.
33:49Yes.
33:50And when you took the life out of her on her 30th birthday.
33:53Objection.
33:54Sustained.
33:57Nothing further.
34:08Hey.
34:10Hey.
34:11The jury isn't buying into this whole Cash White nonsense, right?
34:15I mean, I despise a man, but he didn't kill her.
34:17We are doing our best to make that clear, Lucas.
34:20And I think the jury knows that too.
34:23Okay.
34:29Really believe that?
34:31At best, the jury hates him as a human being.
34:35At worst, they actually think he did it.
34:39Which means we need to rehabilitate him.
34:43How?
34:44I don't know.
34:47But even a horrible human being like Cash does something decent once in a while.
34:55Wouldn't bet on it.
34:57We have nothing to lose.
35:04Cash is just as selfish and horrible as we'd imagined.
35:08No public service.
35:09Doesn't help out his mother.
35:11And give to charity?
35:11Next to nothing.
35:13On a gross income of 12 million.
35:15That was a total waste of time.
35:17Well, not exactly.
35:19Cash told me what really happened the day he was arrested for assault.
35:22What really happened?
35:23Angela was supposed to be babysitting his infant daughter, but went on a coke bender instead.
35:30Cash got home, found the baby alone, crying, covered in feces.
35:35Why didn't he tell you this before?
35:37Because he didn't want to tarnish her legacy.
35:39He felt he owed it to her, given how badly he treated her.
35:42How do you know he's not just making this up?
35:44He has lots of evidence, surveillance video inside and outside the house.
35:48This is why Angela asked the DA's office to drop the charges.
35:51At a minimum, it'll provide some context for his violent outburst.
35:55Yeah.
35:56If we introduce it.
35:58If?
35:59I don't know, Nick.
36:00The idea of blaming Angela for her own assault feels disgusting.
36:07Not to mention her legacy.
36:09Like, her husband doesn't need to know all of this.
36:10Not at this point.
36:11It doesn't feel right.
36:12Of course it doesn't, but that's not the point.
36:14As distasteful as this might sound, there is a distinction, if not a difference,
36:18between a man flipping out after someone endangers his baby
36:21and a man flipping out over something insignificant.
36:23It's like the difference between murder and manslaughter.
36:26They're both horrible crimes, but one is clearly worse than the other.
36:29I get it, intellectually, but the idea of trying to parse domestic violence makes me uncomfortable.
36:37You know what makes me uncomfortable, Sam?
36:39The defendant walking free and killing another woman.
36:42Or staring down her husband, Lucas Peters, and telling him we should have done better.
36:47Alan Ross needs to spend the rest of his life in prison.
36:50And if the cost of doing that makes us uncomfortable, so be it.
37:05Hey.
37:08Uh, look, I know, uh, Nick thinks it's a good idea, but, uh...
37:12Well, if it helps our case.
37:15But does it?
37:17We've already established that Cash didn't commit the murder.
37:20Even better, we've established that he couldn't have committed the murder.
37:23That should be enough.
37:25You know, Cash is a hell of a target.
37:27He's easy to hate.
37:30Easy to blame.
37:32Yeah, but trying to somehow rationalize this horrific behavior,
37:37well, it could backfire.
37:39Alienate the jury even more.
37:40Yeah, it's possible, but, um...
37:42It is never okay to beat the hell out of your girlfriend.
37:49Full stop.
37:59Where were you on the night of the murder at 1219 AM?
38:04In an Uber.
38:06People's Exhibit 15.
38:08Pickup time, 1219 AM.
38:10Pickup location, 632 15th Street.
38:14Destination, 77 Greenwich Street.
38:16Is this information accurate?
38:17Yes.
38:26A few years back, you were arrested for assault, correct?
38:33Yes.
38:34And you have expressed deep regret over this incident, correct?
38:39Yes.
38:40You wish it never even happened?
38:44Yes, but it did, and I've got to live with that.
38:48I imagine that would be difficult.
38:51It is.
38:53A man should never do something like that.
38:57No matter what the circumstances.
39:04Right.
39:06No matter what the circumstances.
39:20Yeah, and, uh...
39:25Despite all this, you continue to love Angela Cole.
39:38Yes, very much.
39:48Nothing further.
40:05I heard about the mistrial.
40:09Judge pushed them to reach a verdict.
40:11You pulled up short on this one, Nolan.
40:16Letting the jury know what really happened that day might have made a difference.
40:21You don't get paid to do the comfortable thing.
40:25Or the noble thing.
40:27You get paid to win.
40:28It's the right for you to be here.
40:30Yeah, it.
40:43Oh, I hope my god is here.
40:44Oh, my God.
40:47No.
40:48Oh, my God, my God.
40:51Oh, my God.
40:54Oh, my God.
