00:09Base po sa findings ng DOJ, gaano katibay yung ebidensyang hawak nyo na
00:13para makumpirma po yung pagkakakilanlan ng utak ng pamamaril sa Senado?
00:20Nasaan na po yun, no? Nasa fact-finding panel po na kinonvene
00:23to determine the accuracy of the facts and the evidence
00:26during the period of May 11 to May 14 sa Senate.
00:30So, kung po kayo mabibigyan ng definitive answer right now
00:35dahil as scheduled, today po ang deadline ng mga law enforcement agencies
00:41sa pagbigay ng complete evidence to the DOJ.
00:44So, wala pa po sa atin lahat ng ebidensya for us to make a statement on that matter.
00:49Marami rin po kasi nagtatanong kung nakita ba daw sa findings kaya ninyo
00:53kung isolated incident yung pamamaril
00:56o may kinalaman ito sa ibang issues sa Senado
00:58tulad po ng arrest warrant kay Sen. De La Rosa
01:00o kaya sa impeachment trial po ng vice-presidente?
01:05Well, ang titignan na naman po ng DOJ
01:08is kung may krimen na naganap.
01:10As to the motivations behind it,
01:12labas na po doon sa pag-determine ng krimen.
01:15Because as we know under the law,
01:17ang mga krimen ho, ang mga crimes,
01:19may mga elements yan,
01:20mga kondisyon na kailangan masatisfy.
01:22Bago po natin masabi na okay,
01:24sasampahan talaga ng kaso to.
01:27So, as to the context of how things occurred,
01:32the DOJ will just be looking strictly at the facts,
01:35keeping it factual,
01:36and determining if criminal charges are warranted.
01:38Kailan ho inaasahang lalabas yung official report?
01:41Kung sino po ang utak kaya dito sa pagpapaputok sa Senado?
01:45Well, kaya po nang sabi ko,
01:47today lang po yung deadline for law enforcement
01:49to submit their evidence.
01:50Law enforcement being PNP, NCR,
01:53Pasay City Police District,
01:55ito NBI na rin ho.
01:57So, wala pa pong definitive timeline.

02:01Do understand na urgent ka po ito.
02:04We see the urgency in this regard,
02:06in this matter.

02:07Kamusta naman ho yung coordination ng DOJ sa NBI
02:10na may lead na rao sa lokasyon ni Sen. Bato de la Rosa?

02:16We take note and acknowledge the statements made by the NBI
02:20through its director, Director Matibag.
02:22So, lahat po yan will form part of the wealth of evidence
02:26that we have and that we will be receiving eventually.

02:32Sa panayam po kasi namin kay Attorney Israelito Torrio

02:35ang sabi niya, nagtataka raw siya.
02:37Kung bakit nag-i-insist ang government agencies
02:40na ipatupad yung foreign warrant of arrest sa Senador
02:43na hindi raw dumaan sa ating local courts.
02:46Ano ho ang inyong tugon dyan?
02:47Okay. So, linawin lang po natin, no?
02:50Hindi po siya foreign court.
02:52Neither is it a foreign warrant.
02:53It's an international court, an international warrant.
02:56Of which na miyembro ho ang Philippines sa Rome Statute dati.
03:01Alam po natin, March 17, 2019, we withdrew.
03:04Pero ayon din po sa Rome Statute,
03:07and ayon din po sa Supreme Court mismo natin,
03:09Korte Suprema na ho ng Pilipinas
03:11ang nag-rule na may residual obligations pa rin tayo sa Rome Statute
03:18being a past member of the ICC.
03:20Okay.
03:21And ang sabi po is that during the time na miyembro tayo,
03:24may mga obligasyon tayo doon,
03:26at whatever investigation was conducted,
03:28at the time na member tayo,
03:31may effect pa rin po ngayon.
03:33Ito still affect our obligations.
03:34So, it's not a foreign court.
03:36It's not a foreign warrant.
03:37It's an international court,
03:38an international warrant.
03:40Okay. Ito ho ang sinasabi,
03:42may gumagulong bang proseso para magkaroon daw ng warrant
03:44laban sa Senador na mula sa local courts kaya?
03:49Right now, wala po.
03:50Wala po po sinasabi yung kagawaran ng DOJ.
03:53So, again, depende yan po sa fact-finding panel
03:56at ang kanilang determination if charges are warranted.
04:00So, right now, masabi ko po, wala pa.
04:02Wala. We'll see.
04:03We'll see what the panel decides on.
04:06Okay. Ano ho ang ibig sabihin para sa DOJ
04:08ng sinasabing protective custody ng Senado
04:11kay Senador De La Rosa?
04:12Eh, wala na ho ngayon sa kustudian ng Senado itong si De La Rosa.
04:16May kakulangan ho ba yung Senado about this?
04:21Ang mga sabi lang po namin is naiintindihan po namin yung Senado
04:25when they surmounted their challenge to the warrant,
04:27which is naging directive nga po ng DOJ,
04:30ni Secretary Vida, SOJ to NBI,
04:35and all law enforcement is to stand down for now.
04:38In deference sa Senate as a co-equal branch of government
04:41and yung pinatupad din ang protective custody,
04:44at a time at least na nandun po si Senador Bato.
04:48Ayon po sa batas, wala naman po talagang protective custody under the law.
04:52Technically, wala po.
04:53But we do understand their sentiment.
04:55And para po, wala nang gulo, no?
04:57So, the directive was to stand down.
05:00So, yun po lang po muna masasabi namin.
05:02Okay.
05:03Ano naman ho yung inaasahan nating mangyayari
05:05ngayong may rekomendasyon na ang inyong tanggapan?
05:08Nakasuhan ng ombudsman si Sen. Jinguay Estrada,
05:12dating DPWH, Secretary Manuel Bunuan,
05:14at iba pang mga taga-DPWH,
05:16kaugnay po dito sa flood control projects.
05:19Well, nasa, ano po, no?
05:21The Office of the Ombudsman has received
05:23the recommendation by the DOJ.
05:26So, ibig po sabihin nun,
05:28nasa kanila na ang bola, so to speak.
05:30Because, ang ombudsman naman po talaga
05:32ang may competence or jurisdiction
05:36to file the charges
05:37if warranted against these officials named
05:40in the recommendation.
05:42Sapagkat, ano po yan, eh?
05:44Nasa salary grade.
05:45Yung level sa government determines
05:47kung sino po ang kaanong korte ka kafailan,
05:51kung makita nila may krimen nangyari,
05:52and kung sino mag-iimbestiga sa'yo.
05:55So, from the DOJ,
05:56nilipat na po namin sa ombudsman,
05:59kaya sila po makakapagsabi
06:00how long it may take and what to expect.
06:02Upon the review,
06:04they can either modify our recommendation,
06:07our findings,
06:08affirm it, or reverse it.
