38:43prove to everyone that it was right all along.
38:46That doesn't feel right.
38:48Anyway, that doesn't explain the bullet.
38:50Why was that there?
38:52So what happened?
38:53He was alone on that boat, six miles out at sea,
38:56and our three suspects were all on dry land when he died.
39:00How and why did he end up dead?
39:06Maybe these two have the answer.

39:13There are no striation marks on the bullet.
39:16So they can't match it to Kelvin Mason's gun.
39:19Same make, same calibre, but...

41:04It's helped us make sense of the present and the past.
41:08In the present, it's what solved the mystery of your ex-husband's death, Miss Smart.
41:13Leading me to finally understand why and how Giles Parry's body was found dead in the water,
41:19looking like the Lusker, the legendary sea monster he'd spent seven years searching for,
41:25had finally caught up with him.
41:26And in terms of the past?
41:29We'll come to that, surely.
41:31Throughout this case, we've worked on the basis that whatever happened to Mr. Parry,
41:36it all happened at the same time while he was out at sea.
41:41But we've now realized that his injuries were actually sustained in two separate locations.
41:48The first injury, the bruising to his stomach and the rupturing of his spleen,
41:53that happened on dry land, down by the harbour, when you and he tussled Rory.
42:00You're saying it was me?
42:02You will be charged with involuntary manslaughter.
42:05We know you didn't mean to kill Giles, far from it.
42:09However, his subsequent fall from your push caused a serious internal injury.
42:18He just didn't know it at the time.
42:20Oh, my God.
42:22Giles was totally unaware that his life was slipping away.
42:25That's why he walked away from you, got on his boat and went out to sea.
42:32He was probably already a few miles out when he started to feel ill.
42:37Initially, some discomforts in his abdomen, feeling faint, feverish.
42:43But it was only by the time he reached his destination, six miles from land,
42:49that he fully comprehended what was happening.
42:53We know Giles used to be a paramedic, so it's safe to assume he worked out what was wrong.
43:00That he had minutes left to live.
43:04I'm so sorry.
43:06And if his imminent death wasn't a grim enough prospect,
43:09Mr. Parry also realised that if his body was found on deck,
43:14we would start to question how he was fatally injured.
43:16And the post-mortem would more than likely lead back to the altercation he had with you, Mr. Lyons.
43:22And subsequently, some time in prison.
43:24And knowing what you told him about yourself and Kara wanting to start a family,
43:30well, he didn't want to inflict any further suffering on you both.
43:33That's the way he phoned and asked Rory if he loved me.
43:38That's why he needed to know, to be sure.
43:42Do you love her?
43:44He could protect you both by making it look like he killed himself.
43:52It was Dias Tomasi who noticed the ropes were missing from the life rings on Giles' boat.
43:57The two life rings there are missing their ropes, so let's hope no one goes overboard.
44:02I didn't think anything of it at first.
44:04But then when I started to understand what happened that day,
44:09that's when I realised why those ropes weren't there.
44:16And hopefully this call will confirm it.
44:20Yeah.
44:21They found the ropes tied to the boat's spare battery on the seabit.
44:25Okay. Thank you, Sergeant Fletcher.
44:30So, we think Giles knew that if he tied those ropes around his body tightly enough,
44:36then leave red markings. Friction burns.
44:39And therefore, when his body was found, he hoped this would also explain his internal injuries.
44:45The bruising.
44:46All so it would misdirect from you, Mr. Lyons.
44:51Any similarities to the Luska was a coincidence.
44:54If that's what happened, why was his body found floating on the surface?
44:59Because of this.
45:02As Giles sank to the seabed, by some quirk of fate, he saw this bullet.
45:10Maybe it got caught under a rock or wedged in some coral.
45:15We can't be sure.
45:17But there it was, a single bullet in the same spot his son went missing.
45:24And after his recent discovery of the smuggling that was going on out at sea,
45:29not far from the same spot, Giles is already beginning to suspect that his son's,
45:34your son's disappearance might have been for more sinister reasons.
45:37Is it to do with Benjamin's disappearance?
45:41Maybe.
45:43So we believe he loosened the rope, grabbed the bullet,
45:47and allowed himself to float to the surface, determined to cling to life as long as possible.
45:55But by then, it was already too late for him to climb back on board his boat.
45:59So with his life ebbing away, Giles did one last thing.
46:04One final attempt to let everyone know what he discovered on the seabed.
46:10He threw this bullet onto the deck.
46:13A message from him to us to not give up on his son.
46:17But maybe Ben's killer was still out there.
46:22That's what you meant about the bullet helping with the past.
46:37That bullet we found, it turns out it's been sat on the seabed for the last seven years.
46:46In the exact same location, Giles and Kara's son went missing.
46:52It was fired from your gun to kill Benjamin Parry.
46:58But he drowned at sea.
47:00Why are you no saying he was shot?
47:08This photograph was taken the day before Benjamin went missing.
47:14It's of him and his father outside your office.
47:20And this was taken by one of the Guadalupe police officers the day after he disappeared.
47:27You witness statement is unremarkable in every way apart from this photograph.
47:36I had to get the magnifying glass out to really notice.
47:42But in this photograph of Benjamin and his father, the wall behind your desk is set farther back from the
47:52window
47:52than it is in this photograph of you where it appears 40 or 50 centimeters closer to it.
48:01Which left me wondering why less than 48 hours later, your office had seemingly shrunk.
48:12The only conclusion I could draw was because a new wall had been built.
48:18But leaving Benjamin's body at sea would have meant there was a possibility he could be formed.
48:26And if he was, then it would be discovered that he'd been shot.
48:33Whereas if you hid his body and everybody assumed he drowned at sea, then maybe you'd get away with it.
48:45But where to hide it?
48:49We have a team at your office as we speak about to tear down that wall.
48:56So if I'm wrong about what's been hidden behind it the last seven years, you have nothing to worry about.
49:05But if I am right, now is your chance to start talking.
49:24That morning, seven years ago, it was real early.
49:34But when I got back up with the day's delivery, he was there recording me on his phone for evidence.
