00:42It depends on the justice members if they will consider this in their determination of probable cause.
00:49But in as far as our proceeding is concerned, for us look,
00:54we will just proceed with our hearing and conclude it in the determination of probable cause.
01:01Bukod po sa pagharap ng NBI, ano po po yung mga asahan ng taong bayan sa huling bahagi po ng

01:08We need to resolve the issue on whether or not to open the BIR box, no?
01:14Kasi it was laid on the table during the last hearing.
01:17And then we will be hearing also from the justice members if indeed we are decided to vote already.
01:23Because we are not sure yet whether the majority of the justice members are ready to vote, no?
01:29So, kung wala naman silang ibang inclination, then we should be able to vote tomorrow after the clarificatory hearing.
01:37Gaano po kayo kaingat sa pagdeal dito sa issue ng box mula po sa BIR?
01:43Dahil pwede ho bang questionin ito at maging technical laban sa inyo at iparating sa Korte Suprema kung sa kasakali?
01:50Kami, Rafi, we've been very, very careful.
01:53We've been very, very conservative.
01:54That is why we are maintaining the position na lahat ng ginawa ng Justice Committee is constitutional, no?
02:02As a matter of fact, it is very clear na ang position namin about inquiring into bank records is legal.
02:12Which means that the Justice Committee can actually subpina the bank records and the bank officials.
02:19Because it is very clear under the bank security law na exception ang impeachment case.
02:26However, it's because we are very conservative, we are taking the safer route, we opted to subpina the AMLAC instead.
02:36Instead of the bank, no?
02:38But nonetheless, in spite of the caution that we have exercised,
02:44Attorney Mascarpio still filed this criminal case against us.
02:49Pero we acknowledge naman that this is part of the options of the defense team.
02:54Just like the petitions which are already pending before the Supreme Court.
02:58Sa amin lang, Rafi, for as long as walang TRO, walang injunction,
03:04we are very much conscious that this is a constitutional duty that we have to conclude.
03:09So, tuloy-tuloy lang ang proseso dito sa Justice Committee.
03:13Gano'n po ba kahalaga sa inyo na mabuksan pa yung box mula sa BIR?
03:17Well, actually, that, that, kasi sinagpina namin is ITRE.
03:23That is supposed to disclose the personal income of the spouses, no?
03:28So, one possibility, it can justify the 88 million.
03:34Dalawang bagay, pwede it will help the defense team or it will help the complainant's case, no?
03:42Kaya lang, until now, we cannot help because we haven't seen the contents of that box.
03:48But nonetheless, gusto ko lang i-highlight that the threshold in our proceeding is very minimal.
03:55That is only probable cause.
03:58So, I don't know if opening the BIR box is an issue which will hamper the Justice Member's determination of
04:07probable cause.
04:08Again, this is very minimal. Probable cause is very minimal.
04:11Plus, considering that the defense did not present any evidence.
04:17So, it appears that the complainant's evidence are all unrebutted, no?
04:21So, it depends on the Justice Members if they will still consider this the contents.
04:27If they're still interested to see the contents at least for the purpose of being able to vote in the
04:35determination of probable cause.
04:37Tama naman po, ano bukas na yung huling pagdinig ng inyong komite?
04:40At bukas na rin po ba pagbabotohan yung probable cause ng impeachment complaints?
04:45Rafi, I haven't seen the majority of the Justice Members, no?
04:51Kasi, dito ko lang naman nakikita yung majority kapag ka nag-i-hearing, eh.
04:55So, this should be my answer to you.
04:57Kung wala na silang ibang inclinations, kung wala na silang ibang concerns,
05:02at natapos ng clarificatory hearing on the allegations of that,
05:06then the Justice Members should be ready to vote on the existence or non-existence of probable cause.
05:12At kung sakali sa, kailan po kaya matatala kayo ito sa plenaryo?
05:16Um, in case we will be able to vote tomorrow, no?
05:23To request another hearing date on May 4,
05:27that is intended for the approval of the committee report.
05:32And then, upon its approval on May 4,
05:35we will immediately transmit it to the plenary on the same date, no?
05:39And then, we anticipate that the plenary will be transmitting all the documents to the House members,
05:46including the complainant and the respondent vice president.
05:50That is in preparation for the plenary vote,
05:54which should happen after giving all these parties sufficient time to study
05:59the, if ever it is in favor of probable cause,
06:03the articles of impeachment, including the attached evidence.
06:07Bagamat hindi po umattend ang bisis sa inyong pagdinig,
06:11inaasahan nyo po bang dadalo pa siya?
06:13At kung hindi man siya dadalo,
06:14e po pwede kayang maging basihan din ng inyong mga members,
06:18yung mga naging pahayag nila outside of the hearing?
06:21Well, we have been extending a continuing opportunity
06:25to the vice president to present her evidence, no?
06:29Kasi gusto rin naman talaga namin makita yung ebidensya niya.
06:33So, the members will be guided in their voting,
06:37in the determination of the existence of probable cause, no?
06:40Sabi ko nga, dito sa Justice Committee,
06:43there are two possibilities.
06:44Pwede rin ma-dismiss,
06:46at pwede rin ma-determine ang probable cause, di ba?
06:49But, I don't know how we can consider the dismissal
06:54if the evidence of the complainants appears to be unrebutted.
07:00Unrebutted because the defense is not presenting their evidence, no?
07:05So, kung darating sila, we will be welcoming them
07:07and we will be interested to hear the evidence
07:11and to see the evidence of the vice president.
