08:38and his girlfriend Elizabeth, to head down to the Farmington police station.
08:42A convoluted story will soon emerge, leaving the detectives with the difficult task of uncovering
08:48the truth.
08:49So, based on everything that we've looked at so far, I wanted to just interview you further.

09:22with Robert.
09:23Heather works as a third-grade teacher and at the local library.
09:26It was there that she met Robert about a year ago.
09:29The two had just married on September 5th, 2020, around 12 weeks earlier.
09:35Heather then begins to recount the events of the evening, beginning with her and Robert
09:39spending time together while he played the video game Fallout.
09:43She says the only time she left his side that night was to warm him up some pie.

11:20At first, Heather couldn't remember where she put the shirt before cleaning Robert's wounds.

13:30With Heather unable to say when Robert's injuries occurred, detectives also questioned the
13:34other two adults in the home.
13:36starting with Heather's son, Tyler.
13:38His testimony will eventually prove to be the most enlightening, but likely not in the
13:43way anyone anticipated.
13:45Tyler explains that in March, he suffered a traumatic brain injury when he fell off a
13:49longboard and now takes medication at night, which he says knocks him out completely.
14:08With this interesting beginning to Tyler's interview, investigators ask him about the dynamics of
14:14of his mother's relationship with Robert.
14:16How are things between your mom and Robert?
14:19They've always been really good, you know, like, every time, like, even if I, like, I'd start getting
14:24frustrated with my mom about something, Robert would defend her and he'd be like, she's my
14:29wife.
14:30So, like, I have to do what she wants, you know, and they were always really cool.
14:35I never heard them fight.
14:37I never even had to, like, I think they're fighting or none of that really ever happened.
14:44They're really sexual.
14:45I know that because me and my mom, we've got that kind of relationship because she was saying,
14:49like, when they search my house, they're going to be able to find some stuff.
14:53And I'm like, oh, mama, she's like, oh, I'm a Toys R Us kid.
14:57I'm like, oh, okay.
15:00Investigators also spoke with Elizabeth, Tyler's girlfriend, and she shared her thoughts about
15:05Heather and Robert's relationship.
15:07To kind of go off of that, how would they treat each other?
15:09Really good.
15:10Like, they would be here together all the time and they always had a really good time with
15:16whatever they were doing.
15:17Elizabeth, Tyler, and their two small children had moved into Heather and Robert's house in
15:21September, about two months earlier.
15:24Heather was financially supporting her son and his children, along with Robert, who had
15:28lost his job at the library due to COVID.
15:31He'd previously worked as a nuclear operator on submarines during his time with the Navy.
15:36In an EWU exclusive interview, Sonia, Robert's sister, gave some insight into how Tyler and
15:41Elizabeth ended up living with Heather and Robert.
15:44When he realized that Tyler's girlfriend was several months pregnant and they didn't have
15:50transportation, she needed to go to doctor's appointments.
15:54And so Robert talked Heather into them going down to Albuquerque and moving Tyler and his
16:00girlfriend to Farmington to live with them.
16:03What has it been like?
16:04What's been the atmosphere?
16:06It's pretty good.
16:07They're, they are just all, it's kind of like a honeymoon thing, like they're all over each
16:11other, but they've also been like that since they've gotten together and it hasn't really
16:15changed so much.
16:15You know, you mentioned kind of honeymoon-ish, so, you know, that usually doesn't entail any
16:21arguing.

16:37Back in her interview, Heather describes Robert's wounds, which she examined after removing
16:42his shirt and cleaning them.
16:44Were they bleeding?
16:45And I know this, again, this is hard, but I got to ask the hard questions.

17:20at first.

17:27And then the wounds look super superficial, like very scratches.

17:36place also noted that there wasn't very much blood in the bedroom.

19:41Heather has also made it clear that she discovered Robert unresponsive on the ground around 5 a.m.
19:47But in Elizabeth's interview, she recounts hearing something that may put this claim in question.

19:55And so, uh, that was up a couple times throughout the night.

20:00And then, uh, I think it's now when we were at 4.30 or 5, I'm not exactly too sure

21:50I can tell you for sure that during the last 12 months of his life since he met Heather,
21:56that was the happiest period of his entire life.
21:59He was working at the Farmington Public Library, and a mutual friend introduced him to Heather.
22:07They hit it off, and it was just this amazing relationship.
22:11During their investigation, authorities tracked down Robert's first wife,
22:15who shared that they'd remained in sporadic contact, occasionally messaging over Facebook.
22:20In fact, she'd received a concerning message from him about a year and a half earlier.
22:24In 2019, he sends just this.
22:30I did not cut deep enough.
22:32I'm making a mess.
22:36So, seeing this bothered me.
22:39And clearly...
22:40And that was in 2019, June of 2019.

23:22his mental health.
23:23When you guys were together, was he ever depressed enough that he would talk about suicide or
23:29anything like that?
23:31I would say that I think he probably did really suffer from depression.
23:39and like I said, like, he started drinking heavily and he would call very sad and tearful.
23:53He never, ever mentioned that he was going to hurt himself or suicide, anything like that.
24:02Pilar had also been aware of Robert's drinking.
24:05Does he drink a lot?
24:06He drinks every night.
24:07How much do you see, from what you can see?
24:11I've seen them drink two fifths of Crown Royal.

24:20He drinks a fifth of vodka pretty much every night or a 12-pack of beer every day.
24:29I've never seen him go a day without drinking.
24:33When investigators accessed Heather's text messages, they revealed that she was more than
24:37aware of Robert's alcohol consumption.
24:39In one message, Heather wrote to Robert,
24:41You know you can't be drinking because I can't take her tonight, right?
24:45To which he replied,
24:46Yes, dear.
24:47Another time, Robert told Heather that he felt terrible and she replied,
24:51I'm sure you did nothing but drink all day yesterday.
24:54What did you expect?
24:55Are you planning on drinking today?
24:57On other occasions, Heather asked Robert to promise me no booze and to please, please take it easy.
25:03In her interview, Sonia, Robert's sister, also mentioned his struggles with alcohol.
25:08He struggled with alcoholism his entire life.
25:11And he always felt kind of socially on the outside.
25:15And the reason why is we are confident that he had undiagnosed Asperger's.
25:22She also shared that Robert left the Navy and then worked at Fuji.
25:26He was back with that job for a while and then had a fallout from that job.
25:30And so then he moved back home.
25:33And then just during those years, alcoholism just really built up because he was so unhappy
25:39and not making progress in his life like he wanted.
25:43The detective speaking with Heather won't confront her about this just yet and takes a break,
25:48returning with a new set of questions for her.
25:50Now, you didn't see anything.
25:52He didn't make any mention to you.
25:53No.
25:54But so that's telling me that something happened before he went to bed.
25:59This this all would have had to happen before he went to bed.

27:07and so she would have likely seen him grab one.
27:10I'm a little concerned as well with why you first see his injuries
27:16and then don't do anything.
27:19I didn't think they were that bad.
27:20I really don't.
27:21They didn't look deep.

27:24But he's complaining that he's hurting prior to bed.

27:31That's the thing.
27:32Though Heather is stating this now, it isn't what she said earlier.
27:36And then he went to bed about 11 or midnight.

27:55Since her questioning at the station began,
27:57Heather has stated that she cleaned Robert's wounds when she went into the bedroom around 3 a.m.
28:02However, initially she said she cleaned his wounds when he first went to bed.
28:07The deviations in her story only become more alarming from here.

55:31In her interview, Sonia also shared some reasons why it may have taken so long for there to be any
55:36developments in Robert's case.
55:38We have a single lab in the state of Mexico to process evidence.
55:43And so everything they did was on a slow scale.
55:47It took months for things to be processed.
55:50It just kind of got put on the back burner, I guess.

56:01It was good.
56:03It was actually great.
56:04I have the best job.
56:06I live my best life.
56:07Robert's cause of death was ruled to be three stab wounds to the chest.
56:11But the manner of death was undetermined.
56:14The pathologist listed that he had minor blunt force injuries on his head and neck,
56:18including an abrasion and underlying hemorrhage on his forehead,
56:22an abraded contusion on his abdomen,
56:24and a few contusions and abrasions on his arms.
56:26His post-mortem blood alcohol level was 0.084,
56:30which is the blood alcohol limit for driving in New Mexico.
56:34The steak knife was also tested, but no blood was found.
56:38However, Robert's DNA was present on the blade.
56:41So, Ms. Fernandez, you've been advised of your rights.

57:52The autopsy also revealed that the two stab wounds to Robert's right chest entered the chest cavity and punctured his
57:58right lung, resulting in a collection of air around the lung.
58:02He also had one stab wound on his left chest, which punctured his left lung and lacerated the coronary artery
58:09of his heart.
58:10This injury resulted in approximately three liters of blood collecting in his chest cavity and explains the lack of blood
58:17found at the scene.
58:18Both of the wounds to his chest resulted in collapsed lungs.
58:22According to police documents, it would be almost impossible for Robert to have injured himself to the point of puncturing
58:28both lungs and severing a coronary artery and then proceed to eat pie with Heather.
58:33As well, the pathologist stated that it wasn't likely for his death to occur over hours and estimated that it
58:39was more likely to have been within minutes to hours.
58:42As well, according to police documents, when Heather initially called 911, she told the dispatcher that, quote, he got mad,
58:50though she never explained this statement further.

59:04Heather was charged with second-degree murder and tampering with evidence.
59:08After her arrest, she was released on a personal recognizance bond while awaiting trial.
