00:14Being a homicide detective in the city of New Orleans, a stressful day at work, could
00:20mean having seen things that 99% of the population has never seen and will never see.
00:329-1-1, what's going on from the M-A-X-N-6?
00:35There's a man shot by Chapitula.
00:38And like, I think that's Andrew.
00:41Chapitula St. Andrew?
00:43Yeah.
00:44He landed on the ground.
00:46Oh, my God.
00:48They're going to steal trombones.
00:50We have units on our way.
00:53Is this your car?
00:54Yeah.
00:54All right, we're going to cut this traffic off and send it down that way.
00:57Temple.
00:58So, I get EMS to the intersection of Chapitula's in the area.
01:01We have one victim down.
01:04Person, gunshot.
01:06Couple to the body, one to the head.
01:09Hey, guys.
01:10There's lots of y'all stepping, all right?
01:11They got cases everywhere.
01:13They got a left man right here.
01:15They got a right homicide.
01:28The only information I have is a black man who was shot, about six caissons on the scene.
01:36And SUV apparently fled from the scene.
01:39A dark gray GFC Yukon just got information that the same SUV may have crashed somewhere in New Orleans East.
01:48This is the warehouse district.
01:51It's kind of mixed residential apartments and businesses.
01:55It's right outside of the Prince Quarter of New Orleans.
02:04As I'm walking into the crime scene, I notice immediately that there's just a large number of people in the
02:10area.
02:11It was the last night of Essence Festival, a three-day festival every year that we have around 4th of
02:16July.
02:17It brings in a lot of visitors to the city.
02:21In this case, the first responding officers were working in detail literally within probably 100 yards of where the homicide
02:27occurred.
02:29What's up?
02:32What do we have?
02:33We got one body?
02:34Yeah, one body.
02:35Okay.
02:38We had a deceased male on the scene.
02:42There's a lot of people there, but nobody wanted to come forward with what they possibly saw related to the
02:49actual homicide.
02:51So I knew that I was going to be relying on video surveillance evidence in the area.
02:56Ugly Dog has cameras.
02:58See, they have a camera right there on the side.
03:01All of the cases are over there by that Nissan, by the Ugly Dog.
03:06So I think he probably got shot over there and ran over this way.
03:09Yeah.
03:10Okay.
03:14It looks like the cameras were pointed in the direction where the murder took place.
03:18Unfortunately, the Ugly Dog is closed at this time, so I'll have to come back tomorrow.
03:23Any idea who the victim is yet?
03:25This is a guy named DeMond Foley.
03:28DeMond Foley?
03:29Okay.
03:33DeMond Foley is 36 years old.
03:35He's self-employed.
03:37He was out enjoying Essence Fest, but instead he was shot and killed.
03:50Now you're going to head to the right.
03:55On time.
03:58More casing gear, huh?
04:01There were a number of shell casings.
04:04they all appear to be the same caliber those are definitely not a millimeter
04:11blood goes all the way over that in that direction yeah there's blood on the gun too
04:18there was a handgun that was in very close proximity to the victim
04:23at this point i'm not sure if that belonged to the victim or the perpetrator
04:49the magazine in that gun was at full capacity and there is a live round in the chamber the gun
04:57is a 40 caliber but the spin cases that are on the crime scene they're non-millimeter
05:04it's likely at this point that i'm looking for another gun
05:07the deputy that was black in the street right there he said he heard sick shot he waited a few
05:14minutes there was nobody around but he saw the door color and it should be the yukon coming from this
05:20way when it took the shot street right that's what was it okay did he see the shots coming from
05:25the
05:25yukon no no he just heard the shot he said there was nobody out here okay
05:31the gmc yukon denali was seen fleeing the crime scene by sheriff's deputies the tires were screeching
05:38that's a little suspicious so we want to know more about that vehicle
05:43yeah i contacted the rtcc and they gave me um video for the um denali
05:50and the vehicle was in this area at the time of the homicide okay
05:58so um they have people over there they want to know if the victim is somebody named penny penny yeah
06:04penny and i was asking them to describe penny and they showed me a picture of him i said what
06:10kind
06:10of car he's driving so he's driving on a denali um detective smith was approached by someone at the
06:19crime scene who is concerned with whether or not penny is the deceased victim i go over to speak to
06:28the
06:28gentleman how you doing man i'm detective ball who's me you okay what brought you out here like
06:36i will sleep i just got a phone call and they said that they saw him on instagram he was
06:41at the
06:41drug and they said that they thought that this was him okay what does he look like is that a
06:48recent
06:48picture yeah how recent uh about three weeks the gentleman shows me a photograph of penny
06:57it's not the deceased individual that's on the ground but i can't tell him that because i still
07:03want to get as much information as i can i then asked what penny's real name is um and he
07:10tells me
07:11it's alfred pennington alfred pennington yeah what kind of car does it drive oh you called an island
07:19what color is it oh you don't like i like really don't move hang tight i'm gonna come talk to
07:25you
07:25in a minute okay he tells me someone named alfred pennington drives a dark color gmc yukon
07:33that matched the description of the vehicle scene fleeing the homicide scene
07:39so uh the rtcc gave me a plate on the vehicle it is a texas plate oh that's who it's
07:46registered to
07:46yeah they call it's right they call him to pennington they call him penny so they sort of
07:50called register to detective smith confirmed with us that the registered owner of the gmc yukon
07:57was in fact alfred pennington so he became a person of interest i wanted to use all right
08:11we got information that dark colored suv a yukon fled the scene at a high rate of speed heading
08:18towards the interstate and in new orleans east right after this shooting there is a dark colored suv with
08:27the same plate on it that crashed so we're going to be heading out there right now
08:42what did they get i mean it looks like the tire just blew out but i mean they probably hit
08:46something at some point outside of it's all chewed up yeah was anybody here any witness or anything
08:52when y'all got here that license plate matched the license plate on the vehicle
09:03that was fleeing the scene it belongs to alfred pennington so at this point i do have enough
09:10probable cause for a search warrant for that vehicle let's have it toad okay you get it put
09:16in the cage for me yeah okay thank you brother appreciate it no problem bye man
09:30hello good morning good morning yeah
09:38in processing the vehicle my goal was to find any evidence that's related to the crime scene like a gun
09:46and any identifying evidence on who was inside the vehicle
10:00if you could take the phone for sure and let's do dna exterior and interior door handles dna
10:12what i need at this point is a gun that i can link to the shell casings found at the
10:17crime scene
10:25no gun
10:30so far i've got really no evidence that alfred was actually in here
10:36i don't know at this point i still need to determine who was in that vehicle at the time
10:43the homicide occurred whether they were the driver or passenger okay thank you much i appreciate it
10:50i need to find the murder weapon and i need to find video that captures the murder without any of
10:57that
10:57i'm at a dead end
10:58so
11:05so
11:12so
11:13so
11:13so
11:19so
11:22so
11:25so
11:27At this point, I still need to determine who was in that vehicle
11:30at the time the offense occurred.
11:33So we're heading to the Ugly Dog Saloon,
11:35which is a business that's located just outside
11:38of where the homicide occurred.
11:41They supposedly have video of the entire offense,
11:45so I'm anxious to see that video.
11:52I am born and raised in the city of New Orleans.
11:55Back in 1985, my grandfather was unfortunately murdered.
12:01It was an armed robbery, and since I was a child,
12:05I've grown up wanting to be a policeman,
12:09specifically homicide.
12:10I was motivated by his case,
12:14and I have had, as long as I can remember,
12:16a sense of wanting to just do my part in solving crime.
12:27Hey, what's going on, man?
12:28Doing well, how are you?
12:29Good, good. Nice meeting you.
12:31Yeah, the video from the camera that's right there.
12:34Have you seen it yet?
12:35Uh-huh.
12:36Okay.
12:37So I'm looking for a gray Yukon Denali that fled, supposedly.
12:41Oh, God, this is a good video.
12:48That's the Denali, huh?
12:51Yeah, that's the Yukon, yeah.
12:55It's like they're in between the two cars.
13:07Wow.
13:09The video recording from Ugly Dog,
13:11it is from a little bit of a distance
13:13in terms of being able to identify the shooter.
13:18But I can hear the gunshot,
13:20and the victim is seen running away,
13:22and the shooter is seen chasing after the victim,
13:26continuing to shoot
13:26as the victim eventually collapsed across the street.
13:30I don't know at this point
13:31that the shooter is Alfred Pennington, for sure.
13:36But I do see the shooter
13:38get into the driver's side
13:40of the dark gray GMC Yukon and flee.
13:44Having this video is great.
13:46For the first time,
13:46I'm able to see exactly what occurred.
13:48What I need at this point
13:50is to be able to identify who that shooter is
13:52and who it was that was operating that GMC Yukon.
13:56That's the one angle.
13:57Okay.
13:58And then I have the other one from behind
14:00looking down the enunciation.
14:03Sweet.
14:06So there's the SUV right there.
14:09That's the shooter.
14:10Come across the street,
14:12then get in his SUV.
14:14Okay.
14:18Here's the victim coming, huh?
14:19Yeah, right there.
14:20Walking right there.
14:23It goes around the front.
14:26That is a great video.
14:38And then they're in between the two cars.
14:50Looks like he had a distinct logo
14:53or emblem or something on his shirt,
14:55front and back.
14:57Do you see his shirt?
14:59You're right.
14:59He did hear something.
15:00Yeah.
15:02So what I'm thinking,
15:03I'm going to go back here
15:04and try to pull a video of him walking
15:05and see if I can get him,
15:08his face.
15:09But yeah, that's great.
15:15The video is pretty cut and dry.
15:17It definitely put everything into perspective.
15:21There's still many unanswered questions
15:23at this point.
15:24What occurred in front of the Yukon?
15:26Was there a physical altercation?
15:28Was there a threat?
15:30We collected a gun at the crime scene.
15:32Did the deceased victim pull the handgun out
15:35and point it at him?
15:37All I know about the gun
15:38is that it was stolen about a year ago.
15:40That doesn't really tell us much.
15:43The shooter,
15:44he's got a pretty distinct shirt.
15:45It's got some kind of logo
15:46on the front and back of it.
15:48So I have a reference point
15:50on what to look for.
15:52Hopefully we get a good image
15:53of his face.
16:13There is a man
16:15that just got shot
16:16and he is on the ground.
16:18He's on the street
16:19on the side of his car.
16:21Louise, he's starting to look like
16:23he can't die.
16:25Oh my God.
16:27No, I'm looking for one.
16:28We're still looking for him to get me.
16:29Yes, I need an animal out there.
16:32Louise Street.
16:33Fullman just got shot.
16:34They need somebody here right now.
16:37Somebody en route?
16:38Yes, sir.
16:39Okay, okay.
16:40Thank you, baby.
16:52Please shut up all up and down.
16:54Okay.
16:56You were driving?
16:58Yes.
17:17You're doing good, man.
17:19You all got the other guy?
17:21We're working at 30 for us,
17:23possible 30.
17:32We're working at 30.
17:54I get a call
17:54from 5th District.
17:57They're saying
17:57that they're working a shooting.
18:00The two victims
18:00have been transported
18:01to the hospital.
18:02One of them
18:03was shot in the hip,
18:04but he's expected
18:05to survive his injuries.
18:07The other was shot
18:08in the chest area
18:10and he passed away
18:11due to his injuries.
18:13His name
18:14is Stanley Williams.
18:16But to friends and family,
18:17he's known as Doody.
18:19He was in his 40s.
18:20He's from New Orleans.
18:22He grew up in this area.
18:31Once I walk through the tape,
18:33I'm able to see
18:33that there's our crime scene units.
18:36They're starting to cone
18:38certain things in the street,
18:40some casings
18:41that are on the sidewalk.
18:43I noticed that most of the scene
18:44seems to be around a Jeep
18:46that's parked
18:46in the middle of the block.
18:47It clearly has
18:48some kind of bullet damage
18:50to it on the driver's side
18:52and its windows
18:53are shattered out
18:54on the passenger side.
18:56There was a witness
18:57who was on scene.
18:59Detective Walt Vedman
19:00is going to talk
19:01to the witness
19:01and see what we can find out
19:04about who did this.
19:06So what do we have on scene?
19:09We got the,
19:10this is like
19:11the surviving victim's clothes.
19:12We got six 40-calibre
19:14shell casings all over here.
19:16Oh, Walt said,
19:18the witness says
19:19the shooter is a guy named Dino.
19:21And he came over here
19:23and started arguing
19:23about some video
19:25the victim took of him
19:26on the victim's phone
19:28or something like that.
19:29And then Dino
19:30started shooting him.
19:33Our witness
19:34was able to tell us
19:35that my decedent,
19:36Stanley, was sitting
19:37on the passenger side
19:38in the Jeep.
19:40There was some kind
19:41of argument happening
19:43between Stanley
19:44and the shooter
19:45standing on the passenger side
19:47of the car
19:47about some kind of video.
19:49The witness
19:50started hearing gunshots.
19:52He saw Stanley was shot
19:54and the driver
19:55was also shot
19:57and he said
19:59Dino did it.
20:01He didn't know
20:02Dino's real name,
20:03but he knew
20:05Dino lives in the area.
20:07So this is Dino's address?
20:09Supposedly this.
20:12And that came from Walt?
20:14This came from Walt
20:15who got it from the witness.
20:17So I'm raising S.O.D.
20:19to get the house surrounded
20:20and if we can get
20:21a warrant for the house,
20:22boom.
20:25Dino supposedly lives
20:26right around the corner,
20:27a couple houses down
20:28from where we're all standing.
20:31Now that we know
20:31where Dino lives,
20:32we need to get
20:33a search warrant
20:34and now we're calling
20:36the SWAT team.
20:50Hey, Lou.
20:51It's Donnie Williard
20:53over at Homicide.
20:53How are you doing?
20:54Hey.
20:55So we got a 30 over here.
20:58We're still, like,
21:00wrapping up the actual
21:01original crime scene,
21:02typing up a warrant
21:04very quickly on this house
21:05and seeing if S.O.D.
21:06can assist
21:07with executing
21:08the warrant.
21:10I'm working just
21:11some intel real quick,
21:12seeing if we can
21:13just figure out
21:13who the perp is.
21:15We may be hitting
21:16an empty house, though.
21:17It's possible.
21:19Type in your risk assessment,
21:21your search warrant,
21:22and when you get that,
21:23send it to me.
21:24All right.
21:24Sounds good.
21:26Once the witness told us
21:28where Dino lived at,
21:30I began researching
21:31the address,
21:32trying to see
21:32if I could find out,
21:34checking our databases,
21:35who lives there.
21:37All right.
21:37Well, this is interesting.
21:38We got a Devin Green,
21:4236 years old.
21:46All right.
21:47So I pulled up
21:48the address,
21:48and I got a hit
21:50for a Devin Green,
21:53who is 36 years old,
21:55light-skinned black male.
21:56He's 5'7",
21:57which is exactly
21:58the description
21:59we got from the witness.
22:01But at the very least,
22:03even if we hit the house
22:03and it comes up blank,
22:04we can show a lineup.
22:06Yeah.
22:07Yeah.
22:08Yeah.
22:42So a positive ID
22:43on our pertinent.
22:48Hey, Lou?
22:50Who's it?
22:50Uh, just got a positive ID
22:52from...
22:53It is going to be
22:54Devin Green.
22:55Okay.
22:57It's minutes
22:57before the briefing.
22:59I just got the call
23:00that my witness
23:01actually picked out
23:02Devin Green
23:03in the lineup,
23:04confirming that
23:06Dino is Devin Green.
23:09This is my suspect.
23:12I get a search warrant
23:14for Devin's house.
23:16All right.
23:17What's going on, guys?
23:18Good evening.
23:18Thank you all for coming.
23:19I know y'all, uh,
23:20were activated
23:20at kind of last minute.
23:21Uh, so earlier today,
23:23around 2 p.m.,
23:24two victims were shot,
23:26one fatal,
23:27one non-fatal.
23:28We were able to identify
23:29the perpetrator
23:30as Devin Green.
23:31We actually knew
23:32where the perp lived.
23:34We don't know
23:35if he's inside.
23:36Appreciate y'all being here,
23:37and if there's anything else.
23:40We want to get
23:40into this house
23:41as soon as possible
23:42because the last thing
23:44that we want
23:45is for my possible suspect
23:47to go back to the house
23:48and start cleaning things up,
23:50getting rid of evidence,
23:52getting rid of any guns.
23:53The more time that goes on,
23:55the more evidence
23:56that we are at risk of losing.
24:02All right.
24:03I guess we'll follow
24:04the train out of here.
24:14Clock is ticking.
24:15Is Devin Green
24:16going to be inside or not?
24:18It's just the moments
24:19where I start to get, like,
24:21nervous, like,
24:22you got to catch him off guard,
24:23or is he, uh,
24:24already in hiding?
24:26Find out pretty soon.
24:30All right, fellas, let's go.
24:32Take your time.
24:38Three, one, two, four.
24:46Police, there's one.
24:48Open the door all the way.
24:50All the way.
24:54Who we got?
24:55Who we got coming out?
25:06Someone else just came out.
25:09I don't think that's the target, huh?
25:11I don't think so.
25:12No, they just let him walk like that.
25:14No.
25:20So right now,
25:21he might be inside
25:22because they're still calling
25:24his name.
25:26Yeah.
25:26Which they would do if...
25:27It's the lock.
25:29Just take this half section
25:30so no one drives up on us.
25:32Oh, .
25:33Shot.
25:34Back up.
25:36Take cover.
25:37Cover!
25:37Cover!
25:39Cover!
25:51We have Devin Green's house
25:53surrounded
25:53and somebody just started shooting
25:55from inside.
25:57I don't know if any of our guys are hit.
26:00We're calling for as many units as possible
26:02to respond to the area,
26:03get a perimeter around the location.
26:06Right now, it's a standoff.
26:09This is a tense moment
26:10waiting to see
26:12what's going to happen next.
26:14But our SWAT guys
26:15are going to do everything they can
26:16to make sure
26:17that we come to a peaceful resolution.
26:29Good morning, everyone.
26:31This is an update
26:32involving an officer-involved shooting
26:34that occurred on October 5th
26:36around 7 o'clock at night.
26:39This incident took place
26:40during the service
26:41of a high-risk warrant
26:44related to a homicide
26:45that had occurred earlier in the day.
26:48That homicide suspect
26:50was a 36-year-old man
26:52by the name of Devin Green.
26:54Mr. Green fired at the officer
26:58from inside the residence.
27:01This resulted in our officer's
27:03returning fire.
27:05After a nine-hour standoff,
27:09Mr. Green finally surrendered
27:12and was taken into custody.
27:14In the exchange of fire,
27:17no one was struck,
27:20and therefore there were no injuries.
27:31The smoke is practically still settling.
27:34It's surreal.
27:36I can't believe
27:38the number of rounds
27:39that were being fired
27:40that nobody got hurt.
27:42I'm grateful.
27:44Nobody wants to see anybody get hurt.
27:46We want the criminal justice system
27:48to hold people accountable.
27:49I can finally breathe some relief
27:52now that Devin is in custody
27:54and our guys are okay.
27:57We did the search warrant
27:59inside the house,
28:00and there was two guns,
28:03a rifle,
28:04and a pistol.
28:05The pistol matches
28:07the caliber of casings
28:09that we had
28:09on the scene of the homicide.
28:13Now, I want to see
28:14if I can get a statement from Devin.
28:16I still need to be able
28:18to prove that Devin's
28:19the one who killed
28:19Stanley Williams.
28:22And do you die?
28:24Yeah, so he's at the hospital.
28:28So we'll see what he says.
28:30Okay.
28:59How's it going?
29:00Case gone.
29:01What's up, bro?
29:02Yeah, it's good.
29:03So I'm getting ready
29:04to look at some video
29:04from a restaurant,
29:06which is right across the street
29:07from Ugly Dog.
29:09I have a good idea
29:10of who the perpetrator is.
29:12A gentleman named
29:13Alfred Pennington.
29:15So hopefully this catches him.
29:17I mean,
29:17I've got a good reference point
29:19with the shirt.
29:19He had like an emblem.
29:21Why can I never get video
29:22like that?
29:25Look how clear it is.
29:28Now, I don't know
29:29who's panning this, but...
29:30It's got to be motion.
29:31It picks up on alt motion
29:32that's going.
29:34I have video
29:34from the Ugly Dog
29:35that shows him
29:36walking this way
29:37from here
29:38across the street.
29:40And you can tell
29:41he's got some distinct logo
29:42on his shirt.
29:44So there were
29:45sheriff's deputies
29:45working or something?
29:46Yeah.
29:47Right across the street
29:47from where the shooting happened.
29:49The shooting happened
29:50right here.
29:50Wow.
29:52That's breezing.
29:53Yeah.
29:56Hopefully that is
29:57turned that way
29:58when it happens.
30:02There he is.
30:03Is that the suspect?
30:06That is him.
30:09You see the logo?
30:12Oh, my God.
30:14That's Alfred.
30:15How do you know him?
30:17I have a picture of him.
30:19Perfect.
30:20All right.
30:21Now he's on scene.
30:23Damn.
30:25I'm able to
30:26pretty much
30:27identify this shooter
30:28from the Ugly Dog
30:29saloon video
30:30as Alfred Pennington
30:31using those
30:33identifying features
30:34from the T-shirt
30:35as a reference.
30:38It's clearly
30:38the same logo.
30:41Now watch.
30:41You're going to see
30:42victim right behind him.
30:43Look.
30:44Here's the victim.
30:47Oh, bro.
30:48He's skipping.
30:52No, I pan...
30:56Look, there's a victim
30:57going across the street.
30:58Yeah, I see him.
31:00So 1.23.
31:02What time did it happen?
31:03What happened at 1.24?
31:07Camera ain't gonna catch it.
31:10No.
31:11But what this does,
31:13it gives me his face.
31:14Yeah.
31:17It is a very
31:18aha moment for me.
31:20This places
31:21Alfred Pennington
31:22at the crime scene
31:23at the time
31:24the offense took place.
31:26So at this point,
31:27I do have enough
31:27probable cause
31:28for an arrest warrant,
31:29and I'm confident
31:30that a judge will sign it.
31:32But I still have
31:33a lot of unanswered questions.
31:34What occurred
31:35in front of that
31:36GMC Yukon?
31:38Why did Alfred Pennington
31:40allegedly shoot DeMond?
31:43Hopefully, I am able
31:45to find Alfred Pennington
31:46and get answers
31:47to all these questions
31:48that we have.
32:17I just talked to DeMond
32:19Dino, a.k.a. Devin Green.
32:21After Devin surrendered,
32:23he started saying,
32:25I had an old groin injury
32:27and it's aggravated right now,
32:29so I want to get checked
32:30out of the hospital.
32:31And so it was there
32:33that I interviewed him.
32:35Devin ends up telling me
32:37that Devin owed Stanley money,
32:40and Stanley had told Devin
32:42he was going to get back at him
32:43for this money owed.
32:45And Stanley was sharing a video
32:47that depicted Devin
32:50in a light that Devin
32:52didn't want other people
32:53to see him in.
32:55And so Devin felt
32:57his manhood had been disrespected,
32:58and Devin said,
33:00that's why he did it.
33:02He even went as far to say
33:04that the second person
33:05who was in the driver's seat
33:07was nothing more than
33:08collateral damage.
33:12So right now,
33:13we're pulling back up
33:15in the area
33:16where the homicide happened.
33:19I still want to get
33:20as much evidence as possible.
33:23I'm going to walk up the block
33:25and just see if there's
33:26any other cameras,
33:27ring doorbells,
33:28or anything that might
33:28give us an actual look
33:30at what happened.
33:54I secured an arrest warrant
33:55for Alfred Pennington
33:57for the murder
33:58of Devin Foley.
33:58I received a phone call
34:00from Alfred Pennington's attorney
34:02who expressed that
34:04Alfred wanted him
34:04to turn himself in.
34:05He was aware that he did
34:07have an arrest warrant
34:07out for him,
34:08and he came in
34:09with two attorneys.
34:12Now, I have a lot of questions.
34:15The obvious question of
34:17what occurred in front
34:18of that GMC Yukon
34:20that he needed
34:21to possibly shoot
34:22Devin Foley.
34:24Okay, you do have
34:25a warrant for your arrest.
34:27The warrant is
34:28for a second of your murder.
34:30It's an incident
34:31that happened July 8th
34:32in the evening.
34:33Why don't you tell me
34:34what happened?
34:36Hmm.
34:37I came down Friday
34:41to go to
34:42the festival.
34:44I don't live here.
34:46I live in Houston.
34:48I just was out
34:49trying to have a good time.
34:52So, I went in the club
34:55and I walked in.
34:57Somebody pulled my shirt.
34:58I turned around
34:59and I saw who it was.
35:02And it's just God
35:03that I don't know
35:05what I even associate with.
35:07It's just like,
35:08what's up?
35:09And I'm like,
35:10I'm chilling, man.
35:11I live in Texas now.
35:13You know, I'm not into
35:14none of that footage
35:15just no more.
35:16And as I walked off,
35:18he pushed me
35:19and said,
35:21you're a bitch.
35:22You're gonna die tonight.
35:23And I
35:24immediately tried to exit.
35:27In Alfred's statement,
35:28he tells us that
35:30he felt threatened
35:31by Daman
35:32and Daman told him
35:33that he was gonna die tonight
35:34and decided to leave the club,
35:37which is consistent
35:38with what we see
35:40so far in the video
35:41that Alfred leaves
35:43and then Daman
35:45follows behind him
35:46towards his vehicle.
35:50When I sat down
35:52in my car
35:53as I took a breath,
35:58he was grabbing
35:59at my door.
36:01Like, grabbing
36:02at my door.
36:03Yeah, let me in this bitch.
36:06Let me in this bitch.
36:07Yeah,
36:07he started clicking
36:09around.
36:10And he just was like,
36:12yeah,
36:12told him you're gonna die tonight,
36:14bitch.
36:15I'm about to die.
36:16I'm about to kill you.
36:17I'm about to take this bitch.
36:18And
36:20I got out
36:22when he was ramming
36:23on the door
36:25like instinctively
36:26because I was thinking
36:27about to start shooting
36:28in the door.
36:29I don't know what he's
36:30about to do.
36:30I don't know.
36:31I'm just scared.
36:33I'm just scared.
36:36Oh!
36:39And he just came
36:40and got up on me.
36:44And
36:44he was reaching
36:46for the guy
36:47and I just
36:47hung it off
36:48for a second.
36:49But he
36:50I didn't even
36:51get to grab it.
36:52It just was so quick
36:53and I just
36:54I just shot.
37:03I just started shooting
37:05and
37:05when I started shooting
37:07in his statement
37:16Alfred Pennington
37:17admitted that
37:17he did shoot
37:18Damond fully.
37:19He said Damond
37:20pulled a gun
37:22and Alfred
37:23felt threatened.
37:25Eventually
37:25Damond started
37:26running away
37:27and he continued
37:28to fire his handgun
37:28at him.
37:31I was just scared
37:32and I just
37:33got back in my car
37:36and I just
37:37dunked down
37:37and just
37:38put the gas
37:39on like
37:40I got a few
37:42blocks up
37:43and I just
37:44I just
37:45drove
37:45like
37:46I just
37:46drove
37:47like
37:50that's
37:50what happened.
37:54He's obviously
37:55emotional
37:56right
37:56about everything
37:57I don't want
38:00him answering
38:00a lot of
38:01questions
38:02with him
38:02in his face
38:02but I want
38:04we know
38:04Warren's army
38:05out there
38:05and we want
38:06you to know
38:06the truth
38:07because obviously
38:07the investigation
38:08keeps going
38:09I want you
38:10to hear
38:11his side
38:11of the story
38:11that's
38:12effectively
38:13everything.
38:15You know
38:15he's under arrest
38:16then right?
38:17Of course.
38:18I was hoping
38:18to clear this up
38:20I have questions
38:20for you
38:21and I can't
38:22ask them
38:22because your attorney
38:23doesn't want me
38:23to ask them
38:23for you
38:24so the only way
38:25for me to clear
38:25it up
38:25is to ask
38:26my questions
38:26that's it
38:27there's a lot
38:27of holes
38:28that I need
38:29filled
38:29for my investigation
38:30so
38:31without that
38:32you will
38:33go to jail
38:35I have one
38:36question for you
38:36Sure
38:40Do you turn
38:40the gun into you?
38:42It's evidence
38:43I don't have to go
38:44no
38:45Okay
38:46I don't have a
38:49I'll be right back
38:53The fact that
38:54I'm able to
38:55make an arrest
38:56for Alfred Pennington
38:57related to
38:58the homicide
38:58of DeMond Foley
38:59is great
39:01DeMond
39:02his family
39:03are victims as well
39:05because they're
39:05the ones
39:06that are left
39:07suffering from
39:08the loss
39:09of their loved one
39:11So
39:11it gives me
39:12satisfaction
39:13that I'm giving
39:13closure to
39:14DeMond Foley's family
39:16to
39:26the
39:27Lord
39:27God
39:27I don't have to
39:32know
39:44what
39:46to
39:51I want to call the mom of the decedent, Stanley,
39:56now that the chaos has kind of settled down.
40:01Hello.
40:02Hi, is this Ms. Desiree?
40:05Yes, it is.

40:19Oh, as well as to be expected.
40:21We did arrest an individual.
40:24I don't know if you're familiar with the name, but his name is Devin.
40:29No, I'm not familiar with him.
40:32Again, I am so sorry for y'all's loss.
40:35If you do have any questions about the investigation,
40:39or, you know, even if you just need a few minutes to talk,
40:42this is my cell phone number, okay?
40:44You call me anytime you need, okay?
40:47Okay.
40:48Bye-bye.
40:49All right, bye.
40:52Kids are not supposed to pass before their parents,
40:56and unfortunately, that's what happened here.
41:09Bye-bye.
41:12Bye-bye.
41:16Bye-bye.
41:22Bye-bye.
41:25Bye-bye.
41:37Yeah.
41:39Yeah.
41:41Yeah.
41:41Yeah.
41:41Yeah, he was.
41:43I remember he was a happy person.
41:45Happy.
41:46Humble.
41:47Outgoing.
41:48Respectful.
41:49Close to his family.
41:51Right.
41:52And just always being there for whoever needed him.
41:55Right.
41:56Since he's been gone, everybody, like, they really missed him because he was doing a
42:00lot of stuff for a lot of people.
42:04He would start what he's doing to give you a hand.
42:07He'd take you anywhere you want to go, but he wasn't for free.
42:11Better have some gas.
42:13Better have some gas, man.
42:14If he wasn't family.
42:16I'ma miss him.
42:17I'ma miss him.
42:18Yeah.
42:20Doody loved his family.
42:22Doody loved New Orleans.
42:23He loved our culture.
42:25He loved the food.
42:27And he was a mama's boy.
42:29Yeah.
42:30He definitely was a mama's boy.
42:32Yeah.
42:32He was a mama's boy.
42:34Yeah.
42:35Since he's been gone, I keep hearing him, ma.
42:39Yeah.
42:39Uh-huh.
42:40Hey, ma.
42:41You know, I just keep hearing him calling me.
42:45Doody deserved justice.
42:48He deserved it.
42:50Yeah.
42:51It just would be serious.
42:52It will.
42:54It will.
