00:05at Batangas 2nd District Representative Jerville Luistro.
00:09Magandang umaga at welcome po sa Balitang Halimang.
00:12Good morning Connie and thank you for having me here again in Balitang Halim.
00:42And that is why nagpasya kami to defer that is the meaning of to lay on the table
00:48the question of whether to open or not.
00:51But definitely Connie, pagdating ng April 29,
00:54because we are anticipating to vote already on April 29,
00:58we need to resolve that issue first before we finally vote on the determination of probable cause.
01:10Sabi ko nga, so near yet so far.
01:16It is because we defer to the BIR Commissioner.
01:21We respect their position.
01:23And also, since day one of our impeachment proceedings,
01:28talaga we've been very conservative, we've been very careful,
01:32we've been very cautious dahil ayaw ng Justice Committee
01:36na maging subject matter ito ng panibago na naman ang petition before the Supreme Court.
01:42I see.
02:02is qualified in the sense na it should happen during a legislative inquiry.
02:12The proceeding that we are having is definitely not a legislative inquiry.
02:17It is an impeachment proceeding.
02:20As a matter of fact, the proceeding has its own set of rules,
02:24separate and different from the rules governing legislative inquiry.
02:30And it is on that sense that some of the members of the Justice Committee
02:34are of the position na huwag buksa.
02:38In addition to that, itong manifestation ni Kong Zia Jong,
02:44anong sabi niya?
02:45E bakit doon sa bank si Crisilo,
02:48in-express nila, except impeachment cases?
02:51E bakit naman itong NIRC, or the National Internal Revenue Code,
02:56they did not express na exception ang impeachment cases.
03:02He was explaining the fact it was not included.
03:05It means that that was not the intention of the author of the law.
03:19that the impeachment proceeding is definitely greater than
03:22any kind of proceeding in the HREP.
03:25So if a legislative inquiry, if a legislative inquiry's executive session
03:32is an exception to the confidentiality of the tax records,
03:36the more reason that the impeachment proceeding should be considered
03:40as an exception.
03:42That's the argument of Congresswoman Delilah.
03:45So definitely divided na divided Justice Committee on their position.
03:51And that is why the decision differ, lay on the table,
03:55and perhaps sa 29, we will be able to resolve that.
03:58Okay, just in case sa 29 ho, hindi pa rin magkaroon ng resolution
04:01kung bubuksan itong tax records,
04:07sa impeachment proceedings?
04:10Go ahead, ma'am.
04:12The documents we subpoenaed, Connie, are income tax returns.
04:15So dito natin makikita yung mga income generated from private sources.
04:21Unlike the SAL-N, it includes both the income from the government
04:27and the private sources.
04:29Ito, very particular, ITR, ang naka-come from private personal income, no?
04:36So there's a possibility na maja-justify ng ITR itong 88 na net worth.
04:42But there is a possibility also na baka lalong lumaki ang disparity
04:49as has been established already in yesterday's hearing, no?
04:52So, no one can tell kung anong laman ang kahon.
04:57Sabi ko nga, so near, yet so far.
05:06We only know that it contains ITR, but as to what are indicated in the ITR,
05:11we're totally clueless, no?
05:13So, ang medyo problema lang dyan,
05:17kung narinig mo ka, when I ask Commissioner Mendoza,
05:21kung hindi allowed ang Justice Committee,
05:24on the assumption lang na may probable cause
05:27and it will be supported by the Plenary
05:30and we will be able to transmit to the Senate,
05:33will the Senators be allowed to open the box?
05:36And I think the question yielded a negative answer.
05:40And that is because talagang may gray area ang NIRC
05:45as far as confidentiality is concerned.
05:47So, this is one particular law na kailangan talagang ma-amiendahan
05:52para maging maliwanag itong cases of accountability.
05:56Paano naman ito?
05:58This is an impeachment proceeding.
06:00So, I have no definite position yet, Connie.
06:03Very much divided and valid, both positions of the Justice Members.
06:24lumabas na yung decision denying the appeal,
06:28consequently affirming the 73 million notice of this allowance.
06:33Lumabis na rin yung tatlong additional notices of this allowance pa
06:37that corresponds to the 1st, 2nd, and 3rd quarter of 2023 OVP Confidential Fund.
06:44Pagdating naman dito sa unexplained list,
06:47oh my God, 6.77 billion transaction was reported to the AMLC, no?
06:55But the net worth or even the item for cash and the Pagdeposit,
07:03either meager, walang declaration,
07:07or the amount has a very big disparity.
07:11The net worth is 88 million in salen.
07:14Total transaction per report to AMLC is 6.7 billion.
07:21And then we have to consider also the 2019 to 2025,
07:27walang declaration ng cash or back deposit,
07:31zero declaration.
07:32That's why sabi ni Kong Joel Chua,
07:35eh di wow.
07:37Kasi ang dami ng transactions per AMLC
07:41and yet zero declaration pagdating sa salen.
07:45There's a very big disparity to be explained.
07:48So, of course, I cannot speak for the Vice President,
07:52but if I were her,
07:53I will take advantage of the last hearing date
07:56para makounter ang evidence,
07:58especially with respect to Confidential Fund
08:01and unexplained wealth,
08:03as well as the non-disclosure in the salen.
08:11Thank you, Connie,
08:26Representative Jerville Luistro.
08:29Jerville Luistro.
