00:27There's a good Samaritan call.
00:29He said he was flat down by someone,
00:33stating that someone was in the woods on East 11th Street.
00:38It's gonna be towards the west of the woods.
00:41The caller says he was in his taco truck
00:43when a man ran up and said he'd just found a body in the woods.
00:47Have you gained contact with the body at all?
00:50Yeah.
00:52He looks to be defeated.
00:55No way.
00:56No way.
00:57No way.
00:59First responders race to the scene.
01:03He's down in this little camp, man.
01:06And discover a man lying in a tent within a small patch of woods.
01:11There's a lot of blood.
01:14Shot dead.
01:23Got a call about a suspicious death over in the area of 11th Garnet.
01:27Detective Vernon McNeil will lead the case.
01:31It's a mix of hotels and businesses,
01:33but you have a large transient population out there.
01:36A lot of them live in camps in the woods surrounding the intersection.
01:41A lot of times what they'll do is get room at one of the hotels,
01:44and that gives them a place to shower and clean up.
01:48The victim was found deceased in a tent.
01:51So that's where we're going to head to.
02:09He's next to a tent.
02:11The tent's there.
02:17What's his name?
02:19David Drywater.
02:2442-year-old David Drywater was born in Claremore, Oklahoma, and raised in Tulsa.
02:32The oldest of eight children, David was a member of the Cherokee Nation and worked as a day laborer.
02:39He leaves behind his mother, three daughters, and three sons.
02:48He's got facial trauma.
02:51It's hard to see for sure.
02:54It looks like a gunshot wound inside the mouth of me.
02:59So, like, suicide?

03:02McNeil will have to wait for the medical examiner to determine the cause of death.

03:12Everybody walked up and they go up there.
03:15It's possibly a suicide or homicide.
03:27For homicide detectives, their chance of solving a murderer is cut in half if they don't get a lead within
03:35the first 48 hours.
03:48I have two witnesses that saw him dead.
03:51I'm Dr. Daniel.
03:53That's the guy that lives down here.
03:57I think I was saying he's the one who found him first.
04:01The other witness is the man who discovered David's body.
04:13The man told officers that he saw someone in the camp point a gun at Daniel yesterday.
04:20I'll have somebody transport them.
04:23Both witnesses agreed to talk at homicide.
04:27Man, that's pretty much what they have now.
04:31It's inconclusive on whether it's a suicide or a homicide.
04:34The wound was in his mouth.
04:36So it could be an intra-or gunshot wound.
04:39But since his head was so bloody, we couldn't tell on the rear of his head if there was an
04:44exit wound.
04:46They didn't find a gun, but it's a transient camp, so if somebody stumbled across them, they could have picked
04:51the gun up and took off with it.
04:53McNeil will head back to homicide to question the witnesses.

05:14McNeil starts with the man who discovered David's body.
05:18Kind of what I want to talk to you about is what's going on tonight.
05:21Where are you currently staying?
05:22Um, I live at the garden there.

05:25I'm staying up there in the tent, in the woods.
05:28In that same little camp where this happened at?
05:30It's a different camp.
05:31He says his camp is a half mile east of the crime scene.
05:35What's your familiarity with that camp over there, right by the creek?
05:40I go by there sometimes to, like, score or just to smoke.
05:45They're friends of mine.
05:46He says he's friends with the other witness, Daniel, who lives in the camp where David was found.
05:53He works about everybody, he opens the door for others.
05:56And that earlier that night, he spoke to Daniel outside a nearby business.
06:01I said, you know, I'm going to go down to camp for about 10 minutes of his school.
06:05He said, yeah.
06:06And as soon as I got down there, I see that guy in that tent.
06:10Do you remember what time he might have been?
06:12Oh, it was about four or five or something.
06:15When you got to the camp, who was all at the camp?
06:17My wife.
06:18So when you got to the camp, dead man.
06:21I ran back out of there.
06:22I started saying someone needs to call an ambulance.
06:25He says he ran back and got Daniel.
06:28He went down there to the camp and he came right back out.
06:31Okay.
06:33There was a car wash going on in that parking lot of our bodies in the taco truck.
06:37And when I asked the guy in the taco truck, I said, will you call number one?
06:41He says the owner of the taco truck called 9-1-1.
06:45And he went and looked at the body.
06:48While you were over by O'Reilly's, did you hear any gunshots?
06:51No.

06:54When you went to the tent, man, you're not in trouble, just be honest.

06:58When you went to the tent, did you see a gun in there next to the dead guy?

07:22McNeil and Detective Reggie Warren turn to Daniel, who lives in the camp where David was found.
07:29How long have you lived over in that camp?
07:31Three years.
07:32Well, that's a long time, man.
07:33Yeah, man.
07:35Okay.
07:36Man, tell me what happened.
07:38I was in front of O'Reilly, bro.
07:40And he came running, you know?
07:42He says he was opening the door for people at a nearby auto barn store when the man who found
07:47David ran up to him.
07:50There's a dead body, you know?
07:52I went and go check it out.
07:54And I grabbed his hand, you know?
07:56Like, hey, what's going on?
07:59Was that your friend?
08:00Yeah.
08:03Did you see a gun?
08:05Mm-hmm.

08:09Let me ask you this.
08:10Did you take a gun from his tent?

09:29He says old school was spinning a .22 caliber revolver on his finger.

09:44He says he asked to see the gun, but then it broke while he was holding it.
09:48And old school got angry.
09:51Is it possible that this guy was so mad at you that he might have came back over to your

09:57And must have took the guy in the tent as being you and maybe that did something bad to him?

10:18And so I think that he doesn't want to tell me everything he knows.
10:23But he referred to gentleman that goes by old school.
10:26McNeil circles back to the first witness, hoping he can give him old school's real name.
10:32Do you know a guy that kind of hangs out over there that has a gun?
10:38The only guy that I know with a gun is a dog.
11:01The witness says Todd's last name is Hibner.
11:06But at the same time, I don't know that Todd frequents that play.
11:09I don't know.
11:12I don't know.
11:13I think I killed him, son.
11:21Do you know if Todd and the dead guy at the camp maybe got into it the last few days
11:26or anything like that?
11:28I have not heard that.

11:32Does Todd stay in camps over there or is he usually at one of the hotels?
11:35Whenever I've gone to see Todd, he's always in the hotel room.
11:39So this is what I'm going to do, man.

11:49Yeah, because whoever did this, I want them to spend the rest of their life in prison.
11:53Because it's not going to be able to matter time for what it did done to me.

12:08So I think old school was going to be Todd Hibner.
12:12I think they're the same person.
12:15He's never been to prison.
12:17Never been convicted of a felony.
12:21Todd Hibner was detained, referencing a flare gun incident last year.
12:26This is some of the body cam footage of that incident.
12:29And this is Todd Hibner.
12:3155-year-old Todd Hibner was born in Wichita, Kansas, and moved to Broken Arrow, Oklahoma as a child.
12:39He's an independent fence contractor, and he has two adult sons and a daughter.
12:46Todd is known to have a gun in that area.
12:48But as of right now, we don't know if this is a murder or if it's a suicide.
12:52Hopefully, by tomorrow, the ME will have done the examination.
12:55If the ME says it's a murder, then that's going to be a person of interest we need to speak
12:58with.
13:06The next day.
13:08When the victim was found and our crime scene people went out there and looked at him,
13:13they couldn't tell if he had an intraoral gunshot wound to his mouth or not.
13:17And so we had to wait for the ME to rule.
13:20This morning, the ME did an examination of the victim
13:23and concluded that the victim had been shot once right above his left eye.
13:28So he ruled it a homicide.
13:31We're going to head back kind of to the area of the scene.
13:33As McNeil and Warren head out to talk to the taco truck owner who called 911.
13:40This morning, it's definitely a homicide.
13:43The rest of the team heads back to the crime scene to search for the second witness, Daniel.
13:49We really do need to re-interview the guy with this new information.
13:53It's not ideal, but we haven't really lost that much time.
14:11The tent's still here.
14:14Looking inside, it's cleared out. There's nothing in there at the moment.
14:19Mark and I may run back behind these hotels, kind of in the northeast of the Quick Trip.
14:24Kennedy and Brown will search other campsites in the area for Daniel.
14:28We have to find out who is mad at David.
14:38Okay, thank you.
14:40An hour later...
14:41Mark and I tracked down these urban campers and they told us that they actually saw David in his camp.
14:48They also told us that David had a girlfriend that was staying at his camp.
14:54They even went as far as to say that they heard gunshots and then heard this girl scream.
15:01They didn't know whether the girl was screaming due to David getting shot or maybe she had something to do
15:08with it.
15:15Hey.
15:16McNeil calls in with an update.
15:19The taco truck owners said Hibner came and bought a Coke and then walked over to the camp.
15:24And then a few minutes later walked westbound towards 169.
15:28And that would have been about 445 to like 515 or 530.
15:35Okay, that's pretty good information.
15:38John and Mark went over to another encampment and said they heard the gunshot.
15:43Around the 5 o'clock time period.
15:47Okay.

15:49I understand he usually stays around the hotels in this area.
15:52So we're over here at the OYO.
15:54We're going to talk to the manager at OYO.
15:57But I don't know if he came back to the hotels or he walked west and is out of camp

16:14McNeil talks to the manager of one of the hotels near the crime scene.
16:26So Todd has a room over here at the OYO.

16:32I was going to get eyes on it and then try to catch him either going in or coming out.

16:46Watkins and Ryden arrive with patrol officers as backup.

19:09walk me through your day yesterday i didn't leave oio till 2 30 in the afternoon i went to sonic
19:17uh the liquor store mazio's and back to the old after dark i call them my rounds i just go

19:25places and i just see you know what they're doing see if they need anything he says he does odd

21:09that guy is dead he was killed yesterday we're homicide detectives there are people who know
21:16you in the community who that work out there and then homeless people they sit here and said that you
21:21got a drink from a taco stand and then they watched you walk over to where his camp was
21:29absolutely inaccurate never went to that camp that's a fact
21:36okay so why would people have nothing to gain about anything sit here and say that they watched you do
21:42this i don't know why people do anything out there anymore did not go to that camp i mean i

22:54we'll need to find daniel again and re-interview him and then i need to figure out who the victim's

23:11then crime scenes back out at the scene mcneil gets a text from major crimes detective stephen
23:18boren who has continued to search the crime scene for the murder weapon this mother here at the scene
23:26david's mother heard someone was killed at the encampment and went to check on him
23:31she hasn't notified of his death crime scene they're going to send the victim's mother up here to talk to

23:44thirty minutes later sherry i'm detective mcneil
23:49so sorry for what you're going through kind of talk to me about your son because i i've never met

23:57he was a father and he turned into an alcoholic okay he would stay with me but then he wanted

24:07drink and i wouldn't let him do that you know i said you need to quit
24:14hard kicking him out and he just ended up living on the streets but i kept telling him
24:22you're drinking and drugs gonna kill you i'm gonna end up burying you
24:28did he ever say he was having any issues with people in his camp no no no because he wouldn't

24:33there he was okay did he have a girl like a girlfriend that was staying yeah god would
24:40she gives him the name of david's girlfriend she always uh would hit him and stuff
24:49when she got drunk it got bad he's got scars all over him
24:57she had these little chickens and one of them kept taking off from her so she cut his foot off
25:05that kind of made me wonder about her you know
25:22but he would go back to her they act like they was in love
25:33okay when was the last time you actually talked to your son last week he called me
25:39telling me he had gotten his id getting they were gonna help him get a place david wanted to get

25:45the streets so a local nonprofit was helping him get an apartment he was all happy and he had asked

25:53i would come pick him up i said i can't come pick you up i got physical therapy man

26:17you can tell she's heartbroken probably wishes she could have tried to done more to help her son
26:23but there's a lot of reasons why homeless people are homeless sometimes it's alcohol sometimes it's
26:28drug addiction but those people actually have loved ones they have mothers some of them have kids
26:33that love them and care for them so they're not going to look at their loved one as somebody
26:37that's been transient that lives out on the streets they're looking at that that's my dad
26:40that's my son and you know that they're hurting it's a sad deal
26:50so more leads i got the name of the victim's girlfriend i'm trying to get a picture of this
26:56girl so we can go look for and try to grab her and bring her up here
27:04there she is she's currently homeless witnesses said that they heard a female yelling just before
27:12they heard some gunshots so it's possible that the victim's girlfriend was present when he was killed
27:19she said the girl's a suspect suspect or a witness okay i think we might have a lover's quarrel situation
27:27maybe i don't know dude i'm still leaning towards todd we had a whodunit a true whodunit
27:37i also need to talk to daniel again because he was scared and it's a possibility he just doesn't

30:53when david and his girlfriend walked by and jean and just looked and looked at us you know and todd
31:01thought david gave him a dirty look i was quick he kind of didn't look furious
31:06he was like i'm gonna shoot that guy all right okay and he's talking about g when he said that

31:44three hours later i caught her out in front of the hotel walking back looked like she was coming
31:49back for a quick trip detective emery ward finds david's girlfriend and brings her in for questioning
31:56so she got in the car and immediately she's like i'm not saying anything i'm not telling you all
32:01anything not i don't know what happened just i'm not saying anything we'll see

34:21what did the gun look like um i think it was like a revolver 22 maybe
34:27he walked out and he walked towards the o'rightly's

34:48he didn't say too many words okay it all happened so fast that's that's crazy you know you're sitting
34:56in a tent and all of a sudden some guy walks up and she's david that's nuts that's somebody that'll
35:00probably do that to somebody else right so we're not gonna let that happen okay have you seen this guy

35:48everything together it clearly points to talk she's saying it's a heavyset guy in his 50s
35:56everybody knows he carries a revolver the day before he's at the same camp messing around with
36:01revolver mcneil will make a photo lineup containing todd hibner if she picks him out then we'll go
36:08snatch him from his hotel be still there hey how are you detective spirit with tvd take a look at

36:52well that's good enough for pc to snatch him up and bring him in yeah i think we're good
36:58she's saying that todd didn't say much he pulled out the gun into shop
37:02i gotta do some warrants but uh the search begins
37:16as the first 48 slips away and that one just says picked out todd so we're gonna go uh over

37:23take a look the team checks the hotel where todd hibner was staying
37:33so basically management walked about that same sense according to the manager
37:38hibner left the hotel shortly after kennedy and brown brought him back

38:51in the first 48 tulsa homicide responded to the killing of 42 year old david drywater found shot in an
38:59urban encampment spoke to two witnesses who said todd hibner spends time around the camp and owns a gun
39:07interviewed hibner who denied any involvement in david's murder
39:11tracked down david's girlfriend who said she witnessed to hibner shoot david
39:17and searched for hibner but had been unable to find him
39:24the next day
39:32he had warned people we were able to locate todd at another hotel a few miles away from
39:36where the murder happened and so we are now going to see if he's willing to talk to us and
39:42then if he
39:42is we'll go from there hey todd how you doing buddy so my plan is to try to talk to

39:54what happened that day i've talked to this guy's family and the question they keep asking me is the why
